Meeting wa called to order at 8:05 p.m. by Acting Clerk Sylvia Britton. Nomination were opened for moderator. Kenneth Olson was nominated on a mot ion by ecil Heidelberger, second by Helen Frantz; Allen Miles was nominated n a motion by Robert Rither, second by Wally Arnt·zen. Motion was made b Ken Maus, seconded by Dick Schneider. to close nominations. Kenneth 01 on was unanimously elected Moderator of the meeting. by show of hand s. Minutes of the March 13, 1973 Annual Meeting were read and approved as read. : -""'/!:, Treasurer' report was presented by Janett Eveland and accepted as read. OLD BUSINE S Supervisor Holasek gave a status report on the Town Hall. He explained the reason for the increase of funds approved at a special meeting because the bids recei ed had increased from the original estimate and went from $95,000 to $125,00 . Site (parking lot and landscaping) will be' completed later in the spring He pointed out what else needed finishing and that we had a large stor ge space at the rear of the building. - '-.-' James Gris old gave a brief summary of what the Parks/Recreation Advisory Board had ccomplished during the past year, such as the summer recreation program, C pman Addition tot lot, park tOUTS. He reiterated our plans for the regula ion hockey rink at the rear of the Community Center; mentioned that the m etings were held on the second Thursday of every month and that everyone w s invited to attend. Lawrence C rIson, Chairman, gave a brief report on incorporation, the comprehensive plan and 0 matters in general. He pointed out that at present, due to our Township s atus, we are losing $60,000 per year in state aid for roads; that we must tr to forestall piecemeal annexation by Anoka; that our current problems are such t t they can be handled by us; and that the City of Anoka, in their financial mpact statement, have only offered us many expensive services which we don't nece sarily want and that the statement has been answered by Dick Beens. The Compre ensive Plan will be ready on March 13 for presentation to the Zoning and Planni g Commission. This is a controversial plan and various aspects affect eac one of us directly. There must be public hearings when the plan will be re iewed by residents, and Chairman Carlson urged everyone to attend those meet ngs. He said that we have a wonderful community and even though the job ha been difficult it has been rewarding. We have handled a lot of problems a d have come up with the right answers most of the time. March 12, 1974 - Page 2 James Lie inger questiQned the $60,000 for roads - Is this the only reason for wanting in orporation? Chairman Carlson explained that a monetary reason only is a 001' reason, but the principle behind the reason is generally more important. So far Moka has g:i;ven only monetary reasons for desiring annexation. Supervisor Christenson cømmented that the incorporation testimony is complete and that e are awaiting a final decision from'the Municipal Commission. He stated tha we will be much better off from an administrative standpoint than we are as Township if we incorporate. He repeated that' the Comprehensive Plan would be coming from the Planner on March 13. Zoning and Planning Commission will then eview it and give their recommendation to the Town Board. He al so asked that everyone attend the public hearings regarding the Plan, because this plan is fo the City of Andover. He lauded the Building Committee for the beautiful 'ob - the Community Center turned out to be more 'than we had expected - they did a fantastic job. Rosella So steby asked if the people should have voted on whether or not they wanted inc rporation. Supervisor'Christenson said that in essence it was voted on a a regular monthly meeting when they decided on the name - City of Andover - hich was ch0sen by those pres'ent at that meeting. Attorney Hawkins - pointed ou that the Board members are elected by 'the people to represent them and that t ere are certain instances where the electors are not required to -.-' vote. Thi happened to be one of them. John Lawst om (sp) asked if we received any aid from the state or federal government . Attorney Hawkins pointed out that we receive approximately $74,000 in Local Government Aid and approximately $15,000 from Revenue Sharing funds. Mr Lawstrom then asked if we would receive those funds if we do not remain a T wnship. Mr. Hawkins stated that just by having the status of City we would l' ceive some additional revenues such as the $60,000 for roads as quoted by hairman Carlson, and that we may stand to gain a little more in local government aid based on population figures Moderator lson asked if there were any other questions; Linda Gibson said she just wante to put in a good word for the council. She knew how many problems there were and she thinks