Commissioner Loehlein requested the following corrections: Page 2, Line 2, The address should be 17337 Roanoke Street NW. Motion by Loehlein, seconded by Shafto, to approve the minutes as amended. Motion carried on a 4-ayes, 0-nays, 2-present (Godfrey, Hudson), 1-absent (Koehler) vote. PUBLIC HEARING. Comprehensive Plan Amendment Request — PID #23-32-24-32- 0006 and PID #23-32-24-32-0006 To change the guided land use for the above noted properties from URHL — Urban Residential High Low to URH— Urban Residential High and 1.5 acres ofNC—Neighborhood Commercial (Applicant. J.A. Wedum Foundation). The Planning & Zoning Commission is requested to hold a public hearing and make a recommendation to the City Council on Comprehensive Plan Amendment Request — PID Regular Andover Planning and Zoning Commission Meeting Minutes — November 14, 2023 Page 2 1 923-32-24-32-0006 and PID #23-32-24-32-0006 To change the guided land use for the 2 above noted properties from URHL — Urban Residential High Low to URH — Urban 3 Residential High and 1.5 acres of NC — Neighborhood Commercial (Applicant: J.A. 4 Wedum Foundation). 6 Mr. Janish reviewed the applicant, J.A. Wedum Foundation, is working with SilverCrest 7 Development, LLC and will be the owner of the project. SilverCrest Development, LLC is 8 a consultant to J.A. Wedum Foundation and will be the operator of the project upon 9 completion. SilverCrest Development, LLC had been working with the City of Andover 10 moving forward with a project at this location. Due to the current market conditions the 11 applicant is seeking changes to the Comprehensive Plan in order to accommodate the 12 commercial component of the development. A revised concept plan was attached for 13 Commission review, but it is not the subject of this evening's review. 14 15 The proposal is to have a 1.5-acre parcel for the commercial vs. having the commercial as 16 part of the multi -family building. If this request is approved, Met Council will require the 17 City of Andover to remove 1.5 acres from the overall acreage of the parcel when 18 determining density of the site. Due to the 1.5 acres being removed it is expected the 19 development will have a density of slightly over 20 units per acre. This then requires the 20 City of Andover to change the future land use of the residential portion to align with density 21 ranges in the Comprehensive Plan. This would change the current designation from URHL 22 — Urban Residential High Low to URH — Urban Residential High. 23 24 The last review had shown a residential unit count of 232 units. The current layout shows 25 218 residential units. The increase in density for the project is not because the applicant is 26 increasing units, but is instead because the applicant is providing commercial in this area, 27 and the current market is looking for a separate lot. The loss of the acreage for commercial 28 is making the project appear denser. 29 30 Mr. Janish reviewed the Historic Land Use of the property and indicated the location on a 31 map. 32 33 The proposed Comprehensive Plan Amendment consists of two changes (1) Guiding 1.5 34 acres of land within the parcels as Neighborhood Commercial; and (2) a request to re -guide 35 the remaining subject properties to the URH land use district. 36 37 Mr. Janish reviewed the Commission is asked to answer two questions: 38 1. Is it appropriate to have 1.5 acres of Neighborhood Commercial? 39 2. Is it appropriate to increase density from URHL —Urban Residential High Low (12 40 units to 20 units) to URH — Urban Residential High (20 units to 25 units)? 41 42 The review criteria for Comprehensive Plan Amendments was provided for both of these 43 questions. Mr. Janish explained the roadway functional classifications. 44 Regular Andover Planning and Zoning Commission Meeting Minutes — November 14, 2023 Page 3 1 The Planning & Zoning Commission is requested to hold a public hearing on the 2 Comprehensive Plan Amendment request and make a recommendation to the City Council. 3 Approval of the Comprehensive Plan Amendment shall be contingent upon approval of the 4 rezoning request. If the City Council approves the Comprehensive Plan Amendment, it 5 will be forwarded to the Metropolitan Council for review and authorization prior to final 6 adoption by the City Council as part of a future consent agenda. Pending approval of the 7 amendment, any future development proposal would still require approval of a preliminary 8 plat and a planned unit development from the City. These items would both require a public 9 hearing where specific details of any proposed development would be reviewed. 