CONTINUED PUBLIC HEARING - MARCH 31, 1975
MINUTES
Pursuant to notice published thereof, a continued Public Hearing on Sanitary Sewer
and WatermainConstruction, was called to order by Andover City Mayor,
Richard J. Schneider, March 31, 1975, 7:25 P.M., at the Andover Community
Center, 1685 C'rosstown Boulevard N. W., Anoka, Minnesota.
City Council Mlmbers Present: Holasek, Rither, VanderLaan, and Windschitl.
City Council M~mbers Absent: None
Also Present: : City Engineer, Dewey Kasma; City Clerk, A. Jaworski;
City Building Official, Walter Arntzen; Recording
Clerk, Pat Lindquist; and approximately 50 residents.

Messrs. Paul udd and Bud Redepenny of the Anoka County Highway Department
explained to th City Council, their plans for the improvement of Nightingale Street.
Said improvem nt to be grading and hard surfacing the street, to include a graded
52' with a 24' ituminous roadway with gravel shoulders. $169,000.00 was given
as the enginee 's estimate for the work. Bid opening is scheduled for April 17, 1975.

Sanitar Sewer and Watermain Construction - M2 Area
A presentation as made by City Engineer, Dewey Kasma of Toltz, King, Duvall,
Anderson, and ssociates, covering the following:
1) Facts and figures from petitions, telephone surveys, and well tests.

a As a result of a telephone survey in the area on both sides of
Crooked Lake, it was found that of the 100 homeowners contacted,
73 had deep wells, 21 had shallow wells, and the remaining
did not know their well depths. (Letter dated March 21, 1975)
b 31 wells were tested by the University of Minnesota - 13 were
from deep wells and indicated the water to be free of contamination;
18 were from shallow wells and 15 were shown to have a nitrate
nitrogen level high enough to be considered contaminated/polluted.

e. Emphasized that this part of the system was the most expensive,
however, the oversizing costs will be the same for this project
and those in the future. Front footage and unit charges will
in all probability, increase.
Z) City ngineer Kasma made the following recommendations:
al. Build a central water system, i. e., well, pumphouse, and
I tank at a cost of $546,000.00
b. Build a watermain to serve the Crooked Lake and M-Z Area
J for a cost of $534, ZOO. 00.
Construct a sewer to serve the M-Z Area for a cost of $Z8l, 000. 00
d'. Construct a sewer to serve the Crooked Lake Area for a cost of
$1,058,900.00.
The basis for the above recommendations as follows:
Sewer -
al. Increasing nUIllber of individual sewage system failures in the
J proposed area.
To avoid ground and surface water pollution.
c. Petitions from property owners for sewer (87% for, 13% opposed)

e. Financial consideration for the propsed project has been examined
by the Fiscal Consultants, and has been determined as financially
sound.

15 out of 18 wells (shallow) were deliving water of unacceptable
quality.
Comparison samples taken in 1970 and 1975 have shown a sub-
stantial increase in the nitrate nitrogen levels.
Depth survey taken, show it will be necessary to improve water
quality.
Surveys and petitions indicate 61 % in favor, 39% opposed.
The following q estions and/or statements were executed by the audience:. (Staff
comments are s own in parenthses)
1) Asse sment on Multiple Dwellings. (Front footage would be the same as
a sin Ie unit - connections would be a percentage of individual units per
renta unit - stub charges can vary.
Z) Asse sment on pie-shaped and other irregular shaped lots. (All will pay
an av rage front footage. This will be determined at the Assessment
Hear gs. )
3) Exte sions of trunk lines to go where? (They will go where it will benefit
the e tire City's overall plan. )
4) If re uired connections are not made each year, who will pay the cost?
(Pos ibly a general tax levy will be necessary. )
5) It appears that the City will want to fill the urban area in order to pay
for the project. (Developers must meet requirements the same in the
urban area as in the rural area. )

6) conclrn that the southern part of the City will become another

Minimum lot size if sewer and water is put in. (A Comprehensive
Thvetopment Plan covers this; will probably not be less than 85',
exce t in "cluster" development, however, there is no guarantee. )
8) Deadends on watermains. (Minimum are shown in these projects. )
9) With I interest for over a period of thirty years, the cost of water to
an individual homeowner on a 100' lot would be over $4,000.00.
10) Thr~e or four deep wells could be put in for the price of central water.
11) A mtlch greater percentage of homeowners have "good" deep wells
than 'those with shallow contaminated wells.
12) EveithOUgh their well is contaminated, still does not want central
wate --digging a new deep well is cheaper.

A City Fire Department is necessary in order to receive a reduction
in fite insurance. (20'70 reduction is possible with central water and

14) Only homeowners should be counted in the percentages given; survey
figu es are unfair and appear deceptive if developers with vacant lots
are included. )
15) Most people do not like chlorinated and fluoridated water.
16) Wh n does water quality become "good"? (Usually through the first
har pan layer (100 '), but this can vary. )
17) The cost for the Bunker Lake Area was very high just to serve 25
unit.
18) Val e of homes will not increase anywhere near the cost of sewer and
wat r.
Fiscal Consulta t, Ehlers and Associates, represented by See gar Swanson, Jr.
and Philip Chen weth, furnished the City Council with a letter and two economic
models regardi g the financial costs and recovery of same for the project.

