Regular MeetinJ - May 6, 1975 Minutes - Page 2 City Reporter Mrs. Shirley H tfiel informed the City Council that she would report on K. A. N. O. Radio, and in the Anoka County Union, the Andover City Council Meetings. She requested copiek of City Ordinances and Meeting Minutes in order to brief herself on miscellaneou1s items. MOTION by Rither, seconded by Windschitl, to provide Shirley Hatfiel J.ith copies of City Ordinances and;¿¡fÿf't;ouncil Meeting Minutes, for the purpose rf reporting in the Anoka County Union and on K. A. N. O. Radio. Motion carried unanimously. Sanitary Sewer ÞinanCing Engineer Kasm~ reported briefly on data presented to the Farmers' Home Administration to-date; and req ested the adoption of the three (3) following Resolutions: l. Resol tion giving the Mayor and City Clerk authorization to file applications on beh lf of the City of Andover; and for the City Clerk to furnish the Farm rs' Home Administration all required information. 2. Resol1tion securing William J. Hawkins as City Attorney. 3. Reso]tiOn ordering resident inspection of Sanitary Sewer Collection Syste by Toltz, King, Duvall, Anderson and Associates. MOTION by Va derLaan, seconded by Rither, that the City Council adopt the foregoing three 3) Resolutions. Motion carried unanimously. Auditor's Subdivision 82 Storm Sewer Re ort A background hi tory on the situation was given by Engineer Kasma. Attorney Hawkins reporte on the legal aspects of lawsuits against the Developer; and the financing of the roject should it be ordered.(This to be covered fully at Public Hearings and Assessment Hearings). Residents spoke of the problems, both past and present. Building Official Arntzen confirmed several of the complaints, and informed th Council of others that have presented during the past three years. The Council exp essed the need for an assessment policy for this and future projects. Engineer Kasm to draft up a proposed policy sheet. A 5-Minute Rec ss was called. Meeting reconve ed at 9:15 P.M. . , MOTION by Rit er, seconded by VanderLaan, that the following Resolution be adopted: WHEREA , it has been determined that a storm water drainage problem exists in Aud tor's Subdivision No. 82, and, Regular Meetin~ - May 6, . . /5 Minutes - Page 3 Auditor's Subdivision No. 82 - Resolution Ordering Public Hearing for Storm Sewer Construction (cbntinued). WHERkAS, the drainage problem has generally been known to exist since Spring, 1972r and, WHEREAS, the drainage problem has resulted in continued expenditures in time and ~ffort by the City Council, Staff, Consultants, and residents, and, I WHEREAS, the minimum cost of remedying said problem is said to be $41>,200.00, land, I WHEREAS, the City of Andover is faced with other areas experiencing similar problems, and, WHERlAS, the City of Andover does not possess the financial means to pay for all of the projects out of the General Fund, and, WHER AS, the City Consulting Engineer reported at a City Council Meeting held May 6, 1975, that said storm water drainage project is feasible, NOW, HERE FORE BE IT RESOLVED, by the City Council of the City of Ando er that notice is hereby given that the City Council of the City of Ando er, Minnesota, will meet at the City Hall at 1685 Crosstown Blvd. NW, on Thursday, June 12, 1975, at 7:30 P. M., for the purpose of conducting a public hearir pursuant to MS; A;429, on the proposed construction of storm water draina e and street surfacing in Auditor's Subdivision No. 82. The residents present objected to a project that would involve an assessment. State Aid Street e ort Engineer Kasma read a letter to the City Council, dated April 21 (copy attached), and indicated on posted map, the streets on which the allotment must be used. Mr. Kasma reco mended that the 1975 construction allotment be not spent in 1975, but he Id until 197 ; and a project done at least every other year thereafter. MOTION by Van erLaan, seconded by Schneider, that the City Council authorization of an expenditure of approximately $2500.00 by Toltz, King, Duvall, Anderson, and Associates, for t e inventory of existing streets and studies relating to M. S. A. R., be postponed to e City Council Meeting scheduled for June 3, 1975. Motion carried unanimously. Councilperson W ndschitl requested that prior to the above decision at the June 3 Meeting, there be a discussion and resolution on the policy for roads in future subdivisions. Regular Council Leeting - May 6, 1975 Minutes - Page 5 Spring Street Problem Report A letter to the Ci y Council, dated March 19, 1975, from T.K.D.A., was read b:r Engineer Kasma, outlining work needed on various City streets. Mr. Kasma pointed out that s me of the streets listed, required additional study. MOTION by VanderLaan, sec nded by Rither, to refer this to the Budget Committee for study, with reference to financial information only. Vote: Yes - Windschitl, Rither, VanderLaan, Sch