Resolution 97-12 states their opposition to levy limits; Resolution 97- 13 states their support for a sales tax exemption for local governments without corresponding cuts in HACA or LGA; and, Resolution 97-14 is a request to the Anoka County Board regarding the reclassification of large parcels to residential. RESOLUTION 97-12 RECEIVED APR 1 8 1997 CITY OF ANDOVER CITY OF OAK GROVE COUNTYOFANOKA STATE OF MINNESOTA A RESOLUTION OPPOSING LEVY LIMITS WHEREAS, Several tax reform proposals have been introduced at the State Legislature, the majority of which include a provision for a property tax freeze and/or levy limits with a requirement for voter approval of levy increases in excess of inflation and household growth; and WHEREAS, One (l(the propl)sed bills w9!!!d apply levy limi.t.! to Icc:l! governments base~ on the Price of Government targets set by the legislature and would require voter referenda to exceed those limits; with the additional provision that if a levy in excess of the limit is approved by voters, the jurisdiction loses state aid equal to half of the amount approved by the voters in excess of the levy limit; and WHEREAS, Levy limits based on inflation and household growth could have the effect of encouraging development in areas the Metropolitan Council has indicated should have slow growth; and " ) WHEREAS, Attempts to limit local levy authority are very troubling to local officials for several reasons, among them: · State aids have not kept pace with inflation and population growth, and federal grants to cities have been declining for years while cities have been experiencing Increasing demands for services, new infrastructure, and the need to replace aging infrastructure. · Despite decreasing state and federal support and increasing demand, many cities have been able to keep their property tax levy increases at or below the rate of Inflation. · Requiring voter referenda would add considerable expenses for special elections. · Cities are not the main driver of increased property taxes and local officials must be able to raise sufficient revenues to fund city services, especially in cases of extra expenses in overtime and materials required this past year due to unusually large amounts of snow and ice and the subsequent floods. NOW, THEREFORE, BE IT RESOLVED, that the Oak Grove City Council is prepared to be flScaUy responsible and accountable to its taxpayers, and encourages its Legislative Representatives to vote against any property tax reform bill that includes a property tax freeze or levy limit provisiolL Passed and adopted this 14 rA day of April, 1997. -K; J ATTEST: b>n.~ J Ice M. Olsen, City Clerk , ) RESOLUTION 97-13 CITY OF OAK GROVE COUNTY OF ANOKA STATE OF MINNESOTA A RESOLUTION IN FAVOR OF SALES TAX EXEMPTION FOR MUNICIPAL GOVERNMENT WHEREAS, Legislation has been proposed which would reinstate the sales tax exemption for purchases made by local governments; and WHEREAS, Concerns have been expressed in the Legislature that the sales tax exemption would reduce state revenues by too much and should therefore be made revenue neutral for the state by a cut in HACA or LGA; and WHEREAS, The sales tax was not revenue neutral for cities and counties when it was enacted but local property taxes and other local revenue sources had to be increased to cover said taL NOW, THEREFORE, BE IT RESOLVED, That the Oak Grove City Council '\ hereby states their support for a sales tax exemption for purchases made by local / governments, without corresponding cuts in HACA or LGA. ch fL. .0 Passed and adopted this .J..!!:.....- day of ~ ' 1997. ~w~~ ATTEST: ~m.~ Jan ce M. Olsen, City Clerk '\ ) RESOLUTION 97-14 CITY OF OAK GROVE COUNTY OF ANOKA STATE OF MINNESOTA WHEREAS, Based on certain tax court cases, the Anoka County Assessor has begun to classify as residential (for tax purposes), certain land in Oak Grove zoned as Agriculture; and WHEREAS, The anticipated effect of classifying parcels of land 40 acres or larger as residential for tax purposes will be to encourage development of those parcels into residential (2 1/2 acre) lots sooner than landowners may otherwise undertake; and WHEREAS, The policies of the Metropolitan Council have been to discourage growth in the outer ring of suburbs; and WHEREAS, The Oak Grove Comprehensive Plan recognizes that maintaining large open space is desirable; and WHEREAS, The City of Oak Grove has established policies which maintain a slow yet steady rate of growth, and encourages owners of 40 acre parcels of land to maintain that land as \, open space rather than develop and build; and J WHEREAS, The residents of Oak Grove have clearly supported the council's efforts to maintain a steady rate of residential growth in their community. NOW, THEREFORE, BE IT RESOLVED, That the City of Oak Grove hereby requests that the Anoka County Board reconsider the policy of reclassifying parcels of land 40 acres or larger as residential, except that up to 10 acres can be classified residential if a house is situated on that parcel. Rum River IINo Wake" Zone REQUEST: The City Councils of Anoka, Andover and Ramsey are requested to discuss restrictions governing Rum River boat traffic. Several residents living along the river have indicated the river bank is eroding noticeably. Intuitively speaking, a wake ordinance would be impossible to enforce without similar restrictions with neighboring Ramsey. / Councils are requested to discuss Anoka's approach to River Management, and to see if the Cities of Ramsey and Andover could agree to wake restrictions, J CITY OF ANDOVER REQUEST FOR COUNCIL ACTION '. ) DATE: April 29. 