SPECIAL CITY COUNCI L MEETING - APRI L 28, 1975
MINUTES
A Special Meeting of the Andover City Council was called to order by Mayor,
Richard J. Schn~ider, on April 28, 1975, 7:30 P.M., at the Andover Community

stated that they ould probably be handled at another meeting inasmuch as the
April 28 Agenda as already quite full:
l. Additional views of the City Council relating to the positions .of, City
Coordinat r and Clerk/Treasurer.
2. Develop d tail job requirements for the two positions.
3. Establish alary range for the positions.
4. Develop a ad for publication.
5. Agree on that publications in which to place the ads.
6. Agree on ime-table for hiring.
7. Agree on rocedures for interviewing
8. Determin the present status of Government Funding, and have appropriate
letters pr pared.
MOTION by Van erLaan, seconded by Schneider, to accept the posted agenda, Items
Nos. 1 through 6 and then begin discussion on additional items as proposed by
Councilperson W ndschitl. MOTION AMENDED by Holasek, seconded by Schneider,
to add, "Appoint ent of Tree Inspector" where appropriate in discussion on
Councilperson W ndschitl's added items. Vote: Yes - Holasek, Schneider; No -
VanderLaan, Rit er, Windschitl. Amendment defeated. Motion carried unanimously.
Discussion on 11 ertificate of De osit"
MOTION by Win schitl, seconded by VanderLaan, that the City Treasurer transfer
the amount of $7 979.00 to a daily interest account, and be authorized to transfer
funds from this i to the General Checking Account as needed. Motion carried
unanimous 1 y.
Appointment of eputy Assessor
Mayor Schneider explained to the Council that the County had advised him that
Mrs. Triggs would have to be appointed a Deputy Assessor in order for her to
legally answer qJestions relative to assessments. It was noted that Mrs. Triggs
has been handling the calls during the days, inasmuch as Mr. Triggs is not
available until elenings.

Councilperson vlnderLaan read from the Minnesota League of Municipalities
Handbook, which stated in part that the City Council did not have the power to
appoint a Deputy Assessor. After a lengthy discussion, Mayor Schneider agreed
to contact Mr. Triggs to inform him that he is to take_ç;are of.the appointment of
a.....Pep.m.}'..A.sÂM.ßt;>r, himself; and to remind him that he has a contract with the
City to handle alt the service involved in the assessment.
Metro Council L nd Use Legislation
A lengthy discus ton was had on the "Bill" as it stands after going through both
the House and Sepate Committees. Councilperson Holasek expressed concern
that the "bill" was dictatorial and taking the rights away from the communities.

Councilperson Rither stated that a complete coordination of adjoining communities
was necessary fdr rational development. Councilperson VanderLaan sited examples

of misunderstandings and misinterpretations of this legislation. Councilperson
Windschitl objected to the lack of available information with reference to the
Framework Dev*opment Guide. MOTION by Holasek, seconded by Windschitl,
that the City Cou cil issue a statement to the :legislators, asking that the
Legislature dela voting on the Metro Land Use Bill (HF -1530, SF -1653) until
the next session, in order to give the communities and legislators a chance to
review the "Bill' after the Metro Systems Plan (Development Framework Guide)
is finished and r leased. MOTION AMENDED by VanderLaan, seconded by Rither,
that Councilpers nclolasek's motion be tabled until the Council can check to see if
the Development Framework Guide is available. Vote: Yes - Rither, VanderLaan;
No - Windschitl, Schneider, Holasek. Amendment defeated. Motion Vote: Yes -
Schneider, Hola ek, Windschitl; No - Rither, VanderLaan. Motion carried.
Interview Date - lerical Hel
The date of May , 1975, 7:30 P.M. was set for interviews, allowing thirty minutes
per individual in erview. (Clerk to contact applicants informing them of their
appointments, a d ask for permh¡sion to contact past and/or present employers.
Discussion on Fi
Mayor Schneider asked for opinions on the hiring of a Fiscal Agent. It was noted
that Ehlers' cont act only covered "Part 1" Services; and that the actual bond work
would be covere under a new contract for "Part 2" Services. Councilperson Rither
emphasized that n all work of this type, the City Council must give direction to the
Agent, and advis him what they want and what they are expecting. Councilperson
Windschitl suggested that the City Clerk contact references on both Ehlers and
As sociates, and pringsted, Inc. MOTION by Windschitl, seconded byHolasek,
that the City C le k write Ehlers and Associates and inquire as to their fee on
F.H.A. Loans. Motion carried unanimously.

MOTION by Hol sek, seconded by Schneider, that the Clerk file the Frantz "Stopped
Payment" check I or Conciliation Court. Motion carried unanimously.

Mayor Schneider advised the City Council that Mr. Fields.ot Anoka County, had
informed him th t brush cutting, grass cutting, park maintenance, etc~ could be
be done by the C unty, with payment for same coming from C. E. T. A. Funds.
Councilperson lindschitl emphasized the importance of settling the personnel
questions, in or er that both C. E. T. A. and E. E. A. Funds could be utilized.
A meeting was s heduled for May 12, 1975, 7:30 P. M., to handle the personnel
situation, and s ecifically the items listed on Councilperson Windschitl' s
April 28 Agenda.
Shade Tree Insp ctor
Mayor Schneide requested immediate action on the appointment of a Shade Tree
Inspector for th City of Andover. He noted that he had received numerous calls
from the "State" on this.
A lengthy discus ion ensued on Mr. Jaworski's appointment as Tree Inspector by
the Grow Towns ip Board of Supervisors, the costs involved with a State Inspector
vs. City Inspect r, equipment needed by an Inspector, po s si bility of appointing
Mr. Jaworski 0 a temporary basis, and the necessity of immediate action.

BE IT RE OLVED, that the City of Andover appoint Arthur J. Jaworski
interim Sh de Tree Inspector, to carry out a Diseased Tree Inspection Program
until May 1, 1975; or until such time as the City Council shall make a
permamen appointment to the position. Compensation shall be at the rate
of $5.00 p I' hour.
BE IT FU THER RESOLVED,thatin order for the City of Andover to effectuate
a Disease Tree Control Program, the City Clerk is hereby authorized to
purchase 1 cally, the following items which shall remain the property of the
City of An over:

BE IT FUR THER RESOLVED, that the City Clerk place a suitable notice
in the legal newsPaper that the City of Andover has a Diseased Tree Program
in effect.
Motion carried unanimously.
Discussion on ssl #3 Statement
The general cons nsus of the statement, as prepared and signed by S. E. Scarborough,
was that it did not cover Andover's needs. No action taken.

MOTION by Vand rLaan, seconded by Windschitl, to adjourn. Vote: Yes _ Windschitl,
Rither, VanderLa n, Holasek; No - Schneider (Felt that a decision should be made on
the SSA #3 Statem nt. ) Motion carried.
