REQUEST
The City Council is asked to review and approve the Special Use
Permit request of the Anoka Hennepin Independent School District
No. 11 to install a 10,000 gallon tank for the bulk storage of
liquid fuel (fuel oil). The property is located at 15400 Hanson
Boulevard NW and is the site of the Oak View Middle School.
APPLICABLE ORDINANCES
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
Ordinance No.8, Section 4.26, requires a Special Use Permit for
all uses associated with the bulk storage of liquid fuels.
Planning & Zoning Review
The Planning and zoning Commission, at their November 14, 1995
meeting, made the recommendation to the City Council to approve
the Special Use Permit with conditions as listed on the attached
resolution.
Staff has included with the packet materials the staff report and
minutes from the Planning and zoning Commission.
Attached is a proposed resolution for Council review and adoption.

HENNEPIN INDEPENDENT SCHOOL DISTRICT NO. 11 TO INSTALL A
10,000 GALLON UNDERGROUND STORAGE TANK FOR THE BULK STORAGE OF
LIQUID FUEL (FUEL OIL) ON THE PROPERTY LOCATED AT 15400 HANSON
BOULEVARD NW, LEGALLY DESCRIBED ON EXHIBIT A.
WHEREAS, the Anoka Hennepin Independent School District
No. 11 has requested a Special Use Permit to install a 10,000
gallon underground storage tank for the bulk storage of liquid
fuel (fuel oil) on the property located at 15400 Hanson Boulevard
NW, legally described on the attached Exhibit A.
WHEREAS, the Planning & Zoning Commission has reviewed the
request and has determined that said request meets the criteria of
Ordinance 8, Section 5.03 and 4.26; and
WHEREAS, a public hearing was held and there was no
opposition regarding said request; and
WHEREAS, the Planning and Zoning Commission recommends to
the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & zoning Commission to allow for the installation of a
10,000 gallon underground storage tank for the bulk storage of
liquid fuel (fuel oil) on said property with the following
conditions:
1. The applicant shall provide to the City, in writing,
proof that the tank meets all State requirements and
installation regulations.
2. The Wellhead protection Plan to be adopted by the City
of Andover be considered.
3. The Andover Fire Marshal shall inspect the tank and
the installation.
4. The Special Use permit will be subject to a one (1)
year sunset clause as defined in Ordinance No.8,
Section 5.03(D).
5. The Special Use Permit will be subject to annual
review.

8: 30 p. m. Mr. Carlberg reviewed the request by Anoka Hennepin
Independent School District No. 11 to install a 10,000-gallon oil tank
at 15400 Hanson Boulevard NW, Oak View Middle School. This is for a
backup heating system for the school; the primary system is natural gas.
Staff is recommending approval with five conditions. The Fire Marshal
has been working with the school district, as the tanks are being
installed at this time. He also noted Item 2 in the Resolution refers
to the Wellhead Protection Plan. That Plan is not yet adopted, but the
Engineering Department would like to see that considered.
MOTION by Putnam, Seconded by Jovanovich, to open the public hearing.
Motion carried on a 6-Yes, 1-Absent (Doucette) vote. 8:38 p.m.
Commissioner Putnam asked if the piping system is also doubled walled.
Zack Johnson. Architect at Armstrono. Torseth. Skold & Rvdeen
explained the tank is fiberglass with double walls. The piping i& also
. double walled. Both have monitoring systems. He also explained the
,other safety features being built into the system. The Fire Marshal has
been involved and has been observing the operation. (
Tom Dvkhoff. Adolfson & Peterson - stated the construction has been
completed. Commissioner Jovanovich asked why they didn't come to the
Planning Commission before construction. Mr. Carlberg explained while
going through the review of the site plan, it was determined that a
Special Use Permit was required. The process started immediately, but
the district was also running into a problem with the timing of the
construction. They had it all set up. Staff indicated to the district
not to hold up the construction because the site plan had already been
approved and they didn't see a benefit to holding it up. The Fire
Marshal has reviewed the tanks, and the City is making sure everything
is done properly. The Special Use Permit process is for additional
safety and information for the City.
MOTION by Apel, Seconded by Putnam, to close the public hearing. Motion
carried on a 6-Yes, 1-Absent (Doucette) vote. 8:42 p.m.
MOTION by Luedtke, Seconded by Putnam, to froward to the City Council
the request granting the Special Use Permit for Anoka Hennepin School
District to install underground storage fuel tank located at 15400
Hanson Boulevard'with the five conditions stated by the Staff. Add
"10,000-gallon" underground storage tank in the first, second and sixth
paragraphs. Motion carried on a 6 - Yes, 1-Absent (Doucette) vote. This
will be placed on the December 5, 1995, City Council Agenda. 8:45 p.m.

The Andover Planning and Zoning Commission is asked to review the
Special Use Permit requested by the Anoka Hennepin Independent
School District No. 11 to install a below ground storage tank for
the storage of liquid fuel (fuel oil) at the Oak View Middle
School on the property located at 15400 Hanson Boulevard NW,
legally described on the attached resolution.
The request for the tank is associated with the construction of
the school on said property.
APPLICABLE ORDINANCES
Ordinance No.8, Section 4.26, establishes the criteria for a
Special Use Permit for all uses associated with the bulk storage
of oil, gasoline, liquid fertilizer, chemicals and similar
liquids. By requiring a Special Use Permit, the City has some
assurance that fire, explosion or water or soil contamination
hazards are not present that would be detrimental to the public
health, safety and general welfare.
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process, outlining conditions and procedures.
GENERAL REVIEW
The requested Special Use Permit is for the installation of a
10,000 gallon underground storage tank for fuel oil. The tank
will be required to be installed per State guidelines.
The property is zoned R-l, Single Family Rural. Public Schools
are permitted uses in this district.

RECOMMENDATION
Staff recommends the Special Use Permit requested by Anoka
Hennepin Independent School District No. 11 for the bulk storage
tank be approved with the following conditions:
1. The applicant provide to the City, in writing, proof that the
tank meets all State requirements and regulations.
2. The Wellhead Protection Plan to be adopted by the City of
Andover be considered.
3. The Andover Fire Marshal review the tank and their placement.
4. The request be subject to a sunset clause as specified in
Ordinance No.8, Section 5.03(0).
5. The request be subject to annual review by City Staff.
Attached is a resolution for Commission review and approval.

