A Special meeting of the Grow Township Board of Supervisors met
April 2,1971 at the Crooked Lake School. Chairman Louis Appleby
called the meeting to order at 7:49p.m. Supervisors Richard Schneider
and LeRoy Winner present.
Supervisor Winner made a motion that we publish a notice for a
Public Hearing for Odinance 9 Town of Grow, which is an amendment
to Ordinance ,Section 4.04(A) in the Anoka County Union.
Seconded by Superviosr Schneider.
It is seconded and passed that we take action to publish the notice
of the afore mentioned hearing.
Hearing date to be April 19,1971. The Board of Supervisors will meet
after the hearing to act on the amendment.
Supervisor Schneider mentioned that he takKed with Doctor Annenberg
on a date for the rabies clinic and the east. They agreed to a week
night and the approximate cost would be $3.00 for the shot and then
the cost of the new liscense and a fee for the clerk for making
out the liscenses. Time to be set at the next Board of Supervisors
meeting April 13,1971. Will hold clinic at the Andover Club House.
Clerk asked if the check she is holding for a variance filed by
Lynne and Douglas Bonde should be returned. Board of Supervisors
felt it should be. Variance may not be required if the amendment
is passed. Clerk will mail back and inform them of the Public
Hearing on April 19, 1971.
Chairman Appleby mentioned that he would like to see the portion
of Grow Township south of County 20 rezoned to 1 acre lots.
Supervisor Winner stated that he would be against it. It was decided
to let the matter wait until after the public hearing, and for a period
of about 6 months.
Chairman Appleby mentioned buying culverts for E. V. Builders and
selling the culverts back to them (E.V. Builders).
Clerk asked about holding check from Gilbert Menkveldt for the
Variance he filed. Clerk will hold until after the public hearing.
Moved by Supervisor Schneider to adjourn at 8:25p.m. Seconded by
Supervisor Winner. Meeting adjourned.

The regular monthly meeting of .the Grow Township Board of
Supervisors was held April 13,1971 at Crooked Lake School. Chairman
Louis Appleby called the meeting to order at 8:05P.M. with Supervisors
Schneider, Winner, Treasurer Eveland, Zoning Commission members Jones
Stout, Ri ther, Christenson, Holasek, Building Inspector Langseth, and
Attorney Bhbcock present. }linutes of the February 9,1971 meeting
were read and approved. The treasurer gave a brief financial report.
With regard to the question of the effluent dumped on Ed Fields
property by a cesspool cleaner. It was stated that he will plow it under.
Robert Rither has been corresponding with Dick Swanson, University
Extension Agent. It was found that this is not an approved method of
taking care of the problem. Hr. Rither and Mr. Swanson will see that
it is taken care of properly.
Chairman Appleby stated that the Attorney has started
incorporation procedures. Hr. Babcock agreed that now is hhe time to
do it, but he has not started yet.
Supervisor Schneider said that the money is available for
road and playground work. On the bids for òlading, they were as follows:
Trueman Hulegaard $13 per hour; Myron Roseland $11.50 per hour;
Harold Thompson $11 per hour. Supervisor Schneider made a motion that
Harold Thompson get the bid for blading, and Supervisor Winner seconded.
It was passed. We have no bids on the playgrounds as yet. The Township
would like to build a skating rink behind Crooked Lake School, and the
school would X±kE furnish the land.
Chairman Appleby presented a bill for Grow Township from
Coon Rpaids for our portion on the swimming lessons last summer.
There is a $3.00 fee for non-residents. There were 32 children who
participated and the bill is $32. Supervisor Schneider made a motion
to provide the same servise as last year. Supervisor Winner seconded.
It Vias passed.
It Vias questioned if we could deputize the dog catcher so he
may give citations for a dog running lose. Hr. Babcock stated that all
he has to do is follow the dog L~iHg home and he may issue a tag.
He does not have to be deputized.

Chairman Appleby stated that there is an old car and motor,
litter and other debris on Coon Creek Drive. Trueman Hulegaard got some
names and Chairman Appleby and Sheriff Talbot checked 'the names. Chairman
Appleby mentioned offering a $100 reward. Cecil Heidlberger said that
the dump is closed so they dumþ anywhere. Winslow Holasek said there are
some card along Prarie Road. Mr. Heidlberger said if they bring tires
they charge 25¢ each to dump, so people leave them on their trailer and
dump along the road. Dick Hand said about 1 month ago they charged him
25¢ a tire. Grow residents are supposed to dump free. Dump owner has
permits to issue to residents. Don Boeke said that Jay Street between
131 and Bunker Lake Blvd. is a bad situation. Does the $100 fine for
littering on County and State roads apply to the ~ownship? Nr. Babcock
said we could draw up a simple ordinance for litter. Supervisor Schneider
questioned if we would post signs? Yes, at the Township lines.
Supervisor Schneider said we wpuld be having a rabies clinic
the first part of Nay. It was decided that the clinic would be held on
May 5,1971 from 6:00P.M. to 9:00P.M. at the Andover Club House. Clerk
will post notice in the Shopper and Union.
Playgrmunds were brought up again. There are areas in Red oaks
Manor, Northwoods, and 2 in Cedar Crest. Supervisor Schneider will check
with someone to start on a couple and level them and install a backstop.
Dick Hand presented the final plat of Shady Y~oll. The Zoning
Commission approved it 1 year or more xggmx ago. Chairman Appleby asked
if he had taken care of the road? Yes. Supervisor Schneider made a
motion to accept the plat. Chairman Appleby seconded. It was passed.
Supervisor Winner wished it noted that he aPstained from votin g. It
was so recorded.
Next on the adjenda was the junk yard ordinance. )ÝJI' . Babcock
read the ordinance, which is the proposed revised copy. Attorney Pat
Roach of Weaver, Talle, Herrick was there representing Heidlberger,
Badson, Jellison. He felt that it was more lengthy than necessafy.
He felt it should include name, address, and land. He said that principle
items as a complete enclosure would be taxing on the people involved.

