CITY of ANDOVER
REGULAR MEETING OF THE ANDOVER CITY COUNCIL, HELD AT THE ANDOVER COMMUNITY
CENTER, TUESDAY. DECEMBER 3, 1974 at 7:30 p.m.
Mayor Schneider called the meeting to order with Councilmembers Rither,
VanderLaan, Windschitl and Holasek present.
The first agenda item, Consulting Engineers Diversified bill was passed over.
Representative not present.
Mayor Schneider moved onto the second agenda item, review procedure for
interviewing City employees. Council person VanderLaan questioned the former
Town Board, members, Richard Schneider, Winslow Holasek and RobertRither on,the
procedure used to hire Building Inspector Walter Arntzen. The scoring system
used, was similar to the one suggested by the League of Municipalities.
Councilperson Windschitl stated thtt p~wspaper ad's do not provide the best
candidàte for a job and suggestedT~S¡~foyment agency be, considered. Councilperson
Windschitl referred to the following procedures:
1. A phone screen.
2. Face to face interview.
3. Testing procedure recommended, possibly by the State.
Councilperson Rither stated the procedure arrived at should become a City policy.
Mayor Schneider asked the Council to think on the procedures for hiring City
employees and directed Clerk Jaworski to read the minutes of November 19, 1974
meeting. It was moved by Councilperson Windschitl, seconded by Councilperson
VanderLaan to approve the minutes of November 19, 1974, as corrected. Motion
carried.
Councilperson Rither would like to have his motion on the last page struck,
stating Robert's Rules of Order does not permit a negative motion. The Council
agreed that although no one recognized this fact at the meeting, the motion should
stay in the minutes as part of the meeting.
Discussion again moved to interviewing procedures for hiring City ~mployees, with
Councilperson Windschitl asking former Town Board Supervisor Christenson if there
were some procedures, such as, Civil Service that would take the politics out of
City jobs? Mr. Christenson stated that these types of things are set out in the
State Statutes and previously were not available to the Township form of
Government. The Council directed acting Clerk Art Jaworski to contact the City
Attorney Bill Hawkins on Civil Service procedures or alternatives.
Mayor Schneider appointed Councilpersons Rither and VanderLaan to research the
alternatives and put together a procedure for the Council to use when toterviewing
applicants for jobs with the City.
The next agenda item was the combination of the Clerk-Treasurer position.
Councilperson Rither stated after spending a couple of hours with the Auditor's,
he understood this position thoroughly and noted a yearly audit would be in order.

Councilperson Holasek reaffirmed Councilperson Rithers' statement and noted
it was the most economical way to go with better record keeping. Councilperson
AAAAAAAAA Holasek stated to the Council that if they were for a Clerk-Treasurer position,
Ordinance #25 combining the offices of the Clerk-Treasurer was voted down.
Councilperson VanderLaan stated that in her research, she found that any
Ordinance could be post-dated, to give the Council time to act. After full
discussion, Mayor Schneider appointed Councilpersons Rither and VanderLaan
to draft a job description of the Clerk-Treasurer position as it relates to
the City of Andover, for the Council to review.
Dick Sha representing Consulting Engineers Diversified appeared before the
Council to explain the bill of $2,407.24, owed to them from the City of
Andover for road maintenance contract and other items. Mr. Sha noted their
bookkeeper consolidated the billing, which probably confused the issues.
Mr. Sha also noted that ten and one half hours of Orrin Fricke's time in
this area was for general road inspections. Councilperson Rither asked former
Town Board Supervisor Holasek if he was satisfied with Mr. Sha's explanation.
Councilperson Holasek stated this explanation was sufficient and the bill should
be paid. The Council agreed. Mayor Schneider stated to Mr. Sha that the bill
will be paid the third week in December.
Darrell Berkowitz, representing the City of Andovers' Engineering Firm of
Toltz, King, Duvall and Anderson appeared before the Council and stated that
an error occurred in the resolution passed at the November 19, 1974 City
Council meeting. Mr. Berkowitz explained that the error was in the
resolution, establishing a Municipal and State Aid Road System, control section
103-010 and 104-010. It was moved by Councilperson VanderLaan, seconded by
Councilperson Windschitl that the Andover City Council rescind the resolution
passed at the November 19, 1974 City Council meeting, establishing Municipal
and State Aid Roads. Motion carried.
Moved by Councilperson Holasek, seconded by Councilperson
that the Andover City Council adopt a corrected resolution establishing
Municipal and State Aid Roads. Motion carried. A copy is attached to this
set of minutes. The correction involved changing 173rd A~eaue Northwest to
l72nd Lane Northwest, where it occurred in Control Section 103, segment 010
and Control Section 104, Segment 010.
Mr. Berkowitz requested that the Council adopt a resolution establishing
Engineering and Technical Assistance agreement with the State of Minnesota.
Mr. Berkowitz explained to the Council that when used, the State is usually
less costly in most cases and is especially needed on bridge work.
AAAAAAAA Councilperson Holasek noted to the Council if ad~ertising for the position of
a Clerk-Treasurer was to be considered, Ordinance #25 creating this position
had been voted down previously.