Dear Mr. Carlberg:
We have recently submitted the application for the above mentioned permit process. As has
been discussed, due to the cold weather approaching, we are proposing to proceed with the
installation of this equipment prior to the completion of the Planning Commission process.
We fully understand that the tank cannot be filled without the approval of the City and the
completion of the approval process. The plans which were submitted to the City have been
designed in full compliance with the Minnesota Pollution Control Agency and the installation will
be fully inspected. We will make every reasonable effort to work with the City Fire Department
and Building Inspection staff to meet their concerns. This procedure will save the School District
substantial cost by avoiding winter construction costs. The risk we are taking is that for some
reason the City refuses to approve the plans as designed and some modification to the
installation would need to be made.
We appreciate your continued cooperation and support of this project and looking forward to
completing the review process at your November 14 Planning Commission. Please call me at

CRITERIA FOR GRANTING SPECIAL USE PERMITS
In granting a Special Use Permit, the City Council shall consider
the advice and recommendation of the Planning and Zoning
Commission and:
1. The effect of the proposed use upon the health, safety,
morals and general welfare of occupants of surrounding
lands.
2. Existing and anticipated traffic conditions including
parking facilities on adjacent streets and lands.
3. The effect on values of property and scenic views in the
surrounding area.
4. The effect of the proposed use on the Comprehensive Plan.

2.01 MANUFACTURERS
A. Double Wall Fiberglass Underground Fuel Oil Tanks: Tanks shall be as manufactured by
Owens-Corning Fiberglas, or approved equal.
1 . Approved Equals: Xerxes.
B. Tank Monitoring And Leak Detection Systems: Tank monitoring and leak detection systems;
featuring inventory control, in-tank leak detection, interstitial leak detection, containment
sump sensing, and over-fill alarm shall be Veeder-Root Model TLS-350, or approved equal.
1. Approved Equals: Pneumercator, Petro Vend.
2.02 DOUBLE WALL FIBERGLASS UNDERGROUND FUEL OIL TANKS
A. General Requirements:
1. Materials: Tanks shall be manufactured of fiberglass reinforced plastic using polyester
resins with glass fiber reinforcement.
2. Annular Space: Tank shall have a space between primary and secondary shell walls to
allow for free flow and containment of leaked products from the primary tank.
3. Strike Plate: Primary storage tank shall have deflector plates located directly below
openings into tank. Deflector plates shall be of fiberglass resin to be an integral part of
tank shell.
B. Tank Capacity: Tank shall have a capacity of 10.000 gallons with the diameter and length
indicated on Drawings.
C. Loading Conditions: Tanks shall meet the following design criteria:
1. External Hydrostatic Pressure: Buried in ground with 7 feet of overburden over top of
tank. Hole fully flooded and a safety factor of 2 to 1 against general buckling.
2. Surface Loads: When installed in accordance with manufacturer's installation
instructions, tanks shall withstand surface H-20 axle loads (32.000 pounds per axlel.
3. Internal Load: Primary tank and annular space shall withstand independent pressure test
of 5 psi on tanks of 4-foot through 1 a-foot diameters, resulting in a 5 to 1 safety factor.
4. Design tanks to support accessory equipment, including heating coils, ladders, drop
tubes, and piping sumps when installed in accordance with manufacturer's
recommendations and limitations.
D. Product Storage Requirements: Tanks shall be designed for operation at atmospheric
pressure and, therefore, shall be vented.
1. Tanks shall be capable of storing liquids with specific gravity up to 1.1.

2. Tanks shall be capable of storing fuel oil at temperatures not to exceed 150 degrees F
at tank interior surface.
3. Tanks shall be chemically inert to petroleum products.

1 . Lid inside diameter shall be a minimum of 1 inch larg~r than the outside diameter of the
manway cover.
H. Fittings and Connections:

2.03 ACCESSORIES

tank with a safety factor of 3.
C. Hold-Down Straps: Provide glass fiber-reinforced plastic anchor straps as supplied by tank
manufacturer. Number and location of straps shall be as specified by manufacturer. Straps'
shall be capable of withstanding buoyancy load for tank diameter.
D. Certification Plate: Underwriters' laboratories label shall be permanently affixed to tank.
E. Fill Cap and Spill Containment Vessel:
1. Fill cap shall be McDonald Model 267-C, or approved equal, 4-inch Almag 35 aluminum
cap with a spring loaded brass locking latch. Latch shall have provisions for padlocking.
2. Spill containment vessel shall be Flex Catch Model 705-258G, below grade, 25-gallon
recovery vessel, as manufactured by EBW ,Inc., or approved equal. Vessels shall include
an la-inch round access manhole with fiberglass lid, a light weight aluminum cover, cast
iron attachment ring, cast iron base, and a cement and gravel guard around beltows:

2.05 FUEL OIL PIPING
A. Fiberglass Piping: Fuel oil supply and return piping. fill. vent. sounding line and oil supph

or approved equal. Refer to Section 15592. Containment piping shall pitch down towar
containment sump.
B. Piping in Boiler Room: Piping in Boiler Room shall be black standard weight steel pipe wit.
malleable iron fittings.
C. Steel Piping: Contractor. at his option. may use steel piping in lieu of fiberglass piping. Fue
oil supply and return piping. fill. vent. and sounding line piping above and below ground ma
be black standard weight steel piping with malleable iron fittings. Steel pipe and fitting,
below grade shall be given one coat of bitumastic paint with special care to cover exposec
threads. Oil supply and return containment piping and fittings shall be fiberglass.
PART 3. . EXECUTION
3.01 PERMITS
A. Permits. Fees. and Notices: Contractor shall contact State and local Fire Marshals. obtair
required permits. and pay fees necessary for the installation of fuel oil tank/sl and piping
connections to boilers and other fuel burning apparatus.
3.02 INSTALLATION INSTRUCTIONS
A. General Requirements: Install fiberglass underground tank(s} in accordance with Owens-
Corning Fiberglass Installation Instructions. Publication 3-PE-6304 to include excavation anc
backfill.
1. Installation is related to the procedure for steel tanks, following NFPA 30 and 31
practices. However. backfill shall be washed pea gravel type material, a naturally-
rounded aggregate 1/4-inch nominal size. ranging from liS-inch to 3/4-inch diameter.
2. If pea gravel is not available in a specific area. washed stone crushings 1 IS-inch to 1/2-
inch diameter. meeting requirements of ASTM C33. may be used with satisfactory
results. Other backfill materials shall not be used without consulting Owens-Corning
Fiberglass.
B. Excavation: Tank excavation shall be free from material that may cause damage to tank.
Care shall be taken during installation that foreign matter is not introduced into excavatien
or backfill. Bottom of the excavation shall be hand leveled.
C. Hold Down Pad: Provide concrete hold down pad as shown on Drawings. Tank(s) shall be
separated from concrete slabs by at least 1 foot of washed pea gravel.
1. Concrete pad shall be 12 inches thick and shall extend 12 inches beyond tank in all
directions. Reinforce pad with two mats of No.5 reinforcing bars. 12 inches on center
in both directions.

