REQUEST
The Planning and zoning Commission at its regular meeting on
June 22, 1993, reviewed the request for a lot split by Lynn and
Milton Mardaus on the property located at 13350 Hanson
Boulevard NW. The applicant is requesting to split a .88 acre
(38,500 s.f.) parcel from a 2.87 acre parcel. Both parcels will
meet or exceed the minimum requirements of the R-4, Single Family
Urban zoning district.

the minutes from the Planning and zoning Commission meeting for
further information.
RECOMMENDATION
The Planning and zoning Commission recommends approval of the lot
split request with conditions as indicated on the attached
Resolution.

A RESOLUTION GRANTING THE LOT SPLIT REQUEST OF MARILYN AND
MILTON MARDAUS TO CREATE TWO (2) PARCELS PURSUANT TO ORDINANCE NO.
40.
WHEREAS, Marilyn and Milton Mardaus have requested a lot
split to create two parcels on the property located at 13350
Hanson Boulevard NW, legally described as follows:
That part of Lot 10, Watt's Garden Acres in Grow Township,
Anoka county, Minnesota lying westerly of the East 385 feet of
said lot; Also Except Roads; subject to Easements of Record; and
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance No. 40; and

WHEREAS, the Planning and zoning Commission finds the
request is consistent with the Comprehensive plan and would not
have a detrimental effect upon the health, safety, morals and
general welfare of the City of Andover; and
WHEREAS, a public hearing was held and there was no
opposition to said request; and
WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the lot split as requested.
NOW, THEREFORE, BE IT RESOLVED, that the city council of
the City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission to allow the lot split on said
property with the following conditions:
1. That the applicant pay park dedication fees pursuant to
Ordinance No. 10, Section 9.07.10.
2. That the lot split is subject to a sunset clause as
defined in Ordinance No. 40, Section III(E).
Adopted by the City Council of the city of Andover on this
20th day of July, 1993.

DISCUSSION: Commissioner Squires did have a concern about the City
owning all these little ponds in fee. He thought the City has an
interest to acquire to the extent it needs the property for drainage
purposes, and he didn't see any reason that the City should acquire an
interest more than it needs and is generated by the surrounding
developments. Commissioner Apel argued it is a regional pond designed
under the auspices of the Coon Creek Watershed and is quite a bit
different than meeting the needs in the plat. Mr. Haas repeated the
Water Resources Management Plan requires the developer to provide or
design ultimately for the entire area as if he is the first one there.
VOTE ON MOTION: Carried unanimously. This will be on the July 20,
1993, City Council Agenda for their consideration. 8:25 p.m.
PUBLIC HEARING: LOT SPLIT - 13350 HANSON BOULEVARD NW, MARDAUS

8:25 P.M. Mr. Carlberg reviewed the proposed lot split of Marilyn and
Milton Mardaus to subdivide .88 acres from a 2.87-acre parcel at 13350
Hanson Boulevard NW. It is the north 100 feet of their property being
created to construct a single family home or to rezone to Industrial.
It is currently zoned R-4. The new parcel would abut industrial
property to the north and residential property to the west and south.
They will also be required to hook up to City sewer and water on the
northern parcel being created.
The hearing was opened for public testimony.
Milton Mardaus, 13350 Hanson Boulevard NW - had no objection from the
county for an entrance to the county road. He has decided he'd prefer
to rezone the property to Industrial, asking if that can be done along
with the lot split. He has a purchase agreement for the two acres, but
they can't afford the whole piece of property. In order to make the
property salable, they need the lot split. Mr. Carlberg explained the
rezoning would need to go through another public hearing process and
suggested he wait until he has a sound purchase agreement before
requesting the rezoning.
MOTION by Jovanovich, Seconded by Peek, to close the public hearing.
Motion carried on a 5-Yes, 2-Absent (McMullen, Pease) vote.
MOTION by Peek, Seconded by Squires, that the Andover Planning and
Zoning Commission approve the attached Resolution of the lot split
request of Marilyn and Milton Mardaus to create two parcels pursuant to
Ordinance No. 40 at 13350 Hanson Boulevard NW. Motion carried on a 5-
Yes, 2-Absent (McMullen, Pease) vote. This will be placed on the July
20, 1993, City Council agenda. 8:35 p.m.

The Andover Planning and zoning Commission is asked to review the
lot split request of Marilyn and Milton Mardaus to subdivide .88
(38,500 s.f.) acres from a 2.87 acre parcel. The property is
located at 13350 Hanson Boulevard NW. The property is legally
described on the attached resolution.
The property is zoned R-4, Single Family Rural.
Applicable Ordinances
Ordinance No. 40 regulates the division of lots. A lot split is
defined as any division of a lot, parcel or tract of land into not
more than two (2) parcels when both divided parcels meet or exceed
the minimum requirements for platted lots in the applicable zoning
)' district.

