Schnei er, April 1, 1975, 7:35 P.M., at the Andover Community Center, 1685 Crosstown Bbulevard N. W., Anoka, Minnesota. Councilpersons pJesent: Rither, VanderLaan, Windschitl Councilpersons ABsent: Holasek (Arrived 8:20 P. M. ) Also Present: City Attorney, William Hawkins; City Building Official, Wally Arntzen; City Clerk, Art Jaworski; City Deputy Clerk, Pat Lindquist; City Park Advisory Board Members; and several residents. Councilperson RitÂer suggested that inasmuch as the City Council is responsible for the Clinutes, should a y member feel thatc an item needs expansion or correction requiring research of tapes, that said member do the research and submit the correction, rather than use staff tim to do this. January 20, 1975 Page 2, Para. 5, line 3 - Leave as samples as shown in original minutes. Page 2, Para. 5, line 4 - Delete and stated. February 10,1975 Page 7, Para. 1, line 12 - Correct Martin to "Barton". February 18,1975 Page 8, Para. 1 - Discussion with Mayor Schneider requesting that Councilperson Rither's statement be removed inasmuch as it was incorrect. Councilperson Rither repeated that he had made the statement and wished it to remain on record. March 6, 1975 Page 2, Section 1, line 5 - Delete item 1), add ''1) 75 hours per week presently being worked, were too much for one person. II Page 2, Section 4, line 7 - Add "with the probability of only one area considered for sewer construction at this time. " Page 2, Section 4, line 13 _ Delete with road supervisor duties. Page 3, Para. 4, line 13 - Delete severe hardship, change to "a disadvantage. " MOTION by Rithe, seconded by VanderLaan, that the Minutes of January 20, 1975, February 10, 18, t975, March 4,6,18, 1975, be approved as corrected. MOTION by Vande~Laan, seconded by Rither, to approve the agenda as printed, and delete items NOS.6, 7, & 8, and add Items Nos. 15, 16, 17, 18, and 19. Mayor Schneider stated that action was necessary on Item #6, inasmuch as this must be done, if it is g9ing to be, before the frost is out of the ground. Councilperson Windschitl stated hat he felt that the City Council must at least discuss these items .nasmuch as they ad been published and there were people in the audience waiting for these items. Vote: Yes - Vand rLaan, Rither; No - Windschitl, Holasek, Schneider. 1Æotion defeated. MOTION by Wind chitl, seconded by Holasek, that the agenda be accepted as published with Items Nos. 1 through 14, and add Items No. s 15 through 19. Vote: Yes - Ho1asek, Windschitl, SChneJder; No " VanderLaan, Rither. Motion carried. Hockey's Inn - Ci arette License MOTION by Wind chitl, seconded by Rither, that the Cigarette License for Hockey's Inn be approved. otion carried unanimously. Newell Chester - Mr. Chester furni hed the City Council copies of memos coveringJhealth insurance on the employees (co ies attached), and explained that full health coverage could not be had for Mr. Arntzen u less the City went in under a "Group Plan"; reason being Mr. Arntzen's recent back injury and subsequent claim(s). MOTION by Wind chitl, seconded by VanderLaan, that the City accept Mr. Chester's )roposal to carry ea1th insurance on two (2) additional employees, Marilyn Kappe1hoff and Patricia Lind uist for an additional premium cost of $36. 10 per month. Motion carried unanimou ly. Regular Council Meeting - AF 1, 1975 Minutes - Page 31 Kiowa Terrace - ,inal Plat MOTION by WindSbhitl, seconded by Ho1asek, that the City Council grant an extension from March 10, Ij75 to April 1, 1975 to act on the final plat of Kiowa Terrace. (6_month time limit per Or inance No. 10 expired March 10, 1975.) Motion carried unanimously. Attorney Hawkins ldvised that he had reviewed the Abstract, and had no objections, however, would r~commend that the following be completed before approval of the Final Plat: ~ 1) Par Dedication Fee be paid. 2) Esc~ow Deposit be made to cover engineering, attorney, and other fees. 3) Development Contract be executed. 4) perfrrmance Bond be posted. The Developer req,uested permission to do all the work on the roads etc., and not apply for a building permit until such work had been inspected and approved; this in lieu of posting a perforrnJnce bond. Mr. Arntzen pointed out that problems could arise from this arrangement if something were to happen and the work did not get completed. It was also noted that Andover's Ordinances did not provide for this. Clerk Jaworski was directed to wrtte a letter to the Planning and Zoning Commission, asking that they investigate the procedure of permitting a developer to complete all road construction 'n liou of pn'Un, fond, MOTION by Winds hitl, seconded by Holasek, that the City Council approve the Final Plat of Kiowa Ter ace, subject to the following conditions: 1 ) Park Fees in the amount of $2,800.00 be paid. 2) The eveloper post an escrow amount for engineering, attorney, and othe expenses incurred by the City. 3) The eveloper pay all current outstanding bills. 