eider; No _ Holasek. Motion carried. Metro Sewer serlice Boundary Lines Engineer Kasma ldvised the Council that he had spoken to R. Payne, Metro Staff Engineer, who i armed him that in all probability the sewer areas, with reference to No. 2 and No. 3, would be changed this fall - in keeping with the Metropolitan Framework Deve opment Guide. Councilperson Windschitl: noted that the population projection figure as shown in the North Area and C. A. B. Reports were unrealistic, in that 2,400 as s own could not posßibly include the two trailer courts that are planned for Andoter. Engineer Kasma was requested to check into these figures and report to the [OUncil. '" Time Limit on Meting MOTION by Rith r, seconded by Va nderLaan, to delete Items No. 13 (Purchase of Projector Screen, No. 15 (Junk Pickup), No. 16 (Gopher Bounty); and that No. 17 (Animal Control) e limited to a 10-minute discussion. Motion carried unanimously. MOTION by Hola ek, seconded by Schneider, that Item No. 5 (Shade Tree Ordinance), No. 12 (Aerial M pping), No. 13 (Purchase of Projector Screen), No. 14 (Park Advisory Board _ Summer rogram), and No. 15 (Gop!,er Bounty) be added to the May 20 Regular Meeting Agenda. Vote: Yes _ Schneider, Holasek; No - VanderLaan, Windschitl, Rither. Motion defeated. Animal Control MOTION by Wind chitl, seconded by Rither, that the Mayor and Clerk be authorized to enter into a co tract with B. & E. Patrol, Inc. , on an emergency basis, subject to the review and approval of the contract by Attorney Hawkins. Motion carried unanimously. The representati e from B. & E. Patrol advised that tickets would be issued in all cases of Violatio s of Ordinances 5, 14, and 20 (These fines are in addition to impounding fees); and that ev n if the animal cannot be impounded, a ticket can be issued if the ordinance is viol ted. Resident Com lai t Mrs. A. Powers, a resident, requested that action be taken to have Mr. Orttel clean up the area around the mobile home on 157th Avenue in Nordeen Addition. Mm. Reimbursement f r Count Services The City receive a check in the amount of $864 from Building Official, Walter Arntzen, for monies paid t the County of Anoka by the City of Andover for the services rendered by Dallas Felegy hen Mr. Arntzen was hospitalized. Attorney Hawkins informed the Council that Mr. rntzen had no legal obligation to pay any amount. Mr. Arntzen was thanked by the Co ncil for the check. I The Munici al State Aid allotment for the City of Andover in 1975 was $81,98 .00; $69,597 for cons truction and $12,390 for mainten- ance. The total al otment is determined by the City's state aid roadway cons tructio needs and population. A. MAl TENANCE ALLOTMENT 1, Current Allotment The maintenance allotment is determined by using $1,500 per ile of existent roadway on your state aid system or 250/0 of y ur total allotment, whichever is less. There are 8.26 mile of existent state aid roadw~y mile~ in Andover.' U"es of Allotment The allotment can be used in many ways for roadway m:ain- te ance such as resurfacing a roadway, purchasing maintenance eq iprnent, snow removal,. reshaping roadways, etc. 4. Payment of Allotment The allotment is paid to the City at the following times: January Payment = 50% July Payment = 40"70 December Payment = 10% B. C NSTRUCTION ALLOTMENT Current Allocation Construction allotment is equal to the total allotment minus maintenance allotment. ($81,987 - $12,390 = $69.597) 2. Maximum Time for Saving Allocation The maximum time the construction allocation can be saved is 1-1/2 years without a penalty, therefore money allocated on Ja uary 1, 1975 must be committed before July 1, 1976. A co mittment means an award of contract. If the money was not co mitted by that time the penalty incurred would be your total all tment in thousand of dollars times the annual appropriation of ollars per $1,000 of needs. If this money was not spent in 19 6, it would mean a loss of funds equal to 69.597 x $27.28 = $1 900. C. B NDING CAPACITY UNDER STATE AID ACCOUNT Th City may sell Bonds through a State Aid Bond Account to the extent tha in anyone year the principal plus interest payment on the bond mus t not exceed 50% of the annual s tate aid allotment. The State recomme ds that bonding be done over a period of ten years, but have not object d going 15 years. With the present allocation the maximum principal Ius interest repayment would be .5 x $81,987 = $40,993.50. A ypical example would be to borrow $300, 000 at 6% Over 10 years. A erage payment per year would be $39,900. The principal remaining each year on your bond account is added to your needs for figuring the next years allocation. It would cost the City more in interest for the 10 years than you would receive in adciitional funds from Item 2. above. The a~ditional cost from the above example would be approxirnately $60.000, for the 10 year period. 