Ordinance No.8, Section 6.02 establishes the provisions for
minimum lot width, lot depth and lot area in an R-4 zoned
district. The minimum requirements in an R-4 district are as
follows:

Ordinance No. 10, Section 9.07.10 establishes the minimum area of
land dedicated to park and open space. For all subdivisions by
metes and bounds description the subdivider or developer may elect
to pay, in lieu of the park dedication requirements, the sum of
four hundred dollars ($400.00) for each dwelling unit that could
be constructed upon the proposed subdivided property. In the
event the developer elects to pay said four hundred dollar
($400.00) charge, the City may collect additional park fees if the
developer re-subdivides the property in the future.
Review
The purpose of the lot split is to create a lot for the
construction of a single family home or to rezone the property to

Commission Options
1. The Planning and zoning Commission may recommend approval of
the lot split requested by Marilyn and Milton Mardaus at 13350
Hanson Boulevard NW, legally described on the attached
resolution.
The Commission finds the request meets the requirements of
Ordinance No. 40.
2. The Planning and zoning Commission may recommend denial of the
lot split requested by Marilyn and Milton Mardaus at 13350
Hanson Boulevard NW, legally described on the attached
resolution.
The Commission finds the request does not meet the
requirements of Ordinance No. 40. In denying the request, the
Commission shall state those reasons for doing so.
3. The Planning and zoning Commission may table the item pending
further information from Staff.

Dear Mr. Mardaus,
We have reviewed your request for a driveway located at
133XX Hanson Blvd. (CR 78) , within the City of Andover and
offer the following comments:

If a lot split was granted a driveway in the most
northerly 30 feet will be allowed for the purpose of a
Residence. The Anoka County Highway Department will provide
a drawing depicting the details of the driveway, along with
the required culvert.
Anoka County is currently developing a policy on the
installation of mailboxes adjacent to county highways. Any
mailbox installed for this residence should meet the
attached specifications.

REQUEST
The Planning and Zoning Commission at its regular meeting on
June 22, 1993, reviewed the request for a Special Use Permit by
Mary Hamment on the property located at 524 159th Avenue NW. The
applicant is requesting the Special Use Permit to allow her to
operate an in-home beauty salon in accordance with Ordinance No.
8, Sections 5.03 and 7.03.

further information.
RECOMMENDATION
The Planning and zoning Commission recommends approval of the
Special Use Permit request with conditions as indicated on the
attached Resolution.

HAMMENT TO OPERATE AN IN-HOME BEAUTY SALON ON THE PROPERTY LOCATED
AT 524 159TH AVENUE NW, LEGALLY DESCRIBED AS LOT 2, BLOCK 2, OAK
HOLLOW.
WHEREAS, Mary Hamment has requested a Special Use Permit to
operate an in-home beauty salon on the property located at 524
159th Avenue NW, legally described as lot 2, Block 2, Oak Hollow:
and
WHEREAS, the Planning and zoning Commission has reviewed the
request and has determined that said request meets the criteria of
Ordinance NO.8, Sections 5.03 and 7.03: and

WHEREAS, the Planning and zoning Commission held a public
hearing and received no objections to said request; and
WHEREAS, the Planning and zoning Commission has found that
the request will not have a detrimental effect on the health,
safety, morals and general welfare of the community; nor will it
have a significant negative effect on the property values and
scenic views in the area; nor will it be in conflict with the
spirit and intent of the zoning Ordinance and the Comprehensive
Plan.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission and hereby grants the Special Use
Permit request, with the following conditions:
1. One chair salon/barber shop only.
2. The hours of operation shall be from 12 p.m. to 8 p.m., Monday
and Wednesday, and from 9 a.m. to 5 p.m., Thursdays.
3. Parking requirements shall be as set out in Ordinance No.8,
Section 8.08.
4. The salon/shop must comply with the State Cosmetology Board
and the State Barbers Board requirements.
5. In non-sewered areas, the septic system must be in compliance
with Ordinance No. 37, the On-Site Septic System Ordinance. A
beauty/barber shop shall be considered the equivalent to one
bedroom in terms of usage under Ordinance No. 37.
6. The Special Use Permit will be subject to annual review.
7. The beauty/barber shop shall be owner occupied.
.~ 8. Upon sale of the premises for which the Special Use Permit is
granted, such permit shall terminate.

9. Drawings detailing the salon/shop shall be submitted at the
time of the request for the Special Use Permit
10. In non-sewered areas, a minimum of 39,000 s.f. of lot size
shall be required.
11. In non-sewered areas, the septic system shall be inspected
annually before the Special Use Permit is reviewed.
12. The Special Use Permit shall be subject to a sunset clause as
established in Section 5.03(D).
13. The plans for the shop shall be reviewed and approved by the
Building Department.
14. An inspection shall be conducted by the Building Department.
15. Signs shall be regulated as set out in Section 8.07.
16. Parking shall be as limited in Ordinance 8, Section 4.30.
17. The area within the principle structure being utilized for the
salon shall not exceed twenty (20%) percent of the livable
floor area.
18. On-site sales shall be prohibited except those clearly
incidental to the services provided.

