Costs include regional and local costs of highways, transit, sewers, water and stormwater fadlilies to the year 2020. \ ) In addition, this issue describes ways organizations and the public can teU the . This development pallem is market-<lriven, responding primarily to housing location market forces. Concentrated Development- New growth would be located largely in the existing urban area. Growth would fill in vaetnl land and land available through redevelopment, such as cleanup of polluted sites. " j / Housing density would increase and some redevelopment would mix housing and retail in shared locations. Central sewer and water would not expand much beyond what we have today. Growth Centers-"Mixed use" centers would commingle housing with retail business and job locations in a pallem designed to be friendly to transit and pedestrians. Some centers would spring up on vacant land, while others would be located on redeveloped sites in the older pan of the region. The development pallem would respond primarily to job locations. A Hybrid Option?-A mixture of growth characteristics from each growth option. or a hybrid, is likely to emerge. c COST ESTIMATES .... The <:O>t ehBn (see other side) shows public sector costs for the three options, ranging from an estimated ~ll billion 10 $13.3 billion. The larger the ar~f developmenl, the grev.er the public cost for highwa~ sewers and water. \ Local facilities are paid by\ residents of the local area, while regional costs are , generally paid by aU Twin Citians. Similarly, regional highway costs don't vary greatly among the options. Again. most of the system is already in place or planned to serve growth in the developing suburbs. These suburbs would conlinue to grow rapidly under all three options. The lion's share of capital expenditures is eannarked to repair and upgrade existing facilities. Nevenheless, there is a difference of S246 million between the highest and lowest estimated cost for regional transportation and interceptor sewers among the three options. o Tnnsportation Impacts The options also differ in the likely panerns of travel (see other side). While numbers represent small percenlages, the direction of the trend is important. In addition, the region could reduce ilS dependence on Ihe car by making pedestrian and transil trips more appealing. Business in Residential Zoned District James and Kathleen Junker 13503 Crooked Lake Boulevard NW Planning J'ffJOlrro~ BY: ~. =L HISTORY " ) James and Kathleen Junker have conducted business under the name of 1.1. Construction Inc. at 13503 Crooked Lake Boulevard NW (Zoning, R-4 - Single Family Urban) since December, 1971. The business consists of the installation and service of doors (rolling grilles, accordion gates, revolving doors, fire doors, etc.) and is being conducted in a 30 foot x 54 foot (1,680 square feet) accessory building located on the property of approximately 1.8 acres. The applicant has indicated to staff in most instances, there is one (1) employee in addition to family members and two commercial vehicles on site. COMPLAINT/APPLICABLE ORDINANCES Staff received a complaint in regards to a possible illegal business being conducted in a residential zoned district on April 30, 1996. Nature of Complaint: 1) Should the City allow a property owner to run a business out of an accessory building that involves heavy equipment in a residential area and not pay commercial taxes? Is it equitable for like businesses to pay commercial taxes when competition pays residential taxes? 2) The use is not residential in character. Staff conducted an inspection of the property on May 2, 1996. The inspection identified the following ordinance violations as per Ordinance No.8, Section 4.30 - Home Occupations (see enclosed copy of ordinance): ') I MOTION BY: SECOND BY: Page 2 - Business in Residential Zoned District \ ; 1) The business was being conducted in an accessory building on a parcel less than three (3) acres. Ordinance requires a minimum of three (3) acres and a Special Use Permit in order for a property owner to conduct a business in an accessory building. 2) Staff noted a considerable amount of construction materials associated with the business not being properly stored or screened on the premises. Ordinance requires that all materials be screened from adjacent properties and the public right-of-ways or stored in a building. 3) Staff noted more than one (1) commercial vehicle and a number of passenger vehicles on site. Ordinance requires no more than one (1) commercial vehicle may be associated with a home occupation. The commercial vehicle cannot exceed 12,000 pounds gross capacity. The ordinance also states that the number of employees shall be limited to one (1) person on site in addition to family members. James and Kathleen Junker began conducting business at 13503 Crooked Lake Boulevard NW in December of 1971 after zoning regulations were adopted by the Township of Grow on January 1, 1971. The definition of a home occupation as adopted on January 1, 1971 (Ordinance No.8, .