HomeMy WebLinkAboutOrd. 560 - Amendment Titles 8 & 1CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA ORDINANCE NO. 560 THE CITY COUNICL OF THE CITY OF ANDOVER HEREBY ORDAIN AS FOLLOWS: AMENDMENTS TO CITY CODE TITLE 8: PUBLIC WAYS AND PROPERTY, TITLE 1: ADMINISTRATION, AND TITLE 3: BUSINESS AND LICENSE REGULATIONS 8-4-1: Regulations: P. No person shall ride or operate a bicycle or electric -assisted bicycle in any park or on any trail except in a prudent manner and maintain effective control and operation of the bicycle or electric -assisted bicycle. 8-4-2: Violation; Penalties: A. Any person, firm, or corporation violating any of the provisions of Subsections 8-4-1A, B, F, G, H, K, L, N, and O and P of this chapter shall be guilty of a petty misdemeanor and, upon conviction thereof, shall be punished in accordance with state law. 3-9-3: Retail License: K. Location and Proximity restrictions. No license shall be issued to any Retail Establishment located within a residential zone district. Additionally, no license shall be issued if the proposed location is within one thousand (1,000) feet of a school or five hundred (500) feet of a daycare within a commercial zone, residential treatment center, or within a public park that is regularly used by minors (including playground and athletic field). The following shall guide locations (Amended Ord. 557, 11/8/23): (1) Any school, park, daycare establishment located within a commercial zone, with the distance computed by direct measurement in a straight line from the nearest legal parcel line of the land used for the school, park, or daycare establishment to the nearest external portion of the building in which the licensed Retail Establishment is proposed to be located. (Amended Ord. 557, 11/8/23) • .. .� (32) Any residential treatment facility, with the distance computed by direct measurement in a straight line from the nearest external portion of the building in which the alcohol or drug treatment facility is located to the nearest external portion of the building where the Retail Establishment is proposed to be located. ATTEST: Mi elle 4artne�rCity Clerk CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA ORDINANCE NO. 560 SUMMARY AN ORDINANCE ORDAINING AMENDMENTS TO CITY CODE TITLE 8: PUBLIC WAYS AND PROPERTY, TITLE 1: ADMINISTRATION, AND TITLE 3: BUISNESS AND LICENSE REGULATIONS STATUTORY AUTHORIZATION AND POLICY Statutory Authorization This ordinance amendment is adopted pursuant to the authorization and policies contained in Minnesota Statute 412. Policy The purpose of the Ordinance is to protect the public health, safety, morals and welfare of residents of the City of Andover. The amendments address issues of clarity, consistency and relevance in the City Code. The amendments to City Code Title 8: Public Way and Property address the operation of bicycles and electric -assisted bicycles in parks and trails, and the amendments to City Code Title 1: Administration address the Fee Schedule relative to lot split fees and canvasser/solicitor, transient merchant, and peddler fees. The amendments to City Code Title 3: Business and License Regulations address a discrepancy between the City and State of Minnesota requirements for the sale of cannabinoid products relative to location and proximity restrictions between licensed establishments. GENERAL PROVISIONS AND DEFINITIONS Jurisdiction The provisions of this ordinance shall apply to the City of Andover. Enforcement The City Administrator or his/her designee shall have the authority to enforce the provisions of this ordinance. Interpretation Interpretation of the provisions of this ordinance shall be held to be the minimum requirements and shall be liberally construed in the favor of the governing body. A printed copy of this ordinance is available for inspection by any person during regular hours of the City Clerk. Adopted by the City Council of the City of Andover on this 7th day of May, 2024.