D. Tank Placement: Prior to placing tank in excavation, foreign matter shall be cleaned from
tank. Equipment to lift tank shall be of adequate size to lift and lower tank without dragging
and dropping to ensure no damage to tank. Tank shall be carefully lifted and lowered by use
of cables or chains attached to lifting lugs in accordance with manufacturer's
recommendations. Under no circumstances shall chains or sling be used around tank shell.
1. Line sides and bottom of excavation with filter fabric. Overlap adjoining fabric panels
a minimum of 12 inches. Place backfill on top of filter fabric in and around excavation
perimeter to hold fabric in place.
2. Hold-down pads shall be set and covered with 1 foot of backfill prior to placement of
tank.
E. Hold-Down Straps: Hold-down straps shall be fiberglass (FRPI and shall be of quantity and
location recommended by tank manufacturer.
F. Backfill: Place backfill, consisting of pea gravel. along bottom sides of tank by hand
shoveling and tamping to ensure that tank is fully and evenly supported around bottom
quadrant.
1. Backfill shall be deposited carefully around tank and to a 12-inch depth over tank to
avoid damage to tank.
a. Tamp backfill to 90 percent Standard Proctor Density.
2. Install a second layer of filter fabric 1 foot above tank. Backfill above this layer shall be
similar to material excavated, but shall be clean of foreign matter or material that may
puncture fabric.
a. Tamp backfill to 98 percent Standard Proctor Density.
3.03 FUEL OIL PIPING
A. Installation: Install fuel oil supply, return, fill. and vent piping on undisturbed or compacted
fill as specified. Refer to Section 15592, Fiberglass Fuel Oil Pipe and Fittings.
B. Concrete Slab on Grade: Provide a 1 Q-inch thick mesh-reinforced concrete slab around
manholes and street boxes. Slabs shall extend to a minimum of 1 foot beyond manholes and
boxes. Top of slab shall be 1 inch above finished grade or sod.
3.04 FIELD QUALITY CONTROL
A. Above Ground Pressure Test: An air test of tank(s) above ground is required. Pressure shall
not exceed 5 psig. as measured at top of tank, while a soap bubble solution is applied to
seams and fittings.
B. Below Ground Pressure Test: Before backfilling, a final air test shall be made. Pressure shall
not exceed 5 psig. as measured at top of tank, while a soap bubble solution is again applied
to seams and fittings.

2.03 CONFIGURATION
A. Alignment: Unitary double-walled fittings which are molded shall be used throughout.
Permanent alignment of the inner and outer fittings shall be maintained via molded in ribs.
The ends of both the inner and outer fittings shall be flush (in one plane).

of any fluids in the annular space. No fabricated fittings shall be allowed.
8. Configuration: One piece double containment pipe shall be used. The primary pipe shall be
integral with the secondary pipe via connecting ribs which are continuous down the entire
length of each section of pipe. No centralizing chips, spiders, disks or supports shall be
allowed.
C. Wall Thickness: The inner and outer walls shall be identical wall thicknesses.
O. Pressure Control: Piping systems shall be fitted with at least one molded outer wall adapter
with integral burst disk.
2.04 PRESSURE RATING
A. Pipe and Fittings: Pipe and fittings shall be rated for 75 psi in each size and material.
8. Fittings: Inner and outer fittings shall both be rated for 75 psi. including, but not limited to.
termination fittings, transition fittings. and drainage fittings.
2.05 JOINING METHODS
A. Field Welding: Field welding shall be butt welded in accordance with the general guidelines
of ASTM 02657 for polyolefin piping and in accordance with the manufacturer's printed
guidelines.
1. Welding parameters shall be computer controlled to provide consistency of the welds.
Fully automatic closed-loop control shall apply the various pressures required throughout
the entire welding procedure.

B. Welding Machine: The AutoWeld 400 System, as manufactured by Poly-Flow Engineering,

2.06 CONTAINMENT BOX
I
A. Materials: Materials of construction shall be suitable for the fluid service intended. The box
shall be of the same material as the inner and outer piping of the system. Where appropriate,
clear PVC Type I. Grade I, can be used as the front cover of the box.

B. Pressure Rating: The pressure rating of the piping components shall be at least the same as
the piping system's and shall have been hydrostatically tested to 125 psi. The pressure
rating of the containment box shall be 5 psi.

C. Inlet/Outlet: The containment box shall have dual O-ring flanges welded on to the inlet and
outlet ports to allow installation and removal without cutting into the system.

D. Plumbing Connections: Containment boxes shall be vented and drained.

E. Alarm Detection: Containment boxes shall have a float switch or optical probe as a leak
detector wired to the appropriate alarm system.

2.07 LEAK DETECTION

A. General Requirements: Leak detection shall be provided to monitor the integrity of the
secondary containment in accordance with local administrative authority.
B. Alarm Devices: Float switch adapter fittings shall be appropriately spaced to allow the use
of either magnetic reed switches or optical probes as sensing devices. These shall be wired
to a suitable alarm system.

3.01 INSTALLATION AND SUPPORT
A. Procedures: Installation procedures shall be in accordance with manufacturer's written
specifications. Pipe support shall be adequate to prevent any appearance of sagging.
1. Standard design practice for single wall thermoplastic piping with regards to expansion
and contraction shall be followed.
2. Valves and other auxiliary items shall be independently supported.
B. Periodic Inspection: O-rings shall be inspected during installation to verify surface quality
and, as with all sealing materials. periodic inspections may be appropriate.
1. Stainless steel bolts, nuts, and washers shall be used for flange assembly.
C. Instrumentation and Valving: Gauges, regulators, valves, and similar items shall be
secondarily contained either by a specific location, Le. "wet room areas.. or via a
containment box supplied by the manufacturer of the piping system.
D. Dual Wall Piping: Dual wall piping shall be laid on a 1-foot deep bed of sand or pea gravel.
Backfill with the same material shall be done by hand until pipe is covered with 1 foot of
sand or pea gravel.
3.02 SYSTEM TESTING
A. Air Pressure Test: Air pressure tests shall not be allowed.
B. Hydrostatic: Hydrostatic testing of both the inner and outer pipes shall be performed as
outlined in the Uniform Plumbing Code Section 318 as directed by the local administrative'
authority.

