Minutes of a REGULAR MONTHLY MEETING of the Grow Township Board of Supervisors held
July 9, 1974 at 8:00 p.m., at the Grow Town Community Center.
Present Chairman Schneider, Supervisor Christenson, Attorney Ed Babcock. Supervisor
Holasek not present.
Chairman Schneider noted the Hearing on Grow's Incorporation had again been postponed
until Monday, July 15, at 10:00 a.m., at the Anoka County Court House. Chairman
Schneider noted the issues look favorable for Grow.
Chairman Schneider noted the minutes of the past Town Board Meeting, Special Meetings
and the monthly financial report were posted in the lobby.
The first item on the agenda was a proposal from the Planning and Zoning Commission
to the Town Board on minimum building site criteria. This recommendation was drawn
up after a written request from Building Inspector Arntzen to the Planning and
Zoning Commission which stated possible problems if homes were constructed to c~ose
to the ponding or re-charge areas. (Supervisor Holasek arrived at this point.)
Chairman Schneider read recommendation in full. Chairman Schneider noted that he
would like to change it. He noted the statement, "all areas under five (5) acres
must be seventy-five (75%) percent buildable, should be broken down to; 90% of one
(1) acre buildable, 70% of two and one,·hhlf (2 1/2)acre buildable, 45-50% of five (5)
acres buildable. Supervisor Holasek felt it should be; 100% of one (1) acre, 75% of
two and one half (2 1/2) acres, 50% of five (5) acres. Supervisor Christenson felt
that restrictions to the land be a close as necessary to 100% to keep occupied
structures away from ponds and re-charge areas.
Chairman of Planning and Zoning Alan Miles noted that if the 75% factor was not
agreeable, the Planning and Zoning could re-look at this item. A majority of the
Board felt this should be sent back for re-work. No vote. The Clerk Jaworski is
a member of the Planning and Zoning Commission and he will relay this information
to the Planning and Zoning Commission.
Chairman Schneider called Harlan Lusk of Enchanted Drive. Mr. Lusk was to present a
petition for blacktop of a section of Enchanted Drive. The Clerks office has a copy
of the petition. Mr. Lusk was not present. ,
Attorney Babcock noted that for a public improvement project to be intiated, 35% of
the people in the given area must petition. The Township then is required to turn
the proposal over to the Engineer for a feasibility study. Attorney Babcock also
noted there are other ways to start these projects. Mr. Babcock also noted a Public
Hearing on the feasibility study would be required. Chairman Schneider asked Mr.
Babcock if these can be assessed back. Mr. Babcock stated all or parts could be
assessed back. The Clerk was directed by the Board to convey this information by
letter to Mr. Lusk.
Next item read by Chairman Schneider was a resolution on how to deal with surplus
Township property. Supervisor Holasek has put together this resolution. Chairman
Schneider related the resolution to the Cedar Crest unauthorized dirt removal.

Chairman Schneider asked Skip Rither, (who was in the audience) if this would satisfy
him. Mr. Rither noted he had not asked for a resolution, but asked that the Town
Board take charge of some of these activities, so it will not happen again. Supervisor
Holasek moved to adopt the resolution as read by Chairman Schneider; Second by
Supervisor Christenson; Carried unanimously. Supervisor Christenson noted this
resolution brings visibility to the Township's property and how it will be handled.
Next item covered were Planning and Zoning matters. Chairman Schneider began with the
proposed Horse Ordinance, which he read in full. General discussion that included
audience participation continued for twenty (20) minutes, with the following stands
being taken:
1. Chairman Schneider against Section l-a - Acreage and Section l-e - Rear
yard set back requirement.
2. Supervisor Holasek, for, as is with some reservations on the minimum shelter.
3. Supervisor Christenson, for, as is.
Attorney Babcock noted Section 4-c on notices could be re-worded and 7-b on terms
of Horseman's Council should be re-worded. Mr. Babcock was not sure how thoroughly
Attorney Hawkins had gone over the Horse Ordinance and would like to put it in final
form. All the Board Members agreed to this. Chairman Schneider asked if changes
should be made before the Board voted on it. Attorney Babcock stated that the minor
changes would not change substance and further stated the Board could vote bo "okay"
it in a preliminary stage and after the Attorney ironed it out, the Board could re-read
it publicly, next month, then publish it and it would take effect. Supervisor Holasek
again questioned the minimum requirement for the shelter.