He felt it should reauire fencing on a public street or township highway,
or any portion abutting a residence. In regards to enforcement, he felt
they were less precise than they should be. It was suggested to have
a permanent inspection team of the Building Inspector, Supervisors, and
some from the Planning and Zoning Commission. The same team shanld
inspect all yards. 11r. Roach, Supervisors, and Zoning Commission members
will meet at 7:00P.M. on April 20,1971.
The floor was open for new business. Don Lenrox asked ifi
there was anything that could be done about the vandalism on 159th?
Mr. Babcock spoke to the Sheriff about the problem. They plan to make
1 regular run a night and maybe 2. We can hire Trueman Hulegaard to
pa trol. Mr. Hulegaard was unaware of the problem. He asked that they
call him first if there is any trouble. Larry Stenquist stated that
with our population being close to 4,000 why not have our own car? It
was stated that it would cost $80,000 to $90,000 a year for 1 car 24.

It won't be cheap! fT. Holasek felt it is needed.
11r. Babcock asked if the addition to Soley's Road had been deeded
to the Township? Clerk checked the minutes if SDecember 10,1 !P68 and
found it had, but had not been signed.
There being no other business Supervisor Winner made a motion
that the meeting ad~ourn. Supervisor Schneider seconded. Neeting
adjourned at 9:35P.M.
The meeting was reconveened at 9:37P.M. by Chairman Appleby.
A motion was made by Supervisor Schneider and seconded by Supervisor
Winner granting permission to the Carslyle Company, to connect an 80
acre deve+opement in Grow Township to the existing public sewer. It
was passed. Supervisor Winner moved we adjourn and Supervisor Schneider
seconded. Meeting adjourned at 9:40P.M.

A special meeting of the Zoning and Planning Commìssion ~as held on
Aprìl 20, 1971. The meeting was called to order at 11:00P.M. All
members of Planning and Zoning were present as well as' the To\'1Il
Board.
Under discussion was the variance filed by E. E. Builders. The
reason the variance was fìled was the area in question is zoned R2
and requires 165 foot frontage and most of the lots are 150 foot
frontage. Also a problem with the square footage in some of the
homes.
Attorney Babcock read the definition of basement, cellar and floor
space as stated in the Zoning Ordinance. This matter was brought to
the attention of the Attorney about 10 days ago. He questioned the
Building Inspector (Harold Langseth) on what he uses as floor space
in a splÈt entry? Langseth has counted a split entry as half of the
ground floor and all of the above floor for square footage. He ste.ted
that it is a common practice.
Babcock stated that we have an emergency situation. Their construction
\'Jas shut dovlD. April 20,1971 for not complying \1Ìth front footage.
He would l~~e to see action taken tonight on the footage situation.
The square footage problem and the number of structures under con-
struction are worth a large amount of money. The To\>'Il Board has had
a large part in getting the builder in the position he is in. We either
eli~inate basement from the ordinance" or use the amendment process.
Would like the Zoning and Planning Commìssion to recommend to the
To\'1D. Board tonight on the buildings under construction. Some disG:'Gs-
sion should be exercised. Supervisor Schneider asked if there could
be a divided decision? Yes. Jim ND$h asked if those under construct-
ion should be considered. Al ~ùlton said there are approximately 35
footings poured and those that are sold have June 1,1971 possession.
Hr. 11cPherson said any lots \1Ìth ground not broken vIII wait until
later. It WaG questioned how many homes are needed? Ken said he
needed them all worse than ever. Jim Nash asked why not change the
style of some? Ken - its his business. McPherson suggested a talk
\'~th realtors for ideas.
There are 2 matters under consideration at this point:
1. 'variance on front footage
2. square footage.
Supervisor Winner questioned if the houses under construction could
be modified. Jones asked about adding a garage? Most of the homes
are sold and cannot be changed. 1-1ary MacGregor said we have seen no
evidence that they are sold. Ken stated that 80% are sold. The homes
were tagged at noon today and ¥~y MacGregor said they were still
working this afternoon.