NOTICE OF PUBLIC HEARING
The Planning and Zoning Commission of the City of Andover will
hold a public hearing at 7:00 p.m., or as soon thereafter as can
be heard, on Tuesday, November 14, 1995 at the Andover City Hall,
1685 Crosstown Blvd. NW, Andover, MN to review the Special Use
Permit request of the Anoka-Hennepin Independent School District
No. 11 to install an underground tank for the bulk storage of fuel
oil for the new Oak View Middle School on the property located at
15400 Hanson Boulevard NW, legally described as follows:
A part of the South Half of the Northeast Quarter of Section 22,
Township 32, Range 24, Anoka County, Minnesota.
All written and verbal comments will be received at that time and
location.
A copy of the application and location will be available at
Andover City Hall for review prior to said meeting.

REQUEST
The City Council is asked to postpone the decision on the need
for an Environmental Impact Statement (EIS) for the development
known as Shadowbrook, generally located northeast of the
intersection of prairie Road and Bunker Lake Boulevard NW.
An Environmental Assessment Worksheet (EAW) was reviewed and
approved by the Council for circulation and public comment. The
public comment period ended November 22, 1995. A number of
agencies responded during the comment period requesting additional
information regarding wetlands, etc. Based on the comments
received, staff is recommending the Council postpone the decision
on the need for an EIS for 30 days in order to obtain the lacking
information per 4410.1700, Subp. 2a (attached).
Staff will provide written notification of the Council's decision
as required by the Environmental Quality Board (EQB).

The RGU may hold one or more public meetings to gather
comments on the EAW if it determines that a meeting is necessary
or useful. Reasonable public notice of the meetings shall be

4410.1700 DECISION ON NEED FOR EIS.
Subpart 1. Standard for decision on need for ErS. An EIS
shall be ordered for projects that have the potential for
significant environmental effects.
Subp. 2. Decision-making process. The decision on the
need for an EIS shall be made in compliance with one of the
following time schedules:
A. if the decision is to be made by a board, council,
or other body which meets only on a periodic basis, the decision
shall be made between three and 30 days after the close of the
review period; or
B. for all other RGU's the decision shall be made no
later than 15 days after the close of the 30-day review period.
This lS-day period shall be extended by the EQB chair by no more
than 15 additional days upon request of the RGU.
Subp. 2a. Insufficient information. If the RGU determines
that information necessary to a reasoned decision about the
potential for, or significance of, one or more possible
environmental impacts is lacking, but could be reasonably
obtained, the RGU shall either:
A. make a positive declaration and include within the
scope of the EIS appropriate studies to obtain the lacking
information; or
B. postpone the decision on the need for an EIS, for
not more than 30 days, in order to obtain the lacking
information. If the RGU postpones the decision, it shall
provide written notice of its action, including a brief
description of the lacking information, within five days to the
project proposer, the EQB staff, and any person who submitted
substantive comments on the EAW.
Subp. 3. Form and basis for decision. The RGU's decision
shall be either a negative declaration or a positive
declaration. If a positive declaration, the decision shall
include the RGU's proposed scope for the EIS. The RGU shall
base its decision regarding the need for an EIS and the proposed
scope on the information gathered during the EAW process and the
comments received on the EAW.
Subp. 4. Record of findings supporting decision. The RGU
shall maintain a record, including specific findings of fact,
supporting its decision. The record must include specific

responses to all substantive and timely comments on the EAW.
This record shall either be a separately prepared document or
contained within the records of the governmental unit.
Subp. 5. Distribution of decision. The RGU's decision
shall be provided, within five days, to all persons on the EAW
distribution list pursuant to part 4410.1500, to all persons
that commented in writing during the 30-day review period, and
to any person upon written request. All persons who submitted
timely and substantive comments on the EAW shall be sent a copy
of the RGU's response to those comments prepared under subpart
4. Upon notification, the EQB staff shall publish the RGU's
decision in the EQB Monitor. If the decision is a positive
declaration, the RGU shall also indicate in the decision the
date, time, and place of the scoping review meeting.
Subp. 6. Standard. In deciding whether a project has the
potential for significant environmental effects the RGU shall
compare the impacts that may be reasonably expected to occur
from the project with the criteria in this part.
Subp. 7. Criteria. In deciding whether a project has the
potential for significant environmental effects, the following
factors shall be considered:
A. type, extent, and reversibility of environmental
effects;
B. cumulative potential effects of related or
anticipated future projects;
C. the extent to which the environmental effects are
subject to mitigation by ongoing public regulatory authority;
and
D. the extent to which environmental effects can be
anticipated and controlled as a result of other environmental
studies undertaken by public agencies or the project proposer,
or of EIS's previously prepared on similar projects.
Subp. 8. (Repealed, 13 SR 1437]
Subp. 9. Connected actions and phased actions. Connected
actions and phased actions shall be considered a single project
for purposes of the determination of need for an EIS.

project, and other persons to evaluate proposed projects which

consider alternatives to the proposed projects, and to explore
methods for reducing adverse environmental effects.

The City Council is requested to review and approve the preliminary plat of
Devonshire Estates per Ordinance 8 and 10 and all other applicable ordinances
and policies as requested by Dave Harris.
The Andover Review Committee (ARC) has reviewed the preliminary plat. Their
comments are as follows:
General Comments
I
. The proposed preliminary plat is currently zone R-1, Single Family Rural. In
addition, the proposed plat is not within the Metropolitan Service Area
(MUSA).
. The proposed subdivision consists of 16 single family rural residential lots.
. The developer and/or owner is responsible to obtain all necessary permits
(DNR, U.S. Army Corps of Engineers Coon Creek Watershed District, LGU,
MPCA and any other agency which may be interested in the site).
Comments of the Andover Review Committee
The Andover Review Committee has found the following variances that are
being requested as part of the preliminary plat.