__J Section 3 (J1) - Rules and Definitions states the following: Home Occupation - Any gainful occupation or profession engaged in by the occupant of a dwelling at or from the dwelling when carried on within a dwelling unit and not in an accessot:Y building provided that no signs other than those normally utilized in a residential district are present, no stock in trade is stored in the premises, over-the counter retail sales are not involved, and entrance to the home occupation is gained from with the structure. As you are aware, several provisions in the home occupation ordinance have been amended since the zoning ordinance was adopted in 1971. STAFF ACTION Staff sent an ordinance violation letter to James and KatWeen Junker on May 3, 1996 (see enclosed copy). Staff has met and has had several telephone conversations with the property owners to discuss this issue. Staff has tried desperately to reach an agreement with the property owner to bring the business in compliance with the current ordinance provisions or phase the business out of the residential area over a two to three year period. However, the property owner would like to continue to conduct business for a ) much longer period oftime as stated in their letter to staff (see enclosed copy). '\ ,j Page 3 - Business in Residential Zoned District STAFF HISTORY WITH ILLEGAL BUSINESSES Staff has respected those businesses that have operated in residential zoned districts for long periods of time and has reached agreements in most cases with those property owners to bring them in compliance with the zoning ordinance or phase the business out over a 1 to 5 year period. Staff has been very pro-active in regards to making sure all recent or new home occupations in Andover comply with the provisions of the ordinance. Currently, staffis working with 5-10 illegal business towards compliance, some which have been here for over 15-20 years. COUNCIL ACTION Staff requests that the City Council advise staff on how to proceed with this issue and also wants direction on how to handle other illegal businesses in the future. 1) Should staff be consistent and continue to treat everyone in the same manner by enforcing the ordinance? ~. J 2) Should staff refer all illegal businesses to the City Council and have the Council decide the fate of that business? 3) Should staff be more pro-active. (I) The entire site other than that taken up by a structure or planting shall be surfaced with asphalt, concrete, or other material approved by the governing body. (J) All structures and grounds shall be maintained in a neat, orderly, clean, and safe manner. (K) Pump islands are subject to yard requirements. 4.30 Home Occupations (A) Intent: Planning principles protect the public interest in part by avoiding land use conflicts. One such conflict involves differences between commercial activities and residential activities. This confrontation has commonly been resolved by relegating commercial activities to commercial zoning districts. However, some limited commercial activities have been allowed in residential areas, and have had no negative impact. The purposes of this section are to: 1) allow such limited passive commercial uses as would not detract from the character and integrity of residential neighborhoods; 2) identify conditions under which such uses may be permitted, and 3) continue to require all other commercial uses to be located only in commercial zoning districts. (B) General provisions Home occupation uses may include office uses, repair services, photo or art studio, dressmaking, or teaching limited to three (3) students at anyone time and similar uses. Such home occupations are subject to the following conditions: 1. The number of employees shall be limited to one (1) person on site in addition to family members. 2. The area within the principle structure used by the home occupation shall not exceed twenty (20%) percent of the dwelling's livable floor area. Basements may be included if they meet all Uniform Building Code requirements for ingress and egress. 3. On-site sales shall be prohibited, except those clearly incidental to services provided in the dwelling. 4. Any interior or exte~ior alterations of a dwelling for a home occupation shall be prohibited, except those customarily found in a dwelling. Page 34 Ordinance No.8, Section 5. These home occupations shall be subject to the following conditions: a. The size of the lot shall be three (3 a.) acres or larger. b. The specific location and size of an accessory structure and/or outside storage area shall be as allowed by the City. c. ) ~,d : \ ; J The combined square footage of the accessory structure and outside storage area shall not exceed eight hundred (800 s.f.) square feet. Setbacks of the accessory structure and outside storage area shall be of a magnitude found necessary by the City, but in no case shall it be less than one hundred (100') feet front yard setback, thirty (30') feet side yard setback, and fifty (50') feet rear yard setback or as required in Section 6.02. e. The outside storage area and all vehicles, materials and equipment being stored there shall be fenced, landscaped and screened in such a manner as to prevent it from being visible at any time of the year from road right-of-ways, public properties and surrounding properties. 