Schneider on August 5, 1975, 7:30 P',M., at the Andover Community Ce ter, 1685 Crosstown Boulevard N. W., Anoka, Minnesota. Councilpersons present: Holasek, Rither, VanderLaan, Windschitl Councilpersons absent : None Also present: City Attorney, William G. Hawkins; City Engineer, D. R. Kasma; City Building Official, Walter Arntzen; City Clerk, P.K. Lindquist; and several residents. MOTION by Va derLaan, seconded by Windschit1, that the Andover City Council meet on Monda " August 11, at the Community Center, to order to approve minutes of previous me tings and discuss the possiblättÍJ:::fng:of'an administrator, along with other persnnel matters. MOTION AME DED by Windschitl, seconded by Rither, to include 1) Shade Tree Ordinance, 2) lerk's Mileage Resolution, 3) Purchase of State Statute Books. Amendment an motion carried unanimously. ,~ '''-' ) MOTION by Wi dschitl, seconded by Rither, to approve the published agenda as amended with t e deletion of items 3-a, 6-a, B-a, and 9-a. Motion carried unanimously. Annexation, Pa cel 6320, Plat 65933 The owners of t e property, Dick and Maxine Gregor, were requesting that this parcel be detac ed from the City of Andover and annexed to the City of Coon Rapids to combine with a parcel in the latter, making said parcel a buildable lot. It was noted that the anning and Zoning Commission had approved the annexation for 1) it will now b a buildable lot, and 2) the' sewer is stubbed in on the Coon Rapids side of the lot; nd a resolution had been received from the City of Coon Rapids accepting the 10 into their City. MOTION by Ri er, seconded by Windschitl, to adopt a resolution of concurrent detachment of c rtain premises situate in the State of Minnesota, County of Anoka, City of dover ,described as: The south 50 feet of Government Lot 1, Section 33, To nsmp 32, Range 24, also known,.as Plat 65933, Parce16320. (Exhibit "A" att ched). Motion carried unanimously. "On Sale" Liquor License - St. Patrick's Church ,r\, MOTION by Wi dschit1, seconded by Holasek, that a temporary Non-Intoxicating - , "On-Sale" Liqu r License be tssued to St. Patrick's Church for September,7, 1975, at a fee of $10. O. Motion carried unanimously. Regular Meeting - August 5, 1975 Minutes - Page 2 Hugh's Industri 1 Park - Preliminary Plat ~, ~- Recommendati ns for approval had been received from the Planning and Zoning Commission, n ting: 1) The Plat meets the requirements of Ordinance 10 & lOA, 2) The Park Ad isory Board has given their recommendation, and 3) It meets the intent of Ordin nce No.8. MOTION by Windschitl, seconded by Holasek, that the Preliminar Plat for Hugh'sIndustria1 Park be approved as presented. Mt>.tion carried unanimously. The Oaks - Fin 1 Plat A letter from t e Engineer, dated August 5, 1975, stated that the final grading and surfacing with lass #5 was done and conformed to City specifications. Mr. Windschitl advised the Co nci1 that a Letter of Credit in the amount of $3,500.00 had been posted to complete the bituminous surfacing of the road; and that the objection in the Title Opinion f om Attorney J. Neilson had been cleared and a Quit Claim Deed for the area in uestion had been received. Attorney Hawkins informed the Council that he had the erformance Contract ready for the Mayors"anl Clerk's signatures, and confirmed he Letter of Credit. (Clerk's Note: All attorney and engineer:h1g fees received t -date had been paid by the developer, and a $350.00 Escrow Deposit had been made ith the City to cover those costs not yet billed by the attorney and engineer. ) MOTION by Ho as ek, seconded by Schneider, that the Final Plat of Œ-læe Oaks be .~ approved for th following reasons: \J 1) The Pl t has cleared the Planning and Zoning Commis sion 2) Criteri of Ordinances 10 and lOA have been met. 3) All leg 1 questions have been resolved. 4) Park A visory Board recommends the park area as shown on the Plat. 5) Engineer has stated that all items are in order. 6) The De eloper had entered into a Performance Contract. Councilperson anderLaan stated that she felt she could not approve the Final Plat for the same re sons that she could not accept the Preliminary Plat, i. e., a 1 1/4 acre park only benef ts nine families, and a cash donation would benefit everyone in the City; and that t e trucks and traffic going to and from the Landfill would be a hazard so near a 'tot 1 t'; and that she had heard that the Landfill could possibly be an Industrial Park someday in the future, which would reaffirm her stand on the dedicated parkl nd. Attorney Hawki s advised the Council that should the outcome on this Final Plat be a tie-vote or the Plat denied, the City would undoubtedly be sued by the Developer, and legally the hances for the City prevailing in a suit of this nature inasmuch as the Pr eliminar Plat had been approved by law, would be slim- the Developer met all the require ents of the Preliminary and Final Plats, the City was obligated to approve the Fin 1 Plat. ,~ '~ Mayor Schneide informed the CQuncil that he hoped everyone gave serious thought to this Plat and the information regarding a law-suit supplied by Mr. Hawkins. .