CITY of ANDOVER
Minutes of a REGULAR CITY COUNCIL MEETING held January 21, 1975 at the
Andover Community Center.
Mayor Schneider called the meeting to order at 7:35 p.m., with Councilpersons
Holasek, Rither, VanderLaan, Windschitl, Attorney Hawkins and Deputy Clerk
Marilyn Kappelhoff present.
The Council discussed approval of the December 17, 1975 Regular City Council
Meeting minutes and it was moved by Councilperson Rither, seconded by
Councilperson VanderLaan to approve the December 17, 1975 Regular City Council
Meeting minutes as corrected. Motion carried unanimously.
Minutes of the January 7, 1975 Regular City Council Meeting minutes were not
accepted as submitted.
Mayor Schneider explained to the Council that Clerk Jaworski has requested
that the Shade Treee Ordinance be reviewed by the Planning and Zoning Commission
for their recommendations to the City Council. It was moved by Councilperson
VanderLaan, seconded by Councilperson Holasek that the City Council recommend
the Planning and Zoning Commission study the Shade Tree Ordinance and submit
their recommendations and proposals to the City Council. Motion carried
unanimously.
The next agenda item, Report on the Assessor. Mayor Schneider explained to
the Council that the City Assessor Mr. Triggs has turned the City of Andovers'
assessment books into the County Assessor. Mayor Schneider stated that he met
with Mr. Gayle Leone, of the Anoka County Assessors' Office and Mr. Leone
informed Mayor Schneider that he has randomly checked the City of Andovers'
assessment books and they are in order.

Discussion followed with Councilperson Rither stating that his concern is,
X that a complete assessment be done and that the assessment be acceptable with
the Anoka County Assessors' Office. Councilperson Rither also stated that
if the as~essment is not acceptable with the County, they will re-do the
assessment and charge the cost back to the City of Andover.

After discussion, Councilperson VanderLaan suggested that a committee,
consisting of two Councilpersons and two or three citizens be appointed to
investigate and resolve the complaints of the City Assessor. The Council
agreed. Mayor Schneider appointed Councilperson Holasek, Councilperson
Windschitl, citizen Ted Lachinski to this committee. Mayor Schneider stated
that additional persons who are interested in serving on this committee, are
to come before the City Council for full Council approval.
Mayor ::chneider read a letter addressed to the Andover City Council from the
Anoks-Cooq Rapids League of Women Voters, concerning non-returnable beer and
soft drink beverage containers. Carol Bradley, representing the Anoka-Coon
Rapids League of Women Voters, appeared before the CounciL and requested that
the Andover City Council adopt the resolution of the League of Women Voters,
encouraging the State Legislature to discourage the use of non-returnable
beer and soft drink containers.

After discussion, it was moved by Councilperson Holasek, seconded by Councilperson
Rither that the Andover City Council adopt the resolution of the Anoka-Coon Rapids
Area League of Women Voters resolutio~, as read. Motion carried unanimously.
( A copy of the Anoka-Coon Rapids Area League of Women Voters resolution and letter
is attached to this set of minutes. )
Mrs. Bradley requested that the Clerk write a letter to the three representatives
of 19-A, 19-B, 47-A and Senator Jerry Anderson, stating that the Andover City
Council has adopted the Anoka-Coon Rapids Area League of Women Voters resolution.
Mayor Schneider directed the Deputy Clerk to write a letter, as requested.
Mayor Schneider read a letter from the Andover Lions Club, in full. Ted Lachinski,
second Vice President of the Andover Lions Club appeared before the Council and
stated that the Andover Lions Club would like to assist in two project areas, for
the City of Andover, 1) a volunteer fire department, and 2) park development.
Mr. Lachinski stated that if the City of Andover is not ready for these two projects,
the Lions Club is willing to help in any area the Council would suggest.
Councilperson Rither explained to Mr. Lachinski that the City of Andover is committed
to the 1975 Fire Contract with the City of Anoka and before the City Council
discusses a fire department, a committee, approved by the City Council should be
formed to study the alternatives of a fire department. Councilperson Rither also
stated that the City of Andover has a Rules Committee, consisting of himself and
Councilperson Windschitl and the Rules Committee will delineate committees to be
set-up. Discussion followed and it was suggested by Councilperson VanderLaan that
the City Council recall the Andover Lions Club to a future meeting, to give the
Council time to investigate the different projects that would be coming up and
at that time, a committee could be set-up, consisting of the Lions Club, City Council
and interested citizens. The Council agreed. ( A copy of the Andovers Lions Club
letter will be attached to this set of minutes. )
Mayor Schneider called on Mr. William Boughton, who has requested a variance for
a hobby barn~ Mr. Boughton was not present. Chairman of Planning and Zoning Allan
Miles presented the Planning and Zoning Commission recommendations to the Council
and stated that Mr. Boughtons' variance relates to the side yard set back and to
the height of the accessory building. Chairman Miles explained that the accessory
building is presently higher than the house. Mr. Boughton is going to put a gable
roof on the accessory building and in the future, will enlarge his house and put a
gable roof on the house.