AVENUE NW, MARY HAMMENT
8:35 p.m. Mr. Carlberg reviewed the request of Mary Hamment to operate
an in-home beauty salon at 524 159th Avenue NW, noting the applicable
ordinances. Staff recommends approval contingent upon several
conditions. In addition, he suggested a seventh Staff condition, that
is that the Special Use Permit would terminate with the sale of the
property. Another condition may be that retail sales are prohibited
except those clearly incidental to the services provided per Ordinance
8, Section 4.30.
Mr. Carlberg noted a letter has been received from the applicant
indicating the hours of operation would be Monday and Wednesday, 12 to
8 p.m., and Thursday, 9 a.m. to 5 p.m. He also had a picture of the
residence which indicates the driveway is large enough to accommodate
the parking requirements. If parking becomes a problem, it can be
evaluated at the time of the annual review.
Commissioner Squires asked if the Special Use Permit would be recorded
since it runs with the owner, not with the land. Mr. Carlberg stated
all Special Use Permits are recorded.
~ The hearing was opened for public testimony.
Marv Hamment, 524 159th Avenue NW - didn't expect any traffic problems,
as ~here would not be more than one car at a time. She set her hours to
accommodate her clients. Her present employer is closing down and
selling the building, so she wants to put her shop in her home to
accommodate her cliental. It is strictly a part-time business.
MOTION by Apel, Seconded by Jovanovich, to close the public hearing.
Motion carried on as-Yes, 2-Absent (McMullen, Pease) vote.
MOTION by Peek, Seconded by Jovanovich, that the Andover Planning and
Zoning Commission recommends approval of the Resolution granting the
Special Use Permit request of Mary Hamment to operate an in-home beauty
salon at 524 l59th Avenue NW with the following amendments: No.2 to
include the requested hours of operation (Monday and Wednesday, 12 to 8
p.m.; Thursday, 9 a.m. to 5 p.m.); and to add No. 18, the excerpt from
Ordinance 8, Section 4.30 that on-site sales shall be prohibited except
those clearly incidental to the services provided. Motion carried on a
5-Yes, 2-Absent (McMullen, Pease) vote. This will be place on the July
20, 1993, Council agenda. 8:50 p.m.

The property is zoned R-l, Single Family Rural.
APPLICABLE ORDINANCES

Ordinanc~ No.8, Section 7.03 lists those uses allowed by Special
Use Permit. In a Residential District, Beauty Shops are allowed
under a Special Use Permit.
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
Section 5.03(B)(1), establishes the following provisions for in-
home beauty salons/barber shops.
1. One chair salon/barber shop only
2. The hours of operation shall be approved by the City Council.
3. Parking requirements shall be as set out in Ordinance No.8,
Section 8.08.
4. The salon/shop must comply with the State Cosmetology Board
and the State Barbers Board requirements.
5. In non-sewered areas, the septic system must be in compliance

1. The effect of the proposed use upon the health, safety, morals
and general welfare of the occupants of the surrounding
area.

2. The existing and anticipated traffic conditions, including
parking facilities on adjacent streets and land.
3. The effect on values of property and scenic views in the
surrounding area.
4. The effect of the proposed use on the Comprehensive Plan.
COMMISSION OPTIONS
1. The Planning and Zoning Commission may approve the Special Use
Permit requested by Mary Hamment to operate an in-home beauty
salon on the property located at 524 159th Avenue NW, Legally
described as lot 2, Block 2, Oak Hollow.
The Commission finds the request meets the criteria established in
Ordinance No.8, Section 5.03. The Commission also finds that the
use is permitted by special use under Ordinance No.8, Section
7.03, Residential Districts.
2. The Planning and zoning Commission may deny the Special Use
Permit requested by Mary Hamment to operate an in-home beauty
salon on the property located at 524 159th Avenue NW, Legally
described as lot 2, Block 2, Oak Hollow.
The Commission finds the request does not meet the criteria
established in Ordinance No.8, Section 5.03. In denying the
request, the Commission shall state those reasons for doing so.

REQUEST
The Planning and zoning Commission at its regular meeting on
June 22, 1993, reviewed the request for a Special Use Permit by
Roger Kjellberg to construct an accessory structure (pole
building) prior to the construction of a principal structure on
the property located on 167th Avenue NW and Hanson Boulevard NW,
PIN 10-32-24-41-0001.

the minutes from the Planning and zoning Commission meeting for
further information.
RECOMMENDATION
The Planning and zoning Commission recommends denial of the
Special Use Permit request. A resolution is attached for Council
approval.

LEGALLY DESCRIBED AS FOLLOWS:
The Northeast Quarter of the Southeast Quarter of Section 10,
Township 32, Range 24, Anoka County, Minnesota, except the East
473.50 feet of the West 533.50 feet of the South 460 feet of said
Quarter, Quarter (As measured along the South and West lines
thereof); Also Except Roads; Subject to Easements of Record.
WHEREAS, Roger Kjellberg has requested a Special Use
Permit to construct an accessory structure prior to the
construction of a principal structure on the property legally
described above.
WHEREAS, the Planning & zoning Commission has reviewed the
request and has determined that said request does not meet the
criteria of Ordinance 8, Sections 4.05 and 5.03; and
WHEREAS, a public hearing was held before the Planning and
zoning Commission on the request; and

WHEREAS, the Planning and zoning Commission recommends to
the City Council denial of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & zoning Commission and denies the request of roger
Kjellberg to construct an accessory structure prior to the
construction of a principal structure on said property.

