Minutes of a GULAR MONTII1Œ MEETING of the Grow Township Board of Supervisors held Tuesday, y 14, 1974 at 8:00 p.m. at the Grow Township Community Center. In attendance ere Chairman Schneider, Supervisors Christenson and Holasek, Attorney Bill Hawkins a d others. Chairman Schne der called the meeting to orde.H·at 8:05 p.m. Chet Malek and Bob Rolf asked to be put on the ajenda on 173rd road matters. Chairman Schne der agreed. Chairman Schue der called on Dan Erwin of Crimsoncross Kennels. General discussion in8ued on dog roblems in the Township with the following: 1. n Simonson, Green Acres speaking on dogs running loose and noting farm on South Coon Creek Drive with up to thirteen (13) animals, hich is not allowed by the Ordinance. 2. an Burr l39th in Red Oàks noted dogs had been bothering ducks and ther wild life in area. 3. olleen Wheeling of Crocus Street also noted dogs bothering wild life. 4. ean Johnson of Northwoods noting Ordinance #5 should be more stringent. 5. ary Sanford who resides on Enchanted Drive noted those who dogs are icked up should automaticallYHrec:eive a copy-of Ordinance#5-,from the ownship. ,---., 6. im Olson felt Ordinance #5 must be strickly enforced. '~ Mr. Erwin answ red all questions noting he can not go on"private" property unless asked on. He ent on to explain procedures he used to pick up dogs. Mr. Erwin also explained that from now on Crimsoncross Kennels will use a new procedure for picking up sick dogs t at are to be disposed of. ' A citizen must call Crimsoncross and at that time Crim onCross Kennels will give price to pick up dog, depending on distance to be traveled etc. Mr. Erwin poin ed out to the Board the letter sent from Crimsoncross Kennels is the type of Contra t in use. Attorney Hawkins stated we could accept this le~ter as a new Contract. Sup rvisor Holasek moved to accept letter from Crimsoncross Kennels noting it woul be the new Contract; Second by Supervisor Christenson; Carried unanimously. Chairman Schne der read suggested changes to Ordinance #5, Section 4. ( a copy in changes aCted pon) A copy of these changes will be attached as Item I. Supervisor Christenson mo ed to accept changes as read. Second by Supervisor Holasek; Carried unanimously. The Board note that the charge for picking up dogs would now be $20 and room and board at Crims ncross Kennels would be $2 per day. It is also noted that the phone number for Cri oncross Kennels is - 784-1493. Another idea from the aúdience was to have a News Article published in the Anoka Union covering this issue. Next on agenda was Lary Carlson who's intent was to donate twelve (12) to fourteen (14) acres in he northeastern part of the Township. This property is situated in '-', Carlson's deve opment "Birch Iltdge Estates." Mr. Carlson noting that he was not - require. to gi e this property because area was subdivided before Ordinance #8. - ,~ /~' r', ~ ~ ~. " ,.'- Minutes - May 4, 1974 Page 2 He attached st pulation to the use of this land by the Township (a copy of these will be attach d as Item II.) Generally the Township must use this as an enviromental Park only and f used for any other purpose in the next twenty (20) years, would revert back to Carlson or his heirs. Also Carlson would like two (2) years back taxes paid. A ter heavy discussion on this procedure, which did not satisfy Supervisor Chr stenson, Supervisor Holasek moved to accept park area in Birch Ridge Estates as pre ented by Carlson. Second by Chairman Schneider; Carried unanimously, with Superviso Christenson objecting to procedure and stipulations. Chairman Schne der again called Lawrence B. Carlson for a presentation of White Oaks Country Estate ; a preliminary plat. Chairman Schneider read ~he recommendation from the Plann ng and Zoning Commission into the record and also the Engineers reply to questions a ked by Planning and Zoning. Mr. Carlson supplied overlay of resub- division that as missed at the Planning and Zoning Public Hearing. Supervisor Christenson qu stioned Leroy Winner, the Surveyor for this plat, what zoning category was u ed. Mr. Winner was not sure. Supervisor Christenson noted that in the event of futur subdivision, there were quite a few unbuildable lots. After twenty (20) minutes 0 further discussion with input from citizen Jim Isle, Carlson, the Board members, the Chairman of Planning and Zoning, Art Jaworski noted the Commission gave this plat very careful scrutiny. Supervisor Holasek moved the Town Board accept the preliminar plat, White Oaks Estates based on the recommendations of the Planning and Zoning Co ission, the Park/Advisory Board and the Engineering Firm of CED; Second by Su visor Christenson; Carried unanimously. Next item disc 8sed by the Board was the proposed changes in Ordinance #10, most ~ of which were ecommended by CED Engineer Orrin Fricke to make this Ordinance more .