10 11 Commissioner Shuman asked Mr. Janish about the change in economic conditions and did 12 the applicants request the changes. Mr. Janish stated it was found that businesses want to 13 have their own structures and the financial situation with interest rates rising. Staff and the 14 applicant understand the City Council wants to keep the commercial on the site. 15 Commissioner Shuman asked if there has been any analysis provided by J.A. Wedum or 16 issues regarding the financing of the project. Mr. Janish stated staff has not asked for any 17 documentation from them on a specific lender. 18 19 Commissioner Winge asked if the developer discussed any other potential locations than 20 the intersection of Crosstown Blvd. and Bluebird Street as part of this amendment. Mr. 21 Janish referred to the site plan details and showed the underground parking layout. 22 23 Motion: Chair Godfrey assumed a motion to open the Public Hearing at 7:26 p.m. Motion 24 carries by unanimous consent. 25 26 The applicant, Mike Gould 5402 Parkdale Drive, St. Louis Park, stated economics and 27 partnerships have changed. They have done projects with the J.A. Wedum Foundation in 28 the past. The number of units has been reduced. Some brownstone units have been added. 29 30 Mr. Mark Hyvare 15195 Bluebird Street NW, referred to the right -in right -out proposal 31 and the roundabout. He is concerned that coming out of the property is the only option is 32 to go through the roundabout to go anywhere. He does not want all the cars' headlights 33 shining on his house while using the roundabout. He would like the traffic plan to be 34 different. 35 36 Mr. Eugene Benson, 1292 148`h Lane NW, is concerned with the infrastructure of the City. 37 He asked if the future plans are updated as far as water usage. There are more than 60 units 38 a year being added. He asked how the infrastructure is updated. 39 40 Mr. Janish stated he received an email from Damon and Cari Boswell, 15035 Drake Street 41 NW, regarding the requests. They are strongly opposed, they would be directly and 42 negatively impacted by this development, and think it would result in decreased property 43 values, increased traffic burden, unintentional thoroughfare on Bluebird Street, impact 44 safety of children and families who purchased homes in quiet neighborhoods, inability to 45 integrate an enormous development into the existing community, and has unappealing Regular Andover Planning and Zoning Commission Meeting Minutes — November 14, 2023 Page 4 i aesthetics. Development should not be utilized to profit developers to the detriment of 2 residents. Any development should enhance the resident's lives not line the wallets of the 3 developers. The City is not required to make amendments simply because they are 4 requested to or approved because it meets technical requirements. The neighborhood is not 5 in favor of this project and the majority are in strong opposition. Some of the Winslow 6 residents were not aware of the project as they were outside the notification area. This is 7 not the right location for this project. 9 An email was received from Drew Guhanick, 15102 Bluebird Street NW, who sees no 10 rezoning benefit to the homes east and south to these properties. He would like to see the 11 traffic impact study. He does not feel the streets can handle the increased traffic. The speed 12 limit on Bluebird is 25 mph. Additional traffic is a safety concern. He requested the 13 requests be denied. Mr Janish noted that he provided the traffic study to Mr. Guhanick and 14 there will be more opportunities for residents to voice their concerns. 15 16 Mr. Shawn Mars, 16178 Raven Street NW, asked when looking at the number of seniors 17 that will need to go into senior housing what happens to these facilities when there is not 18 enough seniors to live in them. What will that be in 20-25 years. 19 20 Commissioner Winge asked the applicant if the site plan is the one they are moving forward 21 with or is it conceptual at this point. 22 23 Mr. Mike Gould, Silvercrest, stated the plan has had much thought, and asked the project 24 architect come forward. 25 26 Ms. Sarah Kern, Kaas Wilson Architects, 1301 American Boulevard, Bloomington, stated 27 this is the current plan. The main item was pulling the commercial out so people coming 28 to commercial site would not be a concern as far as traffic circulation. She stated they are 29 trying to keep the commercial as close to Crosstown as possible. The higher density was 30 desired to be closer to Hanson Boulevard. The senior building has been laid out and they 31 don't anticipate it moving very much. Many options were considered. 