AVENUE NW, MARY HAMMENT
"
8:35 p.m. Mr. Carlberg reviewed the request of Mary Hamment to operate
an in-home beauty salon at 524 159th Avenue NW, noting the applicable
ordinances. Staff recommends approval contingent upon several
conditions. In addition, he suggested a seventh Staff condition, that
is that the Special Use Permit would terminate with the sale of the
property. Another condition may be that retail sales are prohibited
except those clearly incidental to the services provided per Ordinance
8, Section 4.30.
Mr. Carlberg noted a letter has been received from the applicant
indicating the hours of operation would be Monday and Wednesday, 12 to
8 p.m., an& Thursday, 9 a.m. to 5 p.m. He also had a picture of the
residence 4hich indicates the driveway is large enough to accommodate
the parking requirements. If parking becomes a problem, it can be
evaluated at the time of the annual review.
Commissioner Squires asked if the Special Use Permit would be recorded
since it runs with the owner, not with the land. Mr. Carlberg stated
all Special Use Permits are recorded.

Marv Hamment, 524 159th Avenue Wd - didn't expect any traffic problems,
as ~here would not be more than one car at a time. She set her hours to
accommodate her clients. Her present employer is closing down and
selling the building, so she wants to put her shop in her home to
accommodate her cliental. It is strictly a part-time business.
MOTION by Apel, Seconded by Jovanovich, to close the public hearing.
Motion carried on a 5-Yes, 2-Absent (McMullen, Pease) vote.
MOTION by Peek, Seconded by Jovanovich, that the Andover Planning and
Zoning Commission recommends approval of the Resolution granting the
Special Use Permit request of Mary Hamment to operate an in-home beauty
salon at 524 159th Avenue NW with the following amendments: No.2 to
include the requested hours of operation (MOnday and Wednesday, 12 to 8
p.m.; Thursday, 9 a.m. to 5 p.m.); and to add No. 18, the excerpt from
Ordinance 8, Section 4.30 that on-site sales shall be prohibited except
those clearly incidental to the services provided. Motion carried on a
5-Yes, 2-Absent (McMullen, Pease) vote. This will be place on the July

Rural. The structure is to be used for storage and for the raising of
pheasants. Because a majority of the area is in the floodplain, the
Building Official doesn't feel it is a buildable parcel for a principal
structure. The applicant does not have plans to build the principal
structure at this time. Mr. Carlberg did not feel this meets the
requirements for an agric~lture building. Because of the wetland
regulations, the only way to access the property is from 167th, though
there is more than 300 feet of frontage on Hanson Boulevard.
Commissioner Apel stated the City has not been very receptive to the
construction of accessory structures without consideration for building
a principal structure except in specific circumstances such as for
agricultural use, when a principal structure is to be built within a
specific time frame or in one instance when the owner lived across the
street. Mr. Carlberg stated there is also the concern of vandalism with
no one being there to watch the building.
The hearing was opened for public testimony.
Roqer Kiellberq, 6107 Campton Avenue N, Brooklvn Center - is one of the
property owners. They bought the 35 acres to use. The accessory
building will not be a pole barn but will be a garage-type structure.
They want to house a few pieces of farm equipment to get it out of the
weather and to keep them under lock and key. They just sold their
property in Plymouth and need to store their equipment. They cannot
afford to build a house and they are not sure when they will build it.
They will try to raise game birds for an income and to slowly work into
farming parts of the parcel. The property is not being farmed now, and
he believes par~ of it is wetland. He is trying to get set up and move
into the rest of his plans in stages.
The Commission suggested he check further as to whether or not he would
be able to begin farming that land because of the new wetlands
regulations. They did not feel the request meets the agricultural
permitted use. If he is able to farm the property, they suggested he
begin the farming operation first, then come in with a request for an
agricultural building. Or, if he came in with plans for a principal
structure within a reasonable period of time, then this request may meet
the ordinance requirements.
Mr. Kiellberq - expressed frustration that he bought the 35 acres and is
not able to use it. It is basically brush and not what he'd consider a
swamp. He bought the land to farm it and eventually build a house on it.
Right now he just wants a building to put his equipment in to get them
ou~ of the weather and to avoid vandalism. The Commission noted he
could have come to the City to find out what can be done with property
before buying it. They suggested he check with the City ordinances and
state law regarding agricultural uses and the wetlands regulations.
Possibly some soil borings will have to be done to find out whether the
parcel is buildable for a house.

zoning Commission recommend denial of the Special Use Permit request by
Roger Kjellberg for the construction of an accessory structure prior to
the construction of a principal structure to be located at 167th Avenue
NW and Hanson Boulevard NW. The Commission finds that it does not meet
the criteria established in Ordinance No.8, Section 5.03; that it does
not meet the Ordinance No.8, Section 4.05(3) where it states that no
accessory building or use shall be constructed or developed on a lot
prior to the time of construction of the principal building except by
Special Use Permit; and also Section 4.05. A public hearing was held.
The Commission finds that the proposed use is not an agricultural use
under the zoning Ordinance and State statutes and that the construction
of an accessory use is determined to be improper where it is doubtful
that a principal structure could be erected due to the lowlands. Motion
carried on a 5-Yes, 2-Absent (McMullen, Pease) vote. This will be on
the July 20, 1993, City Council agenda. 9:12 p.m.