4) The eveloper enter into a Development Contract i'lith the City. 5) The eve10per post a Performance Bond Or Letter of Credit in the amount of $ J06, 800. 00. Ni htinga1e Estate - Final Plat A lengthy discussi n was had on park fees, with comments and questions as to legality of collecting a fee lieu of land on lots of 5 acres or 300 feet in width. Inasmuch as an up-to-date billing had not been received from the engineer or attorn y, it was agreed that Mr. Ken Olson would make an escrow deposit. A five-minute recess was called to check previous Planning and Zoning Cajunission Minutes. Meeting reconvene - 9:40 P.M. MOTION by Winds hitl, seconded by Ho1asek, that the City Council accept the Final Plat of Nightingale Estates - 2nd Addition, subject to the payment of outstanding legal and engineering ba1ancbs. Motion amended by Windschitl, seconded by Ho1asek to include a $150.00 Escrow 1 ccount, to pay legal and engineering fees. Motion carried unanimously. R.gubo Co=o;; . j ,Ung - AF 1, 1975 Minutes - Page 4 Castner Addition Final Plat Jutstanding 1egallnd engineering fees in the amount of $168.76 were paid, with the agreement by Mr.l Castner to pay the engineering bill on which an up-to-date statement had not been recei ed. Councilperson Holasek objected to the payment by Castners of $400.00 for park dedication, inasmuch as it may be incorrect in that this was not investigated thorm.lghly by the Planning and Zoning Commission and the Park Advisory Board; Ordinance roo 10 (lOA) may have been violated due to the $400.00 being possibly less than 10'70 of land value or the possibility of the 100/0 of land in lieu of cash may be a matter on which lthe Park Advisory, Board had not been consulted; and that now may be the time to sec re a park area of "decent" size, instead of waiting until future subdivision when bnlY a 10 ¡:cre parcel may be divided. Councilperson Wi dschitl requested that the attorney draft a letter to the Planning and Zoning Commissi outlining proper procedure on the reviewal and recommendations for Park Dedicati Council ""ncurred. .3aseball Diamond - Northwood Addition MOTION by Wind chitl, seconded by Holasek, that the City Council approve an expenditure not to exceed $1,500.00 to cover fill, finish grading, seeding and other miscellaneous ite s to bring the baseball field into playable condition. Councilperson Rit er questioned the necessity of complying with contractural limitations per State Law_ _At orney Hawkins advised that if the gravel and finish grading cost is in excess of $1,000. 0, two (2) quotations would be necessary. Park Advisory Board to furnish the City C uncil with copies of the quotations, for informational purposes only. Motion carried un nimously. Baseball Field - Center MOTION by Ho1as k, seconded by Schneider, that the Lions Club be contacted and informed that the ity Council has no objection to their using their name on the project at the Co munity Center; and if they are interested in using the park area, they are to furnis the City Council with a concrete final proposal. MOTION AMEND D by Rither, seconded by Schne ider, that it be added that this program/project ou1d tie-in with the overall Park Advisory Board program for the development of th park itself; and that the Lions Club work with the Park Advisory '3oard to insure th t activities or money they expend be c;ommensurare with the City of Andover and Pa k Advisory Board plans. Motion and amendment carried unanimously. Regular Council tv. . ~ting - Apr 1, 1975 Minutes - Page 5 Green Acres Park Equi pment MOTION by WindSIChitl, seconded by VanderLaan, that the City Council authorize the Park Advisory Bojrd to expend an amount not to exceed $1,500.00 for the Green Acres Park, which would include the purchase of 1) Baseball Eackstop, 2) Basketball Backboard, 4) Basketball hoop and net, 5) Buckabout, 6) Physical FitneS'S Center, 7) 8' Slide, 8) Tetherball, 9) edimix for setting equipment, 10) Grass Seed, and 11) Other miscellaneous items. Discussion on the ay-out of the park, with reference to the dangers involved with a baseball field so n~ar the tot-lot; and said tot-lot being close to the intersection of the streets; and tob many activities for such a small park. Discussion on a meting to discuss personnel policies. It was agreed that the full Council should handle the i ediate needs. MOTION by VanderLaan, seconded by Rither, that Monday, April 7, 975, 7:30 P. Review Deputy C1e k's Salar Councilperson 'Hol sek read a re<q1est, dated January 28, 1975, from Marilyn Kappelhoff, for a salary increa e from $3.40 to $4.20 per hour. MOTION by Winds