The Regular I eeting of the Andover City Council was called to order
by, Mayor, Ri hard J. Schneider, July 1, 1975, 7:35 P.M., at the Andover
Community Ce ter, 1685 Crosstown Blvd. N.W., Anoka, Minnesota.

Green Acres torm Sewer
Letters from T.K.D.A., dated June 26, 1975, and W. Artnzen, dated
June 27, 197 , regarding the drainage problem in Green Acres Subdivision,
were read. our residents were present, each of which noted that
they are hav'ng trouble with water in their basements and are either
pumping them elves or having the City do it.
-, MOTION by Wi dschitl, seconded by Rither, that T.K.D.A. be authorized
to prepare a feasibility study for storm sewer drainage improvement
in Green Acr G S.ubdivision. Motion carried unanimously.
Junk Yard Li ense - D. S'hernell
Hr. Shernell was not present and had not furnished the City with a
copy of his urchase agreement as requested. MOTION by Windschitl,
seconded by 'chneider, that the Junk Yard License for Douglas Shernell
be tabled un il July 15; and that the Clerk notify Mr. Shernell of
the reschedu ing. Motion carried unanimously.
Joint Powers A reement - D. Minder
Mr. Minder w s not present. MOTION by Windschitl, seconded by Holasek,
that action d discussion on a joint powers agreement be tabled until
July 15. Mo ion carried unanimously.

Proposed pla s for the Neighborhood Business were presented by J!'. Berg,
Consulting E gineers Diversified. He advised the Council that the
total shop c mplex would be 9500 square feet, however, plans were to
expand in ph ses, starting with a lauµdroma~ of 2600 square feet and
a superette f 3,000 square feet; construction to coincide with the
installation of sanitary sewer in the area. Mayor Schneider read
~- the recommen ations from the Planning and Zoning Commission.

MOTION by W ndschitl, seconded by Schneider, that the rezoning of the
four parcel of land, described as per the attached (E:xhibit "C")
from R-r1 an ï1-2 to NB, be granted for the following reasons:
1 . Hm ets all the requirements of Ordinance No.8 for
neig borhood business.
2. It m ets the intent of the Comprehensive Development Plan
in r lation to neighborhood centers.
3. ~her does not appear to þe any duplication of services.
4. Ther , have been no apparent complaints from neighboring or
adjo ning property owners.
I'iotion amen ed by Holasek, to add Item #5 - Sanitary Sewer Service
has been ap roved for this area.
Motion and mendment carried unanimously.
Variance Re uest - Gail Zimmerman
Planning an Zoning Commission Uhairman, David Jack, fully explained
the Varianc Request; and noted that the Commission had unanimously
approved th variance of one (1) foot between the property line and
the structu e, and one (1) foot between the garage and the house. The
following r asons were listed for the recommendation:
- 1 . Sev ral variances of the same nature had been granted in
the same subdivision.
- 2. bjections from neighboring property owners.

3. Bui ding Official, W. Arntzen, had raised no objection.
MO'rION by W ndschitl, seconded by Holasek, that the City Council accept
the Zimmerm n Variance as presented. Motion amended by Rither, to
add that Ci y of Andover Ordiance No.8, page 9 (Zoning District
Classificat on Chart) - E4 District; side yard setback requires 10 feet
from the pr perty line, and the variance is for reducing the required
10 feet to feet.
Discussion n the required 10 feet between structures, inasmuch as this
was not set forth in Ordinance No.8. The ulerk informed the Council
that this w s covered in the Uniform Building Code - Fire Regulations,
however, sh did not know if there was a provision for variance. The
Building Of icial was not present to answer and give clarification to
the City Co ncil. Motion by Windschitl, amendment by Rither - withdrawn.
Action defe red to July 15. Clerk to contact Building Official for
recommendat ons and clarification.