1. Variance from Ordinance 8, Section 6.02 and Ordinance 10, Section 9.06 A3
as the lots do not meet the minimum requirement of 300 feet at the front
setback line. The developer is requesting variances from the following: Block
3, Lot 6.
2. A variance from Ordinance 10, Section 9.06 F for Block 3, Lot 6 as it is
proposed to have double frontage. The double frontage lot is proposed as
University Avenue NW is a designated Municipal State Aid Street which
Ordinance 10, Section 9.02 C does not allow access to. Also, access from

University Avenue NW is restricted on this lot due to the existing wetlands
between the house pad and University Avenue NW.
The Andover Review Committee has reviewed the variances. Because the
variances will not have an effect on the health, safety and general welfare of the
community, it is recommended to approve the preliminary plat.
Plannina and Zonina Commission Recommendation
The Commission at their November 14, 1995 meeting did hold a public hearing
with a few comments made by the public regarding drainage and how the runoff
from streets will be treated. The Commission is recommending approval of the
preliminary plat as presented.
Park and Recreation Commission Recommendation
The Commission at their November 16, 1995 meeting is recommending cash in
lieu of land as determined in Ordinance 10, Section 9.07.
General Information Per Ordinance 10
8.01 IDENTIFICATION AND DESCRIPTION
a. Proposed name is Devonshire Estates.
d. Scale is 1" = 100'
g. The preliminary plat and the grading, drainage and erosion control plan was
prepared by Pioneer Engineering.
8.02 EXISTING CONDITIONS
b. Total acreage is 72.58.
c. The existing zoning within 300 feet of the proposed plat has been shown.
f. Location of all existing telephone, gas, electric and other
underground/overhead facilities are shown on preliminary plat per ordinance
requirements.
g. The boundary lines within 100 feet of the plat have been shown along with
the names of the property owners.
h. A Tree Protection Plan has been submitted to the Tree Inspector for review.
The plan shall be approved by the Tree Inspector prior to any construction.
j. A soil boring report has been received by the City. All unbuildable soils will
be required to be removed within all right-of-ways and buildable areas for
each lot.
8.03 DESIGN FEATURES
a. The proposed right-of-way as indicated is 60 feet.
c. The storm drains and streets plan and profile will be designed by the
developer's engineering consultant and will need to be reviewed and
approved by the City Engineer.
g. The setbacks for each lot are shown.
h. The proposed method of disposing of surface water has been shown on the
grading, drainage and erosion control plan. The developer is required to
comply with the Water Resource Management Plan that was approved in
January 1993.
8.04 ADDITIONAL INFORMATION
b. Source of water supply is private well.
c. Sewer disposal facilities will be private septic system.
d. Rezoning of properties will not be required.
f. Flood Plain Management is the Coon Creek Watershed District (see Section
9.04(b) for additional information regarding the 100 year flood elevation).
g. Street lighting is required and the installation costs will be paid by the
developer.
J. The total linear road mileage for the proposed plat is 0.64 miles.
9.02 STREET PLAN
a. The typical section, right-of-way and grade are indicated on the preliminary
plat.

a. The proposed right-of-way is shown as 60 feet which conforms to stardards
by classification.
m. Driveway access shall be 60 feet or more from any intersection.
n. Boulevard is required to be topsoil, seeded and mulched (disc anchored) to
provide erosion control.

b. A drainage easement has been shown to follow the 100 year flood elevation.

WHEREAS, pursuant to published and mailed notice thereof, the
Planning and Zoning Commission has conducted a public hearing; and
WHEREAS, the Andover Review Committee has reviewed the preliminary

WHEREAS, as a result of such public hearing, the Planning and Zoning
Commission recommends approval of the plat citing the following:
1. A variance be granted for Ordinance 8, Section 6.02 and Ordinance 10,

Note: The City Council in their review should consider 3 options in making their
decision of the preliminary plat. These options are as follows:
1. Approve the preliminary plat that has been presented in current form.
2. Approve the preliminary plat with contingencies.
3. Deny the preliminary plat as the preliminary plat does not meet the
requirements of Ordinance 10, Section 9.02 A and B as the development does
not provide access to the south from Xkimo Street NW and does not meet
Ordinance 10, Section 9.061 as Outlot A is considered a unusable parcel.
The Planning and Zoning Commission recommended approving the preliminary
plat with contingencies, but unfortunately at this time the developer as we
understand is not willing to comply with those contingencies. Therefore, the
Andover Review Committee is recommending Option 3 which is to deny the
preliminary plat as presented.

Comments of the Andover Review Committee
The Andover Review Committee has found the following variances that are
being requested as part of the preliminary plat.
1. Variance from Ordinance 8, Section 6.02 and Ordinance 10, Section 9.05 as
the streets of 172nd Street NW, Tonto Street NW and 171st Avenue NW
between Xkimo Street NW and Roanoke Street NW exceeds maximum length
of 1320 feet. Length proposed is approximately 2027 feet.
2. A variance from Ordinance 10, Section 9.06 I as Outlot A is below minimum
lot area and is considered an unusable parcel. The outlot does have existing
wetlands.
Note: The Andover Review Committee is recommending Outlot A be split from
the parcel prior to the final plat and combined with the adjoining parcel
to the south.
3. Variance from Ordinance 10, Section 9.06 A3 as Lots 2,3 and 4 of Block 1 do
not meet the 39,000 square foot requirement. 29,000 square feet meets
ordinance requirements, with the remaining 10,000 square feet that do not.
Note: The development of the property is proposed to be a little different than
other rural developments within the City due to the existing types of soil
encountered during the soil boring exploration. This development
contains a sand/clayey loam which is different than the soil in the rest of
the City. Because of these different types of soils, the septic systems
had to be designed in a different way. First of all, the drain field had to
be designed on the existing ground on each lot. These areas were
allotted 5000 square feet and another 5000 square foot area was
allotted for an alternate system for each lot. All lots are being designed
for a minimum of a four bedroom home. Each drainfield area will be I
located and a covenant will be recorded with each lot. This type of
design is new to Andover but has been used in Hennepin and
Washington Counties for some time. The area buildable for each lot is
as follows: 10,000 S.F. for drainfield not graded or encroached upon and
29,000 S.F. for those lots graded to meet the minimum 6 foot water table
requirement.
Note: New septic laws will be enacted next year that will prohibit drainfields
from being installed on any fill soils. If the drainfield cannot be located
on natural ground, the lot becomes unbuildable.
We felt this was the best way to resolve the issues with this plat and any future
plats. The ordinance will need to be changed to reflect this for future rural plats
and all other lots being built on.
The Andover Review Committee has reviewed the variances. Because the
variances will not have an effect on the health, safety and general welfare of
the community, it is recommended to approve the preliminary plat.
Additional Comments bv the Andover Review Committee
1. The Fire Department is concerned regarding the lack of a second access until
the adjacent properties develop. Also in addition to this, the south end of
Xkimo Street NW is recommended by the ARC to be extended to the south
property line to allow for access and circulation for future development of the
adjacent property as required by Ordinance 10, Section 9.02 A & B. See
attached drawing proposed by the developer and proposed by the property
owners to the south.
Note: The preliminary plat that has been presented to the City Council
provides the right-of-way to the south but the developer is not in favor of
constructing the street to the edge of the plat which is required. The
developer and his engineer are aware of the requirement. If the City
Council accepts the right-of-way but does not require the street to be
constructed to the edge of the plat it will be necessary to determine
where the funds would come from to pay for the construction. The past
practices on new developments by the City is to construct to the property
lines as required.
2. Attached is a letter form the Anoka County Highway Department in regards to
access of 173rd Avenue NW to CSAH 7. It is recommended by the City
Engineer that 173rd Avenue NW be eliminated and redesign the plat to serve
Lot 4, Block 1 from the intersection of 172nd Avenue NW and Tonto Street
NW. A couple of options exist:
A. Construct a permanent cul-de-sac north from the intersection of 172nd
Avenue NW and Tonto Street NW. (The preliminary plat that has been
presented shows this option.)
B. Construct a street from 172nd Avenue NW to 173rd Avenue NW with a
temporary cul-de-sac until 173rd Avenue NW is constructed.
Note: The preliminary plat that has been presented shows a portion of
173rd Avenue NW be eliminated and attached to Lot 4, Block 1.
But also a private easement also exists which in the past has been
required by the City to be removed or vacated by the
property owner. But in this case, if the City were to do this the
Schnelzer property would not have an access to his home.
Plannina and Zonina Commission Recommendation
The Commission at their November 14, 1995 meeting did hold a public hearing
with some comments were made from the property owner to the south in regards
to property access to the south to allow for future development (see drawing
submitted by the developer). Otherwise the Commission agrees with the
Andover Review Committee on all items in regards to the variances, disposing of
Outlot A to the property owner to the south and eliminating reconfiguring 173rd
Avenue NW to create lots and attach to adjoining properties to avoid remnant
parcels that are unusable and to extend Xkimo Street NW south to the south
property line.
Park and Recreation Commission Recommendation
The Commission at their November 16, 1995 meeting is recommending cash in
lieu of land as determined in Ordinance 10, Section 9.07.