32 33 Commissioner Winge stated the previous plan seems very different from the current plan. 34 Ms. Kern stated memory care and assisted living will be separate wings. 35 36 Mr. Janish stated there will be fewer homes affected by headlights with this site plan. 37 38 Commissioner Winge asked about the location of the proposed commercial lot as that 39 corner does not seem like the best location. He feels the better location would be at 40 Crosstown and Hanson Boulevards. 41 42 Commissioner Shuman asked the applicant about timelines as they relate to the zoning 43 changes. Is there a difference in certainty levels and timelines. Are we looking at potential 44 having another hearing in a year from now. Ms. Kern stated they would like to start the 45 construction in the summer/fall of 2024. Mr. Gould stated approvals 3 are needed prior to a lender looking at the project. The J.A. Wedum Foundation is very 4 strong financially and many contingencies need to be met before closing on the property. 5 6 Chairperson Godfrey reminded all that this evening they are focusing on the 7 Comprehensive Plan Amendment and not the project which needs to go through many 8 other steps. 10 Commissioner Shuman stated this was previously rezoned and we are looking at rezoning 11 again, which ties into the question from Mr. Mars. If something happens and this project 12 does not come to fruition, the City would have two different zones. It is not clear as to what 13 is different between last year and this year. He feels the timeline is relevant and asked what 14 is different between this year and last year. 15 16 Mr. Gould stated interest rates haven't been like this in over 10 years. The Wedum 17 Foundation will stick with this business, and these are the right players at the right time. 18 He believes this project will happen. 19 20 Commissioner Winge asked when the building code changed. Ms. Kern stated they took 21 place in 2020 and enforced in 2021. It has taken a long time. She only does senior buildings, 22 and it has been approved for a while, but this is a huge change. 23 24 Mr. Janish responded to some raised questions. He explained the City Council has a Capital 25 Improvement Plan (CIP) that goes out five years. Usage of the systems are reviewed 26 against the requirements in the CIP. As part of the CIP, there are discussions on the demand 27 on the water system and any changes are put into the CIP. The storm sewer is identified 28 according to the site. The sanitary sewer is metered to determine the flowage. In 25 years, 29 if the senior housing is no longer needed the property could be redeveloped into other uses. 30 If a structure outlives its usefulness it is redeveloped. 31 32 Mr. Gould, 5204 Parkdale Drive, stated they have facilities that are over 30 years old. The 33 project is rehabbed and upgraded, and he believes that will continue. 34 35 Mr. Janish asked Mr. Gould if something other than a roundabout could go in at that 36 location. It was indicated that this will be discussed with Staff. 37 38 Ms. Ronda Ganske, 2159 153`d Lane NW, asked when reducing from 232 to 218 units, do 39 those 14 units need to be moved elsewhere within the City. With the development on 40 Bunker Lake Boulevard and 71h Avenue, the developer was allowed to build less and there 41 were 60 units that needed to be moved elsewhere. She asked whether one area be really 42 dense to meet the Comprehensive Plan. Mr. Janish stated the Met Council is expecting to 43 see the lowest number of units in the plan. If a site goes to a higher tier of density, it opens 44 up the number of units being lower in another location. 45 Regular Andover Planning and Zoning Commission Meeting Minutes — November 14, 2023 Page 6 1 Motion by Loehlein, seconded by Winge to close the public hearing at 8:05 p.m. Motion 2 carried on a 6-ayes, 0-nays, 1-absent (Koehler) vote. R1 4 Commissioner Loehlein asked staff to display the slide on the history of the property, 5 noting that for 20 years, this was in Comprehensive Plan as General Commercial land use. 6 Something such as WalMart could come onto this property and this request was to break 7 off 1.5 acres of the property into Commercial. 