--... -~ r . , -, ~ '-----~ .' - ~ - - - . Vote: Yes - H lasek, Schneider; No - VanderLaan; Present - Rither. Motion carried. o ema Estates - Preliminar Plat A lengthy discussion was had on the Plat with reference to the 1) Title of property not clear, 2) C metary on,the property not defined and clarified as to exact acreage and boundaries and 3) Parkland dedicated by the Developer is broken up by heavily travell d roads, thus creating a safety hazard. Developer Ron Smith advised the Co ncil that all lots contained at least 2 1/2 acres, with a 3 acre', average, but d e to the necè'ssity of having to tie in to streets in an adjoining 1 acre area, s verallots had to be reduced in width, thus requiring variances, all of which ha been secured!'*' It.~oMMWIi¡..à Ic~ ¡f).,'J.. MOTION by Va derLaan, seconded by Rither, that action on the Preliminary Plat of Ogema Estat s be deferred unt.il such time as the title is clear in accordance with the Title pInion and Objections as indicated in a letter dated August 5, 1975, ~ from James Ne lson. ~ Engineer Kasm advised that test borings had been made and three (3) lots would have to be fille before they could become buildable, as per his letters to the City Council da ed June 28 and July 24. MOTION AME DED by Ho1asek, seconded by VanderLaan, to include "an opinion from the Park dvisory Board on how the safety factor of the prop sed dedicated parkland is goi g to be solved. Motion and Am ndment carried unanimously. William Kem Mr. Kemp had equested to move a building to be used as a Superette into a L-l zoned area, P1 nning and Zoning Commission had approved the permit on the basis of the use being "lesser" than those covered under the present zoning. A lengthy discussion ensu d on the cempatibility of this use in an industrial area, and the fact that Ordina ce No. 8 did not ,provide for a retail grocery store in a L-I Zoning, as an accessor or special use; and that Mr. Kemp should have been advised by the Planning an Zoning Commission to apply for a Rezoning Permit rather than a Special Use P rmit. MOTION by Rither, seconded by VanderLaan, that based - on evidence we ave in Ordinance No.8, noting that there is no provision for the issuance of a S ecia1 Use Permit, and insofar as there was a misinterpretation of the Ordinance b the Planning and Zoning Commission, that the application fee for the Special se Permit be returned to Mr. Kemp, and that he be advised that we cannot is sue a Special Use Permit. Motion carried unanimously. - Regular Counc Itteeting -August 5, '- 1975 Minutes - Page ,~ Green Acres Sto m Sewer Engineer Kasma briefly covered a letter dated July 23, 1975 to the City Council, outlining fully th four alternatives for this project (Exhibit "B" attached). Discussion was had on 1) th question of large undeveloped (0blnof,àev!eil10,palh>:le areas possibly not benefiting and th xefore, not able to be assessed, 2) dangers involved with ditches, 3) advantages of using ditches if the slope is such that they are more the nature of a swale, 4) the ossibilities of ditches lowering the ground water level, and 5) feasiliility of doing just a s all portion of the area. Mr. Kasma was requested to prepare additional infor ation and present it to the Council on August 19. Ja Street Bids 75 _4) Engineer Kasma outlined with the Council the results of the bidding and other costs involved with th project as shown in his letter dated August 5, 1975 (Exhibit "c" attached). Disc ssion ensued on the sodding of the boulevards; Mr. Kasma advised the Council that he contingency factor in the contract allowed either the Contractor or the individual "property owners to handle this. MOTION by Rit er, seconded by Holasek, to adopt a Resolution To Accept Bids for Street Surfacing Project - Jay Street 75 -4. Motion carried unanimously. - MOTION by Rit er, seconded by Windschitl, to adopt a Resolution to Award the ~ Contràct for Str et Surfacing Construction - Jay Street 75 _4, to H & S Asphalt Company~ In the 'amoun1:'òfu $U¡;I''!I0'4)11.s4$. Motion carried unanimously. Auditor's Subdiv sion No. 82 Bids (75 -2) Engineer Kasma read and explained a letter to the City Council, dated August 5, 1975, covering the bid and costs for administrative, engineering and attorney's fees. (Exhibit "D"attached). Ms. Rosella Son teby, a property owner in Auditor's Subdivision No. 82, posed several questions to the ity Engineer regarding the slope of the drainþ':i¡p'eHor the storm sewer from 144th to th outlet being 1. 