REGULAR MEETING - APRIL 15, 1975
MINUTES
A Regular Meeting of the Andover City Council was called to order by Mayor,
Richard J. Schrleider, April 15, 1975, 7:30 P.M., at the Andover Community
Center, 1685 c' osstown Boulevard N. W., Anoka, Minnesota 55303.
Counci1persons Present: Holasek, Rither, VanderLaan, and Windschitl
Councilpersons Absent: None
Also Present: City Attorney, William Hawkins; City Engineer,
Dewey Kasma; City Clerk, Art Jaworski; City Deputy
Clerk, Pat Lindquist; and several residents.

Park Advisory oard Re orts and Requests
Discussion on c mmunicati.cns not received early enough prior to the City Council
to allow time f~ study. MOTION by Holasek, seconded by VanderLaan, that the
City Council ta 1e the request from the Park Advisory Board for action on the
"Summer and T en Programs until the next Regular City Council Meeting, at
which time the udget figures will be ready. Motion carried unanimously.
The Deputy Cle k was directed to draft a letter to the Park Advisory Board, advising
them that Park dvisory recommendations and requests must be on the published
agenda, and inf rmation pertaining to same must be received by the City Council
at least five da s prior to the Meeting__ refer to letter dated March 31, 1975, from
the Park Advis ry Board.
Public Hearing - Sanitar Sewer and Watermain Construction (M-2 Area)
A petition was eceived from W. C. Anderson, requesting sewer, water, and
blacktop street for the S 1/2 of SE 1/4 of S.32, R.24, T.32 (58.4 acres).
Discussion was had On a private water system, which would eliminate the need
for an elevated storage tank and could use a smaller well pipe with a lesser g. p.m.;
and benefits an problems associated with this type of system. Engineer Kasma
advised that thi type of project could be handled in two ways, i. e., petition - to be
done On an assessment basis, or where the developer would install everything
and pay the cos~himself. This would be handled the same as roads are now in
platted areas. r. Anderson was informed that his first step would be to initiate
the rezoning and platting of the property, after which a feasibility report could be
ordered.

Jay Joyner, repr~senting Caswell and Associates, advised the City Council that
Mr. Caswell's oDjection to the present system was that he would receive no benefit
from the trunk liJes on the north side of Bunker Lake Boulevard. Mr. Joyner
was not able to riport on Mr. Caswell's plans for development of the area. It was
notèd that there ere 190 acres included in Mr. Caswell's holdings. Engineer Kasma
informed Mr. Jo~ner that the trunk lines could be put on the south side of the road
with a minimum Óf additional expense. In checking with the Anoka County Assessor's
Office, it was fmind that the above area was not eligible for "Green Acres ".
Councilperson Ho1lasek reported that he had received a call from Jerry Green, in
which he stated qat he would be in favor of water and sewer if he could develop the
area to the east of Crosstown Boulevard and north of Bunker Lake Boulevard.
Councilperson Ho11asek stated that he assumed that inasmuch as Mr. Green favored
the sewer and wat.er in the Crosstown/Bunker Lake area, there would be no objection
from him for the property west of Crosstown Boulevard and north of Bunker Lake Blvd.
Victor Berggren Ind Herbert Moore questioned the estimated assessment costs.
MOTION by Rith~r, seconded by VanderLaan, that the City Council order the
construction of the Sanitary Sewer for the Bunker Lake Estates (M.2) Area, and that
the Engineer pre are final specifications and plans, and that the City Clerk seek
public bids for sa'd project.
The City Council xpressed the feeling that several doubts regarding the feasibility
of this project ha been removed with receipt of new information since the March 31
Public Hearing.
Motion carried animously.
MOTION by Wind chit!, seconded by Holasek, that the watermain construction project
in the Bunker La e Estates (M2) Area be terminated due to the project not being
feasible at this ti e. Motion carried unanimously.
Wilber Variance
The Planning and Zoning recommendation to approve the variance was read by
Planning and Zon'ng Commission Chairman, Allan Miles. Discussion on whether
or not a preciden would be set by granting this variance. It was stated that
Ordinance No. 10 was very clear in this matter. It was noted that even though
Mr. Wilber's pro erty (4.87 acres) was very close to the then required five acres,
several new vari nces could be requested on conveyances where the acreage is
"close" to the reuirement--which in turn, would raise the question of "what is
close". Attorney Hawkins emphasized that building permits can be refused, or
injunctive action an be sought-- which would be eliminated by the granting of a
variance.

