Anoka, Minnesota 55303 A Special meeting of the Grow Township Board of Supervisors met May 4,1971 at the Crooked Lake School. Chairman Appleby called the meeting to order at 9:50P.M. with Supervisors Schneider and Winner present. The meeting was called to order to act on the variances on the Bob Chapman plat and the Gilbert Menkveld plat. Supervisor Schneider moved to accept the variance on the Bob ,Chapman plat. The Planning and Zoning Commission had voted in favor of it already. Supervisor Winner requested to abstain ! from voting, because he did the plating. Chairman Appleby seconded the motion on the Chapman plat and it was passed. ChairmanAppleby moved to accept the Gilbert Menkveld variance. Supervisor Winner abstained from voting, stating he didn't feel right on voting on these variances because he platted them. Supervisor Schneider seconded Chairman Appleby's motion. After much discussion the motion was passed and the variance granted. Supervisor Schneider made a motion to adjourn the meeting at 10:40P.M. Supervisor Winner seconded. Meeting adjourned. Anoka, Minnesota 55303 The regular monthly meeting of the Grow Township Board of Super- visors met Tuesday, May 11, 1971 at the Crooked Lake School. Chair- man Appleby called the meeting to order at 8:05 p.m. vdth Supervisor Schneider present. Supervisor Winner arrived later. Zoning and Planning Commission members Bradley, Christenson, , Holsek, Rither and Stout were present and Attorney Dick Beens. The treasurer gave a brief financial statement. Mrs. Bjorklund asked if Special meetings are published. 11r. Beens stated that the law says only annual to\Vll meetings be published. Supervisor Schneide~ stated that work has started on the play-' grounds. ~~~~ Chairman Appleby said would clean up the roads for $10 . Prairie Road. Coon Creek Drive. Supervisor Schneider made a motion that we hire . Supervisor Winner seconded. it was passed. }~. Beens said that }~. Roach and }~. Heidlèerger met vdth ~æ. Babcock on the junk yard ordinance and some changes were made. Copies vdll be sent to the Zoning and Planning Commission and the Town Board and they may be able to act next month. Carl Vagness of the Springsted Company spoke with Chairman Appleby in regards to being the financial represenative for the bonding of sewers if they come in. It was brought up that we do not have an assessor. Chairman Appleby vdll check and see if we can double up with the Ramsey Township assessor. pæ. Rither suggested we contract vdth the County to do our assessing. According to Bither they have his house on record as 26t x 28t. The County Assessor was surprized at the mistakes. The county feels we should raize our taxes 10-05%. Supervisor Winner and Chairman Appleby were strmngly opposed to the County doing the assessing. 11r. F~edlberger doesn't want the same one we had. }~. Christenson suggested we examine both alternatives, at least someone who can add and subtract. The coúnty contracts for $3000 per year and the township contracts is not to exceed $1500 per year. Chairman Appleby stated that a petition had been presented to restructure the Plannign and Zoning Commission. Chairman Appleby read the following resolution. "Planning and Zoning Board members to be appointed by the Tovm Board at their organizational meeting. There shall be two members appointed each year as their times expire. There shall be a (5) five member board plus 1 alternate 2ho shall be called by the Planning and Zoning chairman if and when a regular member cannot be present at a meaning. Compensation for Planning and Zoning members will be set by the Tovm Board. Ydnutes of the Planning and Zoning Board Shall be taken by the tovm clerk. Clerk shall keep minutes on record and furnish one copy to the chairman of the Planning and Zoning Board." ,- ~age 2 ;jay 11,1971 Yæ. Beens stated that we are a Township with Village powers as es~ tablished in Statute 366.17. Chapter 462 states that we may create a board by an ordinance. We could have a platting authority set up by an ordinance and could change it and have more power. They could handle the picky' things as variances, plats, etc. He said further that the board is legal as it is. We can have as many or as few as we want. Supervisor Winner asked if we should wait to see how the incorporation procedures are coming. Chairman Appleby said they would recognize the petition and file. }æs Bjorklund asked if there was a personal feud with people on the commission with only 35 names on the petition. Superivsor Schneider made a motion that we table the petition for 6 months. Supervisor Winner seconded and it was passed. Supervisor Schnedier said we had a very successful rabies clinic on May 5 and that we have scheduled a second one on the 19th of May from 6 to 8P.M. Next was the plat of Oak Ridge Manor from 161st on north. Six members of the Zoning and Planning Commission voted in favor. Mr. Stout stated that there is a swamp in between the Wallenbecker and Menkveld property. Mr. Wallen becker said he would grant an easement to