8 9 Commissioner Shafto commented he likes this zoning better and that the commercial is 10 being broken out. He thinks the location of the commercial makes sense. He likes the 11 reduced number of units and finds that this zoning request makes sense. However, traffic 12 is a big concern there and that should be considered. 13 14 Commissioner Shuman questioned the process and for this purpose, noting the Planning 15 Commission will make a decision whether this meets the requirements for rezoning and 16 asked if the public be notified as to upcoming public hearings regarding this property. Mr. 17 Janish stated the traffic study will happen after this approval and mailing and signs would 18 notify residents of upcoming public hearings. 19 20 Chairperson Godfrey stated the fewer units, and the separate commercial area will provide 21 a similar product but be more efficient with less density on the property. Also, reducing 22 the commercial to neighborhood business reduces the types of businesses that can go in 23 there. She would be happy to tweak the Comprehensive Plan to make a better Andover. 24 25 Motion by Shafto, seconded by Loehlein, to recommend the City Council approve the 26 Comprehensive Plan Amendment Request — PID #23-32-24-32-0006 and PID #23-32-24- 27 32-0006 to change the guided land use for the above noted properties from URHL — Urban 28 Residential High Low to URH — Urban Residential High and 1.5 acres of NC — 29 Neighborhood Commercial (Applicant: J.A. Wedum Foundation). Motion carried on a 5- 30 ayes, 1-nay (Winge), 1-absent (Koehler) vote. 31 32 Mr. Janish stated that this item would be before the Council at the November 21, 2023, 33 City Council meeting. 34 35 PUBLIC HEARING. Rezoning Request — PID #23-32-24-33-0002 & PID #23-32-24- 36 32-0006 — Rezone Properties from M-2: Multiple Dwelling High Low Density to M-3 37 Multiple Dwelling High Density and NB — Neighborhood Business (Applicant: J.A. 38 Wedum Foundation). 39 40 The Planning and Zoning Commission is requested to hold a public hearing and make a 41 recommendation to the City Council on a Rezoning Request — PID #23-32-24-33-0002 & 42 PID #23-32-24-32-0006 — Rezone Properties from M-2: Multiple Dwelling High Low 43 Density to M-3 Multiple Dwelling High Density and NB — Neighborhood Business 44 (Applicant: J.A. Wedum Foundation). 45 Regular Andover Planning and Zoning Commission Meeting Minutes —November 14, 2023 Page 7 1 Community Development Director Janish reviewed the request. J.A. Wedum Foundation 2 has requested to rezone the unaddressed properties located at PID 23-32-24-33-0002 and 3 23-32-24-32-0006 from M-2: Multiple Dwelling High Low Density to M-3: Multiple 4 Dwelling High Density and NB: Neighborhood Business. A map showing the location of 5 the subject properties was provided for Commission review. If the Comprehensive Plan 6 amendment reviewed as part of a previous agenda item is approved, rezoning of the subject 7 properties will be required to maintain consistency between the Future Land Use Map and 8 Rezoning Map to allow for implementation. Mr. Janish reviewed the review criteria and 9 next steps. 10 11 Mr. Janish stated the subject properties are located within the Metropolitan Urban Service 12 Area (MUSA) and are within the current stage of sewer expansion. Times and conditions 13 have changed with the extension of municipal sewer and water into this area. Urban 14 development including public, commercial, and residential uses has occurred immediately 15 adjacent to the subject properties. The subject properties border Hanson Blvd NW which 16 is classified as a "Minor Arterial" roadway and Crosstown Blvd NW which is classified as 17 a "Major Collector" by the Comprehensive Plan. 18 19 Commissioner Hudson asked if we are locking into a significant location for this 20 commercial. Mr. Janish stated at this point it could shift slightly left or right but at this 21 time, we are trying to keep it flexible. 22 23 Motion: Chair Godfrey assumed a motion to open the Public Hearing at 8:15 p.m. Motion 24 carries by unanimous consent. 25 26 Ms. Mary Hyvare, 15195 Bluebird Street NW, asked how many of the Commissioners 27 would purchase a home on Bluebird or one of the surrounding streets where this project 28 will be developed. She also asked if other locations have been looked at in Andover. She 29 does not think this is the right spot. 30 31 Mr. Janish stated the two letters previously cited continue to apply to this rezoning request 32 as well. 33 34 Mr. Janish stated he received an email from Damon and Cari Boswell, 15035 Drake Street 35 NW, regarding the requests, they are strongly opposed, and they would be directly and 36 negatively impacted by this development. He asked why this was not included in the last version 16 of the Comprehensive Plan. Chairperson Godfrey stated we are not reviewing the project 17 at this time only the rezoning. 