2. The interest payment for the bond account must be paid from th maintenance allotment. Therefore, other funds would have to be appropriated during the 10 years to make up for the reduction in your s tate aid maintenance allotment. D. S ATE AID PROJECT PROCEDUlZE l. prepare an engineering feasibility study for the City Council. 2. Prepare final plans and specifications. 3. Submit plans and specifications to District State Aid Engineer and State Aid Engineer for approval and signatures. 4. Receive bids and award contract. 5. Submit a "Report of State Aid Contract" and an "Abstract of Bids" to the MHD immediately after award of contract. 6. If bonding is required the following steps are necessary: a. Prior to bonding, submit a letter addressed to the Com- mission of Highways, attention State Aid Division, requesting the Commissioner's of Highways Certificate of Allotment of Municipal State Aid Funds to construction and maintenance accounts of the City of Andover for the past two years. b. When the bond issue is sold, the bonding agent must sub- mit a resolution to the Minnesota Highway Department State Aid Division. E. A1SSESSMENT PROCEDURE Ai typical procedure used is to assess 50% of the total cost for improvements to the benefitting property owners and the remaining funding 1'0uld come from State Aid Funds. The reasoning for this, is that the benefitting property Owners should not be required to pay for a roadwaY'f which requires a standard of design greater than the normal acceptab e standard roadway in Andover. F. RECOMMENDED PROGRAM FOR 1975 l¡ We recommend that the City of Andover not pursue a State Aid Construction Program this year, but wait until next year when a greater amount of funds are available. (Award a contract p ior to July 1, 1976). 2 We recommend this year the City of Andover make a complete i ventory of exis ting s tree ts. 3 The City Engineer work with the Planning Commission to r view the existing State Aid System. 4 Prepare and submit updated "needs reports" to the District S ate Aid Engineer for acceptance by the Minnesota Highway Dept. 5 The City of Andover prepare a Rural Street Construction Plan. HAM13L1N Gentlemen We are writing to report on the storm drainage problem in Auditor's Sub- division No. 8 located south of Round Lake. Mr. Gerald Br mstead and Mr. James Lueck property owners of lots on Woodbine Strcet that are directly affected by the storm drainage problem, met with the C uncil on February 18, 1975 and requested the City Council take necessary action to correct the problem. The Council authorized our firm to prepar a feasibility report and cost estimates to resolve the problem. BACKGROUND Thc storm drai Iagc problcm has existcd sincc homes werc constructed by E. V Buildcrs on Lots 4 and 5 Block 8, Auditors Subdivision No 82 in the spring of 1972. On August 8, 19 72 Mr. Truman Hulegaard asked about furnishing and installing a storm sewer o resolve the problem. The Town Board a'grced to contact the Consultant nginee r and have them check out thc situation. On August 14, 972 the ConRultant Engineer submittcd a report recommend- ing a pipe syste or regrading of the street to eliminatc the problem. On August 30, 1 73 the Consultant Engineer submitted a rcport on the meeting held August 29, 1973 at whIch the dcvelopcr stated he planned to remedy the Honorable Ma}or and City Council April 28, 1975 Page Two water problem by constructing a small system consisting of the neces sary catch basins, manholes, and storm sewer to tra.nsfer the drainage of this area northwcst1ward into Rour:d Lake. On June 8, 197 the Consultant Engineer submitted a report recommending a storm sewer s stem to resolve the problem area and serve an approximate 40 acre storm dr inage area south of Round Lake. The preliminary cost estimate for the project cost was $39,000.00 with $13,540.00 Township participation and an assess ent of $335. 00 per lot for 76 lots. On August 16, 1973 the Town Board conducted a public hearing on the pro- posed storm sewer system. The project was continued to the regular meet- ing in Februar', 1974 and if the problem still existed at that time, it was to be investigated further. At the August l6, 1973 meeting, Mr. Trueman Hulegaard agreed to lower the drainage pipe t take care of the two yards. Chairman Carlson stated the town- ship will contr ct with th, Consultant Engineer to do whatever surveying is necessary to a sist in getting the right grade levels. CURRENT SIT ATION Apparently Mr. Trueman Hulegaard installed a partial unde rground system in this area. A r cent field survey conducted by our firm shows the existing storm Sewer system n Figure No. 1. Howeve r, the existing pipe and open ditch system is not satisfact ry to resolve the problem. The reasons it is not satisfactory are: 1. T c existing pipe inlet is too high to permit runoff into the pipe. 2. T e pipe outlet is in a ditch where sand washes in and blocks the fl w of water. 