Minutes of a REGULAR CITY COUNCIL MEETING held December 17, 1974 at the
Andover Community Center.
Mayor Schneider called the meeting to order at 7:30 p.m., with Councilpersons
Rither, VanderLaan, Windschitl, Holasek, Attorney Hawkins and others present.
After discussion and reviewal of December 3, 1974 City Council meeting minutes,
it was moved by Councilperson VanderLaan, seconded by Councilperson Windschitl
to accept the December 3, 1974 minutes as corrected. Motion carried.
After discussion of Consulting Engineers Diversified request on page five,
paragraph five, of the December 3, 1974 City Council meeting minutes, the
Council directed the Clerk to draft a letter to Mr. Keith Caswell and Mr.
Dick Sha of Consulting Engineers Diversified stating that the Andover City
Council fully understood that CED was interested only inCbing the engineering
on the sewer project and not becoming the city engineer. The letter should
also state that the City of Andover is fully satisfied with all aspects of
engineering, including the work on sewer feasibility done by our engineering
firm of Toltz, King, Duvall and Anderson.
Councilperson VanderLaan asked Mayor Schneider if adjournment was possible
at 10 :45 p.m. No second or follow up.
The Council moved onto the Special Use Permit of Gerald Prior. Mayor Schneider
read the Planning and Zoning recommendation in full. After discussion and
input from Attorney Hawkins, it was moved by Councilperson Rither, seconded by
Councilperson Holasek to issue the Special Use Permit to Mr. & Mrs. Gerald
Prior for one year from December 17, 1974, giving the City the automatic right
of review. Further discussion continued with Planning and Zoning Chairman
Allan Miles stating the Kennel Permit required would cover a yearly review.
Councilperson Rither stated to Mr. Miles that this was true, but the Special
Use Permit was the document of importance because the use was special for a
"residential area". Motion carried.
Mr. Dean Lund representing the League of Minnesota Municipalities appeared
before the City Council to explain the advantages of the City of Andover
belonging to the League of Minnesota Municipalities. Mr. Lund stated to the
City Council that the City of Andover, should they decide to join the League,
could influence the League in the following ways:
l. Get appointed to staff or structure committees.
2. Telephone to Leauge.
3. Mail to League.
4. Drop into League offices.
5. Formal resolution.
6. Address the Board of Directors by getting on their agenda.
Councilperson Windschitl requested that Mr. Lund respond in writing, stating
that the City should know what services are covered under membership and what
services are extra. Councilperson Windschitl also requested that Mr. Lund
send out information and by-laws on the Association of Metropolitan Municipalities.
Mr. Lund will respond to Councilperson Windschitl requests.

