Minutes of a SPECIAL MEETING of the Grow Town Board of Supervisors held August 7, 1974
at 7:30 p.m. at the Grow Community Center.
SUBJECT: VALLEY VIEW ESTATES ROAD PROBLEMS
Chairman Schneider called the meeting to order at 7:50 p.m., also attending were
Supervisor Christenson, Attorney Hawkins, Engineer Jim Orr from Schoell and Madson
Engineering Firm, Deputy Clerk Marilyn Kappelhoff, Developer Ray Klenk and others.

Supervisor Holasek arrived at 8:00 p.m.
Chairman Schneider opened the meeting by explaining to the residents who live in Valley
View Estates that Grow Township is in the process of hiring a new Engineering Firm and
the Board has given the Engineering Firm of Schoell and Madson the Street Improvement
Project in Valley View Estates, on a trial basis. Chairman Schneider also stated that
the Engineers Feasibility Study that was done in this area would be no cost to the
property owners, but if the residents in this area decide that it should be a major
road project it would be assessed to the property owners.

At this point in the meeting, Mr. 9&A T~~n~,on from St. patrick's Catholic Church asked
the Board's approval of a 3.2 malt liquor license for their annual Fall Dinner. Clerk
Jaworski's signature was mandatory on this beer license and he was not present at this
meeting, because in the absence of the Planning and Zoning Chairman Alan Miles, Clerk
Jaworski, who also is a member of Planning and Zoning acted as Chairman of the Planning
and Zoning meeting, which Was held in the next room. Marilyn Kappelhoff pursued Clerk
Jaworski's signature.
In the absence of Marilyn Kappelhoff, Chairman Schneider introduced Engineer Jim Orr
from Schoell and Madson Engineering Firm to the audience and turned the meeting over
to Mr. Orr. Engineer Orr thanked Chairman Schneider and presented the following roadway
designs, which have been considered to the residents:
1. A 1 1/2 inch bituminous wearing course on the existing roadway-no grading.
2. A penetration oil stabilized base with a 1 1/2 inch bituminous wearing
course.
3. A 7 inch clay and cinders roadway with seal coat.
4. A 4 inch roadmix sand bituminous base with a seal coat.
5. A 3 inch class 5 gravel base with a 1 1/2 inch bituminous wearing course.
Engineer Orr explained to the residents that the number one (1) and number two (2)
roadway designs should not be considered because they have not produced good results
and he recommended road designs three (3), four (4) and five (5) and explained the cost
of each as follows:
3. Clay and Cinders roadway base with seal coating estimated total cost
$67,450 or $1.204 per lot based on 56 lots within proposed service area.
4. A four (4) inch roadmix sand bituminous base with seal coat estimated
total cost $73,220 or $1,308 per lot for 56 lots served.
5. A three (3) inch class gravel base with 1 1/2 inch bituminous wearing
course, estimated total cost $83,350 or $1,488 per lot for 56 lots served.

Mr. Orr stated that of the three roadway designs, he recommended the three (3) inch
gravel base with a I 1/2 inch bituminous wearing course, which is the most expensive,
but will give the best appearance and least maintenence. Engineer Orr concluded the
following to the Board and residents:
1. The project is feasible from an Engineering point of view.
2. Of the three (3) roadway designs alternatives for which cost information
has been presented, he recommended the three (3) inch gravel base with
a I 1/2 inch bituminous wearing course.
3. The clay and cinders or bituminous roadmix and seal coat alternatives are
completely acceptable. The clay and cinders alternative is least expensive
and also least desireable since it does not include a hand formed curb.
4. He recommended that for any alternative grading work be done to eliminate
present drainage problems and culvert maintenence all of the runoff is
proposed to be carried by surface drainage.
5. He recommends that the entire project cost be assessed ~o the abutting
properties on a one lot, one unit basis. Since the service life of the
proposed roadways is estimated to be approximately 10 - 15 years, he
recommended a 10 year assessment.
6. Should the Board determine to proceed with this project on an assessment
basis, a public improvement hearing would be required at which time the
actual assessment amount, term and interest would be established.
7. Should the Board determine not to proceed with this improvement, he
recommended paving Aztec Street Northwest between 172nd Lane and Avenue N.W.,
the existing erosion and washout problem is best eliminated by this means.
Estimated cost for this work is $7,000.
Mr. Ed Erickson a resident of Valley View Estates stated to the Board that this survey
was not the survey the residents in Valley View Estates asked for and also stated that
they are not looking for a bituminous freeway, they are asking for passage to homes,
mail delivery and school bus service and if they cannot get that, he could not see why
they were issued building permits by Grow Township in the first place.
Chairman Schneider stated to Mr. Erickson that he would have to wait until the Deputy
Clerk came back to have the floor and also stated to Mr. Erickson that the Board asked
for this feasibility study which is a survey these residents do not have to accept.
At this point in the meeting, the Deputy Clerk returned with the Clerk's signature on
the liquor license for St. patrick's Church and Chairman Schneider explained to the
audience that the Board would commence with the Valley View Road meeting after approval
of the liquor license. Chairman Schneider entertained a motion to approve the 3.2 beer
license for St. Patrick's Catholic Church, 3556 l31st Avenue N.W., Cedar, Minnesota to
sell 3.2 beer for one day, September 8, 1974 ; Second by Supervisor Christenson; passed.
Chairman Schneider apologized for the interruption of the meeting and turned the meeting
back to Mr. Edwin Erickson, who had the floor prior to the beer license approval.
Mr. Erickson explained to the Board that Valley View Estates have two severe trouble
spots and he had talked to 90% of the residents in this area and they are not looking
for blacktop roads, they want serviceable roads to their property they purchased when
they applied for building permits from Grow Township and Mr. Erickson stated that the
Board should look at the trouble spots and find out what the Engineer plans to do with
Aztec down to the end of the block and Woodbine.