1', and therœ~<i:[uirements shown in the Minnesota State Plumbing Code ask for a minimum 1/16" per foot (total requirement 3+ feet). Mr. Kasma explained that th requirements of the Plumbing Code are for individual residence' drainage for san tary sewer, and that the specifications for storm drainage are based on a velocity rat of 2' per second. Mrs. Sonsteby also noted a difference in the high water mark shown on the Storm Sewer Plans and the figure given by the State Departmen of Agriculture as indicated in a letter dated July 30, 1974 from Leon Chamberla n to Dallas Felegy (Exhibit "E" attached). Walter Arntzen, City Building Off' cial infoj,med the Council and Mrs. Sonsteby that Engineer Kasrna' s figure indicated he high water mark of Round Lake, whereas Mr. Chamberlain - spoke of the wat r table. Mrs. Sonsteby stated that her concern was that the storm drain pipe outlet would be under water, thus preventing drainage. She was assured that the utlet would be above water, and that the individual ptpes could be in the water tabl with no effect on the drainage. Regular Meeting - August 5, 1975 Minutes - Page - -- Auditor's Subdiv'sion No. 82 - Bids (Continued) MOTION by Rit er, seconded by VanderLaan, that the City Council adopt a Resolution to Ac ept the Bids for Storm Sewer Construction Project for Auditor's Subdiv' sion No. 82 (75-2). C ouncilper son indschitl questioned Engineer Kasma on the two problem areas along Vintage St eet N. W.; Mr. Kasma assured the Council that this problem should be able t be resolved with grading etc., however, if that should be impossible, the ots involved would not receive benefit and would be left out of the project. It as also noted that if the street elevations were changed, the ya:!!olSi involved ould be restored to the homeowners' satisfaction. MOTION AMEN ED BY Windschitl, tJf¡¡\Íi' the area on Vintage Street that the plans and wOrk-out b., he problem bereviewed by the engineer along with the neighbors, and that those p rsons be given an opportunity to come back here and voice their agreement or di agreement. Discussion on th reasons for the amendment being included with the motion to accept the bids Amendment withdrawn. Motion carried nanimously. -- MOTION by Win schitl, seconded by Schneider, that the monies allowed in the total project cost for he solution of the drainage along the southern part of Vintage Street, be reviewed by t e engineer with the residents before anything is finalized as far as that short str tch of street; and the residents be given the opportunity to voice their agreement or disagreement>. A resident in the audience, Mr. Peterson, questioned the neces sity of the people coming back bef re the Council. After discus sion the motion was withdrawn. MOTION by Van erLaan, seconded by Rither, to adopt a Resolution Awarding the Contract for Sto m Sewer Construction Project 75 _2 in Auditor's Subdivision to Central Landsca ing in the amount of $24,085.10. Motion carried unanimously. Park Advisor Board Discussion was ad on the adoption of a resolution or ordinance officially establishing the Board and se ting forth their duties. Postponed until August 11, J:975. Bicentennial Co mittee Arleane .wœhring and Lyle Bradley advised the Council that the Committee was ,-- requesting funds per the list furnished (Exhibit "F" attached), and noted that the State would atch funds on the majority of the items listed. Several members of the Council no ed that they would like additional time to study the list and review it with th Bicentennial Committee. MOTION by Windschitl, seconded by Sch eider, to authorize $1,000.00 to be removed from the Contingency Fund, to be used by the Bicentennial Committee at this time; and at the August 19 Council Meeting, the Council could debate the expenditure of additional funds. Discussion was ad on the items that would be listed to be covered by the authorized amount when app ying for the "matching funds" grant. The Bicentennial Committee was requested to prepare an up-date for the Council. Motion carried unanimously. C rooked Lake - Fence MOTION by Win schitl, seconded by Rither, that the City Council accept the bid in the amount of 508.75 by Tom Strandmark, for heavy-duty fencing for the Crooked Lake blic Landing. Motion carried unanimously. Lion's Club - Co munity Center Ball ark Mayor Schneider informed the Council that the Lion's Club was requesting a - resolution stat in that the installation of a sign at the Community