hitl, seconded by Ho1asek, to raise the salary of Mcarilyn Kappelhoff to $3.75 per hour, retroactive to March 1, 1975. Motion carried unanimously. Regular Meeting - April 1, 19 Minutes - Page 6 FOrmation of Finance Committee Mayor Schneider ~PPOinted Council per sons Holasek and Windschitl to the Finance Committee, with qouncilperson Windschitl as Chairman. MOTION by VanderLaan, seconded by Ritheí' that the City Council approve the appointment of Councilpersons Holasek and Windschitl to the Finance Committee. Motion carried unanimously. Formation of pers1onne1 Committee Considerable diSc1ssion was had on appointments to this committee. MOTION by Ho1asek, seCOnded¡ by Schneider, that Mayor Schneider and Councilperson VanderLaan be appointed to the Personnel Committee. Councilperson VanderLaan objected to the motion and cit,d By_Laws, stating that Mayor must make appointments to committees. MOTION by Windschitl, secnnded by Holasek, that previous motion be laid on the table. Motion carried un~nimously. MOTION by Windschitl, seconded by Ho1asek, that the rules relating to t~e size of the Committee be temporarily suspended to allow three (3) persons to serve of the Personnel Committee. Councilperson Rither objected in that three persons wou d constitute a quorum and decisions could be predetermined. Vote: Yes _ Wind chitl, Schneider, Holasek; No - VanderLaan, Rither. Motion carried. MOTION by Winds hitl, seconded by Ho1asek, that Ho1asek motion on appointments be moved to the table Vote: Opposed unanimously. HII.~-E,'-¡·¡ S nce the original water quality and well depth survey was completed we have had an opportunity to sample additional shallow wells in the Cro ked Lake Area. Previous e had sampled sixteen (16) wells in the Crooked Lake Area during the week of March 10, 1975. Samples were collected from thirteen (13) deep ells and three (3) shallow wells. e laboratory analysis showed all the deep wells to be delivering water of a ceptable sanitary quality, but two out of the three shallow wells showed si nificant concentrations of nitrate nitrogen, a common indicator of contami ation from septic tank systems. A sample water analysis report and interp etation of laboratory findings are attached to this report. A telephone canvas of the Crooked Lake Area revealed twenty- one (21) shallo wells were in use by residents. During the week of March 24, we were a le to sample fifteen of the eighteen wells not previously tested. The sampl s were delivered to the Minnesota State Department of Health for analysis. The attached Figure 1 shows the locations of the tested wells. City Coun il of Andover March 31, 1975 Page Two Survey Results Jhe total number' of wells tested was thirty- one. Thirteen of the wells were deepl, and showed no evidence of bacteriological Or chemical pollution. ~he water analysis of the shallow wells indicated that of the eighteen (18) teste! wells, fifteen showed significant concentrations of nitrate nitrogen. Since nitr te nitrogen is a natural product of the decomposition of sewage in septic t~nk systems, its presence is regarded by the Minnesota Department of Health às an indicator of pollution of the water source by sanitary wastes. Three of the tested wells had concentrations of nitrate nitrogen i excess of 10 mg/1. Preparation of infant formulas from this water ma produce methemoglobinemia in infants under six months of age. The effec of methemoglobinemia is to cause the baby to become listless and drowsy an the skin, too, takes on a blue color. he State Department of Health will send each homeowner a copy of his well w ter report pointing out the particular danger of thes e water supply systems, s shown on Item F of the attached "Report on Water Analysis". Summary he well water quality survey provides substantial evidence that the ground wa er obtained from the shallow aquifier is becoming polluted from wastes from indi idual sanitary sewerage disposal systems. There is also evidence, as pointed out in our Well Survey Report, dated March 21, 1975, that the pollution as significantly worsened during the past five years. It is believed a substant a1 amount of time, perhaps five years Or more from the installation of a sanit ry sewage collection system would be necessary to lower the nitrogen nitrate 1e e1s to an acceptable level by State Department of Health Standards. However, laboratory tests have important limitations which must be r~cognized. If the sample was properly collected and shipped and if the labor!ltory examination was properly performed, the test results should describe ~he quality of the water at the time it was collected. Unfo1'tunately f contamination of a water supply can be intermittent, and a sample drawn on one particular day may not be representative of water collected on