S hneider, on December 8, 1975, 7:35 P.M., at the Andover City Hall, 1685 C osstown Boulevard N. W., Anoka, Minnesota, for the purpose of discussing the Comprehensive Development Plan. Councilperso s Present: $fø>lasek, Rither, VanderLaan, Windschitl. Councilperso s Absent: None Also Present: Aàmmistrator, Norman Werner; Assistant Administrator, Walter Arntzen; City Clerk, P. K. Lindquist; Planning and Zoning Chairman, David Jack; Former Planning and Zoning Chairman, Allan Miles; and others. Council per SO Rither reviewed action to-date on the Comprehensive Plan by the City Council: 1. Adopted the principal concept of the Plan. 2. Adopted the concept of the Urban and Rural Planning Areas. 3. It was noted t at this was the same boundary established by T.K.D.A. 's, Sewer/Water Comprehensive Study for the City of Andover. Councilpers n Holasek questioned if this were the only item on which the Council was oing to make a decision within the Plan; and would the Council be committ" g themselves if the requirement of the lO-acre lot size was found to be 1 gal. Motion carri d unanimously. Council per so Windschitl noted that it would have to be decided how improvement are going to be treated in the Urban Planning Area: 1. Cit provide the improvements? 2. De eloper be required to put in improvements? - 3. All w development only where improvements are already - ava lable? The pros/co s of each method were discus sed. Mentioned was the possibility of the City providing the improvement just before construction, and the developer de ositing an escrow amount of 1 1/2 times the cost of the improvement or the developer paying 1/3 at the start of the project, 1/3in30-6 days, and 1/3 when the project was completed. The Administrato advised that both methods had been used in Coon Rapids. It was agreed that Andover did not have the financial means to finance a developer, thus only leaving two possibilities. P&Z Chair an, Dave Jack, emphasized that a Five Year Capital Improvement Program would eliminate the majority of the problems, and recommende that the City Council allow for this in the budget, By using this, the dev lopers could be told when and where the improvements were coming. Cou cilperson Rither pointed out that on page 201 of the Plan it was outlined ow the Capital Improvement Program would he utilized and how deve opment and improvements move together. Councilperso Windschitl indicated concern with development in the western part f the City, inasmuch as there were several large developable ,~ areas, not sh wn in the Urban Planning Area; and that of lO_acre parcels creating prob ems with future development when addressing streets. The Clerk w s directed to contact Attorney Hawkins to request his comments on restricted development and the meeting of density requirements. Council per so Holasek expressed concern with a City having the a.bility to acquire la d under emminent domain, with no criteria listed for such acquisition; nd the definition of emrninent domain as referenced in the Comprehensi e Development Plan. The Clerk was directed to contact the attorney o obtain his comments and opinions on the above. Adjournment MOTION by ander Laan, seconded by Holasek, to confin1e discussion - on the Comprehensive Development Plan to 7:30 P.M., January 12, and - that the com ents and opinions of the attorney and engineer be available by that time.