Planning and Zoning Chairman Alan Miles noted that 100 square feet would require
inspection by the Building Inspector. Mr. Miles also noted that the only time that
horses would use a shelter, was to get away from flies. Building Inspector Arntzen
noted that the Humane Society does not require a shelter for horses.
Chairman Schneider felt that anything over one (1) acre required for horses was
unreasonable and noted rear yard set-back requirement with large lots was also
unreasonable because on two and one half (2 112) acres if a house was oriented to
take advantage of one part--of<,l1l:le"iet, there could be a lot of land for pasture on
one side or the other.
Planning and Zoning Chairman Miles noted this was discussed at the Public Hearing
and the majority of the Planning and Zoning felt that if being to the front did not
create any problems for neighbors, the Horseman's Council could recommend a Variance
on the set-back requirement. Supervisor Holasek noted that getting a Variance in
Grow, is a problem these days.
Supervisor Holasek moved to adopt an Ordinance relating to the regulations and keeping
of horses, foals and ponies within the Township of Grow, as proposed by the Planning
and Zoning Commission; Second by Supervisor Christenson; Chairman Schneider voted,
NO. Carried. Attorney Babcock will cross T's and dot I's and have this Ordinance
ready for final reading and publication after the next Town Board meeting.

Chairman Schneider moved onto the Variance request of Marlo Strand. Chairman Schneider
read the recommendation of the Planning and Zoning Commission and at this time, Mr.
Strand attempted to refresh the Board's memory on his problem. Mr. Strand has?(four (4)
to five (5) acre piece of land, running from 159th to the Rum River. At one time,
he felt he would like to subdivide this into two (2) pieces. Mr. Strand went through
the proper procedures and asked for a Variance of width, because his long lot was not
wide enough to meet minimum requirements, the Planning and Zoning recommended to the
Town Board that Mr. Strand be allowed a Variance on width and continue to plat the parcel.
The Board concurred.
Mr. Strand and his Attorney, Mr. Mums explained that the high cost of platting should not
be applied to small parcels and simple splits and that this situation is what a variance
is for. Supervisor Holasek noted the Board has been very consistent when it comes to
Variances. Mr. Mums noted you must take each case on it's own merits. Supervisor Holasek
also noted we could be setting a dangerous presidence, by allowing Variance s of this
nature, at this time. Mr. Strand noted the fact that he had sold this lot, but the
contract provided for full repayment, if the building permit could not be purchased.
Supervisor Holasek moved to deny Marlo Strand's Vequest for a Variance from platting
Ordinance 1'10; Second by Supervisor Christenson; Carried unani~ously. Minor discussion
with Mr. Strand and Attorney Mums continued for five (5) minutes.
Next agenda item was Gerald Windschitl Variance request. Mr. Windschitl has a seven (7)
acre lot on Crosstown Blvd. Mr. Windschitl noted to the Board the house on the lot was
small, the lot large, which left him with a shortage of buyers. Chairman Schneider read
the recommendation from Planning and Zoning on this matter, which recommended denial for
two (2) reasons: 1.) premature development and 2.) the split would allow lots under the
minimum requirement for lot size. The Board went over alternatives with Mr. Windschitl
and felt a Variance would not cover the situation. Supervisor Holasek noted are-zoning
to R-4 might be in order, because of existing R-4 on both sides coupled with platting.
Mr. Windschitl will look into this. Supervisor Holasek moved to deny the Variance
request of Gerald Windschitl, based on the recommendations of the Planning and Zoning
Commission; Second by Supervisor Christenson; Carried unanimously.