Chairman Stout read a 'Dortion of the minutes of the Zoning and
Plannign Commission meeting on November 24, 1970.
James Conroy and John Wallenbecker presented a preliminary plat
(metes bounds) described as a line within that part of swt of Section17,
T.32., R.24 also known as Oak Ridge Manor Anoka County, Hinnesota.
Subjects 1'11; is located in R1 zoning district. D-lscussion was held :E:
regarding lot sizes within the proposed sub division. It WÐ.S brought
out that several of the lots do not meet the requirements of the
zoning regulations ordinance while many exceed requirements. Petitioner
stated that homes have already been constructed in the area and that
additmonal construction was under way or completed. Chairman Stout
explained the requirements of the R2 zoning district classification
and asked the petitioner if he would agree to rezoning the area, from
R1 to R2? The Commmssion felt due to the natural features lot sizes
and type housing proposed, R2 zoning would be appropriate. Vlallenbecker
stated that R2 zon:ing district class VTould be acceptable. Hoved by
Jones and seconded by Langseth to rezone that part of Grow Township
described as lying vrlthin that part of swi of Section 17, T.32, R.2lf
Oak Ridge Manor Anoka County. Hinnesp,ta. from R1 Single Family Rural
District to R2 Single Family Estate 'District. There was no mention
made to change lot size.
Holasek saw no reason not to grant the variance from 165' to 150'.
November 24 was the first step. January 1 was the second step ÐL~d
superceeded November 24.
Babcock stated that if we spot zone, in the lanG run it r~ll weaken
the ordinance and we \'lill have chaotic conditions. It is his opinion
that it does not fall in line \'lith the ordinance. 1D.ter on we would
hear, if you did it for E.V. Builders why not for me? In effect it
would weaken the ordinance. Holasek asked how many lots? Appro:::¡~-
iDatel;¡' 45. Holasel: made a motion to grant the variance from 165'
to 150'. Jones seconded. Christenson asked if we Get a chance to
discuss this? Christenson asked specifically what lots south of
161st? Jim Nash does not want his property included in the petition.
Then take all into consideration except the Nash property. Holasek
\'ì.i thdreu his prev-lous motion. Chairman stout asked for any motion.
If the Toun Board and Zoning And Planning Commission see fit to increase
the sost ~~ the variance the court won't say that $25 is not enough.
They may act on the wgole plat.
Jones is in favor. but does not know how to word it. Babcock suggested
putt~nc it in this form: The Plan.~ng and Zo~~g Commission recommends
to ,the Torm Board approval of the variance relating to the front
footage on lots in Section17, requested by E.V. Builders on April 20.1971.
Jones made the motion e.nd Langseth seconded. All were in favor.
BradJ..ey asked if the lots that aren't started could have their frontaGe
increased? Wallenbecker stateà that they are scattered and its alßost
impossible. 90% of the utilities are in- electrical and bur-led tele-
phone.
Christenson questioned which lots were built on? Shouli a variance
be Granted on a slough? One lot #19, block 3 next to Nash property.

Wallenbe'ßker said it was worthless and would sell it for $100.
Nash saiá he would buy it for $100. Jones asked if 15 feet meant that
much? Christenson said tb leave out lot 19, block 3 meaning not to
grant a variance and not a buildable lot. Chairman Stout stated that
it was unanimous only for frontage. Should the Planning and Zoning
at this time make a recommendation to the ~own Board. No clear path
to recommend. Special use permit does not cover this situation.
An amendment would. The Town Board may stop construction cold.
Cease issuing permits until the ordinance is changed. Should cOnst-
ruction continue from a certain point or if they should stop.
Babcock said they should tie it to some level of construction.
Blocks, studs, or whatever. It was asked what the cost would be to
expand 1 house to code? Approximately $3000.
Babcock said the builder should be able to continue from some level of
construction. All homes that have not reached that stage as stated
could be considered as individual cases. Try to avoid liabilities
vdth purchase agreements, if possible. Appleby suggested stopping any-
thing below the basement, and go on from there. Christenson said no
matter what level we choose, we'll run into a contract. People have
a contract with E.V. Builders and they would be liable, and they in
turn would file a counter claim and name the Tovm of Grov.
Appleby asked how many there are from the top of the basemen~ on up?
McPherson said 1 with only the footings poured and 6 with blocks up
and are sold.
Bradley made a motion to proceed on all structures from the blocks
laid on up until the problem is solved, provided houses have been sold
by the builder to a bonafied purchaser prio~ to April 20,1971.
Jones seconded. P~ther and Christenson voted NO; Jones, Langseth
and Bradley YES: Holasek abstained. Lot 22 block 3 is the only house
to stop. (WILL SUBMIT COPIES OF THE PURCHASE AGREEMElrrS TO CLERK)
What is the reaction of Nash and Mac Gregor? Nash -there us no issue
you can get together on and we couldnmt accept that. It was stated that
}lidwest Planning disapproves of 2~ acre homesites.
~ Gilbert Menkveld asked when they would work on his variance.
***The Town 30ard acted on the Recommendation from the Planning and Zoning
Commission. Supervisor Winner made a motion to accept both the variance
and front footage. Supervisor Schneider se~nded. It was passed.
Supervisor Schneider made a motion to adjourn. Winner seconded.

Holasek made a motion to adjourn. Christenson seconded.
