Discuss Request for Relocation Expenses Charles Mistelske ORIGINATING DEPARTMENT Community Development David L. Carlberg Community Development Director Charles Mistelske is requesting the EDA authorize the final payment of the remaining relocation/moving expenses in the amount of$59,350. The EDA, at the October 20, 1998 meeting, authorized the payment of$59,350 to Mr. Mistelske, which was half the remaining $118,700 moving expense entitlement. However, due to a notice oflien claim for fees in the amount of 16,083.09 being served on the City by Schnitker and Associates, P.A., the City could only disburse a payment of $43,000.00 to Mr. Mistelske. If the City does not honor the lien, the City may be liable to pay the lien. Mr. Mistelske is also requesting the City pay $8,000 for the relocation of the concrete pillars. Mr. Mistelske has indicated that Conworth, Inc. did not include this expense in the relocation benefits. Engineering Approve Change Order #6/94-33B/Commercial Blvd. NW j~ntaminated Soil & Debris Removal The EDA is request to approve Change Order #6 for Commercial Boulevard NW Extension Contaminated Soil and Debris Removal (Part 1), Project 94-33B with Belair Excavating. NO. MOTION by EDA member to adopt the following: A RESOLUTION APPROVING CHANGE ORDER #~ TO PROJECT NO. 94- 33B, COMMERCIAL BOULEVARD NW EXTENSION CONTAMINATED SOIL AND DEBRIS REMOVAL (PART 1). WHEREAS, the City of Andover has a contract for Project No. 94-33B with Belair Excavatinq of New Briqhton, MN. NOW THEREFORE, BE IT RESOLVED by the EDA of Andover to hereby approve the change order to Project No. 94-33B. This change order is for the removal of contaminated soils and drums previously excavated on the commercial site.