The agenda for the evening was over at this point. Chairman Schneider called ~lly. I
Hughs, 16315 Round Lake Blvd., at this time. "'a: ~Sl-¡"a.,
Mr. Hughs has the only light is ·I.t~ral
development in the Township. Mr. Hgshs would like the Board to accept 162nd Lane N.W.
so he can close a five acre sale to Gilbertson Block Company. At this time they cannot
get a permit to build, because they do not front on a public reight-of-way. Mr. Hughs
noted the Township has been maintaining the Road, since he had it constructed in 1970.
Attorney Babcock noted that if this portion under discussion meets standards of that
timè frame, the Board could accept the road and on the portion of road to be utilized
for Gilbertson Block Company, he would have to meet current standards.
The Board directed Road Overseer Arntzen to contact Engineer, get Engineer estimate.
Attorney Babcock would draw up performance contract and when Mr. Hughs put up bond for
finishing the road, the building permit could be issued. Mr. Artnzen will cover this
immediately. Attorney Babock also noted that 163rd and 164th might also be looked at
while the Engineer is out for approval, because they have never been formally accepted.

Mr. Triggs, the new Assessor came forward. Mr. Triggs noted he now has the sign he
requested. He would like the Board to pay for his Assessing School. The cost would
be $58.50 total. The Board agreed. Mr. Triggs noted the County Assessor wanted pictures
taken of every house. Chairman Schnèider stated he would "run down" our other Polaroid
camera and it was decided to only take new pictures where changes were in evidence and
that they be in black and white. Clerk Jaworski will search for a buy on quanity of
film if the camera is found.
At this time bills were paid. Discussion on bills to be paid to Hulegaard Excavating
over-run in Dean's Addition in 1973, surfaced with an apparent re-billing for this
project by Hulegaard. Supervisor Holasek produced minutes of the Supervisors meeting,
December 17, where this matter was settled with the Board agreeing to pay $434.50.
Supervisor Holasek and Supervisor Christenson re-affirmed this had been paid. This check
will be held.
Discussion on Hulegaard's billing for Cedar Crest Pond, with Supervisor Christenson
questioning if this project is completed. Chairman Schneider assured him it was.
Jim Griswold Chariman of the Parks/Advisory Board also assured Chairman Schneider it'
was completed. Supervisor Holasek and Chairman Schneider felt Hulegaard should be paid
$1,800.00 on Cedar Crest.
Minor discussion on Gary Duerrs future appearance before Town Board.
Minor discussion on the new Township truck. It is noted that Hansord Pontiac is only
bidder and their bid was not to -sPfi'cifications on tires requested.
Supervisor Christenson moved to deny the construction license for B & J Construction
Balcktop, 3023 174th Lane N.W., because they are trying to conduct a business in a
residential zone. Second by Supervisor Holasek; carried unanimously.
Building Inspector Arntzen brought forth licenses applied for by Contractors so they
can comply with Ordinance #22. Chairman Schneider and Clerk Jaworski reviewed and
signed all, except B & J Blacktop.
On Park matters, after reviewing bids gathered by Building Inspector Arntzen, Supervisor
Holasek moved to accept low bid of H & S Asphalt on Shady Knoll for $1500 for a multi
purpose blacktop piece; Second by Chairman Schneider; carried unanimously.
Supervisor Holasek also moved to accept low bid of H & S Asphalt for $4625 to blacktop
the Community Center parking lot, if spec's are right; second by Supervisor Christenson;
Carried unanimously.
Treasurer Janett Eveland noted the Township was short on funds and could not pay all the
bills this month. Mrs. Eveland had typed up a list of those she proposed we not pay.
After a short discussion, Supervisor Christenson suggested we pay all these smaller bills
and hold one check for $20,000 on the Building, noting there were SOme small items with
problems including the air conditioning for the auditorium. Supervisor Christenson felt
we could pay this $20,000 on the 14th of July, 1974 when these funds would be available
to Grow. The Board agreed.
Minor discussion on file cabinets with Building Inspector Arntzen pointing out we are
full up in most areas.
Supervisor Holasek moved to adjourn; Second by Supervisor Christenson; Carried
unanimously. Meeting was adjourned at 12:20 a.m., July 10, 1974.