a different day. Fori this reason it is necessary to consider tbe location and construction of a well änd pumping system as well äs laboratory test results, in an evaluation of the safety of ~ water supply. If the laboratory examination of water <1rawn from a properly located and constructed supply shows the water to be of good sanitary quality, the supply should be satisfactory from a health rtandPoint. However, an improperly constructed or located well ~annot bel considered safe, r~gardlesB ~f 1aborcat~ results. It is alap possible for a well to be properly constructed and located and yet produce water containing coliform organisms. These organisms may be . introduce'd into the weU at the time of construction or at times when reps:>.rs are made.1 For this reason wells and distribution systems should be properlY disinfec~ed before they ar~ put into service after construction or repai:s. When a w~ll that app£ars to be properly constructed and located shows eVJ.dence of bacte1iologicel contamination, the first attempt at correction should be disinf:cli~n, foll~wed by resampling after a lapse of several days. Fin1ncial considerations The~proposed project has been reviewed by fiscal consultants who have found the project to be financially sound and is within the onding capacity of the City. We þave received verbal confirmation from the Farmers' Home Administration that a long-term, low-interest loan would be jvailable to finance the project. HÞ."~[~I:; We re writing to supply additional information on the proposed Water Sup 1y and Distribution System for the Crooked Lake and Bunker Lake Estates ar as in the City of Andover. We ave conducted a telephone canvas of the property owners in this area to ob ain information on well depths and water quality, and we have collected water sam 1es for analysis by the State Department of Health. The esults of the well-depth survey are shown on the attached forms. A tabulate listing of this survey is as follows: Num er of homeowners contacted 100 Num er of deep wells 73':' (780/0) Num er of shallow wells 21* (220/0) * Th number of wells does not total 100 because several homeowners did not kn w the depth of their well. The ttached Figure No. 1 shows the deep and shallow well locations as determ' ned by our telephone survey. Well water samples were obtained from sixteen (16) locations selected to be repr sentative of both deep and shallow wells in the Crooked Lake Area. The attach d Figure No. 2 shows the sampled well locations. I City Counci of Andover MHoh 21, 1''' Page Two The results of the laboratory analysis showed fourteen (14) of the wells to be of acceptabl~ sanitary quality. 'IWo of the wells showed significant concentrations of nitrate ni rogen. Both of these wells were shallow and were located on the East Side of Crooked Lake near Coon Creek. Figure No. 2 shows the locations of those two we lls. The Minnesota Department of Health Water Analysis Report sent to these two homeownersl contained these comments: "A Si:}ificant concentration of nitrate was found in this sample. Nitrates can occur natur lly, and may have no sanitary significance. However, if this well is located inl a community type area where sewage is disposed of through soil absorption systems and where there is more than about one house per acre of ground, or i1f the well is located so that it draws water from limestone or similar broken rock formations, the presence of nitrates must be regarded as evidence of contaminati n, and corrections should be made in the supply. If, however, the well is located in a rural area. and there is no other evidence of contamination, the nitrate level should be checked semi-annually. A continuous increase over a period of time is e idence of contamination. " The a erage density of development in this area is .83 acres per home. According t the Department of Health comments, the presence of nitrate nitrogen in these wat r systems may be regarded as evidence of contamination by effluent from individ al soil absorption systems. A rep rt on Crooked Lake Area water quality was completed in January, 1971, by Eugene A Hickok and Associates. Several wells in the area were sampled at that tirn e , and w have included two of those wells in our current samples ,to determine if any chang s in water quality have occurred during the past four years. The w ter obtained for testing from the deep well at the Crooked Lake School showed only inor fluctuations in chemical composition over the five year period. The water s mple obtained from the James Junker Residence, a shallow well, showed nitra e nitrogen concentrations had increased from 1.6 ppm in 1970 to 7. 1 ppm in 1 75. An increase of this magnitude is strong evidence of contamination by individual sanitary sewage disposal systems.
