Approve Wetland Monitoring ContracUSEH/97-2 The Economic Development Authority is requested to approve a contract with SEH to provide services to monitor, as required by the state Wetland Conservation Act and the Coon Creek Watershed District, the wetland replacements we have created for the Andover Station site. SEH will also "bank" any additional wetland credits we may have for use on future projects. The funding for this monitoring will be from TIF funds. ! Award Bid/98-17/Bunker Lake Boulevard NW Reconstruction The EDA is requested to review and approve the landscape prices for the Bunker Lake Blvd. project. The low bidder for the project was Richard Knutson. The prices received for this work are as identified on the attached sheet. The EDA had requested that the bids be broken down in order to review various options. The prices for the work and options are as follows: 1. Irrigation System $10,200.00 2. Concrete Cross-walks (4 locations) $15,595.80 (Colored Only) Add $ 7,480.00 (Stamped Concrete) 3. Concrete Median (Colored) Edging $46,913.79 Add $45,495.40 (Stamped Concrete) 4. Landscaping (Includes planting materials, topsoil, and mulch) $144,780.50 TOTAL: $270,465.49 (Approx. Feasibility $282,000) This work will be funded from the new TIF bond. The amount identified within this bond was $250,000.00. (SEH) is pleased to submit this proposal for wetland services for the monitoring of the wetland replacement area constructed at the Bunker Hills Commercial Development and Community Park (hereinafter called the "Project"). It is understood that the City's objective includes approval of the wetland replacement area constructed to mitigate wetland impacts resulting from the construction of the Commercial Development and Community Park and to establish a wetland bank account for the City of Andover with any wetland area in excess of that required for wetland replacement. The Wetland Conservation Act, implemented by the Coon Creek Watershed District, requires that the wetland replacement area be monitored for a five-year period to evaluate the success of the mitigation area in comparison to the goals established in the permit application and wetland replacement plan. The monitoring will also identify any maintenance and management needs to correct any identified problems with the replacement area. Wetland monitoring consists of hydrological measurements and evaluation of wetland vegetation. The collected data is used to determine if the area meets the three wetland criteria (vegetation, soils and hydrology) as well as the habitat goals established in the replacement plan. A field wetland delineation is performed to determine the area of the wetland replacement area. The delineated area is compared to the replacement goal to determine if sufficient area has been created and/or restored to replace wetland filling impacts. Any area in excess of that required for impact replacement can be deposited into a wetland bank account for future use by the City. This letter represents an Agreement for Professional Services between the City of Andover and Short Elliott Hendrickson Inc. (SEH) for providing professional services to monitor the success of the wetland replacement area and determine the area of wetland in excess of that required for replacement of impacts resulting from the development of the surrounding area. The proposed wetland services consist of conducting monitoring during the 1999 growing season and preparation SHORT ELLIOTT HENDRICKSON INC. A task for preparation of the appropriate forms for deposit of wetland credits in excess of those required for replacement is also included, although the timing of the delineation and deposit will be determined by the collection and analysis of the monitoring data. A detailed scope and budget for the proposed services is enclosed as Exhibit A. We propose to perform these services on the basis of actual hours spent plus the cost of reimbursable expenses, for an estimated fee of $3,155, in accordance with Exhibit B-1. Payment for additional services shall be based on the time required to perform the services and the billable rates for the principals and employees engaged directly on the project, plus charges for expenses and equipment. We will bill you monthly for services, expenses, and equipment. The estimated fee assumes prompt payment of our bills and the orderly and continuous progress of the project. If there are delays in the payment of our invoices, it is agreed we are entitled to collect, and you will pay interest at the rate of 1 % per month for all amounts unpaid for thirty (30) days or more. Additionally, if the project is delayed and we encounter additional costs as the result of the delays, it is agreed we are entitled to additional fees upon submission of the appropriate documentation of extra costs. The success of the replacement area and eligibility of banking credits will not be known until the results of at least one year of monitoring are collected and assessed. The deposit of banking credits will depend upon the rate of wetland development and evaluation by the Technical Evaluation Panel. The actual fee will depend on these factors and the actual tasks completed in the first year of monitoring more or less than the estimated amount. You agree to furnish us with full information as to your requirements including any special or extraordinary considerations for the Project or special services needed, and also to make available all pertinent existing information and data that we will need to perform our services. A copy of the As-Built Survey for the replacement area will be needed for inclusion in the first-year monitoring report. Preparation of the as-built survey is not included in this scope of work. You agree, to the fullest extent permitted by law, to limit SEH's total liability for any and all claims, expenses, or damages in any way related to the services provided under this Agreement to the total sum paid to SEH for providing these services. If conflicts arise during the performance of these services, we agree they shall be submitted to non-binding mediation unless we have mutually agreed otherwise. This letter and Exhibits A-I and B-1 represent the entire understanding between the City of Andover and SEH in respect of the Project and may only be modified in writing signed by both of us. (SEH) will consist of replacement area monitoring and submittal of a monitoring report to the Coon Creek Watershed District. The monitoring report will meet the requirements of the Wetland Conservation Act and the Coon Creek Watershed District. The following tasks include monitoring for the 1999 growing season. Additional years of monitoring may be required by the Coon Creek Watershed District before the final task of wetland delineation and bank credit deposit can be performed. Task 1 - Wetland Replacement Area Monitoring Data Collection Objective: Conduct wetland monitoring in accordance with the requirements of the Wetland Conservation Act and the Coon Creek Watershed District. Scope of Work: Hydrologic and vegetative parameters will be measured in each characteristic area of the replacement area during the 1999 growing season. Hydrology of the open water areas will be monitored by recording monthly measurements from a staff gauge to be installed near the outlet from the replacement area. In areas where there is little or no standing water, hydrology will be monitored by measurements in shallow wells installed by the contractor during the construction of the replacement area. Hydrology will be monitored from early May to mid August. Hydrology measurements will be compared to those recorded at a nearby monitoring site maintained by the Coon Creek Watershed District for regional reference. Wetland vegetation and soils will be evaluated once between July and August in each representative area of the replacement area. Documentation photographs will be taken from fixed reference points established in the replacement plan at the time of the vegetation evaluation. Collection of data in accordance with Wetland Conservation Act rules and the Coon Creek Watershed District. Task 2 - 1999 Monitoring Report Objective: Address the reporting requirements of the Wetland Conservation Act and the Coon Creek Watershed District. Result: Scope of Work: A monitoring report will be prepared to describe the status of the wetland replacement, summarize the results of the vegetative and hydrologic monitoring, and discuss management activities and corrective actions conducted during the previous year as well as activities planned for the upcoming year. The report will be submitted to the Coon Creek Watershed District by December 31, 1999. The annual report will include the information required by the Wetland Conservation Act. Task 3 - Wetland Delineation and Deposit of Banking Credits Objective: Establishment of a wetland bank for the City of Andover.