Wilber Variance (Continued)
MOTION by wildSChitl, seconded by Schneider, that the City Council grant the
Variance Reque~t of Donald Wilber (Comm. #2-75-1). Vote: Yes - Windschitl,
Holasek, Schneider; No _ Rither, VanderLaan. Motion carried.
The City counc~l agreed that the City must instigate action on the illegal conveyances.
MOTION by Holasek, seconded by Windschitl, that the City Council direct
Attorney Hawku\.s to proceed with legal action against Mr. Carl Sorenson, for the

Meeting reconvened at 10:20 P.M.
Strand Addition 1- Final Plat
MOTION by Wi dschitl, seconded by VanderLaan, that the City Council accept the
Final Plat of St and Addition.
It was noted tha Mr. Strand had paid all outstanding engineer's and attorney's fees,
and the Park De1dication Fee of $200.00. A question was raised by Coundlperson
Rither on the absence of the Attorney's Report. It was noted that a letter, dated
March 21, 1975 from Attorney Hawkins, covered said reports on future subdivisions
where there wa no street or park dedication.
Motion carried nanimously.
Resolution on C uncil Meeting Time-Limit
Councilperson olasek asked that said Resolution be observed. MOTION by
VanderLaan, se onded by Rither, that the City Council handle only Agenda Items
Nos. 9) T.K.D. . bill, 12) Rabies Shot Fees, 13) Discussion on Russell Roads
Agreement, 15) Authorization of signatures on Building Inspector's Contract.
MOTION AMEN ED by Holasek, seconded by Windschitl, to include Agenda Item
No. 14) Discuss on on Metropolitan Council Planning Legislation. Vote: Yes - Holasek,
Windschit1, Sch eider; No _ VanderLaan, Rither (Objection - too complex a subject to
be covered in a -Minute Discussion. ) Motion carried.
T.K.D.A. Bill
MOTION by Hol sek, seconded by Windschitl, that Voucher No. 175, in the amount
of $479.62, be aid. Motion carried unanimously.
MOTION by Windschitl, seconded by Ho1asek, that an additional fifty cents (50~) be
added to each va cination to cover administrative costs. Motion carried unanimously.

Rabies Clinic Shot Fees (Continued)
MOTION by Rit~er, seconded by VanderLaan, that the additional help needed to
assist the Deputy Clerk in administrating the Rabies Clinic, be paid at the rate
of $2.75 per h01.1r. Motion carried unanimously.

Russell Roads Agreement
Attorney Hawki4s reported that he had received the Agreement from the City of
Ramsey Attorney, and that he felt that there were some additional items which
should be incorporated into the Agreement. MOTION by Ho1asek, seconded by
Windschitl, thatl Attorney Hawkins contact the City of Ramsey Attorney, to suggest
that he insert the date of May 1, 1975 for Mr. Russell to pay the $3,000.00; and
also word the Agreement that the City of Andover will give the City of Ramsey
one week noticelof the gravel delivery, so they (Ramsey) may schedule their
equipment to come out to get the gravel spread and bladed at the time that the
gravel is delive I ed; and that the Andover Mayor and Clerk be authorized to
sign this Agree ent upon the recommendation of Mr. Hawkins.
Counci1per son indschitl suggested that the Andover Engineer check these roads
and make reco mendations before the work is done, in order that it be done right.
Motion carried nanimously.
Metropolitan Co ncil Planning Legislation
A discussion war. had with reference to the filing of a "Position Paper" by the
City of Andover on said legislation. MOTION by Holasek, seconded by
Schneider (withdrawn) that the City of Andover meet to consider the "Land Use
Planning" Legis ation, as proposed by the Metropolitan Council; for the purpose
of deciding if th City Council wants to issue a "Position Paper". Meeting to be
on April 22, 197 5, 7:30 P.M., at the Andover Community Center.
It was noted that the Andover Planning and Zoning Commission should be included
in this meeting. MOTION AMENDED by Holasek, Seconded by Windschitl, to read
April 17, 1975, :30 P.M. Councilperson VanderLaan expressed the feeling that
each councilper on should handle this matter individually. Vote: Yes _ Windschitl,
Ho1asek, Schnei er; No - VanderLaan, Rither. Motion carried.
Employee Contr ct - Building Official
MOTION by Rit ler, seconded by Windschitl, that the City Council authorize the
Mayor and C1er to sign the contract of Walter Arntzen as agreed upon. Motion
carried unanimo sly.