9. In acting upon an application for a Special Use Permit, the City Shall consider: J a. The effect of the proposed use upor. the health, safety and general welfare of the City including but not limited to the factors of noise, glare, odor, electrical interference, vibration, dust and other nuisances; fire and safety hazards; existing and anticipted traffic conditions; and parking facilities on adjacent streets and land. b. The effect on surrounding properties, including valuation, aesthetics and scenic views, land uses, character and integrity of the neighborhood. c. Consistency with the Andover Comprehensive Plan and Development Framework. Page 35 Ordinance No.8, Section , ) d. The impact on governmental facilities and services, including roads, sanitary sewer, water and police and fire. e. The effect on sensitive environmental features including lakes, surface and underground water supply and quality, wetlands, slopes, flood plains and soils; and other factors as found relevant by the City. 10. The Special Use Permit is valid for one (1) year from date of issuance unless otherwise specified in the Resolution for approval and thereafter shall be automatically renewed each year unless objections or complaints are received from neighboring property owners, the City Councilor City staff and a request for review is made. C. Inspection & Revocation: 1. The City may at any time inspect the Home Occupation to determine if the applicant is strictly adhering to the Special Use Permit and the conditions thereof. If it is found that the permit and the conditions of the permit are not being adher.ed to, the applicant shall be notified in writing by the City and given ten (10) days to come into strict compliance. If compliance is not achieved after that ten (10) day period, the City Council shall hold a public hearing to consider the matter and may revoke the Special Use Permit. ~ . / D. Vested Rights: No Home Occupation allowed by Special Use Permit shall confer upon any person or to the benefit of any property any vested right to that use, rather the use shall remain subject to all conditions of the permit as established by the City. The City may find it necessary from time to time to review the conditions of the permit as they relate to the protection of the general welfare of the community. The land (see attached map) consists of approximately 80 acres located south of the old land fill. A value of$303,000.00 has been assigned to the property by the Anoka County Assessor. The land is zoned for General Business and would be available for commercial, industrial, and park uses. , / The Council may want to think about or discuss the following considerations: 1. There are special assessments on the property due to the City in the amount of $261,028.00. If the City were to purchase the property at $303,000.00, the City would get all but $42,000.00 back. 2. Should the City offer less? The property has been for sale for a long time by the private owner; perhaps the County would accept something closer to $270,000.00 for instance. 3. Should the City pass on this chance in hopes a good developer will purchase it? 4. Where would the money come from? The City would tap the dwindling TIF Fund surplus again. Keep in mind the City will be getting back $261,000.00. The County Board would like to discuss the item as soon as possible. Consideration of Community Development Director COUNCIL ACTION REQUESTED: The City Council is requested to consider expanding the position of Planning Director to that of Director of Community Development, and to adding a planner to staff. There are several reasons I am proposing the modification and they are as follows: 1. Central Control/Review of Development Proposals: The Community Development office would become the lead for all plats, building, and development proposals that come to the City. The Community Development Director would be responsible for the dissemination of the work and the follow-up on each activity to ensure schedules are being met. 2. Expansion of Duties: The Planning Department has had the role of coordinating economic development, zoning, plan reviews, the HRA, CDBG funding, code enforcement, as well as the Comprehensive Plan while working with the Met Council. The title change more accurately reflects the work being done presently. 3. MUSA through 2005: The development potential of the City will increase the population of Andover in the next 6 to 7 years by one-third to over 33,000. The department and City will need to more closely monitor and coordinate planning, building, and development for quality control and accountability. 