18 19 Commissioner Loehlein responded to the question of whether the Commissioners would 20 want to live near this project. The request needs to meet the criteria for rezoning. 21 22 Motion by Loehlein, seconded by Hudson, to recommend the City Council approve of 23 Rezoning Request — PID #23-32-24-33-0002 & PID #23-32-24-32-0006 — Rezone 24 Properties from M-2: Multiple Dwelling High Low Density to M-3 Multiple Dwelling 25 High Density and NB — Neighborhood Commercial (Applicant: J.A. Wedum Foundation). 26 Motion carried on a 5-ayes, 1-nay (Winge), 1-absent (Koehler) vote. 27 28 Mr. Hellegers stated that this item would be before the Council at the November 21, 2023 29 City Council meeting. 30 31 PUBLIC HEARING. Interim Use Permit —Mining & Land Reclamation—PID(S) #07- 32 32-24-34-003; 07-32-24-33-0001 and 07-32-24-23-0002 (Applicant: Darren Lazan). 33 34 Community Development Director Janish stated on August 15, 2023, a preliminary plat 35 and grading plan were approved for the Legacy at Petersen Farms rural residential 36 development. As part of the grading of the site, the applicant is requesting an Interim Use 37 Permit (IUP) for the creation of two stockpiles: one consisting of up to 50,000 cubic yards 38 and the other up to 10,000 cubic yards of fill material both stockpiles would be located 39 outside of the plat boundary. The material would be utilized during future phases of 40 development, and for the placement of house pads. 41 42 Since the applicant is proposing land reclamation utilizing in excess of 400 cubic yards, an 43 IUP is required pursuant to City Code 12-13-1 and 12-15-8. A copy of the draft grading 44 plan for the proposed stockpile was provided for Commission review, as well as staff Regular Andover Planning and Zoning Commission Meeting Minutes —November 14, 2023 Page 9 1 comments for Review #1 of the draft grading plan. The applicant will be required to 2 respond to and address each of the comments. 4 Staff is proposing an expiration date of September 1, 2026, or once 90% of the lots within 5 the 3' Phase are constructed, whichever is sooner (5 years is the longest amount of time 6 an IUP can be granted for under City Code 12-14-12-E). If at that time the applicant would 7 like the stockpile to remain on the property, they would need to apply for a new IUP and 8 obtain City Council approval. 10 The criteria including type of fill permitted, haul route, erosion control, coordination with 11 other Agencies, and interim use permit standards were provided along with findings 12 necessary for Council approval. 13 14 Mr. Janish noted the Planning and Zoning Commission is asked to hold a public hearing 15 and make a recommendation to the City Council regarding the interim use permit request. 16 17 Commissioner Shafto asked about the fence to be constructed around the stockpile and how 18 that gets enforced. Mr. Janish stated staff looks at those required items. 19 20 Chairperson Godfrey asked if there should be excess dirt on the roadways. Mr. Janish stated 21 if there is excess dirt or tracking, the City Engineering Department should be contacted, 22 and they will contact the applicant who is responsible for keeping the streets clean. 23 24 Commissioner Hudson asked if they would be going on the street or won't all the material 25 be kept on the property. Mr. Janish stated they may need to cross the road. Commissioner 26 Hudson asked about the end date of the construction. Mr. Janish stated the end date was 27 agreed between the applicant and City Staff. 28 29 Commissioner Hudson asked how this is monitored. Mr. Janish explained that when the 30 building permit is pulled, the Building Department does the inspections. Commissioner 31 Hudson asked why this request wasn't issued at the time. Mr. Janish stated the applicant 32 didn't know how large the stockpile needed to be. 33 34 Motion: Chair Godfrey assumed a motion to open the Public Hearing at 8:35 p.m. Motion 35 carries by unanimous consent. 36 37 There was no public input. Regular Andover Planning and Zoning Commission Meeting Minutes — November 14, 2023 Page 10 2 Mr. Hellegers stated that this item would be before the Council at the November 21, 2023 3 City Council meeting. 