We have reviewed the preliminary plat of Rolling Meadows Estate, to be located west of
CSAH 7 (7th Avenue) and south of 173rd Avenue NW within the City of Andover, and I
offer the following comments:
Existing Ri~ht-of- Way adjacent to CSAH 7 should be adequate for future
reconstruction purposes (60 feet total R/W width west of CSAH 7 R/W
centerline). It appears that some clearing will be required to meet Case I
Si~ht Distance Requirements at the CSAH 7/171st Ave. NW intersection.
Given the existing access on the east side of CSAH 7 near the proposed
alignment of 171st Ave. NW, it is recommended that 171st Ave. NW be
relocated slightly to the north, to line up directly opposite this existing
access. Due to a vertical curve to the north on CSAH 7, Case IV Sight
Distance Requirements cannot be met for the proposed alignment of 173rd
Ave. NW. Because sight distance requirements cannot be met, and the proposed
alignment creates a misaligned intersection with the existin~ location of 173rd
Avenue NW on the east side of CSAH 7, it is recommendea that the plat be
re-worked, and 173rd Avenue NW be eliminated. The City and tbe Developer
should ensure that intersection Sight Distance Requirements are met for this
development Since it is assumed that all lots will access city streets,
right-or-access along CSAH 7 (with an exception at 171st Ave. NW) should be
dedicated to Anoka County. Any trees or inplace field accesses along CSAH 7
are to be removed as a part of this development
Calculations must be submitted along with a grading and erosion control plan
that delineates the drainage areas. The post-developed rate/volume of runoff
must not exceed the pre-developed rate/volume of runoff for the 100year,
24-hour storm, utilizing the "SCS Method" with a curve number determined using
Group C soils as a minimum.

An access permit and a permit for work within the County Right-of-Way is required
and must be obtained prior to the commencement of any construction. Contact
Roger Butler, Traffic Engineering Coordinator for this department, for
further information regarding the permit process.
It should be noted that residential land use adjacent to highways will usually
result in complaints regarding traffic noise. Traffic noise at thIS location
could exceed Noise Standards established by the US Department of Housing and
Urban Development and the Minnesota Pollution Control Agency. Anoka County
policy regarding new developments adjacent to existing County Highways prohibits

ROLLING MEADOWS ESTATES AS BEING DEVELOPED BY TSM
DEVELOPMENT. INC. LOCATED IN SECTION 12, TOWNSHIP 32,
RANGE 25, ANOKA COUNTY.
WHEREAS, pursuant to published and mailed notice thereof, the
Planning and Zoning Commission has conducted a public hearing; and
WHEREAS, the Andover Review Committee has reviewed the preliminary
plat; and
WHEREAS, as a result of such public hearing, the Planning and Zoning
Commission recommends approval of the plat contingent upon the following:
1. A variance from Ordinance 10, Section 9.05 as the streets of 172nd Avenue
NW, Tonto Street NW and 171st Avenue NW between Xkimo Street NW and
Roanoke Street NW exceeds maximum length of 1320 feet. Length proposed
is approximately 2027 feet but eliminate the name of 172nd Avenue NWand
Tonto Street NW to have the same name for the entire length between Xkimo
Street NW and Roanoke Street NW.
2. Variance from Ordinance 10, Section 9.061 as Outlot A is below minimum lot
area and is considered an unusable parcel. It is required to eliminate the
variance for and require it to be conveyed to the southerly property owner
prior to final plat approval.
3. Variance from Ordinance 10, Section 9.06 A3 as Lots 2, 3 and 4 of Block 1 do
not meet the 39,000 square foot requirement. 29,000 square feet of each lot
meets ordinance requirements with the remaining 10,000 square feet of each
lot that do not.
4. Require the outlots created on the northerly edge of the property along the
proposed 173rd Avenue NW west of Roanoke Street NW be attached to the
nearest lot to avoid unusable outlots.
5. Street plan and profile of streets and storm sewers be submitted, reviewed
and approved by the City Engineer.
6. The developer is responsible to obtain all necessary permits from the Lower
Rum River WMO, DNR, U.S. Army Corps of Engineers, LGU, MPCA and any
other agency that may be interested in the site.
7. Park dedication as recommended by the Park and Recreation Commission.
8. That the private easements for 173rd Avenue NW be eliminated from the
preliminary plat as required.
9. That the cul-de-sac from Xkimo Street NW be relocated and extended to the
south most property line of the preliminary plat.
10To create a cul-de-sac to serve Block 1, Lot 4 extending to the north.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby approve the preliminary plat of Rollinq Meadows Estates.

NECESSARY FORMS TO RECONVEY TO THE STATE OF MINNESOTA A PARCEL OF
LAND ACQUIRED BY THE CITY OF ANDOVER FOR PUBLIC PURPOSES AND TO
REPURCHASE THE PROPERTY FOR PRIVATE SALE BY THE CITY.
WHEREAS, the City of Andover acquired a tax forfeit parcel
of property described as Lot 1, Block 1, Hartfiel's Estates on
October 12, 1984; and
WHEREAS, the purpose of the purchase of the parcel was for
ponding until such time as the city installed a storm sewer
system; and
WHEREAS, the city has constructed said storm sewer system
and has no further need of the parcel.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to authorize the Mayor and City Clerk to complete
the necessary forms to reconvey Lot 1, Block 1, Hartfiel's
Estates to the State of Minnesota.

