CITY 01 ANDOVER
Minutes of a SPECIAL MEETING of the Andover City Council held Monday,
January 20, 1975 at the Andover Community Center.
Present were: Mayor Schneider, Councilpersons Holasek, Rither, VanderLaan,
Windschitl, Fiscal Consultant Seegar SWanson of Ehlers and Associates and
City Engineer Dewey Kasma of Toltz, King, Duvall and Anderson.
Mayor Schneider called the meeting to order at 7:29 p.m., and immediately
turned the meeting over to Seegar Swanson.
Mr. SWanson passed out copies of a twenty page document titled, "Preliminary
Finance Study, Urban Planning Area, City of Andover". Mr. Swanson proceeded
to page one and then outlined the Document for the City Council. Mr. SWanson
pointed out the following:
1. The preliminary financial report is designed to acquaint the
City Council with basic financial information prior to a
public hearing for a public works project.
2. Decisions made by this Council will establish precedent for
the City as they affect public improvements for many years
to come.
3. The hearing should not be closed until each and every property
owner has an opportunity to express his opinion.
4. The Clerk must record all pertinent data, names, addresses
for, or against the project.
5. The Council has six months to decide whether to do the project
that was the subject of a public hearing,
, 6. The City Attorney shall act as parliamentarian.
7. The Mayor should Chair the meeting.
8. Written evidence should be incorporated as part of the minutes
by a motion.
9. A motion to continue must contain date, time and place, the
continued hearing would be held.
10. The Clerk must read notice of meeting.
11. There should be three formal presentations:
A. The Attorney should explain the legal ramifications.
B. The Engineer will explain design.
C. The Fiscal Consultant will speak on costs and financing.

Mr. Swanson also stated that when a citizen asks a question, the question
should be re-asked, to avoid duplication of questions.
Mr. Swanson stated three situations that occur at hearings, 1) a sewer
project could protect the public health, safety and welfare of all citizens,
2) the Councils duties are to represent all citizens, inside and outside
of the project area, and 3) special interest groups will make feelings
known at the hearing.
Mr. Swanson stated the following ways to repay borrowed money:
1. Direct special assessments.
2. General funds.
3. Debt service, sinking funds.
4. Borrowed funds, temporary three year bonds.
5. Premature bonds - thirty years.
Mr. Swanson recommended an 8X interest charge to residents and noted that
this would be easier than trying to raise the interest rate later on in the
program and also recommended an assessment policy book, so all in assessment
area are treated exactly alike and the City Council will establish user and
assessment charges. User and assessment charges can be changed by future
Councils to meet changing situations. Mr. Swanson also stated that his
Firm would represent the City Clerk in bonding matters.
Mr. Swanson stopped intermittently as asked for questions from the Council.
Mr. Swanson went On to explain the computer economic models in the back of
the hand out and stated that they were samples. He also noted where bids
were opened, the computer would run out more possibilities and stated this
would be'a waste of time until bids are opened.

Mayor Schneider opened the discussion by asking when the decision was made
to have Seegar Swanson appear on the afternoon of January 23, 1975 as stated
in the letter from Mr. Kasma. Mr. Kasm8 interceded and noted that nO motion
was made¡ but that was the feeling he received at the meeting held, January
8, 1975'1 After discussion, the Council felt his presence, along with the
Attorney and the Engineer would best serve the coœmunity. It was asked and
Mr. Swanson stated that his rate of pay was $45 per hour.

Councilperson Windschitl asked the Council if some kind of voting procedure
should be established for the Council to separate this large project.
Councilperson Rither felt this was slightly premature. Discussion followed
and it was noted that it should be handled in a sequential manner, starting
with the 'Crooked Lake Area project.

Engineer Kasma noted that written commitment comes from the Farm and Home
Administration, after the twenty-five steps required are met, Engineer Kasma
commented on block grants and stated almost nO chance with 1.4 million available
to fifty~two communities.

Councilperson Rither moved for adjournment, seconded by Councilperson
VanderLaan. Motion carried unanimously.
Meeting was adjourned at 10:05 p.m.

Strike entire paragraph, and correct to read:
"Mr. Swanson stated that the proposed projects provide benefits to
Andover in the three following categories:
1 ) A general benefit to the Community as a whole, in that proper
provision for sanitary sewer and water services protect the
general health and welfare of the Community.
2) There is a general benefit to a large portion of the urban
planning area, in that sizing of the initial system has been
designed to provide service beyond that Notice for the Hearing.
3) There is a special benefit to individual property owners within
the immediate project area.
The Council should make their decision on the merits of the proposed
project based on all three aspects. "