Vœ. Menkveld, and he had 2 lots to pick from. One lot is in a low area; lot 29, block 3 or the culdasac on 158th. ,Supervisor Winner made a motion that we accept the plat of Oak Ridge Manor, vdth the stipmlation that l1r. Wallenbecker grant an easement to }æ. Menkveld for a road on 10t29, block 3 to the Menkveld property. Supervisor SchneidÐÐ seconded, and it was passed. pr21iminary Next on the adjenda was the La.vrence Carlson1plat. Zoning and Planning Commission had voted 4 yes and 2 no in favor of the preliminary plat. Chairman Appleby asked who voted no? Hr. Rither sàated that some of the lot sizes do not conform. }æ. Ed Boos said that Winner should not be on the board and neither should the carpenter. It was found that 16 of the 35 lots do not conform. Chairman Appleby asked if building permits would be held up? Hr. Beens said that it should be redesigned right from the top and avoid legal problems. }œ. Beens aaid further that we should stick by the ordinance for every time you stray you weaken the ordinanee. It would be best to hold up on the preliminary plat. H }æ. Carlson feels this is the only way to plat, what would he do? Rezone to R2. Supervisor Winner stated that he ImoVIX Hr. Carlson is opposed to any major change. Trueman Hulegaard said the road is laid out for the land and the houses are set for higher ground. He stated that we do not have a lot of choice property left or for sale in Grow Township. He asked if the lots are 330 feet frontage, would it be approved? The plat has already been held up one year. Chairman Appleby said he would = rather see it redravm. Supervisor Schneider moved we not accept the plat until it is redrawn. Chairman Appleby seconded and it passed. Supervisor Winner abstained from voting. We recieved a letter from the Village of Lino Lakes. They would like us to sign a resolution against having the chain of lakes condemned and also a Metro Park Commission. A Metro Par Commission could rule over a Township and not a Village. Chairman Appleby said he was a~ainst having them dictate to us. Vœ. Holasek said he would like to ~ee the Council monster stopped before it takes over everything. · ¢+ page 3 Nay 11,1971 The Council should be advisory only and make the monies available'to Townships and Villages. Supervisor Winner made a motion to sign the resolution and sent copies to our representative and state senator, adopting the same provisions as Lino Lakes. Supervisor Schneider seconded and it passed. Next was the resignation of Supervisor Winner. Chairman Appleby said we would accept his resignation in 30 days when we find someone to fill the vacancy. . Mr. Beens said that Statute 367.02 states that the position vdll be filled by appointing someone to the position until the next Annual Town Meeting in March, and at that time we vdll elect 2 Supervisors. There vdll be 1 for 1 year, and 1 for 3 years. The 2 remaining Supervisors and the clerk will vote on a new Supervisor. Attorney John King presented a petition to recind the var- iance granted at the Special meeting on May 4 1971. There were a large number of lots on the variances. There are provisions for enforcement. He could go to the County Attorney and stop this nibbling at the ordinance. If a builder is in violation of non-conforming, the building inspector should be kept from granting permits. If we have a precedent of being to harsh or lenient we should conform with the ordinance. Every house should be measured and checked. There should be a responsive body in hhe village and instead of 3 have 5. Not have things crammed down our throats as Sanitary Districts and the Metro Council. Rosella Sonsteby asked if the people had a chance to vote on the Zoning ~Ddinance--heck no a few people pushed it through. Earlier }~. King Hadshowed copiesof building permits belonging to }~. Nash. Chairman Appleby asked if he took them and made the copies? How did he get them? Supervisor Scnheider read from the minutes of a Special meeting on October 21,197œ. "After much discussion of the new zoning map and ordinance, Supervisor Winner moved to accept the ordinance and map as recommended by the Planning and Zoning Commission, adding provision granting those who have preliminary plats already submitted to have one year from the date of this ordiance to file the final plat. Winner and Appleby in favor, Schneider against. It was s~conded and passed." }~. Holasek asked what is a preliminary plat? Šupervisor schneider said if he is wrong he'll take the punishment. Attorney McPherson said the ordinance is inflexible and prejudiced. He presented a petition signed by members of the com- muni ty. He said we are right in assuming the house size. In the , / ordinance the definition of basement refers to a garage. The planner recommends an outhouse to be fair. We need to show a business district for incorporation. There is no district and no plan-therefore we vdll have a long wait. He would welcome intervention in the law suit and recind a variance. Attorney King is not against variances. If he is not