they're doing a great job. Supervisor Holasek said he had no further comments on incorporation, etc., other than to in erject that the Board didn't make the decision to try for incorporation arbitraril , but rather that the public feeling was involved and that the response was for in orporation. He expressed his thanks to ceveryone for being so patient regarding he roads, and pointed out that the reason the Road and Bridge fund showed a d ficit this year was that we tackled three major problem areas, trying to take th worst first, and were hoping we'd have enough left for maintenance when they ere through. It is frustrating not having the funds to do everything, but the on y way we can take care of some of the problems is if the residents '--.., come 'forth with a petition for a public improvement project, which would have - to be bond d and assessed back to the property owners. If we are incorporated and receiv more funds they will help, but we shouldn't expect miracles from incorporat on. He said he realized that all the problems didn't get taken care of as fast as we'd like them to be, but we tried. - ~---\ .~\ , '-...../ ',- .~_/ Minutes 0 Annual Meeting March 12, 1974 Page 4 ~ an all-vol nteer fire department is not rated very highly in the eyes of an insurance ompany either, and it may take more time to gather the volunteers together i they are spread for'miles around that it would take the City of Anoka to get to a fire. Modera,tor Olson then asked for the question·.andthe motion car ied. John Sanfo d moved that we have a study ma,de on starting our own volunteer fire depar ment and the cost difference 'between our own department and the City of An ka. This is to, be reported on at the next Annual Meeting. Motion sec nded by George J'ensen; motion carried with one individual voting no. Attorney B'll Hawkins explained the next agenda item - raising the Town Board members' s laries. There are two provis'ions uÌlder. which Town Board members' salaries a e covered. One provides for $16 per meeting plus mileage; the second stat es tha when a town reaches a certain size - at least 7,000 residents and at least $ ° million in assessed valuation· if the electors approve at the Annual Mee ing, they can authorize $100 per month per supervisor and $150 per month for he Town Board Chairman. Mike Fern asked what their current salaries were and Bll reiterated the $16 per meeting plus mileage.- They are limited to $1,000 per year and after that work for free. After further discussion, Wally Artnzen mo 'ed that we raise the Town Board members' salaries to the maximum allowed; s conded by Mary VanderLaan; Ted Lachinski questioned the raise in - salary. S pervisor HØlasek pointed out that they were not complaining about the curren salaries, but that there are countless hours on the phone that the ~ Chairman i particular is never paid for; all of them take many phone calls but the Ch irman takes the most. Dennis Wallace said he didn't think any of the superv 'SOl'S were in it for the money. Supervisor Christenson pointed out that all m etings are recorded on claim sheets at the present time and that the new' ru ing would change the procedure so "the"supervisors would receive the new am unt regardles'sof what we did, because it ends up that we do one whale of a lot more than $16 a meeting will allow us to. Rudy Vickman stated that Mr. H lasek and Mr. Carlson listened to his problems all last fall and they certa nly earned their money. Phil Rzeszutek asked why We couldn't keep the superv sors at $16 per meeting with no maximum. Bill Hawkins pointed out that the 1 w says they cannot receive over $1,000 per year. Gary Steinke asked if the mil age was included in the $100 and $150 per month figure. Bill Hawkins stated tha the mileage up to l5¢ per mile as determined by the Town Board is on top of he $100 - $150 per month. Moderator Olson then called for the question and the mo ion carried, unanimously. The police contract was explained by Bill Hawkins. He said that the citizens felt there was a growing need for police protection in the Township, so the Board appo'nted a Crime Prevention Committee to study the possibility of additional protection for the Township. City of Anoka, Anoka County, and City of Coon Ra ids were contacted to bid on this contract. The matter is being brought ou at this meeting because the contract requires the approval of the electo ate. Along with providing additional protection, the matter of abolishing the constable position will be discussed. Supervisor Holasek pointed out that t e County had its reasons for d<:)ing it 'that way for safety réasons. Mr. Olson entioned that the sign is almost invisible for that corner and asked that something be done ibout it. Supervisor Holasek said that the sign would be reset. NEW BUSINE The gopher bounty