Mayor Schneider called on City Engineer Dewey Kasma of Toltz, King, Duvall and
Anderson who presented the City Council with the following documents:
1. A Comprehensive Plan on sanitary sewer and water facilities.
2. A Feasibility report; sanitary seweE and water main construction
in the Urban Planning Area.
Engineer Kasma summarized these documents with the City Council responding with
questions on cost and timing. Councilperson Windschitl stated that these projects
all fall in order and felt the first matter to be resolved should be the Community
Development Plan. Councilperson Rither agreed and stated that the Council must
direct the Planning and Zoning Commission to immediately proceed with the
Community Development Plan. Discussion continued on the "position paper", and
the aids proposed to be used at public hearings on the Community Development Plan
by the Planning and Zoning Commission. Councilperson Windschitl made a motion,
seconded by Councilperson Rither that the City Council hold a joint meeting with
the Planning and Zoning Commission, Monday, December 23, 1974 at 7:30 p.m., at
the, Andover Community Center to iron out differences and set up a time table for the
many items that are tied together in the City of Andover. Motion carried.
Planning and Zoning Chairman Allan Miles requested that the date of December 23,
1974 be changed to December 30, 1974. The Council agreed that December 30, 1974
would be a more workable date. Councilperson Rither made a motion, seconded by
Councilperson Windschitl that the date in the previous motion be changed to December
30, 1974. Motion carried.
The Council discussed the Feasibility Study of Valley View Estates by Schoell and
Madson for Grow Township. City Engineer Kasma under instructions from the former
C~w Town Board of Super.iss'.,reviewed this Feasibility Study by Schoell and Madson
and sfated ~ J~e &euncil that he would not have done this Feasibility Study as
e~+-ef1s;''j¡''rLrT' °Þ~"A ønii~>because so often these projects are not carried out. After
further discussion of the Schoell and Madson billing and Study, Councilperson Holasek
stated that he will talk to Jim Orr in the interim. ( a copy of city Engineer Kasma
report will be attached to theae set of minutes.) Tabled.
It was moved by Councilperson Rither, seconded by Councilperson VanderLaan that
the City Council accept the Comprehensive Plan, sanitary sewer and water facilities
and the Feasibility Report, Sanitary Sewer and Watermain construction in the Urban
Planning Area. Further discussion it was noted this motion will show that these
items were presented and accepted for the record. Motion carried unanimously.
The Council discussed the compensation of mileage requested by former Grow Town
Board Supervisor Marvin Christenson. After re-reading the section of State Statute
Chapter 143, compensation and mileage that covers this request, Attorney Hawkins
stated that the rate to be paid must be set at a "town meeting". Attorney Hawkins
also stated that the law allowing mileage had not been put into effect until one
day after the Annual Town Meeting of March, 1974 and upon research, it was noted
that no town meeting was called after the first one in March. In further
discussion, Attorney Hawkins stated it would probably be against the law to pay
this compensation now. Mr. Christenson explained to the Council that he was
satisfied now that this matter was cleared up.

The Council discussed the park dedication of Birchridge Estates by Lary Carlson.
Councilperson VanderLaan stated to the Council that the residents in Birchri~ge
Estates have the right to know what the Andover City Council is discussing about
this park and suggested that the residents and the developer of Birchridge Estates
be invited to the January 7, 1975 City Council meeting. The COUncil agreed. The
Clerk was directed to notify Lary Carlson developer and the residents of Birchridge
Estates to attend the January 7, 1975 City Council meeting.
The next agenda item, payment of interest due from escrow account of Bunker Lake
Estates. Building Inspector Walter Arntzen stated to the Council that all conditions
requested for by the Planning and Zoning Commission had been met by Bunker Lake
Estates and they should receive their money deposited. Councilperson Holasek so
moved. Motion carried unanimously.
The Council discussed the automobile tear-down facility of Myron Roseland at
l6l09 Valley Drive. Attorney Hawkins stated that Mr. Roseland's facility was on
the court calendar.
Councilperson Windschitl stated that he was concerned that G.W. Anderson and
Associates not having their audit report submitted. After Council discussion, it
was moved by Councilperson Windschitl, seconded by Councilperson Holasek that G.W.
Anderson and Associates have this audit report in the hands of the Andover City
Council by January 1, 1975. Motion carried unanimously.
Building Inspector Arntzen stated to the Council that he had some items for Council
approval and requested to be heard. The Council agreed. Mr. Arntzen stated that
Mr. Lee Chesler has requested a temporary occupany permit for a mobile home at
3019 l73rd Lane Northwest, until May 1, 1975. Mr. Arntzen explained that this
mobile home had been occupied twelve years and noted a house being constructed
would not receive a certificate of occupany permit until the mobile home was
vacated and the sewage system blocked up. It was moved by Councilperson Holasek,
seconded by Councilperson VanderLaan that the Council approve as requested. Motion
carried.
Building Inspector Arntzen stated that he had another mobile home request by
Mr. Bergmann, at l36)fJay Street Northwest. Mr. Arntzen explained that the trailer
was originally occupied by the Wilburs and the sewage system and well are health
hazzards and would have to meet code before a permit was granted. Building
Inspector Arntzen recommended denial. Councilperson Rither made a motion, seconded
by Councilperson VanderLaan that the Council go along with the Building Inspectors
recommendation and deny this request of Mr. Bergmann. Motion carried unanimously.
Attorney Hawkins stated to the Council that if this mobile home is not vacated,
it would be a criminal violation and can be acted upon immediately.
Mr. Arntzen stated to the Council that he will be entering the hospital for
treatment of his back and requested that the City Council enter into a joint
powers agreement with Anoka County for building inspection. Mr. Arntzen stated
that Dallas Felegy of the Anoka County Health Department would be doing the
building inspecting for the City of Andover in his absence, on a as needed basis.