Building Inspector Walter Arntzen stated to the Council that he has stopped
-constructionon the structure because Mr. Boughton did not apply for a building
permit and a building permit cannot be issued until the variance request is approved.
Discussion followed and it was moved by Councilperson Rither, seconded by Councilperson

VanderLaan that based on the Planning and Zoning Commission recommendation, the
Andover City I Council grant the variance request of the side yard set back from ten
feet to six feet and grant a variance on the height of the accessory building, located
at 1663 Andover Boulevard Northwest, Anoka, Minnesota. Motion carried unanimously.

Park/Advisory Board member Phil Rzeszutek appeared before the Council to request
additional monies for snow removal of the Community Center hockey rink. Discussion
followed and it was moved by Councilperson Holasek, seconded by Councilperson

Winds chit 1 to allocate an additional $100 to the Park/Advisory Board for snow
removal of the Community Center hockey rink. Motion carried unanimously.
Phil Rzeszutek stated that he has received a request from the Constance Free Church
to use the Community Center hockey rink, for a one day broom ball tournament.
Discussion followed and it was~ by Councilperson Holasek, seconded by
Councilperson Vanderlaan to appoint the Andover Park/Advisory Board the scheduling
authority of the Community Center hockey rink. Motion carried unanimously.
Building Inspector Walter Arntzen explained to the Council that he has bids for
a lawn tractor, with a snow blowing attachment and stated that it will be on the
February 4, 1975 City Council agenda for approval.
After discussion of the 1975 City of Andover budget, the Council appointed
Councilperson Holasek and Councilperson Windschitl to the Budget Committee. The
Council requested that the Budget Committee report to the City Council at the
Regular City Council Meeting of February 4, 1975, with preliminary or final
recommendations.
Councilperson Rither pointed out that the Federal Revenue Sharing forms will be
out February 14, 1975 and must be received at the Revenue Sharing Office before
March 14, 1975. Councilperson Rither requested that the Council alert the Clerk
to be sure that the form is turned in before the due date.
After discussion, agenda items nine, discuss Membership with League of Municipalities
and item ten, discuss Membership with Metro League of Municipalities was tabled
until the budget is confirmed.
Mayor Schneider expressed concern over the selection of Marvin Christenson to the
Steering Committee, without prior Council approval. Mayor Schneider stated to
the Council ¡that he did not object to Mr. Christenson serving on the Steering
Committee and commended Mr. Christenson for his efforts. Councilperson Rither
stated that Mr. Christenson was selected for the Steering Committee because of
his excellent qualifications. Councilperson Rither proceeded to explain the
progress of ¡the Steering Committee and stated that the Planning and Zoning selection
criteria and procedures is completed and ready for Council reviewal. Councilperson
Rither stated that the Steering Committee requests that the Council take action on
the Planning and Zoning criteria, at the February 4, 1975 City Council meeting.

The Steering Committee will meet February 11, February 13 and February 20, 1975, at
the Community Center.