4. Comprehensive Planning: Now that the 1992 Comprehensive Plan has been approved, it is time to start a new one. The City will need a Planner, in addition to the present level of staffing, to meet the growing workloads including comprehensive plan development and site-plan review. \ / '\ / \ ,~ Continued 5. Economic Development Opportunities: With the clearing of the salvage yards and the possible purchase of the 80 acres south of the landfill, the City suddenly has an entirely different approach to economic development ahead of it. A new marketing plan and strategy needs to be developed and coordinated for this new era of development. Budget Implications 1996. Minor. Staff would recommend the hiring of a planning intern for six (6) months at $8.00 an hour. If this individual proves to be a good candidate for a full time position, the intern could be hired on full-time for 1997. The 1997 budget impact would include a title change for David Calberg to Community Development Director with an appropriate adjustment in salary. Park dedication will not be required in this case because buildable parcels are not being created. A condition of the lot split would be to combine the parcels with parcels to the south for tax purposes so they could not be sold separately or built upon. Tract B is proposed to be combined with Tract A and Tract D with Tract C for tax purposes. The parcels would basically be an extension of the back yards and no structures would be allowed them, not even accessory buildings. The lots will remain separate lots of record but combined with the others for tax purposes. The only way to legally combine them would be to replat. Michael E. Ziertman. 2735 134th Lane NW - stated Lot 5 is undeveloped. Orville Tempel lives on Lot 3 and owns half of the parcel being split. He bought the other half from Frank Stone several years ago. He does the upkeep for the area. The intent now is to separate the lots to get the names separate for each parcel so there is no problem when one of )them dies. He wants it for an extension of his yard. With the split, , each of them will take care of their own parcels. Pu(pose. This Ordinance is intended to provide for and permit flexibility of site design and architecture for the conservation of land and open space through clustering of buildings and activities. This flexibility can be achieved by waiving or varying from the provisions of Ordinance No.8, the Zoning Ordinance, including lot sizes, setbacks, heights and similar regulations, while at the same time preserving the health, safety, order, convenience, prosperity and general welfare of the City of Andover and its inhabitants. / Definition. Update on Commercial Boulevard/94-33 a4. At the June 4, 1996, City Council meeting the Council authorized advertising for bids for the Commercial Boulevard project. At that time we had indicated that the on-site wetlands were being delineated and we would be working with the Coon Creek Watershed District on the permitting requirements. The delineation has indicated that areas meeting the definition of wetlands do exist within the areas we are proposing construction. We are currently working with the watershed preparing a sequencing report and a mitigation plan for the site. The reason for the delay is that the electronics for the box at Bunker Lake Boulevard and Prairie Road are on backorder. US West is prohibited from providing cellular phones to these people by the Public Utilities Commission. However, US West has submitted a request to the Public Utilities Commission that basically states that if a person cannot receive telephone service within a reasonable time, US West will be allowed to provide them with cellular telephones. Mr. Dahlberg will be contacting me as soon as possible to let me know the status of the request. We will probably have the same problem when Shadowbrook develops. All lots will be served by 1 inch copper services, with curb stops located at the property line. Fire hydrants will be installed throughout the development to provide adequate fire protection. Storm Sewer Surface water within this plat will be controlled with storm sewers and on-site ponding. All storm sewer sizing and catch basin spacing is based on a 10- year design storm frequency. Ponding is based on a 1 DO-year design storm frequency. Emergency overflow outlets must be provided at all low areas to provide overflow protection of homes for storms more intense than that used for design of the storm sewer collection system. It is proposed to construct catch basins at all low points within the streets throughout the plat and direct the runoff to the various ponds located within the plat (see Storm Sewer Exhibit). All construction adjacent to wetlands must be approved or reviewed by the Corps of Engineers, the Department of Natural Resources and/or the Coon Creek Watershed District. All permits related to total site grading are the responsibility of the developer. Streets Streets are proposed to be constructed to 'Andover City Standards of 32-foot width (face to face of curb) and concrete curb and gutter. Two and one-half inches of bituminous wearing course will be placed over 4 inches of Class 5 gravel base. It is assumed that all street areas will be graded to within 0.2 feet of the designed subgrade elevation prior to utility and street construction. 4 11142 ..., --J -, ~ -, The road shall have a 6-inch crown with 0.5% minimum grade and 7% maximum grade. Grades within 30 feet of street intersections shall not exceed 3%. Boulevards are proposed to have a positive 2% grade from the back of curb to a distance of 8 feet behind the back of curb. Beyond 8 feet behind the back of curb, the maximum boulevard slope shall be 4:1. -, -1 --J 5. Sidewalks -1 -, An eight foot wide bituminous sidewalk is proposed to be constructed under Phase I.