PUBLIC HEARING: SPECIAL USE PERMIT - COMMERCIAL GREENHOUSE, COMMERCIAL
RECREATIONAL FACILITIES AND CONSTRUCTION OF AN ACCESSORY STRUCTURE PRIOR
TO PRINCIPAL - 17154 SEVENTH AVENUE NW, HARE STUART
9:12 p.m. The Commission asked what happens to the Special Use Permit
granted within the last year for this property to allow the construction
of a church. Mr. Carlberg stated a Special Use Permit goes with the
property; however, the church requesting that permit did not purchase
the property. Staff will check with legal counsel before going to the
City Council to make sure there is no conflict.
Mr. Carlberg then reviewed the request of Hare Stuart to operate a
commercial greenhouse, a commercial recreational facility and to
construct accessory buildings prior to the construction of a principal
structure. There are no plans to build a principal structure on the
parcel. In order to consider the commercial recreational facility, the
property would have to be rezoned to a General Recreational District;
therefore, it has been determined that it is not a permitted use.
The hearing was opened for public testimony.

Hare Stuart, 15921 Fox Street NW - stated the firm is not planning to do
anything related to recreation and asked to delete that area of
discussion. The reason for this location is they need additional space,
noting his present location at the corner of Bunker Lake and Hanson
Boulevards. When he started there , it was primarily wholesale. They have
since combined wholesale and retail. Because of the contamination of the
soils there, they are moving the retail operations to Coon Rapids,
Ramsey and Rochester. They plan to keep the production area in Andover.

APPLICABLE ORDINANCES
Ordinance No.8, Section 4.05 states that, "No accessory building
or use shall be constructed or developed on a lot prior to the
time of construction of the principal building except by Special
Use Permit".
Section 4.05 also states that, "No permanent sheet metal, painted
or unpainted accessory building, except small garden sheds not
exceeding one hundred twenty (120) sq. ft., shall be allowed on
parcels of three (3 a.) acres or less in all residential
districts...".
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.

The applicant has stated that the structure is to be used for
storage purposes and also for the raising of pheasants.
The applicant may construct a principle structure in the future,
but is not planning to at this time. There also is a question of
wehther the lot is buildable for a principle structre.
COMMISSION OPTIONS

Permit requested by Roger Kjellberg to allow for the construction

The Planning and zoning Commission of the City of Andover will
hold a public hearing at 7:30 p.m., or as soon thereafter as can
be heard, on Tuesday, June 22, 1993 at the Andover City Hall, 1685
Crosstown Blvd. NW, Andover, MN to review the Special Use Permit
request of Roger Kjellberg to construct an accessory structure
prior to the construction of a principal structure as established
in Ordinance No.8, Section 4.05, Accessory Buildings on the
property located at PIN 10-32-24-41-0001, legally described as
follows:
The Northeast Quarter of the southeast Quarter of Section 10,
Township 32, Range 24, Anoka County, Minnesota, except the East
473.50 feet of the West 533.50 feet of the South 460 feet of said
Quarter, Quarter (As measured along the South and West lines

Our present animal control contract with the Anoka County Humane
Society expires on December 31, 1993. The Humane Socieity has
requested that the term of the contract be from August 1st to
July 31st of each year. With the exception of five cities and
townships, the Humane Society has contracts with the other cities
in Anoka County and all of the contracts are for the same time
period.
The contract will remain the same as the one we are operating
under at this time. A copy of the new contract is attached.

the Humane Society is qualified and willing ~o

from the Humane Society in accordance with this

NOW THEREFORE, in consideration of the mutual covenants contained
herein, it is agreed and understood as follows:

II. BASIC SERVICES

county area in cooperacion with municipal officals
when necessary.
III. RESPONSIBILITIES OF THE MUNICIPALITY
IV.
1. The Municipality shall call the Humane Society for
pick-up of animals during normal business hours,
as specified above, or will transport the animals to
the shelter on a 24 hour basis.
2. After normal business hours, the Municipality shall
obtain treatment for injured animals that are in a
life-threatening condition. The Humane Society will
pick-up the animal as soon as possible after
treatment.
COMPENSATION
1. The Municipality shall pay the Humane Society the
following fees:
A. IMPOUND FEE: An administr.ative charge of
$30.00 per animal for the first day of impound.
B. BOARDING FEE: $9.00 per day, per animal, for
each day after the first day of impound.
C. QUARANTINE FEE: In addition to the regular
boarding fee, $5.00, per day, per animal, for
all animals which must b~ quarantined.
D. TRANSPORTATION FEE: 530.00 per hour.
E. VET SERVICES FEE: $30.00 per hour.
F. EUTHANASIA FEE: $.31 per pound disposal
(see attachment for euth solution fee).
2. License fees shall be turned over to the
Municipali ty.
3. The Municipality will not be charged those costs
recovered from pet owners.
4. Charges for services, shall be paid monthly or within
thirty (30) days after submission of the monthly
claims by the Humane Society to the Municipality.