The Council discussed the Auditors' Report. Councilperson Windschitl stated that
page three, 'of the Auditors' Report concerning the travel expense claim of the
Building Inspector, being paid illegally by the Town of Grow should be investigated
by Attorney Hawkins. Attorney Hawkins will review the Auditors' Report and inform
the Council.

Bill Hart, representing St. Patrick's Catholic Church appeared before the
Council and stated that St. Patrick's Catholic Church requests that the Andover
City Council approve a bingo permit, allowing St. Patrick's Catholic Church to
participate in a "bingo evening", once monthly, commencing the latter part of
February, 1975, through this calendar year, ending December 31, 1975. The Council
had no objections and allowed a bingo permit to St. Patrick's Catholic Church,
Cedar, Minnesota, fer LIn::; wOI.&lb "'£ rebruary. Attorney Hawkins stated to the
~ouncil that there is a procedure to follow, before issuing bingo permit~\and
he will review the Statute and inform the Clerk.
Councilperson Windschitl requested a five minute recess. The Council agreed.
Meeting recessed at 10:00 p.m., and reconvened at 10:05 p.m.
Mayor Schneider stated to the Council that he will attend the Weed Inspectors'
Meeting, to be held at the Twin City Federal building, in Anoka, on Wednesday,
January 22, 1975.
Building Inspector Arntzen presented a clarification to the Building Inspectors'
Annual Report to the City Council. Councilperson Holasek had requested, at the
Regular City Council Meeting of January 7, 1975 that a clarification to the 50X
charge to the Building Inspection Department and the balance used on other City
businesa. After discussion, the Council decided to place the Building Inspectors'
clarification on the February 4, 1975 City Council agenda.
Attorney Hawkins stated to the Council that the City Engineer and Deputy Clerk
have requested information on the validity of past petitions to improvement projects.
Attorney Hawkins explained that past petitions would be valid, provided that they
have been received within the past six months. Attorney Hawkins also stated that
the Council must take action on improvement project petitions within six months
and the ,petition must contain 35X of the laRd ~¡U8rso
Clerk Ja~orski explained to the Council that he has discussed disposition of

tapes ~ previous meetings with Attorney Hawkins and was informed by Attorney
Hawkins that previous meeting tapes must be kept for six months, but the decision
is up to the Council. The Council will place disposition of tapes ,~ previous
meetings on' the February 4, 1975 City Council agenda. ð~

Councilperson Rither pointed out typographical errors on the checks for payment
and attributed the errors to poor workmanship.

It wss moved by Councilperson Rither, seconded by Councilperson Windschitl to
allow bills to be paid in the sum of $13,808.29. Motion carried unanimously.

Building Inspector Arntzen appeared before the Council to request approval of
$50, for the purchase of a radio for the Clerks' Office, to be used ~ the City
employees' to alert them of inclement weather. After discussion, Mayor Schneider
stated that' he would lend a battery operated radio for the City employees use.

The Budget Committee will meet on February 3, 1975, at 7:30 p.m., at the
Community Center.
Counci1person VanderLaan informed the Council of a school for the Council,
sponsored by the League of Municipalities for new and old Counci1person's, to
be held January 24, 1975 and January 25, 1975, at the Mariott Inn, in Bloomington,
Minnesota. Counci1person VanderLaan requested that the Council approve the $35,
per person registration fee for the two informational sessions. After discussion,
-,it was moved by Councl1person VanderLaan, seconded by Councl1person Rither that
the Andover City Council encourage the Andover City Council to attend the school
for Councilperson's, to be held at the Mariott Inn and the City of Andover pay
the $35, per person registration fee for the informational sessions. Motion
carried unanimously.
It was moved by Counci1person Rither, seconded by Counci1person Windschitl that
the meeting be sdjourned. Motion carried unanimously.
Meeting was adjourned at 10:55 p.m.

area, that the City Assessor has not inspected their property, and this being
a full assessment year, ( inspect each parcel in the City of Andover) was
questioning if the City Assessor finds no one at home, the first time, if he
makes an attempt to recall or set-up an appointment, at the resident's convenience.