Councilperson Holasek asked Walter Arntzen if the second two-way radio had been
installed in the snowplowing truck of Burton Kraabe12 Building Inspector Arntzen
explained that it had not, but he would take care of this matter immediately.
After discussion on traffic and street signs that have been vandalized, broken
or missing, the Council directed Building Inspector Walter Arntzen to inventory
signs in the City of Andover. Councilperson Windschitl stated that Red Oaks
and Northwoods residents are asking for speed limit signs and enforcement of them.
After discussion, it was moved by Councilperson Rither, seconded by Councilperson
Windschitl to direct the Planning and Zoning Commission to work up a recommendation
on information signs for the City of Andover. Motion carried. Councilperson
Rither moved that the City Council have the street inventory on signs available
for the first City Council meeting of January 7, 1975. Carried unanimously.
Councilperson Windschitl stated that Attorney Hawkins had not answered the question
of who would be responsible for fire bills received by the former Grow Township
up until November 11, 1974 when Grow Township became the City of Andover. Attorney
Hawkins stated those responsible could be charged or assessed only until November
11, 1974 and noted that the City is responsible for fire bills.
Engineer Kasma noted it was to the City's advantage to adopt by resolution the
Federal Aid Urban System. Engineer Kasma noted he had previously sent copies of
the resolution to the Councilpersons. It was moved by Councilperson Rither,
seconded by Councilperson Holasek that the Andover City Council adopt the Federal
Aid Urban System resolution. Motion carried. ( a copy will be permanently
attached to this set of minutes. )
The Council discussed the Engineers bill for professional services in connection
with Andover Planning services. Attorney Hawkins will review the contract and
report to the Council.
Former Grow Town Board Supervisor Marvin Christenson presented a letter of
immediate community needs to the City Council. ( a copy will be-sttaQRed to

It was moved by Councilperson Rither, seconded by Councilperson Holasek to pay
bills in the amount of $26,099.70. Motion carried. A list of these' bills paid
is on file at the Clerks Office.
It was moved by Councilperson Rither, seconded by Councilperson VanderLaan that
the meeting adjourn. Motion carried.

We are writing at the request of Mayor Schneider to review
and to make a recommendation to the City Council on the payment of a statement
from Schoell and Madson, Inc.. Consultant Engineers.
We understand that the City Council is reluctant to make payment for the
engineering services provided on the feasibility study for streets in Valley View
Estates at this time. Mayor Schneider requested that our firm review the
work done by Schoell and Madson and recommend what action should be taken
by the City Council.
To assist the Council in understanding what work was involved in this project
and similar projects, I will review a step by step procedure.
FEASIBILITY REPORT PROCEDURE
(a) The Engineer must determine what information is required to answer the
questions of the City Council and interested property owners. For this
specific project, the consultant determined it was necessary to make field
surveys consisting of centerline elevations and cross section elevations.
(b) Upon completion of the field work, it was necessary to draw the plan sheets
showing the c~nterline elevations to design a street grade and to draw the
cross section sheets to determine the amount of street excavation necessary
for the construction at the design grades.

(c) Upon completion of the street grade design, the consultant prepared
preliminary cost estimates for various types of street construction.
(d) To present the information to the Council, a plan sheet was drawn
showing the proposed projec.t area.
(e) The consultant assembled the information as a bound report and presented it
to the City Council at a public hearing.
(f) As a result of the public hearing, the consultant prepared supplemental
information and presented it to the Council and citizens at a second
meeting.