V. CCMPLIANCE WITH LAWS
In providing all services pursuanc to this contract, the
Humane Society shall abide by all statutes, ordinances,
rules and regulations pertaining to or regulating the
?rovisicn of such services, i~cluding ~hosa now in effect
and hereinaf~er adopted.
VI. AUDIT DISCLOSURE AND RETENTION OF RECORDS
The Humane Society agrees to make available to duly
authorized representatives of the Municipality and either
the legislative auditor or the state auditor for the
purpose or audit examination pursuant to MN. stat. 163.06,
any books, documents, papers and records of the Humane
Society that are pertinent to the Humane Society's
provision of services hereunder. The Humane Society
further agrees to maintain all such required records
for three (3) years arter receipt of final payment and
the closing of all other related matters.

VII.
INSURANCE
The Humane Society shall purchase, maintain in full force
and effect during the term of this Contract and provide
proof of the following insurance coverage:
A. WORKER'S COMPENSATION: Coverage at statutory limits
as provided by the Sate of Minnesota.
3. COMPREHENSIVE GENERAL LIABILITY: Coverage shall have
minimum limits of $1,000,000 per occurrence, Combined
Single Limit for Bodily injury Liability and Property
Damage Liability.
C. BUSINESS AUTO LIABILITY: Coverage shall have minimum
limits of $500,000 per occurrence, Combined Single
Limit of Bodily Injury Liability and Property Damage
Liability. This shall include owned vehicles, hired
and non-owned vehicles and employee non-ownership.

Current, valid insurance certificates meeting the
requirements herein identified shall be filed with
the Municipality before the signing of this Contract.
All policies shall provide, and the certificates
issued shall evidence, that the Municipality will be
notified in writing at least thirty (30) days prior
to cancellation or modification of coverage.

or withou: cause, upon thirty (30) days written notice,
delivered by mail or in person, to the other party. For

It is understood and agreed by the parties that the entire
agreement of the parties is contained herein and that the
Contract supercedes all oral agreements and negotiations
between the parties relating to the subject matter hereof
as well as any previous agreements presently in effect
between the Humane Society and the Municipality. The
parties hereto revoke any prior oral or written agreements
between themselves and agree that this Contract is the
only and complete agreement regarding the subject hereof.

Approve street Spec Change

The City Council is requested to review and approve a change of
specification to require 3 inches of bituminous to all new street
construction (urban and rural).
Currently, the City specification requires a minimum of 2 inches
on new street construction (urban and rural).

There will be some advantages. Examples include longer lasting
pavement (compared to 2 inch pavement)and less cracking which
means less maintenance to the city.
The disadvantage is to the developer to pay more. The additional
cost per lot in the urban area would be approximately $500.
The City of Blaine recently changed their specification from 2 to
3 inches. The first 2 inches would be initially placed and the
remaining 1 inch would be placed when the development is 80%
complete.

The city Council is asked to authorize the expenditure of up to
$9,000 of Community Development Block Grant Funds for the City
to participate in revising the Anoka County 2010 plan. The
revision will include the traffic study on TH 10 that has been
requested by the Metropolitan Council. The total project cost is
$27,000 and will be split three ways between Anoka County, Ramsey
and Andover.

The City has $20,000 in CDBG Funds allocated towards planning
projects for this year. The City requested this amount based on
the understanding that we would have to participate in the
transportation study to receive future Metropolitan Urban Service
Area (MUSA) expansions.
Note: The City of Ramsey has allocated the same amount as being
requested this evening.

The Engineer's estimate on the project is $5.88,155.74. I am recommending
award to the lowest bona fide bidder, ~.B. Miller, Inc. in the amount of
$499,910.40. This includes the modular concrete wall on the Andover side of
the street. The City of Andover will have to decide on the wood or concrete
wall, so Ham Lake's approval should take this into account.
Contract award must be made 45 days from July 12, 1993, which is August 26,
1993, or an extension must be requested.
The project plans have been sent on to the District office of MNjDOT for
review and approval and then to the main office for signature. It is .
anticipated the approval might come the week of August 23, 1993.

WHEREAS, the agreement indicates the City of Andover will take
over as a local roadway, that portion of Andover Boulevard,
previously known as County State Aid Highway Number 16, between
Crosstown Boulevard NW and Hanson Boulevard NW.
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
roadway known as Andover Boulevard, formerly known as County State
Aid Highway Number 16, between Crosstown Boulevard NW and Hanson
Boulevard NW, be in ownership of the City of Andover.
BE IT FURTHER RESOLVED that the City of Andover accepts the
right-of-way and responsibility of maintenance and repair of said