BE IT FURTHER RESOLVED that the City Council of the City of
Andover authorizes the Mayor and City Clerk to complete the forms
necessary to purchase the parcel for private sale by the city
after it has been reconveyed to the State.

On August 5, 1995 the Andover City Council authorized the consulting firm of
TKDA to prepare the plans and specifications for the Commercial Boulevard
Extension. TKDA is currently in the process of completing the site survey of the
area and is beginning the project design. The City has also retained the land
surveying firm of Hy-Land Surveying to create a right-of-way plat for this street.

As the City has purchased a number of properties within this area, the City
Council is asked to include the grading of these parcels as part of the street
construction project. This would provide for some economies as some of the
storm ponding areas could be constructed and material from these sites could
be used for the construction of Commercial Boulevard.

We are also asking the Council to consider including ornamental lighting and a
concrete sidewalk along Commercial Boulevard.
The City Council is also asked if they have additional inclusions or requests of
the City's consulting firm to look at or include with this project at this time.

The City Council is requested to consider, for discussion purposes, expanding
park use with the hiring of a Parks and Recreation Director.
In the last 2 years there has been explosive growth of park facilities along with
the demand for use of those facilities. Problems are developing with scheduling,
programming, maintenance and billing for use of City park facilities.
Volunteers who have given up thousands of hours of personal time need
assistance with the coordination of programs.

A PARK AND RECREATION DIRECTOR IS NOT intended to replace any of the
volunteer organizations presently in existence. The City simply could not
duplicate the efforts of the various athletic associations, nor is it necessary.
What is necessary is for the City to begin giving the organizations a helping
hand by continued assistance in scheduling and also providing space, material
and times for program registration and coordination.

maintaining facilities and equipment to carry out those
programs to meet the needs of the citizens within budget
conscraints.
MAJOR RESPONSIBILITY AREAS AND TrME SPENT:
1. Manage long term Park & Recreation planning and
development:
a. Review and recommend parks and recreational
areas and facilities. Create opportunities
for park uses, acquire, develop physical
facilities and administer a maintenance and
operations program for the city parks.

Identify short and long term issues.
recommend solutions and implement corrective
and/or preventative programs in park and
recreation. Coordinate long and short term
planning including City planning,
comprehensive plans. in addition to
coordinating with other governmental units
and private concerns that affect the city.
c. Coordinate Parks & Recreation requirements
and facilities needs and improvements with
Public Works improvements, and with City
planning activities as they affect Parks and
Recreation facilities and or opportunities.

5. Act as staff liaison to the Park and Recreation
Committee. Ensure that input and communication
through the Council representative is completed,

Coordinate with other city commisions to ensure
cooperative efforts.
6. Supervise the Reforestation program and administer
the diseased tree control program. Oversee any
tree replacement needs both short and long ~erm.
Work with other city departments to ensure that
the tree and park dedication programs are
implemented.
7. Establish and maintain communication links with
the public through the use of the staff. city
newsle~ter, cable TV and the general media of
programs, special events, facility improvements,
etc.

Act in a full management capacity to coordinate
the Department's personnel system. This includes
all employee issues inclUding hiring. performance
reviews, discipline, and handling complaints
within this Department. Advise the Administrator
as necessary.
9. Manage the Park Fund capi~al projects. Review and
recommend both short and long term projects in
accordance with the department and City goals.
Adjust as necessary during the interim. Seek
input from the public, Council. Park & Recreation
Commi~tee, o~her city departments and other
persons as required. Ensure that annual
objectives are implemen~ed.
10. Manage all park maintenance construction projects
and capital improvements in city parks. Review
all specifications and planning for adherence to
City expectations. Coordinate other city projects
to ensure park and recrea~ion issues are
addressed.
11. Plan. prepare and administer the Department
budget. Seek al~ernative sources of revenue
through grants, private funding or other
assistance, join~ effor~s and innovative programs.

The City Council is requested to consider an increase in the
contract for Peach Associates. Attached is the proposal which
would increase City Council minutes from $21/hour to $22/hour
plus an increase from $7.50 per typewritten page to $7.80 per

be increased from $18.30/hour to $19/hour and an increase from

Ms. Peach has not had an increase since 1994. The proposed

The Honorable Mayor and Council:
Enclosed is an updated contract between the City of Andover and
Peach Associates, Inc., for the taking and transcribing of
Minutes of the City Council and the various other Committees and
Commissions.
The contract proposes an increase in the 1996 rates; however, it
should be noted that this is the first increase since 1994.
City Council -Increase from $21/hour to
$22/hour of meeting
Increase from $7.50/typewritten page to $7.80 per
/ typewritten page of Minutes
Commissions and Committees - Increase from $18.30/hour to
$19/hour of meeting
Increase from $7.50/typewritten page to $7.80 per

The proposals equates to a 4.1 percent increase, or about 2
percent for each of the last two years. As always, I have been
very careful to keep the costs to the City down, often times not
charging for pages of less than one-half, for running a few
minutes to the next meeting, or for meeting the needs of the
Staff for copies of minutes or motions quickly.
I look forward to continuing my service to the City of Andover
and, as always, appreciate the support the Council and the Staff
has given me over the years. Thank you.

CONTRACT AGREEMENT

This contract agreement between PEACH ASSOCIATES, INC., 15830
University Avenue NW, Andover, MN and the CITY OF ANDOVER, 1685
Crosstown Boulevard NW, Andover, MN shall be effective beginning
Tuesday, January 2, 1996, and may be terminated by written notice
within 60 days by either party.
The contract agreement includes the following:
1. Peach Associates, Inc., agrees to provide the City of Andover
with one Copy of Minutes for City Council, Planning and
Zoning Commission, Park and Recreation Commission, Tree
Commission, plus any other committee meetings so directed by
the City, within seven working dates after the date of the
meeting.
2. The City of Andover shall provide City letterhead for the
first page of the Minutes, tapes for recording the meetings,
and supporting Agenda material for the meetings. All other
supp~ies shall be furnished by Peach Associates, Inc.
3. The City of Andover agrees to pay Peach Associates, Inc.:
City Council - $22 per hour or fraction of for meeting
attendance and one-half hour of travel time ($11) per
I meeting; plus $7.80 per typewritten page of Minutes

