Councilpersons ~resent: Holasek, Rither, VanderLaan, and Windschitl Councilpersons 1 bsent: None Also Present: City Building Inspector, Walter Arntzen; Conciliator for Mr. Arntzen, Harry M. Simpson; Recording Clerk, Pat Lindquist; and the following interested parties: Cecil Heidelberger, Helen Frantz, Rosella Sonsteby, Marvin Christenson, Lyle Bradley, and DÛlas Felegy. Mayor Schneide announced the following dates to be recorded: May 1, 197 _ Board of Review Meeting, Andover Community Center, 7:30 P.M. May 7, 197 - Dog Rabies Clinic, Andover Community Center, 6:00 P.M. 1) Requested that the Clerk's Office attempt to ascertain the number of dogs expected. 2) Advised that the veterinarian's charge for the rabies shot is to be $3.00; and suggested the possibility of charging an additional 50ç to cover administrative costs. The City Council is to decide on the full charge prior to the Clinic. Contract Negotiations (Clerk's Note: ontract covering period of April I, 1973 to March 31, 1975, hereinafter refe red to as "present contract"; and contract covering the period from April 1, 1 75, hereinafter referred to as "new contract".) Mr. Arntzen presented to the City Council, a list of proposed changes that he was requesting for t e new contract. (Copy attached to these minutes) Section 1. - Em 10 ment Councilpers n Holasek noted that the Minnesota League of Municipalities had stated at a recent meeeting, that the 'duties' in a contract were not negotiable, and the 'ter s' in the contract were matters on which there could be negotiation. Discussion f llowed with the main topic being salary as opposed to various job titles, i. e., Zoning Administrator, Building Official, and Road Supervisor. The 1974 Stanton Report and individual reports from surrounding communities were read, noting specific salaries for individual duties. Councilpersons Holasek and Windsch'tl felt that the position of Road Supervisor should be covered under a separate c ntract. Councilperson Windschitl felt that the hours required to cover these jobs were unreasonable for one person. Vote: Yes - Rither, Schneider, and VanderLaan; No - Winds¢hitl and Holasek. Section 2 - est Efforts of Employee MOTION byl Rither, seconded by VanderLaan, that this section remain as stated in present contract. Motion carried unanimously. I Section 3 - Term of Employment MOTION b1 Windschitl, seconded by Holasek, that Section 3 of new contract read, "The term f this agreement shall be for a period of one year, commencing on April 1, 19t and terminating on March 31, 1976." Motion carried unanimously. Section 4 - om ensation of Em 10 ee Discussion n salaries, means, and percentage of increase for surrounding communitie was had. Mr. Simpson stated that the main consideration must be whether r not the person can perform, and the manner in which he performs; and also the questions of whether or not he fits the requirements of the employer. Councilpers n Holasek expressed the sentiment that the sanitary sewer and water main onstruction and connections should not constitute a considerable work-load. Lyle Bradle issued a statement commending Mr. Arntzen for an honost job, well done; a d noted that the City should pay accordingly. Mr. Arntzen advised that his sal ry comes from permit fees, and not the taxpayers. Mrs. R. Sonsteby noted that t e Building Official should be required to keep track of his time. Councilpers n Windschitl agreed that Mr. Arntzen was perhaps carrying too much of a work-l ad ~th-the--Roa.d-StlperviBuL duLies, however, should Mr. Arntzen be asked and a ree to continue with this, the salary should be commensurate with the work- ut stated separately in the contract for this position. MOTION by Rither, seconded by VanderLaan, that Section 4 in the new contract shall read, 'Employer shall pay employee, and employee shall accept from employer, i full payment for employee's services, compensation at the rate of $17,576. 0, for the period commencing on April 1, 1975 and ending on March 31, 1976. Motion ame ded by Rither, seconded by Vander Laan to include, "Employer shall provide the necessary transportation required in the performance of employee's duties and shall assume all expenses incurred therein. Councilperson Windschitl noted that he would like to see the wording 'split apart' on pdsitions, i. e., $900.00 plus 4% for Road 'Supervisor and $16,000.00 plus 4% for Building Official/Zoning Administrator. Councilperson VanderLaan stated that the three positions were addressed in Section 1 of the new contract as an entir~position, and should be treated the same throughout the contract. Mr. Arntze advised that if the position of Road Supervisor were removed {rom his cortract, he would request a 10% salary increase over the present $16,OOO.DO Motion and lmendment restated. Vote: Yes-Rither and VanderLaan; No - Holasek, W ndschitl, and Schneider. Motion defeated. MOTION by Hol sek, seconded by Rither, that the meeting recess for five_minutes. Motion carried nanimously. Meeting reconvened at 10:10 P.M. Mr. Arntze~ informed the Council that he would be willing to accept separate job descriptions with a separate salary for each,-with Building Official and Zoning Ad linistrator as one title with one salary of $16, 900. 