MINUTES
A Regular Meeting of the Andover City Council was called to order by
Mayor Richard t. Schneider, March 4, 1975, 7:35 P.M., at the Andover Community
Center, 1685 C'!osstown Boulevard N. W., Anoka, Minnesota.
Councilpersons ~resent: Holasek, Rither, VanderLaan, and Windschitl
Councilpersons bsent: None
Also Present: City Attorney, William Hawkins; City Engineer,
Dewey Kasma; City Clerk, Art Jaworski, City Building
Inspector; Recording Clerk, Pat Lindquist; and several
residents.
MOTION by Rither, seconded by VanderLaan, that City business be finished at 10:30 P.M.,

MOTION by Van er Laan, seconded by Windschitl, that the Minutes of January 7, 1975,
January 21, 197 , and January 23, 1975, be approved as corrected. Motion carried
unanimously.
Ed Ba ers - Ke ne1 License
Councilperson R ther read from Ordinance #5, Sec. 6, regarding kennel licenses, and
questioned the C1ty Attorney on the necessity of a License Application having to come
before the City 'ouncil. Attorney Hawkins stated that there was no clear answer on this,
however, it was Idone on all licenses in most communities.

MOTION by WinldSChitl, seconded by Holasek, that the Kennel License for Ed Bayers
be approved. Motion carried unanimously.
Public Hearing 1 Crooked Lake Area, Watermain Construction
Charles ViemanJpresented sealed statements from the residents in the area. The
matter was cont nued until later in the Meeting to allow the Engineer and Clerk to
record the abov~ statements on a map. Interested citizen were invited to witness
the recordation of these findings.
Public Hearing 1 M2 Area, Sanitary Sewer and Watermain Construction
Inasmuch as a dlcision for/against the project in this area tied in with the results
of a decision on the Crooked Lake Area, the matter was tabled; to be brought forward
later in the meeÜng.
Rules committel Report
Councilperson Jindschitl, Chairman, presented a proposed ordinance to the Council.
The City Counci requested time to review said proposed ordinance; and agreed to
table a decision ntil March 18, 1975. The Council was questioned as to their feelings
on whether the p oposed ordinance should go through as an ordinance or a resolution.
Mayor Schneide felt it would be less costly, with reference to publication, etc., to
handle this in re olution form. Councilpersons Rither and Windschitl noted that an
ordinance would be more official, effective, and less apt to be changed than a
resolution.
Councilperson indschitl suggested that some action should be taken with reference
to Planning and oning Commission Meeting dates, inasmuch as there has become a
time problem in that several items are being delayed up to three weeks before receiving
Council action b sed on Planning and Zoning Commission recommendations.
Council per son R ther suggested that Allan Miles, P & Z Chairman, be contacted to
consider possibl changing of Planning and Zoning Commission Meeting date to allow
time to place Co cil items on the Agenda for the City Council Meeting following the
Planning and Zo ing Commission Meeting.

Council per son ~ither noted a letter sent by the Committee to the Council with
reference to the 1 additional work required to complete the report; the only segment.:
left at this time is to tie specific jobs together to be as signed to each individual.
He noted that twb additional meetings have been scheduled (March 11 and March 13),
with the hope of Iconcluding the Report at that time; and requested that this item be
placed on the MJrch 18, 1975 Agenda.

Council per son Hlolasek presented a resolution with reference to concluding
City Council Meftings at 10:30 P.M. Discussion followed as to the possibility of
including this item in the Rules Committee prop osed ordinance (By-Laws).

Discussion on S lling Firearms
Mayor Schneide reported that he had received an offer of $100.00 from
Frank Schoonov r for the purchase of the 38-Special handgun presently owned by the
City of Andover. Mr. Jaworski has had the gun appraised for $85.00. In answer
to a question by ouncilperson Holasek, Attorney Hawkins reported that it was not
necessary to ad ertise for bids on items where value is less than $500.00.
Additional Items Not On Agenda
The following ite s, although not on the agenda, were presented in the interim of
waiting for the blic Hearing to resume:
- Mobile Home
Slyzuk had requested information on the possibility
of parking a mobile home on his property to house migratory workers during the
work season of March - November. Counci1person Rither read from Ordinance #6,
Section 2, i which it was stated in'part, that such a use is not permitted.

