In attendanc were; Chairman Schneider, Supervisors Christenson and Holasek, Attorney Bll Hawkins and others. Newly electe Chairman Richard Schneider called the meeting to order at 8:10 p.m. Chairman SCh eider introduced newly elected Clerk, Art Jaworski, Himself, Supervisors ChristensOn nd Holasek. Chairman Schneider noted there would be II no smoking" in the aud1:tori m. The first ag nda item, changes in Ordinance #10, was tabled because copies of the changes were not in the hands of all Supervisors. Chairman Schneider noted this , would be han led at the next Regular Town Meeting, the second Tuesday in May. Minor discus ion insued with the Chairman Schneider explaining that one section requiring an land subdivided under 20 acres be platted, had nothing to do with the Comprehe sive Plan. Attorney Hawkins pointed out, no pu~c.hearing is required to change th platting Ordinance #10. The next age da item, adoption of Ordinance 119, an Ordinance amending Ordinance #15, relatin to the adoption of the Minnesota-Building Code byre;ference was- ,,,' re~-in it'. entirety by Chairman Schneider. Chairman Schneider weùt on to explain, - this is some hing we must do to be in compliance with state law. No further discussion. Chairman Schneider asked for a motiQÐ4 with Supervisor Christenson --' moving we ad pt Ordinance #19 as worded. Second by Supervisor Holasek, Motion carried unan usly. A copy of Ordinance'#19 will be kept with thes_minutes. Third agenda item, a petition from Red Oaks Manor, 139th and 140th Avenues, was brought to 1 ghtby Chairman Schneider, who asked spokeswoman, 'Mrs. Lillian Adkins, what their p oblem was. Mrs. Adkins went on to read the heading on the petition; We thepeopl of Red Oaks Manor, would like an engineers study done on th. collective s eets o,f 139th Av,nue and 140th Avenue, to find a temporary c!:1;' permanent solut,iÓD due to the following reasons: 1. es of precipitation during the Spring, Summer and Fall, the above ment oned streets break up an deteriorate and it is usually a few days befo e the grader comes to grade. 2. When the above mentioned streets are dry and there is a wind, the sand of t ese streets is blown all around. Not only does the sand blow on the aWDs,'heavily but also into the homes. 3. The onstant deterioration of these above mentioned streets cost us mane due to the rough treatment on our cars. Mrs. Adkins p esented the petition to the Clerk Jaworski., Generàl discussion insuedwith M s. Adkins going into detail. She explained, there are 160 homes in Red Oaks, wit l570ccupied. In discussion with Chairman Schneider, &he pointed ~ out they waul like an engineers study done with some alternatives to blacktop .~ being present d. The people in the area felt blacktop before sewer and water would be unca led for. At this point, Ed Erickson entered into the discussion with ,road pro lems from Valley View, 172nd and Woodbine. ',Minutes - Apri 9, 1974 Page 2 Lillian Adkins was asked by Attorney Hawkins, 1£ they were petitioning to have the roads worked 0 under general road funds or expected to be assessed back. Mrs. Adkins noted, they we e petitioning for an answer to solving the problsm first, then a decision on h it would be handled with the citizens of Red Oaks participating in the final ded ion. Discussion continued with Lauren Anderson. real estate appraiser stating, he ha never traveled roads in worse condition. Jerry Shermer, John Bonicer, Roland Fostand Randy Adkins joining in. James Conroy of Red Oak. added, they should add another en ranee to the area, this would cut down traffic on thesa two streets. Chairman Schne der noted, the Township has never bought any land for roads, we usually accept them fr m the developer. Supervisor Holasek noted, a study was done on this aree last Spri g, with storm sewer, an'alternative to some of the problem. He noted, there is only t certain times, usually after a rain, that grading does 8111 good. Discussion ins ed on hard surface with S11 Adkins again noting, they were not asking for blacktop. Chairman Schneider noted the questioning was gettingrepeti~ious and he would take ne more. Supervisor Holasek noted, a new proéessuSingc1nders¡;àrio clay was u.ed n some roads in other Townships. Ron Buckhouse stated ha would like to sée what th Engineer would present for alternatives. More disêussion insued on alternate ways to get out of Red Oaks. Chairman Schneider notéd ,''*hen Engineers reviewal was r ady, the Board would contact Mrs. Adkins, SO she could get out her troops. I , At this point, Chairman Schneider brought the Itlenk Addition, "Valley View .states," back'to the fl r. Ed Erickson noted that the school bus WO\Jld not come in and the ma11 was left t the blacktop. He noted, all they wanted were passable roads and access to thei property. Attorney Hawkins noted, this was uniquesftuation, which - in all probabi ity will never happen again. Mr. Erickson and Attorney Hawkins discu88ed ~ the problem at length. Mr. Erickson stated, the roads were only plowed once this Winter and wer not yet graded this year. Al Westberg pointed this out also. Supervisor Holasek said r cords on grading were kept and that he would check to1see if for some reason, this a ea was over-looked. At this point, Fred Walz of Red Oaks asked for a , motion on thei road problem. Chairman Schneider noted, it would be 'in the minutes ~! and this would be sufficient. Ron Buckhouse of Quinn, in Red Oaks asked 1£ it was possible to ge the state or county to work on the roads. Supervisor Holasek noted that 1£ we wer incorporated, we would be eligible for state'aid funds within a year, possibly $60, o per year, but also noted these funds would have to be used on specific ",roads. Next item on t e agenda was, CrÛl8oncross Itennels. Dan Brwin,represenUng with anew contract. Thi was tabled, because the Board had not reviewed the nèw proposed contract. Chairman Schne der proposed this matter be tablad, unt11 next month lÌo the Board and the Attorney c uld review the changes and react to thsm. The Clerk would pull copies of Ordinance I for the Supervisors, so they could up-date, to c~ in line with new charges. Supe isor Christenson agreed. Next ,on the ag nda was revision of røad procedures. After minor discussion with all Supervisors pa tic:ipating, Chairman Schneider noted all calls 'should 'go to Town Hall with the Deput Clerk, then passing them on to Supervisor Christenson. Discussion ins ed on Road Mainteqøc~ Contract with Supervisor Holas_ noting we might want to .parate maintenance from blading. Attornay Hawkins.tated he had a contract put t gether by the Bngineer that the SUparvisors should study, before making .- a decision. Roger Funk noted he lived on one of these roads and would like to keep it private. ere is pressure for the Township to issue permits on this private road, just off Ward ake Drive. Attorney Hawkins noted we would go by the Ordinance which statea, buildi g permits would be issued only on lots fronting a public right-of-way. He noted we co ld be presently in the process of bdng challenged on this in court. Chairman Schne der noted they could ask for a variance to build, but noted it would set a aangerou presidence and chances for a variance would be slim. lten,Orr entered discussion wit question of "why did they have street address on road, if it was not a public road? Supervisor Christenson uQted, they had to address each resideøce and if the roa was accepted, tbis addreu,.would be,tbe same. Supervisor Holasek again reiterat d, we shogld stand on policy. At this time, Sherri Heidleber'ger interrupted di cussion with their old, cancelled building pe~it problem. Attorney Hawkins implie , if she moved out illegally placed trailer hoùse,the Township WQuld issue building permit, because of their timing and because of their persona], problems , they should no be cJenied the right to build. Building Inspector. Wally AJ:!.1tzen objected noting theywo ld have to tàke out new peQDit. He a:lso noted they'haves...problem---- as other peopl , with no frontage on public right~"f-way. Jerry Menge~kok noted, thatth~e are areas in Grow that North Central Public Service witl not Serve. Mr. Menglekok oted, he worked for a Gas Company himself andtheÝ,s'~em to serve who they want, whe they have an obligation to serve all the public. The Town oard of the Township of Grow, Minnesota, does ordain: SECTION 1. The Grow Town Board hereby adopts by reference the following appendixes, annexes and supplemental provision of the Minnesota State Building Code: 1) State Building Code Appendixes A, D, E and F. 2) 1973 Uniform Building Code Appendixes - Chapters 15, 13, 38, 48, 49, 51, 57 and 70. 3) Minnesota Plumbipg Code Appendixes A, C, Df E and F. 4) Minnesota Flood Proofing Regulations, Section 201.2 ~ through 208.2. ''-" SECTION 2. Group J buildings and structures shall not be used or occupied until the administrative authority ha~ issued a Certifi ate of Occupancy in accordance with the provisiops governing any such issuance currently in effect. - SECTION 3.
