Minutes of a SPECIAL MEETING of the Grow Township Board of Supervisors held July 11, 1974
at 8:00 p.m., at the Grow Community Center.
Chairman Schneider called the meeting to order at 8:05 p.m., also attending were
Supervisor Christenson, Attorney Bill Hawkins, Building Inspector Wally Arntzen, Mr. & Mrs.
John VanderLaan, Deputy Clerk Marilyn Kappelhoff and others.
Supervisor Christenson noted Supervisor Holàsek absent. Supervisor Holasek arrived at
8:15 p.m.
The purpose of this meeting was to discuss the VanderLaan road improvement on 177th
Avenue N.W.
Attorney Hawkins explained to the residents, who own property abutting this road that
the procedure that has been in issue is known as the Local Improvement Code, whereby
the Township has the power to put in a local improvement such as, a road, sewer line"
etc, and assess the cost of this improvement back against the benefited land owners.
Attorney Hawkins stated that the reason these residents were here is because Grow's
Ordinance will not allow building permits where the lots do not front on a public road-
way, and in order for Grow Township to accept 177th Avenue N.W., is for the Township
to up-grade the road and the Township has to determine whether or not they want to accept
it.
Chairman Schneider asked Attorney Hawkins if the right-of-way has been deeded over to the
To"nship. Attorney Hawkins stated that it has not and it will have to be deeded over
from the land owners on either side.
Mrs. Ada Orr stated to the Board that there "ere six (6) land ownersswho would have to
deed over thirty-three (33) feet, but to her understanding there is an easement of
thirty-three (33) feet, a private easement. Chairman Schneider explained to Mrs. Orr
and the other residents that this easement would have to be deeded over to the To"nship,
in order to· make it a Township road.
There were several questions from the residents and the majority stated they were not
in favor of any extra costs at this time.
Mr. John VanderLaan stated that he would have to be for the road easement because they
will have to get the road improvement or a variance and he guessed for another reason,
within a year or t"o there will be four new houses on this road and with the extra load,
it "ould be postponing the inevitable. Mr. VanderLaan also stated that the road is
going to deterioate to the point where the road will have to be improved, either by the
land owners or the Township will force the land owners to improve it and it would be
less expensive now, because Class #5 is used and two (2) or three (3) years from now, it
may require blacktop.
Attorney Ha"kins stated to these residents that the To"nship has problems like this
throughout the To"nship and he proposed to the Board that if they accept the roads that
are not up to standard, it is just going to have an effect on all the planning in the
future. Attorney Ha"kins stated that the To"nship is just going to have to come to goods
with the fact that there were mistakes made with the people who divided the land and
mistakes made by the Township.

Attorney Hawkins recommended the following to the Board:
1. Accept all private roads that are in existence now, prior to the platting
ordinance, or prior to the twenty (20) acre minimum.
2. Have the Engineer look at these roads and determine whether or not they
were constructed, at the time the Township accepted them sufficiently, to
handle all the traffic that the road will have on it, so the emergency
vehicles can get through, then there will be no improvement to the road
at this time.
3. If more houses are put on the road and will require better road, then the
cost of upgrading will be assessed against everyone on the road.
4. Assuming someone turns over a road that is not private, then the Township
will make it adequate so everyone could be served and charge that cost
back to the land owner.
**·k'¡"'~ Attorney Hawkins explained to the residents that-tRr Township has people who want to front
off of that road, so the Township has to obligat¿Dsomething so they can get in and they
are going to share in that cost like everyone else.
Roger Funk asked Attorney Hawkins how they would be assessed? Attorney Hawkins explained
that on roadways, generally it is on front foot basis, but he understands that there is
another lot that has access from Ward Lake Drive and generally a lot is not benefited
sufficiently when it has two roads on one side, usually a full road is assessed on one
side and a percentage assessed on the other side, so the corner lot does not end up
paying the whole footage.
Attorney Hawkins then asked these residents if the Engineer looks at this road and he
feels it is adequate and there would be little or no additional expense, would you then
make this road a public road? The residents were in agreement.
Attorney Hawkins will prepare a deed if adequate and and requested the residents to write
their names and addresses so he can contact them by mail of the Engineers decision.
Building Inspector Arntzen stated he woúld know by Monday, July 15, 1974 of what the

Attorney Hawkins stated to the Board that he had spoke with Wally Hughs on his roads and
Mr. Hughs is going to get a bond for 150% or a savings certificate and deed the roads
to the Townshi,p and requested authority from the Board for Wally to issue Building
Permits upon receipt of the bonds and deeds. The Board agreed.
Mr. & Mrs. Gary Duerr, appeared before the Board for approval of a permit to live in
their mobile home, until the closing on their,new home. Supervisor Christenson made
a motion to grant Mr.:&\Nrs. Gary Duerr, 2053 Bunker Lake Blvd., a mobile home permit
until, September 1, 1974; seconded by Supervisor Holasek. motion carried.
Mr. Hemp appeared before the Board to find a solution to his problem of not being able
to get a building permit in the Stenquist Addition. Attonney Hawkins reitereated that
this is the same situation as the VanderLaan's and in order to help people like Mr. Hemp,
and who else might own land in the Stenquist Addition, the Township is going to have to
take the roads over and assess the costs to everyone.

Building Inspector Artnzen stated that he agreed with Attorney Hawkins that the only
way the Township is going to resolve their problems, because of mistakes made in the
past, is to accept all these roads, if acceptable with the Engineer, to the past standards,
and from now on make the new roads be done the way they should be. Arntzen stated that
the Township is wasting a lot of money with Engineers to study these roads and they are
not going to get fixed anyway.
Attorney Hawkins explained to the Board that he will contact Stenquist's Attorney
and get a contract and deeds and then Wally can issue Mr. Hemp a building permit.
Supervisor Holasek stated that we should get the deeds before issuing the building permit.
Minor discussion on the Green property that the Township purchased from Mr. Green. Attorney
Hawkins will contact the Deputy Clerk and inform her of the date of purchase.
Attorney Hawkins had to leave for another meeting and stated to the Board before he
left that quite a weight had been lifted off his shoulders now that the VanderLaan
problem is solved.
The Park/Advisory Board appeared before the Board to ask the Board's permission to
purchase three screens and one sand point for the hockey rinks in Shady Knoll, Cedar Crest,
and Langseth Pine Acres. A motion was made by Supervisor Christenson; seconded by
Supervisor Holasek, carried that the Board approve expenditure of $700 for the Park/Advisory
Board, for material for three wells and a pump.
Chairman Schneider entertained a motion to adjourn, Supervisor Holasek statedhe had
one item of business before adjournment. Supervisor Holasek stated to the Board that
Mr. Hatfield has a radio unit identical to the one in the Building Inspector's truck and
will sell it to the Township, including radio, installation and antenna for $450. The
Board directed Wally Arntzen to contact Mr. Hatfield and offer him $250 for this unit.
Discussion on fencing along the parking lot at the Community Center was brought out
by Building Inspector Arntzen. The Board directed Arntzen to check on the prices of
rough cedar fencing and post and cable fencing and then present the figures to the
Board.
Motion for adjournment made by Supervisor Christenson and seconded by Supervisor Holasek:

CORRECTIONS:
*** Attorney Hawkins stated to the residents that the Township has an obligation to the
people who want to apply for a building permit on 177th Avenue. Attorney Hawkins also
stated that these people will share in the costs like everyone else.