A resident from Valley View Estates questioned the Board on what roads were approved?
~** Supervisor Christenson explained that approval means two,things; 1) the plat which
accepts the right-of-way as laid out on p~r and 2) the construction.~ this was
---~done only on 172nd Lane construction wise~ as approved~~ccordance with the Township's
"vague" standards that exis,ted at that time, subsequent to that, the Township has not
even examined Aztec, 172nd Avenue or Woodbine for the purpose of construction.
Attorney Hawkins stated to the Board that Once the Board signs the final plat, the
developer no longer has any obligations to improve the roads, the Township is responsible
for the road s, but if the Township only takes the easements and makes no effort to
maintain the roads, the Township cannot be forced to do so. Attorney Hawkins also
stated that Mr. Klenk has done everything that was asked of him and 172nd Lane was the
only road the Township requested be brought up to standard and the responsibility is
now the Township's.
Ray Klenk the developer of Valley View Estates stated to the Board that when he started
to plat, there were no road standards in Grow and he depended on the surveyor and the
contractor and he tried to comply with each change in the Township's Board and also
stated now Grow has road standards and he will comply by these st~nd~rds.

Supervisor Christenson moved that the Township spend whatever~~~ turns out to be to

accepting/and the responsibility the Township has to these residents;tmotion died
because of a lack of a second.
Supervisor Holasek proposed the Township put class five on, fix the two problem areas
with blacktop, which would be approximately $23,000 and split the cost three (3) ways;
one-third (1/3) general revenue; one-third (1/3) Mr. Klenk; one-third (1/3) the property
owners. The residents were not in agreement because they felt it was the Township's and
Mr. Klenk's responsibility.
Mr. Fisher questioned the Board on Supervisor Christenson's motion. Supervisor
Christenson stated that the motion is up to the Chairman of the Board. Chairman
Schneider stated that the Board has to check into the Townships finances before they can
spend money and asked Mr. Klenk if he would be willing to meet with the Board and
negotiate. Mr. Klenk stated to the Board that he had no obligations.
Supervisor Holasek stated that if Grow Township issues anymore building permits in
Valley View Estates unless the roads are blacktopped and approved by the Engineer, the
Township is crazy. The residents agreed.

Supervisor Holasek suggested that the Board review what amount is in the Road and Bridge
Fund and determine what amount can be spent on this project and then the Board will
meet with these residents and Mr. Klenk with a proposaL

After some discussion the Board decided to meet with the residents of Valley View
Estates on August 19, 1974 at 7:30 p.m., at the Community Center with a proposal.
Supervisor Holasek will check with the Kottke Bus Company and the Anoka Post Office
to find out what they recommend for these residents to receive service.
Chairman Schneider stated to the Board that he had received a call from Roger Funk
requesting a variance to build a horæe barn . Building Inspector Wally Arntzen
stated to the Board that he has already talked to Mr. Funk and explained to him that
he should wait until the road is accepted and then he will not need a variance.
Wally also stated that he resents Mr. Funk bypassing his directions and asking for
special treatment from the Board and felt Mr. Funk should be ~enaJ4~~~ocrs.
Attorney Hawkins stated to the Board that the Township has a very delicate problem with
Mr. Funk because the Township does not have Mr. Funks signature on the road easement
for 177th Avenue and if the Board antagonizes Mr. Funk before the Township gets his
signature the:'VanderLaan road project could come to a hault. Attorney Hawkins explained
to the Board that Mr. Funk did not get a building permit for his chicken house, his
lot does not front on a public road and the structure is too close to his house, but
Attorney Hawkins felt that before the Board takes any action with Mr. Funk, the
easements on 177th Avenue should be finalized first. Wally will notify Mr. Funk when
he can purchase a building permit.
Chairman Schneider stated to the Board that Mr. Clarence Smith would like to purchase
some snow fence from the Township. After some discussion Supervisor Holasek moved to
allow Mr. Clarence Smith to purchase snow fence from the Township at the following
cost:
1. Fifty foot rolls in good condition $5.00
2. Fifty foot rolls in poor condition $2.50
3. Steel posts needed .75 - each
Second by Supervisor Chtistenson; passed unanimously.
Chairman Schneider entertained a motion to adjourn; second by Supervisor Christenson;
Meeting adjourned at 10:55 p.m.