A RESOLUTION DECLARING COST AND DIRECTING PREPARATION OF ASSESSMENT
ROLL FOR THE PLATTING OF ANDOVER BOUNDARY COMMISSION PLAT 1
FOR PROJECT NO. 90-17
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY RESOLVES:
WHEREAS, the Professional Services of Surveyors, Title Company
and Attorneys have been used to review and correct the abstracts of
Auditors Subdivision 82, and the expenses incurred or to be incurred
correcting the abstracts, resurveying the properties and recording the
plat known as Andover Boundary Commission Plat 1.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover, MN:
1. The portion of the cost of such improvement to be paid by the City
is hereby declared to be $ - 0 - and the amount of the cost
to be assessed against benefited property owners is declared to
be $ 47,850.00
2 .
Assessment shall be payable in equal annual installments extending
over a period of 5 years. The first of the installments to be
payable on or before the first Monday in January 1994, and shall
bear interest at the rate of 5 percent per annum from the
date of the adoption of the assessment resolution.
The City Clerk, with the assistance of the Finance Director shall
forthwith calculate the proper amount to be specially assessed for
such improvement against every assessable lot, piece or parcel of
land within the district affected, without regard to cash
valuation, as provided by law, and she shall file a copy of such
proposed assessment in her office for public inspection
3 .
4. The Clerk shall, upon the completion of such proposed assessment,
notify the Council thereof.

Dear Council Members:
The following is a summary of items discussed and action taken at the regular meeting of the
Puldover City Council on Tuesday, July 6,1993.
1. Residential Forum:
Mr. G. Windschitl, developer ofWeybridge 3rd Addition and the contractor, Scott Voyt of
Old is Gold Contracting, spoke to include reconsideration of award of contract for City
Project 92-19 as an agenda item.
Council Action: The request was granted.
2. Emerald Glen Addition - (93-11), Comm. No. 10454:
A. Preliminary Plat Review and Approval
Mr. Todd Haas did present the Puldover Review Committee (ARC) report. Street
configuration of the northwest comer (Martin Street at 134th Avenue NW) was
modified from a semi-cul-de-sac to a greater than 90 degree deflection
intersection. It was suggested that a 90 degree intersection be platted with
variance granted to Lots 6 and 7 for width requirements.
The exception defining the wetlands was suggested to be platted by extension of lot
lines. The drainage area would be defined as permanent drainage easement in lieu
of City ownership. Mr. Windschitl indicated that the City of Coon Rapids has
funds to purchase the wetlands from Mr. Stanton the owner. He defmed the area
as a "regional pond". It was suggested that the developer establish the ownership
question with the City of Coon Rapids. The staffs of Coon Rapids and Puldover
will meet and determine a suggested procedure to affect the ownership of wetlands
by future lot owners within the plat.
Council Action: The Council, by resolution, approved the preliminary plat with the
conditions as suggested.
B. Feasibility Report:
Mr. Davidson presented the report dated July 6, 1993. Specific mention of the
storm sewer assessment credit by the City of Coon Rapids for prior lateral
assessments was pointed out. The credit (reimbursement) for lateral storm sewer
will be paid by the City of Coon Rapids to the City of Puldover. Therefore, no

lateral storm sewer assessment is anticipated, since previous assessments equal or
exceed estimated storm sewer costs.
Council Action: The Council, by resolution, received the feasibility report and
authorized preparation of plans and specifications subject to escrow of engineering
funds.
3. MUSA Boundary/Comprehensive Plan Minor Amendment:
The Council authorized the City Planning Director to proceed with a minor amendment for
approximately 200 acres of additional MUSA designation within present unplatted areas.
The area of development at this time will be generally south of Crosstown Boulevard and
east of Hanson Boulevard. The exception would be the Sonsteby 8 +/- acres adjacent and
west of Rosella's Addition.
5. Consent Agenda:
The Council, by one motion, did approve agenda line items without discussion as follows:
A. Proj. 93-12 - Hills of Bunker Lake 5th and 6th Additionn:
The Council received a petition for improvements and authorized preparation of a
feasibility report.
B. Proi. 93-14 - Woodland Pond Addition. Comm. No. 10474:
The Council received a petition for improvements and authorized preparation of a
feasibility report.
C. Proi. 93-5 - Winslow Hills 3rd Addition. Comm. No. 10365:
The Council, by resolution, approved the final plat of Winslow Hills 3rd Addition.
6. Weybridge 3rd Addition. (92-19), Comm. No. 10258:
The City Council at the regular meeting June 15, 1993 did award the contract for
construction of improvements for the above named subdivision. Award was subject to the
developer signing a development contract. Bids had been opened June 10, 1993.
During the design and bidding phases of Proj. 92-19, a second project, Proj. 93-9 - Xeon
Street Trunk Storm Sewer, went through informational meeting, Wednesday, June 2,1993
and public hearing June 15, 1993. An area s defmed in City Project 87-11B dated
February 12, 1988 was designated as the subwatershed requiring pond controls. The
feasibility report was received May 18, 1993 and an amended page 3 (Rev.) on June 2,
1993. TIle revision included Weybridge 3rd Addition which was affected by the overall
drainage system due to its connection and discharge through the Andover Boulevard
regional pond (Andover Lake).

