MINUTES
Pursuant to no ice published thereof, a Public Hearing covering storm sewer
improvement nd street construction for the area known as "Green Acres",
as outlined un er ,M. S. A. 429, was called to order by Mayor Richard J. Schneider,
September 18, 1975, 7:30 P.M., at the Andover Community Center, 1685
Crosstown Bo levard N. W., Anoka, Minnesota.
Councilperson present: Hola sek, Rither, Vander Laan, Windschitl
Councilperson absent : None
Also present: City Attorney, William G. Hawkins; City Engineer,
D. R. Kasma; City Administrator, Norman J. Werner;
City Building Official/ Zoning Administrator,
Walter L. Arntzen; City Clerk/Treasurer, P.K. Lindquist;
and approximately 35 residents from the Green Acres Area.
Engineer Kas a explained in detail, the letter dated August 26, which had been sent
to the property owners in the proposed improvement area (Exhibit "A ", attached).
Items covered ere 1')' type of construction, 2) costs, 3)benefits now and in the future,
and 4) manner f assessment.

Mayor chneider - Asked jf there was any chance of getting this project
completed this fall; and noted that some of the ditches ,
were put in when Mr. Menkveld developed the property. ,

Engine r Kasma - Stated that the project could be completed yet this fall,
except for the clean~up.
Council erson RitheF - Asked the earliest starting date jf the project were
ordered now; and noted that the streets in the Green Acres
Areá were constructed without the supervision of an
engineer;and asked if any of the Class 5 could be saved
when the sanitary sewer improvement was put in.
Engineer Kasma - Stated that the project could start November 15; and
that approximately one half of the Class 5 could be
salvaged.
Council erson Holasek _ Asked if there was any clay in the area; and if
the water running into the streets would cause the surface
to wear away.
Enginee Kasma - Noted that there might be :s.ome clay; and that a little
gravel would wash away, but the grading should handle it.

Asked if it ould cost more to install the sanitary sewer and storm sewer as
separate pr jects; and noted that this year was an unusual year for flooding,
etc., and th s was the first time that he had ever had water in his basement;
and that he id not feel that ditches would solve the problem.
(Dewey Kas a - Yes, it would be more expensive to do the storm sewer and
sanitary se er as separate projects. )
Herb Loren - 3030 l42nd Lane N. W.
Asked why e people on Ivywood were not included in the project inasmuch as
some of the ater that was causing the problems did come from their lots; and
who would k ep the proposed ditches clean. Noted that his drainfield was in
the lowest a ea and yet he had never had a problem. Felt that sanitary sewer
and storm s wer should be done at the same time.
(Dewey Kas a - The people on Ivywood did not have a problem and would not
benefit from the project; and that the City would keep the ditches open. )

(Councilpers n Holasek - I would like to see both put in at the same time, but
there seems to be no time set. )
(Walter Arnt en - Two years ago when it was first brought up, everyone opposed
sanitary sew r-this spring again, everyone opposed it; I believe that if the
storm sewer and sanitary sewer were proposed together for this hearing, everyone
would have a ain opposed it. There are septic systems in the area that cannot
be repaired.
John Noa;rd - 14126 Heather Street N. W.
Stated that h felt that the septic systems failures were the fault of the installing
contractor a d the water table was not the contributing factor. Asked what good
the ditches ould do along his back property line when his yaædwas 4 - 5 feet
higher, caus ng the ditch to be at least 6 feet deep; and the only reason the
water sits ·no is because the ditches are full. Stated that he would not give
,~ any easemeri s for ditches because he did not feel they would do any good.
- Questioned e possibility of a closed system and the costs; and stated that he
believed the oads were Class 5 right now.

near 6' deep A closed system would not help the ground water and would cost
approximate y $64,500.)
Asked when he sanitary sewer would be going into Northwood Addition and
possibly Re Oaks 1st; and if a different type of storm sewer system would
be installed f the sanitary sewer and storm sewer were done at the same
time.
(Dewey Kas a - If the petitions come in as information has they will-it could
be next spr" g. If you are interested, the petition should be in by November 1,
as we can u ually gehbetter bids in the spring when the contractors are looking
for work; an the storm sewer system would probably be the same even if the
sanitary se er were put in at the same time. )