MOTION by V nderLaan, seconded by Schneider, that the Non-Intoxicating
Off-Sale an On-Sale Licenses be granted to Hockey's Inn for the period

MOTION by Ri her, seconded by Windschitl, that the Clerk be directed
to transmit letter to the City Deputy Sheriff asking him to make an
investigatio of the facts in Ordinance No. 28 as to the requirements
listed there·n. Motion carried unanimously.

A letter fro the Department of Agriculture was read regarding changes
in the propo ed ordinance. The ordinance as corrected to be re-typed
and placed 0 the agenda for July 15.

- Bi-Centennia Committee Re ort
Arleane Nehring, Chairman - Andover Bi-centennial Committee, gave a
very interes ing and informative report on the Committee's activities
to-date. She advised the Council that the Committee was working on
three separa e segments of the bi-centennial, 1) Heritage - this to
be the possi le restoration of the cemetary on the Hunt property,
2) Festivals - dedication of the Community Center Building, and
3) Horizons a map showing all City parks and points of interest.
Mr. and Mrs. yle Bradley and Mrs. Arthur Stenquist are the newest
members of t e Committee

Discussion w,s had on the necessity for such a fund at this time.

It was agree that the signing of this contract would be postponed
until Ehlers and Associates contract expired on August 11 , 1975.
Discussion 0 Coon Creek Foot-Bridge
- Nayor Schnei er informed the Council that W. Johnson, Principal -
Crooked Lake lÜementary School, had contacted him requesting that
- he, Mayor Sc neider, and lVlary VanderLaan attend the School Board
Meeting on J ly 7; and that the School Board was requesting a
resolution p rmitting the anchoring of the foot-bridge to the property
on the east ide of the Creek, owned by the City of Andover.
Discussion 0 the fact that the School Board has not been keeping
Councilperso VanderLaan, who is investigating and collecting information
on the bridg , informed of progress to-date. Councilperson VanderLaan
noted that s e had,requested a report from the Transportation Committee
but had not etreceived any verbal or written facts.

MOTION by Rither, seconded by VanderLaan, that the Clerk telephone
the suggested persons aSking them if they would serve on the
Horsemen's Council to insure compliance with the Horse Ordinance.

MOTION by R" ther, seconded by VanderLaan, that the Clerk telephone
the suggest d persons asking them if they would serve, and those
accepting w'll be sent a letter confirming their apfointment.
Motion carr'ed unanimously.
MOTION by R'ther, seconded by Holasek, that a per diem compensation
of $5.00 be paid with a 15¢ allowance per mile for transportation to
carry out t e duties as outlined in Ordinance No. 23, for each member.
Motion carr'ed unanimously.

A resolutio covering mileage for City personnel was proposed by
Councilpers n Rither, seconded by VanderLaan, and withdrawn.
Pa ment of laims

'- MOTION by H lasek, seconded by VanderLaan, that bills in the amount
of $7,315.5 be paid. Motion carried unanimously.
MOTION by H lasek, seconded by VanderLaan, that the sum of $59.25
be paid to rthur Jaworski to replace Voucher #242. Motion carried
unanimously. (This amount disallows mileage to Council Meetings
as requeste on the claim sheet.)

The proble as stated is not a new one" Previously, the other consultant
prepared ( ) a study for installation of a storm sewer system to serve the
northerly art of Green Acres Addition area (a copy is attached) and (2)
plans for c nstruction of a open ditch (as shown on the attached map).

RECOMM
Based on 0 l' review of the problem we recommend that the Council authorize
a storm dr inage study of this area to provide the Council with a permanent so-
lution to th problem. We do not have enough information from the existing
l'ecords. s a m"tter of fact, the proposal of a n open ditch system draining
-. part of the area in one diroction and a undorground storm sower system in the
'-_/ other dire tion leads me to conclude thêre, is a need for a master drainage
plan for th entire area.
We would repare alternate methods of resolving the storm sewer problems
and then a siet the Council in conducting public hearings 0 n the necessary im-