3. E isting ditches are too deep to encourage residential development along the street. 4. E isting ditches do not have turf to keep sand from washing in and bl cking wate r flow. The following is a list of the areas whic we investigated and a brief report on each area: 1. On 139th Avenue east of U lander Street Existi g problem is water standing in road without storm drainage outlet. Appar nt solution is construction of catch basin on each side of road and approx'mately 130 feet of 12" storm sewer installed along the property lot Un discharging to the rear of the lot. 2. 139th venue and Ni hten ale Intersection Existi g problem is water standing in intersection. Apparent solution is to grade treet to slope to east cutting down intersection to provide surface draina e across the intersection. This can be accomplished by the City street ontractor. 3. ale Street and Partrid e Street Intersection Existi g problem is storm water standing in street at intersection. Apparent solutio is to construct open ditch to east into low area. Also install one 40 foot long culvert under Nightengale Street at the intersection. 4. Raven treet and 140th Avenue NW Existi g problem is water standing in street at intersection. Apparent solution is to g ade Raven Street from this low point north past the intersection of Raven treet and 140th Lane. This would require lowering the intersection of Rav n Street and 140th Lane approximately 3 feet. This will not adversely affect he adjacent property owners. Crosstown Boulevard and 138th Avenue The exi'sting problem is water standing in intersection. Apparent solution is to ha~e Anoka County Highway Department install culvert and construct ditch atl this intersection area. A letter will be sent to Mr. Paul Ruud, Anoka County Highway Engineer, regarding this problem area. 6. 135th A~enue NW and Rose Street Existin~ problem is water standing in the intersection. A review of the enti're Chapman Addition pointed out the need for an entire storm drainagle plan for this area. This area would be an excellent one to have aerial photo- graphic mapping to enable us to study the storm drainage problem. 7. 142nd iXvenue at Point 500 feet east of Round Lake Boulevard Existint problem is water standing in road. There is no adjacent low area to drain this water to. A storm sewer system would have to be considered to provide a solution to this storm drainage problem. Additiotal field studies would be required to provide a feasibility report on this, roblem area. 8. Woodbi e Street a roximatel 500 feet north of 143rd Avenue Exi s tin problem is water standing in street and running into two low yards 0 west side of street. This area was authorized to be studied by the ity Council at a recent meeting. We will make the necessary field su veys as soon as the snow cover has melted. 9. East end of 144th Avenue in Dehns Addition Existin problem is water standing in road. Apparent solution is to install o foot long culvert and necessary ditching to drain water into existin low park area east of the street. 10. 159th A enue near Rum River Existin· problem is water standing in road at a point approximately 300 feet ea st of urn River on 159th Avenue. There is a steep grade on 159th Avenue which c uses a washing problem. This can be eliminated by shallow ditching on each side of the street to the low point. The major problem in this location is an 0 tlet to a low area. The apparent outlet for the area will be the Rum River I cated approximately 300 feet east. A field survey will be required to dete mine the requirements of the project solution. lI. Xenia Street north of 158th Avenue Existin problem is water standing in the low area approximately 800 feet north 0 158th Avenue. The proble1 area is located at 15854 Xenia Street. This work can be done by the City street contractor. 12. 161st A enue a'ld Tulip Street Existingl problem is water standing in street. Apparent solution is to fill this low~rea which is approximately 50 feet north of the intersection by grading irt in from the adjacent streets. This work can be done by the City str et contractor. ' 13. Orchid Jtreet and 176th Lane NW EXisting problem is water standing in street at a low point approximately 300 feet south of intersection. Apparent solution is to grade a ditch north to the intersection for drainage to the west. This work can be done by the City strjet contractor. 14. Bluebir Street- 181st Ave. NW - Ward Lake Drive severallstorm drainage problem areas along street. Apparent solution is to co struct open ditches from low spots into vacant property. Will require lstaking of work for City street contractor. 15. South C on Creek Drive and U lander Street , Existin i storm water problem at intersection results in street washout during neavy rains. Apparent solution is culvert and ditch construction which c n be done by City street contractor.