was discussed. Helen Frantz moved that Grow Township match the l5¢ to be paid by the County for the cøming year. Motion seconded by Cecil Heidel berg 1'" Discussion: Elvis Zimmer - How much did this cost us in the past? Moderator lson said as he remembered he probably took out $50 two or three times when he was in charge of it, so the amount is not that great. Moderator Olson then asked for the question and the motion carried. Fire prote tion contract was the next agenda item. Attorney Hawkins stated that every year the Grow Township B<:)ard, in order to provide fire protection for the To ship, has been contracting with the City of Anoka. They submit a contract each year, charging us a flat fee based on 1/6 of a mill of assessed valuation Ius an hourly rate per call of $150 per hour*and $60 for each additional ha1f-hour~ The flat rate for 1974 would be $2509.80 plus the hourly rates (*01' any fract ion t ereof). Discussion followed: Ted Lachinski asked if anyone had checked - with Coon pids for service. Chairman Carlson stated that he had received a letter ~ from Coon pids and'that they would rather not serve our area. ,The cost would be $300 pe hour to go with Coon Rapids, so he felt we have no choice but to go with Ci y of AnQka. Motion was made by Dennis Wallace to renew the fire protection contract for 1974 with the City of Anoka. Motion seconded by Allen Miles. Di cussion: John Sanford asked what would happen if we incorporated and Attorney H wkins informed us that the contract would still ,stand. Art Jaworski said he ha had several people ask him why we haven 't started our own fire department Supervisor Holasek said the biggest reason is cost; that we are at the max mum mill levy now and it would take a special referendum to raise the taxes or it. The Board doesn't think it is feasible at this time. Mr. Jaworski a ked if it had been studied, or if the decrease in insurance premiums would offs t the increase in taxes. Attorney Hawkins pointed out that we have 7,000 resi ents and we would have to have pretty substantial savings on the insurance o justify spending $100,000 to $150,000. Supervisor Holasek said that if the peo Ie wanted a study done we could certainly do so. -Lynn Milliman asked where fire numbers are obtained. Supervisor Holasek pointed out that because we now have s reet names and house numbers we no longer need fire numbers. Leroy Severson - Are fire calls charged back to the homeowner? Attorney Hawkins said that if we do not have enough in our budget to pay for fire protection we have the right o ask the property owner to pay for it and if he refuses that cost can be add d to his taxes., A public hearing is held each year before those costs can e added to the taxes. Severson asked if we are charged the same as what we ar billed by the City of Anoka. Supervisor Holasek stated that the property 0 er is billed exactly the same amount. Chairman Carlson pointed ! - out that g nerally the property owner's insurance will cover the cost of the ~ call, and hat we should always check our policies for that coverage. The Committee included Qrd:i.!1a'!:y' citizens a.nd enfQrcement office:J:s who a:J:e residents- fGrow but are in police departments in Minneapolis, Coon Rapids, and the ka County ~he~iff's Department. The COI!Ul!ittee looked at several different ays of handHng the prQb1em, but the County provided the best 801 te:J:native. The net cos,t; to us for one man for an eight hour shift, or approximat ly 1-1/2 men, covering the co",,"uni,ty seven days per week, 365 days per r, a, fully equipped ear - $34,000 per year. We are basically not charge' for administrative services rendered by the County, many of theix supp rting officers, and we end up w:i.th many morè hours in the field than we eo ld consider possibly with our own police ofncer, After receipt of fines, tc., the net w~ll be less than the $34,000 figure. After study, we accept the recomme¡¡dation of the COI!Ul!ittee which was to go with the County, or to recoI!Ul!end to you tonight the use of the Anoka County Sheriff's Department for police protection for the Township. Robert McClure asked if we would b locked in on the eight hour period for patrol. Chairman Carlson said the 11. urs would be at our discretion and it will vary if we find that, one shift, s not working out - we will change that shift. !3ill Hawkins pointed out that t is item is covered in the contract - we won't have set hours if we don't want them. Chairman Carlson pointed out that the other 16 hours will ,~ be covered in the normal way, i.e., the Sheriff's Department will be on call at all tim s as they are now. This would be in addition to that. Ron !3uckhouse - asked if d ring that eight hours there would be a policeman in the Township. Chairman C rlson stated that they must remain in the Township for the