The original feasibility report for Project 92-19 was prepared in three phases dated
February 4,1992. At the regular meeting June 2,1993 the Council received a
supplemental feasibility report, which was prepared to revise costs between February, 1992
and June, 1993 as well as adjust area charges and connection charges and relate to the
exact number of lots being finally platted as Weybridge 3rd Addition. This is consistent
with previous projects developed in phases. The revised feasibility report also included the
storm sewer area assessment which was anticipated during the preparation for hearings
under Proj. 93-9.
At a staff, City Engineer and City Attorney meeting held July 2,1993, it was determined
that to prevent a repeat of what happened in the past and legal costs due to developer
agreements 110t defming all anticipated costs, that the developer agreement in this ~
include the area storm sewer anticipated costs. Mr. Windschitl has related to prior
assessments dealt with in 1987 and inferred improprieties which have no bearing on the
present case in point. Records indicate that Parcel PIN No. 26-32-24-42-llilill did llQ1 pay
previous area storm sewer assessments and that said parcel was and is tributary to the
system.
He related to an amount charged to PIN No. 26-32-24-42-!:!002 as area assessments paid by
Gaughan when Creekview Crossing Proj. 91-2 was assessed. In fact, the credit related to
by Mr. Windschitl was to oversize and deepen storm sewer for benefit to Weybridge 2nd
Addition and was generally not used in his [mal design.
Council Action: The Council did not alter their conditions of award of contract. The
developers agreement must be signed and include anticipated assessable costs.
7. Special Meeting:
The Council set a special meeting to discuss assessment policy for July 15, 1993 at 7:00
P.M.
The engineer was excused at approximately 11:00 P.M..t

Dear Chief Mashuga:
On June 23, 1993, at approximately 6:30PM, we reported a lightning strike to our
residence at 14238 Raven Street NW, which included a small fire within the attic and
damage to the electrical system, structure and appliances.
Although we suffered only minimal damage to the structure and contents, we would like
to thank the Andover Fire Department and Rescue, for their timely response and the
professional demeanor exhibited by all responding personnel. The care and
consideration given to us and our property (Le., furnishings, carpet, walls, etc.) reduced
our monetary loss.
As a result of the actions of the Andover Fire Department, we feel fortunate to reside in
a community which maintains this type and caliber of service.

The following is a summary of engineering matters discussed and action taken at the Special
Council Meeting held July 15, 1993.
1. Assessment Policy:
The purpose of the special meeting was to discuss the assessment policy of the City. In
particular, a review was made of storm sewer assessments.
Mr. Davidson presented a letter report dated 7-15-93 (attached). The purpose of the report
was to indicate actual versus potential assessment rates within the Xeon Street storm sewer
district. A potential $10,000 per year over 10 years did not appear to be an unusual
surplus for City protection of unknown conditions. (i.e. lO-year full development; total
actual developed area; rates of interest and Metro Council determination of MUS A. )
2. Development Policy:
Mr. Davidson has suggested one annual improvement policy with a predetermined
deadline for platting and urban improvements.
A copy of the lnver Grove Heights Development Policy is attached. This policy is
currently in affect and was initially adopted in 1973.

The hearings for the above described project were held on June IS, 1993. Financing for the
project was proposed at $0.04 per square foot or $1,742.40 per acre. The project was again
discussed at the July 6, 1993 Council meeting.
Certain concerns were expressed related to the $0.04 per square foot assessment rate. We have
determined the unplatted and/or unassessed usable area remaining within the defined watershed
to be 225.1 acres. This area does include the three plats presently under consideration to be
assessed. The three plats are Winslow Hills 2nd and 3rd Additions and Weybridge 3rd Addition.
The estimated project cost was shown to be $216,900. TIle amount to be i1nmediately assessed
upon completion of the project for the tluee subdivisions is $142,700. This leaves an unassessed
balance of $74,200.

Re: Trunk storm sewer changes for the Old Colony Estates,
Creekview Crossings and Weybridge Additions.
Dear Mr. McKelvey:
When the Gaughan Companies and the City of Andover met about the
Plat of Old Colony Estates various proposals were discussed. We
platted part of the land as Old Colony Estates and sold the
remaining land to two other developers who platted Creekview
Crossings and the Weybridge Additions.
At that time, the Andover City Council held a number of meetings
on various trunk storm sewer proposals and I had a number of
meetings and negotiations with Mr. James Schrantz in which a
final trunk storm sewer cost was agreed to for all of the land in
the proposed Old Colony Plat, including the area known today as
Creekview Crossing and the Weybridge Additions.
In negotiating the final trunk storm sewer changes for the entire
Old Colony Plat, the Gaughan Companies agreed to:
(1) Pay a certain amount of money as a trunk storm sewer
charge.
(2) Pay for part of the trunk storm sewer that was built
within the Old Colony project.
(3) Donate approximately 8 acres of land for,the regional
storm water holding pond.
The above costs were assessed to the Gaughan Company and the land
was donated.
Based upon the above agreement, it was my understanding that no
further trunk storm sewer costs would be assessed against any of
the Gaughan properties, including the area now known as Creekview
Crossings and the Weybridge Additions, as the combined value of
the three items above exceeded the amount of money that was due