Mayor Schneider stated that he had received a request from Ed Lullbeck to present
his product to the City Council at the next meeting. The Council felt that there
was no rush 'to handle this item at the next Council meeting. Councilperson Rither

Russell Roads
Mayor Schnlider informed the Council that he had spoken to Mayor Cox of the
City of Ram'sey, and was told by him that Ramsey did not intend to do anything
insofar a6 tll:se roads. The City Clerk was directed to contact the City of Ramsey
and ask for ritten confirmation of their intentions in response to the Andover
City Counci letter of February 20, 1975.
Dog Clinic
Mayor Schneider volunteered to handle the arrangements for the Clinic, to be
held sometïJ.ne during the Month of May.

Public Hearing - M-2 Area, Sewer and Watermain Construction (continued)
Engineer Kasma Jresented a map, color_coded to show the results of petitions and
written statementk from the residents on the east side of Crooked Lake and the
M-2 area. The f llowing was indicated for the east side of Crooked Lake:

16 -- Again t Sewer 36-- Against Water
It was noted that anitary sewer had previously been approved for the Crooked Lake
area, therefore, he watermain construction was the only project under consideration
for that area at this Public Hearing.
Per a telephone s rvey. the following was shown for the M-2 Area:
10 -- For S wer 1 -- Against Water 1 -- Neutral
9 - - For ater 1 -- Against Sewer
Engineer Kasma eported that he had contacted the owners of the large tracts of land
in the area regar ing the possibility of future development; with said contacts indicating
that Meadowcreek Baptist Church, Hand Construction, and Adolphson's had no plans
for development i the immediate future; and Caswell Engineering may develop and are
in favor of both w ter and sewer.
The following co ments and/ or statements were rendered by citizens in the area:

Asked how any owners had been contacted in the M-2 Area, and was told by
Mr. Arntze that 12 of the 15 were called; and pointed out that most of the
12 contacte owned more than one parcel in the area.
Tom Funk - 13504 G1adio1a Street N. W.
Noted that t e west side of Crooked Lake is owned to a great extent by developers,
however, the east side is owned and lived on primarily by individuals, and it is
those individuals that the City Council should consider in making their decision.

Stated that he wished to impress on the City Council the fact that of those on the
east side ofl Crooked Lake, 36 out of 50 were opposed to the water; and said 36
were indivi ual homeowners and long-time residents, whereas on the west side
of the LakeJ one man owns the majority of the land.
After some dis cul sion, the City Council agreed to continue the Public Hearing after
Mr. S. Swanson, ¡City Fiscal Agent, had arrived to explain the financial impact of
the project, WherrbY giving them additional information on which to base their decision.
Aerial Photographic Mapping
Engineer Kasma JXP1ained the value of aerial mapping of the City for both the present
and the future, arid reported the following information with regard to the photography
and mapping: ~
Projects au h as sewer, water, streets, storm sewer, etc., can be done from
the maps, rather than sending men out into the 'field' to survey etc. If a contract
were signed with an Aerial Photography Company, e. g. Mark Hurd, they would
1) fly and p otograph the City for a cost of approximately $700.00, 2) basic
ground cont ols from field work would then be executed for a cost of approximately
$11,300.00 (both of these it ems are one-time costs). Actual mapping could then
be done for ny section of the City at any time at a per acre cost. The costs for
the actual' apping' can be recovered all or in part by 1) charging to the project
involved, 2) selling information to developers at a per acre cost, 3) selling sheets
to indi vidua property owners.
Councilperson Va œrLaan suggested that the City Council wait until the Budget Committee
has given their R port to determine a time for this work, dependent upon whether or not
funds are availabl . Budget Committee Chairman, Councilperson Ho1asek, advised that
the Budget Comm ttee could not do any work until the Rules Committee Report was in.
Counci1person Rit er stated that the present Budget Committee had been established,
and should work ith their current members, as this Committee is very crucial to the
City and the Budg t must be presented soon.
Mayor Schneider uggested that the question of aerial photography be tabled until the
Budget Committe reported. The City Council concurred.
Tractor Bids
MOTION by Rith r, seconded by Windschitl, that the bid of Montgomery Wards in the
amount of $2446. o for a 16 HP Lawn and Garden Tractor #33155, with the following
specifications: 2_Yr. Service Contract; #33178, 42" Sweeper Brush; #33161,48" Mower;
#33068, Wheelwei hts; #33066, Tire Chains; #33053, 36" Snowthrower, P.T.O. and
:Iydraulic Lift; be accepted for delivery within sixty (69) days, delivery date to be
specified by the C ty of Andover. Motion carried unanimously.