1997 AGENDA SECTION ORIGINATING DEPARTMENT Discussion Administration Richard Fursman ITEM NO.5. Establish New Hunting Zone REQUEST: The City Councils of Anoka, Andover and Ramsey are requested to discuss the establishment of hunting districts As the areas continue to grow and expand with residential development, the need to examine ordinances regulating the discharge of firearms and bow and arrows. Once again the river area needs special consideration. River front residents have expressed concerns about firearms discharging across the river. " Different firearm boundaries can lead to confusion and difficulties in regulating fire arm use. ) '\ J Section 3. Prohibited District: The attached map shall become a part of this Ordinance. Section 4. Penalty: Any person who violates any provision of this ordinance shall be guilty of misdemeanor and upon conviction thereof, shall be punished according to prevailing State Laws. Section 5. Validity: The validity of any section, clause or phrases of this ordinance shall not affect the validity of any other part. Section 6. Repeal: Ordinance No.2, adopted October 15, 1966, Ordinance No, 12, adopted September 18, 1972, Ordinance No. 12B, adopted November 3, 1981, Ordinance No. 12C, adopted November 17, 1981, are hereby repealed. (62B, 12-19-89) The City Council of the City of Andover hereby ordains: Section 1. Definitions: The following definitions shall apply in the interpretation and enforcement of this ordinance. A. .Ri.tk - a shoulder weapon with a rifled bored barrel and discharging a single shot or pellet at a time. B. Shot~un - a shoulder weapon with a smooth bored barrel or barrels and normally discharging more than one pellet at a time, except when using a single slug. C. Handgun - a hand held weapon with a rifled barrel and discharging a single shot or pellet at a time. D. Bow & Arrows - for the purpose of this ordinance to mean all long bows used for target and hunting purposes as regulated and defined by Minnesota Statutes, Chapter 97B. (62C,5-15- 90) E. Firearms - for the purpose of this ordinance this shall mean shotguns and pellet weapons, whether C02 or pneumatic powered. (62C,5-15- 90) Section 2. Regulations: No person shall discharge at any time any firearm or bow and arrows upon or onto any lands within the City of Andover except as provided by this ordinance. A. No person shall discharge a firearm within five hundred (500') feet of any residence or a bow and arrow within one hundred fifty (150') feet of any residence. (62C,5-15-90) . I B. No person shall discharge a firearm or bow and arrows in the City of Andover !' "- except for the following conditions: " J 1. Landowners may discharge firearms or bow and arrows upon their property provided the property is ten (lOa.) 10 acres or more in size and the projectile does not carry beyond the property line. (62C,5-15-9O) 2. Landowners may discharge bows and arrows upon their property is two and one-half (2 Y2 a.) acres or more in size and the projectile does not carry beyond the property line. (62C, 5-15-90) 3. Landowners may discharge a firearm upon their property for the purpose of slaughtering animals provided the property is five (5 a.) acres or more in size and the projectile does not carry beyond the property line. (62C, 5-15-90) 4. No person shall discharge any firearm upon the property of another person in an allowed area often (10 a.) acres or more in size without written permission of the owner or lessee. (62C,5-15-9O) 5. No person shall discharge any bow and arrow upon the property of another person in an allowed area of two and one-half (2 Y2 a.) acres or more in \, size without written permission of the owner or lessee. (62C, 5-15-90) , I 6. Recreational target shooting of firearms in an allowed area often (lOa.) acres or more in size shall be directed at a target with a backstop of sufficient strength and density to stop and control the projectile. (62C, 5- 15-90) 7. Recreational target shooting of a bow and arrow in an allowed area of two and one-half (2 Y2 a.) acres or more in size shall be directed at a target with a backstop of sufficient strength and density to stop and control the projectile. (62C, 5-15-90) 8. The discharge of a rifle or handgun utilizing a solid projectile shall not be allowed with the City of Andover. (62C,5-15-9o) C. No person shall discharge any firearm or bow and arrows within the City of Andover shown on the attached map as "Prohibited District". (62C, 5-15-90) D. The provisions of this ordinance shall not apply to the discharge of firearms, rifles or handguns when done in the lawful defense of persons or property.