MOTION by Va derLaan, seconded by Holasek, to order the construction for the
extension of Sa itary Sewer for the Bunker Lake Estates M_2 Area, and that the
engineer prepa e final specifications and plans; and that the City Clerk seek
public bids for e construction of said project.
A lengthy discu sion ensued with reference to the feasibility of the project, if
the property 0 ed by Caswell and Associates did not develop; and the possibility
of this same pr perty being filed under "Green Acres", which would mean that
even the front f otage assessment could be deferred. Mr. Chenoweth reported that
there would hav to be a geaeral tax levy if no income could be realized from this
property. Cou cilperson Windschitl noted that even if Caswell did develop to its
fullest, there s ill would not be enough to cover costs. Councilperson VanderLaan
questioned the ossibility of using future connection charges and assessments in
other areas to pay for this project. Mr. Chenoweth advised that funds can be
cycled.

Councilperson ~olasek stated that a health problem in the M-2 Area could possibly
force the City into the project even if the Caswell property did not develop; and
then we could fate the chance that a 5'70 loan may not be available. Councilperson
Rither stated th1t a land use and a planning program must be instituted, or we
could face the s1me problem with the Caswell property as is in the Bunker Lake
Estates Area no~; we must get into a posture where development is contiguous
with the Sanitar 1 Sewer program.
Motion restated Vote: Yes - VanderLaan, Rither; No _ Windschitl, Holasek,
and Schneider. Motion defeated.
MOTION by Va derLaan, seconded by Rither, that the City Council order
construction of the water system for the entire Crooked Lake Area, and that the
City Engineer pJ,epare final specifications and plans, and that the City Clerk seek
public bids for e construction of said project. Vote: Yes - Rither, VanderLaan;
No - Schneider, Windschitl, and Holasek. Motion defeated.
Mayor Schneide asked for a motion covering just water on the Vie st ;::'ide of
Crooked Lake i asmuch as a petition had been submitted by. W. Anderson,
covering a deve opment area in the Southeast Half of Section 32. The Council
felt that this wo Id not be feasible.
MOTION by Rit er, seconded by VanderLaan, that ~':1e Public Hearing on the
Sanitary Sewer nd Watermain Construction be closed.
Several Council ersons wanted additional information on the Caswell property, as
to development nd "Green Acres" qualification. Motion defeated unanimously.
MOTION by Hol sek, seconded by VanderLaan, that the Public Hearing on the
sanitary sewer uestion for the M-2 Area be continued to April 15, 1975.
MOTION AMEN ED by Holasek, seconded by VanderLaan, to include the
time of 7 :30 P. . and location of the Andover City Hall, 1685 Crosstown Blvd. N. W.
Motion carried animously.

The following is a confirmation of the engineering matters discussed
with the City Council at the March 31, 1975 meeting and the action
taken b the Council:
1. The ,ity Council conducted a continuation of the Public Hearing with
rega d to feasi bility of providing sanitary sewer to the Bunker Lake
Esta es Area and a central water system to serve the C rooked Lake
Are and the Bunker Lake Estates Area.
I revie ed in detail with the Council the results of a telephone canvas of
the pro erty owners in the Crooked Lake Area with regard to their private
wells. he survey pointed out that approximately 750/, of the wells in the
area were deep wells.
I revie ed with the Council the well testing which was done to provide in-
formati n regarding the deep and shallow wells in the Crooked Lake Area.
T he 13 eep wells tested all proved to be satisfactory. 15 of the 18 shallow
te sted ere contaminated and were not providing a safe drinking water.
I re vie ed with the Council the proposed project financing for various portions
of the water and sanitary sewer systems. The details of that financing pro-
g ram a e on a letter to the City Council dated March 24, 1975.

The Ci y Council voted to drop the Bunker Lake's Estates Sanitary
Sewer roject. However, later during the discussion the Council
agreed to continue the Public Hearing to consider additional informa-
tion on the Bunke r Lake E states project. The City Clerk is to con-
tact Caswell Engineering Company and request in writing from them
what pl'ans they have for the development of their property. The City
Clerk i's also to contact the Anoka County Treasurer office to determine
if the Jroperty owned by Caswell qualifies for Green Acres at this time.
The cik Council voted to drop the Central Water System for the
Crooked Lake and Bunker Lake Area. There was no provision for
continJing cons ide ration of installing a Central W ate r System unde r
this Public Hearing proceeding.
The Ci y Council continued the Public Hearing for consideration of to.
Bunker Lake Estates Area until 7:30 P.M. on April 15, 1975.
2. Mr. Wallaœ Anderson, property in Andover submitted a petition
thro gh the City Council requesting water, sanitary sewer and
bitu inous surfaced streets in an area directly west of the Meadow
Cre k's addition. Mr. Ander son requested that the petition be
disc ssed at the April 15, 1975 meeting. The City Council agreed
to p ace this petition on the agenda at that meeting.

With rJference to the recap of cost in your engineer's letter of
March 24, 19175, "Ii' have revie\"ed the recap of costs and assessments with
additional cbmment as to its feasibility.
The t\<o project areas are defined in paragraphs three and seven of
Mr. Kasma 's eport, which sites the costs of providing se,<er (three) and
water (seven for the Crooked Lake and Bunker Estates areas.

To meet the average debt service of $59,675, about 30 connections @
$2,000 (water and sewer) would be needed each year until the bonds are retired.
If the $ ,000 connection charge were to increase $100 per year such as
$2,100 the fi~st year, $2,200 the second, $2,300 the third, etc., about 17
sewer and wat r connections would be needed to avoid a tax levy.
Bea r in ind there has been no provision made for capitalized interest or
discount in t e above computations. If the actual bid prices on the project
are as estima ed, the balance to be collected from connection charges would
be $254,600 a ditional or about $17,200 more per year.
The atta hed Exhibit indicates a cash flow of assessments and connections
for the propo ed area using a bond issue of $2,425,000 and assessments of $1,535,000.