Stated that h believed the water was coming in through the basement floor
rather than he walls, which would mean a high water table; and that he did
not feel that this system would help the flooded basements unles s the ditches
were below e basement level. Asked why a temporary solution could not

(Dewey Kas a - With a City as large as Andover, there is no way that this
could be don - if it were the taxes would go out-of-sight. The Council does
not feel it to be fair for someone in the northern part of the City to pay for
something b nefitti'1J;g only those in the southern part, and vice-versa. )
Kim Mahrer - 2939 l42nd Avenue N. W.
Noted that h had had water in his basement since April, and that the water is
not coming rough the walls, but rather the floor; and that he will have to do
work on his asement regardless of whether the storm sewer goes in or does
not. Asked hy the City had not maintained the ditches up until now; and that
he did not u erstand chargingt<!>c1ean out the ditches now, then later on paving
the streets a d eliminating the ditches. Also noted that 90% of the ditches
proposed we e already in existence.
(Dewey Kas a - This is true, however, someday you will have to do what
we are prop sing; and the work done now will not be wasted.)
Arlene Preb e - 2949 - l42nd Lane N. W.
~ Stated that ey have had their basement tiled and yet the water still comes
through the f oor; and that this happened even with a crack all the way across
- the wall, the efore, it is not surface water coming in and a storm sewer
would not he p, and that they pumped out as much as 3,000 gallons of water
in one day.

Stated that e ditch was re-graded and still did not have any water in it; and
that you cou d see the water draining from the west. Suggested putting a
culvert acro s Heather Street and letting nature do the pumping.
(Dewey Kas a - We have checked this out and it would not be the full
solution. )
Jim LaValle - 3025 142nd Lane N. W.
Commented hat he felt that the ditches behind him would do no good unless
they were 3' - 4' deep-the water is 2' deep in his yar<i!. at times, and yet
the present itch is empty. Questioned the proposed drainage and did not
feel that it ould help. Also noted that there were two people who would
not give eas ments.

just cannot a ford to pay for all the improvements; and if it is done for one
it would hav to be done for all. )

Noted that w en the culvert was installed under his driveway, it ran up-hill;
and that som driveways had no culverts at all. There is no drainage in the
40 acres beh"nd him and always ponds in the spring.

Stated that h felt that the Council mist consider what was best for the majorit y;
and it appea ed that the majority did not have a problem.
(Dewey Kas a - Storm sewers seldom are wanted by everyone; those persons
who do not h ve a problem sometimes are the people whose outlaw water is
causing the roblem for the others.)
(Councilper on Rither - On'May 4, 1971, the Town Board had the opportunity
to solve the roblem by not grantëa a ''blanket variance" on your lots. The
Planning an Zoning Commission recommended denial of this variance, however,
the Town Bo rd did approve it-now, the results have caught up with us. )

petitions circulated only asked for an opinion on sewer and water,
and did not s y one or the other. Stated that the residents had accepted the
fact that sa tary sewer would be coming within five years.

Questioned hy the people at the end of the cuI de sac were not included in
the project.
(Dewey Kas a - Those persons were not notified, and if any additional are
included, th re will have to be a new hearing. )
MOTION by Rith r, seconded by VanderLaan, to close the portion of the Public
Hearing which al ows resident input. Motion carried unanimously.

January 20, 197 , 7:30 P.M., Andover Community Center, unless a petition for
sanitary sewer i received prior to that date; then an earlier Hearing will be
conducted.
MOTION AMEN ED by Rither, seconded by Holasek, that such a notice be published
in the official ne spaper and include the expanded area and send additional notices
to the affected r sidents. Amendment and motion carried unanimously.

to discus s the fe sibílity of constJ:ucting storm sewers and improved gravel surfaced
streets in the G een Acres Addition, City of Andover.
The following in ormation is presented on the proposed project,
1. Wh is a S orm sewer s stem necessar ?
The probl m of storm water runoff must be faced in every area which undergoes
developme t into home sites. Prior to development, surface runoff presents few
problems, But as gJ:owth occurs, the surfac;:e topography is changed and natural
drainage ays are altered or blocked. Driveways, streets. the roofs of buildings
and other ai)made structurli's increase :the amount of runoff. Rainfall which

may have vaporated or soaked away previously, now runs off and settles ìn 10-

sewage disposal faílures,and also caused the ground water table to rise re.