--' operable. lan.ing and Zoning added four (4) changes which included; accepting Park dedicatio on industrial and commercial plats and requirtág all developed under twenty (20) ac es be platted. After thirty (30) minutes of discussion these changes were accepted, excluding Section 9.02-c, which was a duplication overlooked by the Planning and Z ning Commission and the Engineers. Also to leave Section 9,03-a as is. Next agenda it m was~wnshiP road cleanup. General discussion- no decision. Chairman Schne der ca uck Bankey who will be coming in with the final plat for Cedar Cres Estat s third' ddition. He was informed he has four (4) obligations at time of sig ing of plat., 1) Supply Bond of 110 per cent. 2) Have titles opinion on land for the Township. 3) Be prepared to sign a development Contract that row's Attorney will prepare. 4) Pay all administrative, Engineer and Legal fees to date. Chairman Schne der called Harold Wilber who has a complaint about dust problem on Jay Street, ca sed by Kottke Bus Company. The Bosrd will meet with Chuck Peterson of Kottke Bus 0., May 20, 1974 at 7:00 p.m. The Clerk will set up this meeting. Bob's Auto Par s was called by Chairman Schneider but was not present. Chairman Schne der called Don Eri~kson ~ Variance request single family dwelling -fJite. The pro lem being his five" (5) acres piece does not have adequate road frontage. ~ Chairman Schne der read the recommeddation of the Planning and Zoning in full. This had a requirem nt that Mr. Erickson donate permanent easement of thirty three (33) '- feet from Sout Coon Creek Drive to Coon Creek. Mr. Erickson agreed to this and the Township Attor ey will follow up on this. Supervisor Holasek moved; Chairman Schneider seco d that this variance be allowed based on 8i"d8uce reviewed. Mr. Malek noting that rain is washing 'Sway sod and his driveWay becau e asphalt lip has yet to be installed. Bob Rolf alluded to November 1973 minutes, hat stated the Township would seed the re1Qrked ditches in front of his house. Su ervisor Holasek will follow up on this item noting he was Road Supervisor at he time this project was done. Bob Rolf felt e Board should also hear him out on the payment of culverts on l73rd Lane. H felt he was improperly informed of his rights when he paid for his culverts. Sup rvisor Holasek noted that of 173rd residents, Blesi paid for his, Clems was improperly installed and could not be charged&for. M~eks was improperly installed and now that i was properly installed, M~ek traded easements for drainage on his property for c lverts. Blesi was paid back for his because it was taken up and used at Maleks. Cl ms was no longer needed as the asphalt now taked care of drainage in front of hi house. Supervisor Holasek also noted that both are still in use at Bob Roiks. At orney Hawkins noted that State Statue lays down procedure for collection and if Mr. Rolf had not paid for those culverts, it would have been collected by 0 her means. No action taken. Mrs. Helen Fra z came before the Board to ask consideration for aleviation of the dust problem 0 Ward Lake Drive. The Board noted they were discussing a type of surfacingusin cinders and clay on Ward Lake Drive. Lillian Adkins of Red Oaks asked the Board if they were following up on l39th. Supervisor Hol sek noted this project is now in the formulation stage. ~ -' Mrs. Dorsey of Gladiola Street, between l35th and Bunker Lake Blvd., asked five (5) minutes of the Boards time to discuss their badly broken up street. The Board noted that a project there hinged on Engineering advice. Supervisor Christenson has talked to Mr. Dorsey nd other citizens on this street and felt it was just a matter of time until this can be studied. David Fricke 0 Chamberlain Equity Corporation was called before the Board by Chairman Schne der. Fricke stated that because of some items including costs, they would like to o the whole project in 1974, instead of staging it through 1976. Attorney Hawki s advised this would require: 1. new Bond be drafted. 2. addendum be added to the development Contract. The Board d this could be finished this year. The particulars will be worked out by Attorne Hawkins and Fricke. The Board was supplied with signed copies of the first Deve opment Contract by Clerk Jaworski. on 6",,11 ~.."", Supervisor Hol sek opened discussion 9AhalÞark at l40th^and Yukon. He noted that some fill is n eded at the site. The Board agreed that Burton Kraàbel should finish this site and llowed up to $250 for completion. After ten (10) minutes of discussion Supervisor Christenson moved to have Ordinance #9 strickly en orced in the Township, noting the problems on Bunker Lake Blvd. Second by Supe visor Holasek; Carried unanimously. Attorney Hawki s and Building Inspector Arntzen will work together on this and go to court wh never necessary. Attorney Hawkins noted to the 'sùpervisørs~ that this could cos more than $25. The Board note that meetings are to be held: Monday, June 14, 1974 at 7:00 p.m., with Kottke Bu Company - Cedar Crest unauthorized dirt removal at 8:00 p.m. - Interview Plan ing and Zoning applicants May 16, 1974 at 7:00 p.m. Bills weze pai .