WHEREAS, on December 12, 1995, the County Board of the County of Anoka,
intends to adopt a resolution revising the designation of Coun!)' State Aid Highway
Numbers 7, 16, 78 and 116 within the corporate limits of the City of Andover as follows:
That County Road 116 (Bunker Lake Boulevard) from Crooked Lake
Boulevard (Old County State Aid Highway 18) to County State Aid Highway
17 (Lexington Avenue NE) be designated as County State Aid Highway 116.
The length of this segment is 8.755 miles.
That Anoka County revoke the designation of County State Aid Highway
16 (Andover Boulevard NW /NE) from County State Aid Highway 78
(Hanson Boulevard) to TII 65 with said revocation 3564 miles in length.
That County Road 116 (Bunker Lake Boulevard/Industry Ave. NW) from
County State Aid Highway 9 (Round Lake Boulevard) to County Road 57
(Sunfish Lake Boulevard) be designated as County State Aid Highway 116.
This segment is 4.136 miles in length.
The Anoka County Board designates County Road 7 (Rum River Boulevard)
from County State Aid Highway 27 to County State Aid Highway 22 (Viking
Blvd.) as County State Aid Highway 7. This segment is 2.289 miles in length.
The Anoka County Board revokes the County State Aid Highway designation
on County State Aid Highway 27 (179th Lane NW) from TII 47 to County
State Aid Highway 7 (Rum River Blvd.). This route is re-designated as
County Road 27. This revocation is 1.374 miles in length.
The County Board designates County Road 78 (Hanson Blvd.) from County
State Aid Highway 20 (161st Avenue NW /Constance Blvd.) to County State
Aid Highway 22 (Viking Blvd.) as County State Aid Highway 78. This is a
4.000 mile increase in the Anoka County State Aid Highway System.
NOW TIIEREFORE, BE IT RESOL YED by the City Council of the City of
Andover, that said revision of the Anoka County State Aid Highway System is in all things
approved.

As noted in the attached letter from Ashford Development, one section of street
on 155th Lane NW west of Raven Street NW will need to be repaired due to
some settlement and cracking that has occurred. The repair, as noted in the
letter, will be performed at the developer's expense next spring. This item would
be covered by the mandatory one year warranty for this project as noted in the
resolution.

A RESOLUTION APPROVING THE FINAL STREET AND STORM SEWER
CONSTRUCTION OF WITTINGTON RIDGE AS BEING DEVELOPED BY
ASHFORD DEVELOPMENT.
WHEREAS, the developer has completed the streets and storm sewer of
Wittington Ridge.
NOW THEREFORE, BE IT RESOLVED by the City Council of Andover to
hereby approve the final street construction of Wittington Ridge contingent upon
providing the following:
1. Developer provide a 1 year performance bond or an escrow as determined by
the City Engineer from the date of this resolution.
2. An escrow amount as determined by the City Engineer be retained until turf
has been established to the satisfaction of the City.
Adopted by the City Council of the City of Andover this 5th day of
December ,19 95.

On November 14, 1995 City staff met with the engineering consulting firm of
Toltz, King, Duvall, Anderson and Associates (TKDA) to review the City and
consultant relationship and to discuss how to improve upon and continue to
provide a high level of engineering services for the City.
The purpose of the meeting was to discuss and identify the areas where
improvements can be made both on the part of the City to respond and provide
the necessary information to the City's consultants and also on the consultants
end to provide the level of service the City expects.

Some of the difficulties that have occurred in the past have been due to the fast
pace of the development and the ability of staff and the City's consultants to
keep up and provide the necessary level of service.
. )
The following list of items are areas that were identified where improvements will
be made.
1. Preparation of plans and specifications by the consultant shall be complete
and shall have a complete review(s) by City staff prior to advertisement for
bids.
2. A contract shall not be awarded until all platting requirements have been met.
3. Authorization to proceed on developer initiated projects will not be given until
the site grading has been completed and has been certified by the
developer's engineer.
4. Change orders will be held to a minimum by the following actions:
- Adequate time will be required prior to bidding to allow adequate field
surveys, preparation of plans and assembly of permits and data.
- Adequate time will be made for City staff to review and comment on plans
and specifications and a reasonable time for adjustments will be made.
- An increased level of plan review by the City and the consultant will be made
prior to bidding.
5. A more detailed description and reason for a change order will be

In addition to these items, a number of other topics were discussed on how to
continue to improve the engineering services for the City. We will begin to
implement many of these ideas on new improvement projects and continue to

The City Council is requested to approve emergency funding
to repair pumps on Engine No. 3 and Grass Truck No.1.
The pump on Grass Truck No. 1 needs to be replaced due to
some broken internal parts that caused the pump to be damaged
beyond repair. This happened while operating the truck at a
grass fire late this fall. The quoted price to remove the
existing pump and install a new pump is $1,100.

The pump on Engine No. 3 was found to have some damage while
undergoing an annual pump re-certification and service. The
pump does not pass the ISO and NFPA pump certification
guidelines. It is felt that there may be some debris in the
impeller causing the pump to not function properly. The
estimated cost to repair this pump is between $3,000 and $4,000.
The majority of this cost will be for labor to remove the pump.
If the impeller is worn and needs to be replaced, this will cost
an additional $1,000.

Subject: Constance Free Church / General Contractor Escrow Resolution
Dear Sir :
It has been called to my attention that the General Contractor for our new facility, G.
A. Domino Construction, Inc., has had difficulty receiving a return in full of a $4000.00
escrow amount tr,Jm the city. In addition, I understand that for his request for this full
return to be heard, it must go before a City Council Meeting.
My purpose in writing is to provide you with information, and also to request that this
matter he placed on the December 5, 1995 agenda of the City Council Meeting I would
also like to offer an alternative resolution ofthis
The area of concern is apparently the seeding of the area around the water drainage
and retention pond on the northeast portion of the property. I want to assure you that this
seeding was completed on the evening of September 27, 1995 with supervision and
participation by Y cuth Ministry adult volunteers and participation of children from the
youth group. ShOilly after this an inspection was scheduled and to our knowledge the
inspector did not c:Jmc to the church as idledulecl. In addition, before there V"1iS snow
cover, we obsel"J~ grass seedlings as we were performing other work around the pond.
To our knowldge, all required work has been performed by the General Contractor.
It seems to us an llreasonable position to hold back any escrow amount, particularly
when the timing of this is such that inspection and any further work cannot be performed
for as much as four months or more.
Alternative Resolution
If it seems reasonable to the city, Constance Free Church is willing to set a date in the
spring for an inspection of the area, we accept full responsibility for any further work as
agreed to with the city.