Genter designating '~ the Lion's Club allpark; and the approval of the park concept as presented by the Club. The Coun il agreed that this had been stated at previous meetings to be completely agre able, and did not feel that a resolution was necessary; and that this would be a City park, therefore, the City would be obligated to maintain it. Payment of Clai s MOTION by Van erLaan, seconded by Rither, to pay Vouchers #282 and #307 in the amount of $9,095.61. Motion carried unanimously. School Board Ele tion Inasmuch as the ommunity Center is the official polling place for the City of Andover, the Council agre d that the School Board Election on October 7, 1975, should be held here. M. ~ ~ ~- - CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA -~ -' RE OLUTION OF CONCURRENT DETACHMENT OF CERTAIN PREMISES S TUATE IN THE STATE OF MINNESOTA, COUNTY OF ANOKA B IT RESOLVED, that the City Council of the City of Andover finds that the roperty described as: The Soúth 50 feet of Government Lot 1, Section 33, Township 32, Range 24, in Anoka County now located i the City of Andover abuts the City of Coon Rapids and is properly su ject to concurrent detachment and annexation by concurrent resolutions of the two Councils of the two municipalities pursuant to Minnesota Statutes 414.0 1. It is the desire of the City of Andover that the above described pro erty be concurrently detached from the City of An,dover and annexed to the City of Coon Rapids. T at this resolution is being adopted concurrently with a similar ~, resolution by he City Council of the City of Coon Rapids approving such detachment '~ and annexatio as provided above. If we eliminated e boulevard work the estimated project cost would be $15,000 - $1,900 = $13,7 O. However, we recommend including the boulevard work to provide a finished proj ct. PROJ EC T NE D The need for d ainage improvements in the Green Acres Addition is explained in our letter to the Council dated June 26, 1975. Failures of individual sewage disposal syste s and "wet" basements require a solution. PROPOSED ST RM SEWER SYSTEM Since the devel ped area of the Green Acres Addition utilized drainage ditches, a study was do e to evaluate these ditches. Using these results, £òu:rc :,: alternates were consider d. Detail cost estimates and figures illustrating the sy:stems are attached. ALTERNA TE 1 Alternate 1, as shown in Figure No. 1, consists of constructing an open ditch system from H ather Street NW to Dahlin Street NW and emptying into the existing ditch just east f Dahlin Street. This proposed ditch would run west to east along f'-., existing lot lin s about 480 feet south of the centerline of 142nd Lane NW. The ditch , would be appro "mately 5 to 8 feet deep. ',~ A second ditch unning along lot lines would drain the low area SW of the Heather Street NW - 142nd La e NW í'niersection. This ditch would be approximately 2 to 3 feet deep. . ,~ /' ' .----, . -j ~ ~, Andover City ouncil ~ July 23, 1975 Page Two The existing d" ches along the streets would require some improvement and five culverts ould be required as shown in Figure No.1. Th~s is the lea t costly of the suggested alternates, however the deep open ditch between eather Street NW and Dahlin Street NW could be objectionable from an appea ance and safety standpo~nt. The prelimina y cost estimate for Alternate 1 is $23,800.00. ALTERNATE Alternate 2, a -shown in Figure No.2, consists of a storm sewer system to service the ent re area. The system would include 12", 15" and 18" reinforced concrete pipe nd 10 manhole and/or catch bas~n structures. Again the exist ng ditches along the street would need some improve~ nt to insure drainage to the storm sewer catch basins. In the future the street could be lowered ~: to permit curb and gutter street construction and the proposed storm sewer would '~ be deep enough to accommodate the lower street elevations. The preliminar cost estimate for Alternate 2 is $64, 500. 00. AL TERNA TE 3 Alternate 3, as shown in Figure No.3, combines the open ditch in Alternate 1 between Heather Street NW and Dahlin Street NW and a storm sewer system draining west to Coon C eek. The existing di ches along the streets would have to be improved as in Alternate 1. The preliminar cost estimate for Alternate 3 is $39,500.00. The problem w th this alternate is the deep open ditch is required in the easement area between H ather Street NW and Dahli~treet NW. ALTERNATE 4 Altern;"te 4 is t e same as Alterna1e'2 except a 18" storm sewer would be installed in the easement f om Heather Street NW to Dahlin Street NW to eliminate the deep open ,~ ditch. , - The existing dit hes along the streets would have to be improved as in Alternate 1.