the Public Hearin~s. Mr. Swanson explained that the many variables in the beginning
called for an extremely high estimate. Mr. Kasma explanined that costs can also
differ due to estWates on number of projected connections. Mr. Swanson indicated
that the Computer Runs show that unit charges will increase until they reach $1540.00
in the year, 2006. He pointed out that the exhibits show that the City Council is taking
a greater risk of recOVering costs by ordering a small project.
Errors were note on three of the computer models in that sewer and water connections
did not agree. Cduncilperson Windshcitl questioned the 378 additional connections shown

,hat the area to th west of the presently developed section, was assumed to be platted
within the next fe years. Council person Windschitl emphasized that the costs of the

reported that all Qversizeing costs were shown on the exhibit hhand, therefore, the
recovery for said costs must be shown.
Engineer Kasma oted, that from an engineer's standpoint, savings on fire insurance,
potential growth, nd the condition of the water in the existing area must be considered;
and that the proje t is feasible, hut risky if the system is not going to be used to its
fullest potential.
Councilperson Ho asek agreed that sound financing indicates the water should be put
in the same time s the sewer, rather than wait two or three years and,do-it; however
if the wait is goin to be over five years, then it s~be forestalled, r~g<l;r,dl~. '

Stated that Jis well was deep and would last him for the next twenty years;
and that the streets could be done anytime.
Wally Arntzen (City Staff)
Informed thb residents that there were areas in Champlin, Minnesota, with

deep wells that were going dry simply because of heavy development.

of the area n question for watermain construction was not developed and verbal
statements y the large landowners indicated there were no plans for development

Stated that 1 e had found while talking to residents in the area during a house_to_
house surv y, that the phrase most often used was "I would like it, but I do not
have the m ney to pay for it".

Stated that he City Council mùst look to the future as to development, and the
prevention f those people having to pay for deep wells, only to get central
water short y thereafter.

Councilperson Ho asek asked the City Engineer for a figure showing comparison
of deep wells to shallow wells in the project area; and stated that he felt that if
the water was goihg to be needed within ten years, it should be done now, and
if not, the project should be terminated.

Councilperson Rither noted twelve points to be considered before making a
decision and requbsted additional time to study this.

Bills
Bills were review d and signed. It was agreed to hold the voucher for Glenn Smith;
md to direct the eputy Clerk to send a letter to Mr. Smith, asking for a new claim
showing dates of service.
MOTION by Rithet seconded by Windschitl, to pay bills in the amount of $3,422.89.

unanimously. Ad itional Council busines s to handle.
MOTION by Rithel, seconded by Windschitl, to direct the Clerk to write a letter to
Seegar Swanson 0t Ehlers and Associates, Inc., requesting that he provide the
City Council with detailed statement of costs of professional services incurred
to date on the Sanitary Sewer question, and that Mr. S",anson provide a detailed
written explanatioh of the difference in the original unit assessment of $1,000.00,
and the new unit a~sessment of $500.00. Motion carried unanimously.
Mayor Schneider ~resented a letter and ORS Form 3233 received on February 25, 1975,
from the Department of Revenue Sharing. Council per son Rither directed the Clerk to
check with the att6rney to see whether or not the figures shown are correct and if
action is neces sa1Y'
Mayor Schneider asked the Council if they wished to interview other Bonding Agents.
Councilperson Rither felt that the Council should wait for Mr. Swanson's letter.
Councilperson WJdsChitl suggested getting information from other Bonding Companies.
MOTION by Rithe , seconded by Holasek, that meeting be adjourned. Motion carried
unanimously.