The proposed shallow open ditch between Ivywood Street and Heather Street
Northwest ill provide needed surface drainage to eliminate standing water
in individu 1 sewage disposal system locations. The proposed open ditch
(3-4 foot d pth) through the undeveloped area between Heather Street NW and
Dahlia Street NW will provide an outlet for the entire area. A future pond
could be c nstructed in the same general location as the proposed ditch,
The propo ed underground pipe system on Heather Street NW from a point
350 feet so th of l42nd Avenue NW to l42nd Lane NW will provide needed
outlet for oth l42nd Avenue NW and l42nd Lane NW~ Open ditches (5-6
feet depth) in this area would be too deep to be acceptable in a residential
area~
The proposed storm sewer system would best be used by the improvement
/~ of existing street drainage. This can be done by regrading ditches to "clean
'--' up" the bo levard or by lowering the street and eliminating the ditches and
culverts al ng the street. We have prepared separate preliminary cost esti-
mates for 1) the lowering of the street and (2) the regrading of the street
ditches,
3. What t e f street construction is ro osed for our area?
The street reconstruction would include establishing the proper street grade
for urban t pe streets including curbs, excavating the existing dirt streets to
a 32 foot w dth at proper grade to provide surface storm drainage, place 32
foot wide 4 inch thick gravel surfacing.
4. Wh install storm sewers and im rove the streets when ublic sanitar sewer
!!l.3!:X be ins alled within several ears?
The proposed storm sewer will help solve the problem of the individual sewage
disposal systems and will be needed in the future after public water and/ or
sanitary se er has been installed, To make the proposed storm sewer effective
it will be n cessary to at least regrade the ditches and adjust culverts. Rathe r
than spend ime and money to redo the ditches that effect could be used to im-
prove the a ea by reconstructing the streets to provide the same surface drainage.
¡---, The only " asted" cost would be the loss of gravel when public facilities are in-
,- stalled and at that time provisions would be made to salvage as much gravel as
possible du ing construction op=ations.

The install tion of public water and/ or sanitary sewer in your area will be
based on r quests by property owners or by the need for the Council to pro-
vide sanita y conditions in the event numerous individual sewage disposal
systems fa'l in your area..
The Counc 1 has ~ time schedule proposed for installation of public water
and/ or san'tary sewer in your area at this time.
6, What is th osed time schedule to install the ro osed storm sewers and
reconstruc streets?
The earlie t possible date to complete the storm sewer system is late fall or early
winter. T is would provide relief in the spring when r'unoff and water problems
,~-.. are most s vere. The street reconstruction could be accomplished in the spring
------ of 1976.
7. What ste s are necessar et the work done?
The follow'ng steps necessary for the completion of the project:

8. How much will the storm sewer and street reconstruction cost me?
We have p epared preliminary cost estimates for construction of the storm sewer
system an the bituminous streets. These costs are as follows:
Storm Sew r Construction $30,000
Street Rec nstruction 35,700
Street Ditc Regrading 13,000
The entire cost of each of these improvements is proposed to be assessed against
the benefit d properties. Streets are assessed on an adjusted front footage basis
to all abutt'ng properties. Adjusted front footages will include provisions for
corner lot and irregular shaped lots.
Based on t e preliminary cost estimate of $35,700 and a total front footage of
6600 feet t e front foot assessment for street would be $35,700/6600 FF or $6.60

Storm sew rs are assessed on a square foot basis. The boundaries of the drainage
area are d termined and each lot within those boundaries is assessed for each
square foo of area draining into the system. Based on the preliminary cost
estimate 0 $30,000 and a total benefited area of 970,0.00 square feet the assess-
ment would be $30,000/970.000 SF or $.031 per square foot.
The assess ent for an average lot 110 feet in width by 167 feet deep, whích drains
entirely int the storm sewer system would be as follows:

taxes over a 10 or 15 year period. The annual charges, based on a $1,296.00

The constr ction iI1dustry prices have continued to rise in the past years, and
the outlook is for continued higher prices. The Engineering News Record Cost
Index, which is a national publication that indicates cost trends in construction,
lists the fo lowing increases in recent years based on $100.00 worth of construction
in 1965:

If a projec is needed. it is reasonable to proceed with the project as soon as
pos sible to obtain the benefit of the improvement since the interest at 8% will
probably b less than the annual increased construction cost.