RECOMMENDED FEE SCHEDULE
The Minnesota Society of Professional Engineers has published "A Guide for
Engagement of Engineering Services" to assist in establishing a proper under-
standing of the relationship between consulting engineers and their clients.
A copy of the pages of the Schedule referred to are attached to this letter.
The preparation of the Preliminary Phase (Feasibility Report) normally accounts
for 100/0 to 300/0 of the total basic engineering services which include preliminary
phase, design phase and construction phase. (Page 6)
The preliminary contract cost estimate for the street construction was approxi-
mately $70, 000.00. Referring to the MSPE Guide for Engagement of Engineering
Services (Page 15) the basic services engineering cost should be approximately
100/0 or $7, 000. 00.
As previously noted, the Preliminary Phase normally accounts for 100/0-300/0
of the basic services engineering costs. The preliminary work accomplished on

this project consisted of field work and plans which would have been used in the
final de sign. Therefore 30% of the total engineering fee would be reasonable for th
work performed. Based on 30% of the total engineering cost, the Preliminary Pha,
would cost $2, 100.00.
With the above information as a guide, we can state that the $2,234.50
engineering statement is reasonable.
CONCL USION
Since the Town Board authorized the work done by Schoell and Madson" Inc., and
since the Town Board did not request a contract or a maximum limit on their fees,
we recommend the City Council make payment to Schoell and Madson in the
amount billed of $2, 234. 50.
The City Council must keep in mind that "a feasibility report" can be interpreted
differently by different persons and companies. For this reason, it is important
that both the Engineer and Council realize what the project should consist of before
work begins on any project.
I will review this letter report with the Council at the December 17, 1974 meeting.

SCOPE OF PROFESSIONAL ENGINEERING SERVICES
GENERAL
The engineering services performed by a Consulting Engineer may, for convenience, be
grouped into two broad categories: (1) Basic Services for a design-type project; and
... (2) Special Services. The Basic Services involved in a design-type project generally
follows a conventional pattern, while Special Servi~es vary widely in nature and scope.
The two basic categories are discussed separately in the paragraphs which follow.
BASIC SERVICES
Basic Services for a' design type project usually include a Preliminary Phase, a Design
Phase and a Construction Phase.
A. The Preliminary Phase, which normally accounts for 10% to 30% of the total
Basic Services, would includ~ the following:
1. Collection, interpretation and report on information affecting the feasibility
of proposed project, including possible alternative cost estimates.
2. Recommendations regarding feasibility.
3. Recommendations of concerned regulatory agencies.
4. Procedures for further implementation of project.
B. The Design phase, which normally accounts for 50 to 80% of the total Basic
Services would include the fOllowing:
1. Preparation' of design plans, specifications and bidding documents.
2. Estimates of construction cost.
3. Preparation of permit applications to regulatory agencies.
4. Assistance' in advertising for bids and recommendations on award of bids.

SUBJECT: CORRECTIONS TO CITY COUNCIL MINUTES
I hereby submit the following corrections to the
minutes of the Andover City Council meeting held
December 17, 1974.
Page 1 paragraph 6. It was moved by Rither, seconded
by Holasek, that in accordance with the recommendation
of the City of Andover Planning and Zoning Commission,
Reference 1074-1, a Special Use Permit be issued to allow
the operation of a dog kennel in the R-l Zoning District,
White Oaks Country Estates, Lot 10, Block 2 (Mr. and Mrs.
Gerald Prior) subject to the following restrictions:
(1) no dog shall be boarded, bred, and/or offered for sale
in any accessory building or structure on the property
and, (2) said Special Use Permit shall be valid for a period
of one year commencing December 17, 1974 and expiring

Page 2 paragraph 5 line 2. Change to read: ...the former
Chairman of the Grow Town Board . . . Underscored added.
Page 2 paragraph 6 line 4. Add the following to the motion:

Page 4 paragraph 2. Correct as follows: It was moved by
Rither, seconded by Windschitl, that the Andover Law Enforce-
ment Committee be directed to conduct a survey of the City
and make a recommendation to the City Council as to the type,
number, and location of traffic regulatory signs for the
City of Andover. It was moved by Rither, seconded by
that the Andover Planning and Zoning Commission be directed
to conduct a survey of the City and make a recommendation'
to the City Council as to the type, number, and location of
informational type signs for the City of Andover.
The first correction listed above is to clarify what was
perhaps implied but hot stated,cin that it combines the
Council's restriction and the P & Z recommendation. The
last correction clarifies one motion and adds one motion
which was omitted from the minutes entirely.