5 PUBLIC HEARING: Consider a variance for the width of an access road to a single- 6 family home to be located at 2274160 Avenue NW (PID 15-32-24-22-0015) (Applicant. 7 Shawn Mars). 9 City Planner Peter Hellegers explained a variance is a way that cities may allow a specific 10 property to deviate from a dimensional standard in City Code based on a unique attribute 11 of the property. The City must consider specific review criteria from Minnesota State 12 Statute, and in Andover City Code, when reviewing a variance request. If a variance is 13 approved, it becomes a property right which runs with the land. Mr. Hellegers showed the 14 location of the property on a map. 15 16 The subject property was shown as Outlot B on the Preliminary Plat for Kimberly Oaks 17 but was left off the Final Plat for Kimberly Oaks in 2005. Due to the large areas of wetland 18 across the front, drawings from the plat process contemplated either a long driveway from 19 1641h Avenue or an extension of Raven Street into the southeasterly portion of the subject 20 property, which would also have to cross wetlands from the property to the south. At the 21 time of the Final Plat in 2005, staff noted that the ability to access the upland area of the 22 subject property had not been demonstrated and suggested combining Outlot B with the 23 larger 40-acre parcel to the east. This language was included in the approved resolution, 24 but both parcels remain separate. 25 26 There is an upland area of approximately 73,000 square feet at the back of the subject 27 property, where a house is now proposed, which should more than accommodate the 8,600 28 square feet of upland area required for a rural lot; including the area for the house (3,600 29 sf) and the septic system (5,000 sf). The upland area also appears to be commensurate with 30 that of properties in the adjacent Kimberly Oaks development. 31 32 The applicant is requesting a variance from the access drive width requirement established 33 by City Code 12-4-2(B): Lot Provisions, which requires that a 20-foot-wide access drive 34 be provided for every principal building which is 300 feet or more from a thoroughfare or 35 street. The variance request is for a 12-foot-wide drive. 36 37 The applicants stated on the variance application that the buildable area of the lot is 38 approximately 350 feet from the closest street (164`h Avenue NW). Since the access drive 39 would have to cross wetland to reach the buildable area, the applicants note that they have 40 been in contact with wetland regulatory agencies to discuss wetland fill for an access to the 41 buildable area. The proposed curved alignment would transverse about 150 feet of wetland 42 versus 275 feet if they tried to build the driveway in a straight line from the house to the 43 street. The regulatory agencies have said that they would only consider access alternatives 44 that have the least direct and indirect wetland impacts and have required the applicant to 45 petition for the variance for the width of the access drive. The applicant's 3 narrative addresses items for the practical difficulties findings. Those include that they 4 propose to use the property in a reasonable manner by providing an access drive to reach a 5 single-family home they would build on t he property, that there are unique circumstances 6 based on the wetland area that they must cross to reach the upland area of the lot and the 7 requirements to minimize wetland impacts, and the essential character would not be 8 harmed as the variance would allow them to construct a single-family home which is 9 consistent with the comprehensive plan. While economic considerations are certainly 10 present, there are significant topographic issues which are specific to the subject property, 11 as well as the additional wetland requirements, appear to be the main considerations for 12 practical difficulties in the proposed variance request. 13 14 The Planning & Zoning Commission is requested to hold a public hearing on the variance 15 request, compare the variance request to the review criteria of City Code 12-15-9, and make 16 a recommendation to the City Council based on findings of fact. 17 18 Chairperson Godfrey asked the purpose of the 20-foot width in the City Code. Mr. 19 Hellegers stated no purpose is listed in the Code; however, it is designed to provide 20 adequate access to the principal structure. Mr. Janish stated it is related to emergency 21 response vehicles. 