Moved by Council person Rither, seconded by Councilperson Holasek that the
following resolution, establishing Engineering and Technical Assistance
for the City of Andover be adopted. Motion carried.
WHEREAS, the City of Andover will, from time to time, be engaged
in various road and bridge projects; and,
WHEREAS, various technical and engineering data will need to be
provided during the course of activities, and,
WHEREAS, the State of Minnesota, through the Commissioner of
Highways, makes available, through a Technical and Engineering Assistance
Agreement the delivery of this datum;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Andover, that a Technical and Engineering Assistance Agreement be entered
into for 1975 with,the State of Minnesota, Commissioner of Highways.
A copy of this agreement will be permanently attached to this set of minutes.
The Council, after discussion did not act on a resolution in regard to Federal
Aid Funds to be used in the future on Andover Roads. Mr. Berkowitz will send
copies of this annual agency agreement to the Council, the Clerk, the Road
Foreman and the Attorney for study.
Mr. Berkowitz stated to the Council that final inspections had been completed
for the repairs to the Prairie Road Bridge and recommended payment of $890
to Northern Contracting Company. The Council authorized payment upon receipt
of the billing.
Phil Rzeszutek and Dave Jack, representing the City of Andover Park/Advisory
Board, appeared before the Council requesting the Council's approval to
purchase hose to be used for the flooding of the Community Center hockey rink.
Dave Jack stated he had worked out figures on friction water loss and it was
decided that, three 100 foot lengths of standard fire hose should be purchased,
along with one coupling and one nozzle. After discussion, it was moved by
Councilperson Windschitl, seconded by Councilperson Holasek that the
Park/Advisory Board be authorized to purchase hose for the flooding of the
Community Center hockey rink, in the amount of approximately $360. Motion
carried.
Councilperson Rither brought up the question of safety as it relates to the
Andover Community Center Parking lot at night. After discussion, it was moved
by Councilperson Rither, seconded by Councilperson Windschitl that on a
temporary basis, three security lights be installed on the perimeter of the
parking lot and one more security light on the west side of the hockey rink
be installed. Motion carried.

After discussion on signs for the City of Andover, it was decided to have
Clerk Jaworski obtain more prices. Moved by Councilperson Rither, seconded
by Councilperson VanderLaan that the Council table action on signs. Motion
carried.
A statement of value of open property, park equipment, hockey rinks, etc., of
the City of Andover was signed by Mayor Schneider in the amount of $2500 for
insurance purposes as recommended by Insurance Agent Newell Chester.
Councilperson Windschitl asks for recess. Moved by Councilperson Rither,
seconded by Councilperson VanderLaan that the Council recess for five minutes.
Motion carried.
Mayor Schneider stated to the Council that he has ordered signs with the
words, " City of Andover Assessor .., to be used by the City Assessor Mr. Triggs.
After discussion, the Council directed the Clerk to get the information in
writing from the City Attorney on the following items:
1. What obligation does the City Council have to decisions made
by the former Grow Town Board, i.e., park property accepted
by the Town Board from Lary Carlson in Birchridge Estates with
respect to the unique situation.
2. Does the City of Andover have law enforcement powers and
Ordinance control on lakes, (Round Lake) and rivers, (Rum River).
3. If the Council fails to raise the levy"limit to the maxinrom,
can this amount be added on next year? The same situation applies
to special levies, sewer bill, shade tree disease control.
4. A reading on mileage allowed for Supervisors and Clerks under
State Statute and how it applies to the former situation in
Grow Township.
5. Civil Service or alternatives available to the City to keep the
politics out of jobs.
6. How does the City stand on fire bills received until the November
11, 1974 change over.
After discussion on procedures used to pay bills, the Council decided that the
checks be attached to the bills to save time and not duplicate moves.
The Deputy Clerk should inform Crimsoncross Kennels of the area the City of
Andover received from the City of Ramsey.
Mayor Schneider appointed Councilpersons Rither and VanderLaan to formulate
a newspaper ad to select candidates for the Planning and Zoning and the
Horsemans Council.

The Council directed the Clerk to notify the Planning and Zoning Commission
to review a shoreland zoning ordinance for the City of Andover.
Mayor Schneider stated that Tom Mangan will host a meeting of the municipalities
at the Andover Community Center, Wednesday, December 11, 1974 at 7:30 p.m., to
discuss legislative needs for the municipalities.
Councilperson Rither stated that nine items were added to the agenda and
requested that agenda items only, be heard, except in cases of emergency.
Discussion on the Schoell and Madson, Engineering bill for the Feasibility
Study of Valley View Estates. No action taken.
Mayor Schneider stated to the Council that Consulting Engineers Diversified
would like to do the impending sewer work for the City of Andover. No action
taken.
Bills were allowed and ordered paid in the amount of $8,088.29. A list of
bills paid is on file with the Clerk.
Moved by Councilperson Holasek, seconded by Councilperson VanderLaan that the
meeting adjourn. Motion carried.