00; and Road Supervisor s one title with one salary of $676.00. Council per son Holasek que stioned e "worth" of the Road Supervisor position as to a dollar amount. Mayor Schn ider objected in that if the Road Supervisor position were removed from the co tract and given to another employee, the salary may not be commensur te with the job. Councilperson VanderLaan felt that this position could not be assessed with a dollar amount, inasmuch as it would have to be addressed t the duties of the individual of which it is included, as they may overlap. C uncilperson Windschitl stated that he felt there would be nocproblem if this posit on was always included with the Building Official/ Zoning, Administrator, however, if this is assigned tò another individual severe ~.d~hip'could be created for both the City and Mr. Arntzen. Mr. Arntzen advised that if the Road Supervis or osition were removed from his contract, and no additional position added or su stituted which would call for the same amount of work hours, that he would be in agreement with a $676.00 decrease. MOTION by VanderLaan, seconded by Rither, that Section 4 in the new contract read, "Emp oyer shall pay employee, and employee shall accept from employer, in full paymtnt for employee's services, compensation at the rate of $16,900.00 for the peri d of April 1, 1975, and ending March 31, 1976, for duties in the position of Building Official and Zoning Administrator; and an additional compensatidn of $676.00 shall be allowed for the position of Road Supervisor: and last par~graph in Section 4 of present contract be restated in new contract. MOTION bJ Rither, seconded by Windschitl, that Section 4 of new contract read, "Employer ~hall pay employee, and employee shall accept from employer, in full payment for employee's services on the following basis: For the category , of Building Official and Zoning Administrator, compensation at the rate of $16,640.00:for the period commencing April 1, 1975 and ending March 31, 1976. For the category of Road Supervisor, compensation at the rate of $936.00, for the peritd commencing on April 1, 1975, and ending March 31, 1976. Employer s all provide neces sary transportation required in the performance of employee', s duties and shall as sume all expenses incurred therein. Vote: Yes 1 Windschitl, VanderLaan, and Rither; No - Schneider; Abstain - Holasek. Jotion carried. Section 5 - keqUirements of Employee "Town Boar " in present contract to read "City Council" in all subsections. Council agr ed to restate Subsections A, B, D, E, F, G, H, as written in present con ract. Mr. Arntze stated that the reason for his proposed change to Subsection C, was due to is having to attend five or more meetings per month during his present con~ract period. Councilperson Holasek felt that the City Council and the PIa ning and Zoning Commission should use discret ion in requesting the Building Official to attend meetings. Mayor Schneider stated that there should neve be more than two or three meetings per month for which the Building Off cial's attendance is required. Councilpersons VanderLaan and Rither both tated that they thought Mr. Arntzen's proposal should be stated in the new c ntract. After considerable discussion, is was agreed by both the City Co cil and Mr. Arntzen that Subsection C should remain as stated in present c ntract. Mo.TION by Rither, seconded by Holasek, that Section I of new contract to read, "The City C uncil shall consider the advice of the Building Official/ Zoning Administrat r with respect to the ~iring of clerical help. The City Council shall set the rate f pay for said clerical help." Motion carried unanimously. Section 6 - onditions of Em 10 ement MOTION by Holasek, seconded by Windschitl, that Subsection A of new contract to read, "T e Building Official/Zoning Administrator serves at the direction of the City Co cil, however, he shall be entitled to a Public Hearing before dismis sal. MOTION bJ Rither, seconded by Holasek, that Subsection C of new contract read, "No ity Council Member, Planning and Zoning Commission Member, or other City official will use his or her position to exert individual influence , on the Building Official and Zoning Administrator to render decisions. MOTION b VanderLaan, seconded by Windschitl, that the Clerk write a letter to the City ttorney asking him to give his legal opinion on Section 7 _A, and to SUgg1st proper wording of that portion of the Contract; and that he be requesteî to respond to the City Council by letter. Motion carried unanimously. Councilperson Windschitl stated that whatever was done on this contract insofar as hblidays were concerned, would establish a precedence. MOTION by Windschitl, seconded by Rither, that one additional floating holiday be added fo a total of nine (9) Holidays; said floating holiday to be chosen by the employe and approved by the City Council, with choice of Good Friday, day before r after Thanksgiving, day before or after Christmas, day before or after Ne Year's. Motion carried unaniInously. MOTION by Rither, seconded by Holasek, that Subsection B in new; contract read, "Emp oyee is granted the following paid holidays: 1) New Year's Day - January 1 ) President's Day - 3rd Monday in February ) Memorial Day - Last Monday in May ) Fourth of July - July 4 ) Labor Day _ 1st Monday in September ) Veterans' Day ) Thanksgiving Day - 4th Thursday in November ) Christmas _ December 25 ) One Floating Holiday When Janua y 1, July 4, and December 25 fall on Sunday, the following day shall be consider d the holiday. When January I, July 4, and December 25 fall on Saturday, We 'preceding day shall be considered the holiday." Motion carried unanimousl,,!. The City Council and Mr. Arntzen agreed that Subsection II in new contract (SUbsection~c. of present contract) to list only the period covered by the contract; in that the ity Council will be establishing an employee benefits program which will cover vacations, and should there be a change at that time as to increase in vacation benefits for year(s) of service, it will automatically cover the new contract. \ Subsection D of present contract to be deleted from new contract. I Subsection D. of new contract (Subsection E in present contract) to read, "The City agrees to pay hospitalization insurance premiums for the employee cup to a maximum of $640.00 per year." (Reference November 19, 1974 City Council Minutes) Section 8 - greements Outside of Contract The City Co ncil and Mr. Arntzen agreed to restate this section in new contract. MOTION by Rithe , seconded by VanderLaan, that the meeting be adjourned. Motion withdrawn; additio al busines s to be handled. Councilperson Holsek objected to Mr. Arntzen being employed by Burns Township as Building Inspec~or in that the City of Andover was paying for additional schooling and Burns Townsh .p was receiving benefits from such schooling. Councilperson Windschitl sugges ed the possibility of Mr. Arntzen doing the inspections for Burns Township u der a Joint_Powers Agreement. MOTION by Rithe , seconded by VanderLaan, to adjourn.