against, why reconsider there are many proper cases. Jean Nelson stated that individuals make up the Township and they elected the TownBoard. Supervisor Schneider would like the reaction of Winner and , page 4 May 11,1971 Appleby. Supervisor Winner said that the deeds were deeds if record are entitled to permits. Chairman Appleby stated that the amendment would take care of this and he would like to see it passed. }!rs. Bjorkland asked how many lots are involved? Already there are 133 on the Menkveld variance. Mr. Blesi asked how it affects him. Mr. Menkveld said hhe resords were lost from July to September. Mr. Rither said he would like to correct }!r. Menkveld~-Zoning and Planning did not keep a record until ~ovember 24,1970 when he began taking minutes. Supervisor Schneider said he was doing a good job. Chairman Appleby felt the Board did right and would not recind the variance. }!r. Beens said the problem presented a good number of lots to individuals and there are 4 possibilities: 1. We could do nothing; 2. rezone as laid out; 3. amend the grandfather clause, the 60% provision; or 4. variance- but it doesn't say 1 or how many can be on 1 variance. Rezoning and the grandfather clause are legally safe. Supervisor Schneider made a motion we accept the Preliminary Comprehensive Sewer Study, by Tri-State Engineering, Inc. Supervisor Winne~seconded and it passed. Hr. Heidlberger asked Supervisor Schneider where the building permit is posted for the house he is building? Supervisor Schnèèder said it was on the utility pole next to the house. }!r. Fleishner stated that there is a restrictive code in the area, and would the Board consider revievång the code våth professional help, and the possibility of revising it. !'!r. Rither stated tha hhe Building and Zoning Ordinances are based on the Federal Ordinance. }!r. Fleishner said a consultant would agree if ours is correct and he is a credited consultant. }!r. Wick cited the verbal abuse taken by the Zoning and Plan- ning Commission and the Tovm Board. If anyone thinks the job is so easy why aren't they up there. Anoka, Minnesota 55303 A.Special meeting of the Grow Tovmship Board of Supervisors met May 18,1971 at the Crooked Lake School. l1eeting was called to order at 9:20 P.M. follovring the Zoning and Planning Commission meeting. Chairman Appleby and Supervisors Winner and Schneider present. Supervisor Schneidàr made a motion to grant a variance to Joseph T. Faubert to divide his land in hhlf to build a house. ~ Supervisor Winner seconded and it passed.~, /.,ad-~< <.. ~~~' Supervisor Winner made a motion to grant a v~riance to Harland P. Nelson on property described as lot 4 Supervisor Schneider seconded and it passed. Supervisor Schneider made a motion granting a variance to Lester L. Corrow to build a garage. It was recommended by the Zoning and Planning Commission that he use fireproof siding. Supervisor Winner seconded. It passed. Chairman Appleby presented the Beer License for Steve Nemeth. Supervisor Winner asked if we had ever had any trouble at his place? No. Supervisor Schneider made a,motion to grant the license and Superviso r Winner seconded. It was passed. Chairman Appleby stated that the gopher bounty fund is getting low. Supervisor Schneider made a motion to put in $200. Supervisor Winner seconded and it passed. Next Lawrence Carlson appeared before the board to defend' himself, and give his side after the Tovm Board had rejected his preliminary plat. A variance was filed and a fee presented to the clerk.. On that night }æ. Rither said ~t appeared to be okay. :Hr. Carlson said he felt it was decietful of Xìm them to do this. He is trying to work around the land. The road is approximately 1501 over from where N.H.C. had the street platted. He had some test holes dug and it was found that thelow land would be better. He asked the plat be approved as is by the variance. He s:l1:11àed that Otto Schmid said that this is a good plat and the only way. Supervisor Schneider would like to see an easement for a raod across the property somewhere. There vrill be building restrictions on the deed to keep it nice. Supervisor Schnèider said that some of the lots could have their frontage on the county ~d and that would be big enough. Supervisor Schneider made a,motion to grant a variance and accept the plat, because of the variance. Supervisor Winner abstained from voting and Chairman Appleby seconded. It was passed. Next was voting for a Supervisor to Fill Supervisor Winner's post. Nominations were: Don Wick, Lawrence Carlson, Gerald Windschitl, Lyle Bradly and Jim Moen. Yœ. Carlson said he felt he should with- draw his na~e because he develops land. Mr. Menkveld told him to leave it on. Hr. Chairman Appleby told him that the developer usually puts them in. He heard that ather tovms are putting them in and we figured we could too. Supervisor Schneider vdll check vdth Ramsey and Ham Lake to see if they do. Supervisor Winner made a motion that we adjoùrn and Super- visor Schneider seconded. Meeting adjqurned at 10:22P.M.