full eight hour He said the hours can be changed around, but they don't want to have sp it shifts. Ted Lachinski asked if a man would be hired especially for us. C airman Carlson said yes, and !3i1l Hawkins pointed out that that person be ertified by the Minnesota !3ureau of Criminal Apprehension. We will have ly experienced men to do the job. Robert Wagner asked if the COI!Ul!ittee d made comparisons with other Townships who have protection against ours which as no protection as far as crime rate dropping. Chairman Carlson pointed out that we reviewed the costs, actual contracts in force between the County and ther cOI!Ul!unities and that ,the County was trying to treat all cOI!Ul!unities with this type of program alike. As for the drop in crime he didn't know. Art Jaworski pointed out that this is the first time anyone had used th County Sheriff's Department in that capacity. During ,the coming year the Crome Prevention COI!Ul!ittee will look at the picture in the Township and designa e certain areas as problems if necessary, but it will take the full year t do so. The change in hours is possible but cannot be done over- night. Bil Hawkins stated that because Ham Lake and East Bethel are also contracting with the County there will be a basis for comparison in a year or so. Ken Ma s asked if the County will be keeping a running list of calls. Chairman Ca lson stated that they are required to do so; Supervisor Christenson then explai ed the communications system at the County Sheriff's Department. Moderator 0 son asked for a motion. Dave Jack moved that we accept the police contract as prepared and act upon it in an affirmative manner; seconded by Wally - Artnz en. 13 11 Hawkins stated that the County will provide protection beginning ----- June 1, 197 . Supervisor Christenson pointed out that the mileage is variable. If we exce or begin to approach the $36,000 total figure for the year we will i , discuss wit the County the possibility of setting a limit for mileage. Attorney awkins explained tha,t the Township can authorize the abolition of the Const ble position, and since we have adopted thepQlice contract there will prob bly be no need for the Constable. Chairman Carlson asked if the constable position can rema.in in the community and was told that it could if we'd l'ke it to. Moderator Qlson'asked if the Constable could be deputized by the Co nty. Attorney Hawkins explained that the Minnesota Statutes give a CertHi d Officer greater power a$ far as ai'rest, etc. Moderator Olson introduce Ken ~~us as the person on the ballot and asked him to stand. Mr. Ma.us . s a police office in the Minneapolis police Department and Moderator Olson ask d if he was certified. Because he is certified, Mr. Hawkins said he could rrest people just like he can down in Minneapolis. He pointed out that Ken us would have to work with the Sheriff's Department. They would like to co suIted before we authorize someone to go out and enforce our laws. Attorney Hawkins also pointed out, that the abolishment would not take effect until the next election of the position - two years from now. Moderator Olson asked for the motion to abolish the constable effective in 1976. No otion made - no action taken. The matter is tabled until 1976. , , Chairman C rlson was asked to explain the proposed budget for 1975. He ~ reviewed t e expected income and explained that the Building Inspector's, Department is self sufficient. He then pointed out t,he expected expenses and how th budget was balanced. Moderator Olson asked for a motion to accept the 1975 budget at this time. Said motion made by Charles Plowe; seconded b Mike Fern. LeRoy Severson asked if the budget included any monies we ould receive as a result of incorporation. Chairman Carlson pointed ou that we could not assume that we would be incorporated for purposes 0 this budget. Moderator Olson then called for the question and the motion carried unanimously. Moderator Ison then asked for additional new business. Cecil Heidelberger raised the question of the $2,000 raise for the Building Inspector to a $16,000 per year j b. Chairman Carlson stated that, the Building Inspector's contract was signed in February 1973 and calls for a salary effective April. 1, 1973 through Ma ch 31, 1974 of $14,000; then provides for an increase of $2,000 per year e fective April 1, 1974 through March 31, 1975. The contract is voidable w thin thirty days after notification by either party. The I contract w s signed before Chairman Carlson and Supervisor Holasek were elected to the Board, but that Supervisor Christenson was on the Board at that time nd he would be able to answer the questions. Cecil then asked Supervisor Christenson why it was that we have the poorest Township around and the most e pensive building inspector. Supervisor Christenson suggested that he re d Ordinance #8, last paragraph, which states that Mr. Arntzen - is the ord nance enforcing officer in the Township, and that he is paid for ,-' - ("', ,~ - ' \ ~ \. /) \--) , . After fur her discussion and seve:lèal votes of confidence from various c it izens, Dennis Nelson stated that he felt' it was a fruitless discussion and that 'f we need outside help Bernie Steffen certainlýis an able administr tor and could help uS out, Lyle Bradley pointed out that if we went back. to the old method of paying the building inspector with a percentag of the building permits, Wally's salary would be about $40,000. Moderator Olson then ended the discussion and asked for any other general comments egarding Township matters. Cecil Hei elberger pointed out that ,the Township truck was in bad shape ~. for being only one year old and he felt that the Township should buy their trucks in tead of leasing them, then made a motion to that effect. Moderator ~ Olson sug ested he make a recommendation instead of a motion, which was done. The reco endation was seconded . by James Elmer?' Moderator Olson restated the motio as follows: Cecil made a motion that he,.récommended to the Town Board tha they purchase rather than lease (trucks). This gentlemen then -- would you state that again -- John Hibbard then stated his amendment as: "that we rchase or lease 'depending on ,which is the most economical." That moti n had been seconded by Elmer. After discussion on the technicality of the mo ion, Moderator Olson asked for the question and the motion was defeated. ith no one voting aye. Dave Mac! tyre asked how much the population had grown since last year. Art Jawor ki stated that we had gained approximately 700 people in the past year thro gh new homes built in the area. Lynn Mill an asked if there was anything new on the airport question. Supervisor Christens n pointed out that there had never been a final communication to the Grow ownship Board regarding that subj ect and that during the last year there hav n't been any rumors. Jerry Men elkoch asked if there was any working relationship between Grow Township nd the North Central Public Service - do we have a franchise agreement with them. Attorney Hawkins stated that we have no franchise. There has been a Utiliti s Regulation Committee set up to govern them, however it doesn't apply to Grow T wnship. Supervisor Christenson pointed out that a city can become -' involved n a franchise whereas a Township cannot. Supervisor Holasek s id nQ prioritièshad been set so far but that area is ¢ne that will certainl be considered, Robert Wa ner asked when sewer win be com~g into the Township. Engineer Larry Kos ak stated that we are in limbo'úntil a decision is made on incorpora ion as to what direction the Township is going before we can move ahea . Chairman Carlson said ,that the most severe problem is in the Crooked L ke area, which area has been proposed for annexation by Coon Rapids. If that h ppens then we have no author:i,ty or power to put it in there; likewise tllat ist e source of sewer fo1' us and that is' one of the reasons wily we have insisted .0. an answer on our incorporation proceedings, because we don't know what to d with that. Supervisor Christenson stated that the engineers have prepared hree alternatives for the location of the sewer. There is a large intercept I' line that ends at the south line of the Township near Nemeth's Store. Were that line goes depends on the alternative chosen by the Board; ~ and when 't goes depends on when the people are ready for it; some have petitione for sewer in the Crooked Lake area. Art Jawor ki pointed out that at the last annual meeting we had spent over an hour t lking about road problems, showing slides of various bad spots, etc. Mo eratoI' Olson pointed out that an earlier question pertained to an indivi ual problem, not overall problems, and Supervisor Holasek had asked tha it be handled at a regular Board meet~g. Engineer· Koshak pointed 0 t that the slides, etc., had been requested by the last Board and thit hey had been asked to make an inventory of road problems; said inventory still in effect, so we'd be discussing the same problems. Super- visor Hol sek pointed out that some of those problem has been resolved. Superviso Christenson stated that the rationale for that activity was to bring vis bility to the townspeople as to the magnitude of the problem. They know about their own individual situations, but he was not sure that they were aware of the others, so we wanted to show what it was like and did I so throug the slide presentation. Out of that number of pictures and situations we were g ing to select those which were of the most importance because of the difficult es that they present and we chose and did in fact work on three of those - t e first three.