22 23 Commissioner Shuman asked if the upland area will allow for the passing of emergency 24 vehicles and has there been an assessment done to see if that is sufficient for the Fire 25 Department. Mr. Hellegers stated the Fire Department would prefer to have the 20-foot 26 width, noting there is risk if there is a fire and that narrowed access road extends the 27 response time. Mr. Hellegers explained it would not provide any more of an issue than 28 there is today as other structures are farther away. The risk would be limited to the 29 household only with the access not being 20 feet wide. 30 31 Commissioner Winge referred to Exhibit A. Section 12.2.2 and asked if that is correct or 32 City Code. Mr. Hellegers stated that is a Zoning Code reference. 33 34 Motion: Chair Godfrey assumed a motion to open the Public Hearing at 8:50 p.m. Motion 35 carries by unanimous consent. 36 37 Ms. Tracy Strombeck, 16401 Uplander Street NW, referenced the parcel to the upper 38 northwest of the cul-de-sac, noting it is heavily wooded and if anything were to happen 39 back there, a fire would spread very quickly. She stated this is a land -locked 10-acre parcel 40 and asked if you can build a driveway/access road over a wetland. She also asked if 41 wetland must be given back 2 to 1, will this be a regular primary residence, and is this 42 already approved. 43 44 The applicant, Mr. Shawn Mars, 16171 Raven Street NW, stated the property was 45 purchased so they could build a home on it. They were under the impression they needed to buy 2 wetland credits. He stated it has taken 2% - 3 years to get to this point. He plans to build a 3 single-family home and 300 feet is the benchmark for the 20-foot-wide driveway. If the 4 driveway is 299 feet, it is acceptable. All the (regulatory) agencies have said the driveway 5 needs to be narrower. He explained the house could move but it would be a greater impact 6 to the wetland and the driveway is longer to impact the wetland the least. If it is safe for a 7 12-foot-wide driveway for 299-foot driveway with a 20-foot area near the home, this would 8 be a fair compromise. He wants emergency vehicles to be able to access his home and he 9 is not taking an unnecessary risk to live in the home. Right now, there would be no access 10 to fight a fire and it would need to use helicopters. He stated they had to hire civil and 11 environmental engineers and pay for the drawings to be produced. He has spent thousands 12 of dollars on drawings and is being forced to buy extra wetland credits. It would be $15,000 13 if this request is denied, which he feels is excessive. He feels his request is a fair 14 compromise to the Code. 15 16 Motion: Chair Godfrey assumed a motion to close the Public Hearing at 9:00 p.m. Motion 17 carries by unanimous consent. 18 19 Mr. Janish stated it is possible to build a driveway over a wetland if you go through the 20 permitting process. There is also floodplain that needs to be mitigated but wetland credits 21 can be purchased. 22 23 Commissioner Shafto thinks this is exactly what a variance request is for. He feels the 24 request is reasonable and all criteria has been met. He noted that not impacting the wetlands 25 as much as possible is good and to him, this makes a lot of sense. 26 27 Commissioner Loehlein stated he agrees with Commissioner Shafto in general but 28 questioned the plight. He asked can the 20-foot driveway be constructed and is there an 29 existing plight. 30 31 Commissioner Shafto stated the plight is the regulatory agency. This is how the regulatory 32 agency wants it done. 33 34 Chairperson Godfrey stated she is in favor of preserving wetlands as much as possible. She 35 appreciates the effort of the applicant. She personally cannot get past the fact that the Fire 36 Department wants 20 feet, so she is not willing to go with a variance on this issue as the 37 20 feet is needed for the fire safety issue. 38 39 Commissioner Hudson stated in most cases he would agree but he has the high spot where 40 the road can be 20 feet. He finds this request is a reasonable, common-sense solution, 41 noting the 12-foot road is not impacting as many wetlands. He is inclined to grant the 42 variance. 43 44 Chairperson Godfrey asked if this is inside the MUSA. BACKGROUND A lot split is a division of one property into no more than two properties. If both properties are greater than 5-acres in size and meet City Code requirements, the lot split application can be administratively approved by City staff without Planning & Zoning Commission or City Council review. The proposed lot split would require a public hearing as one of the parcels is smaller than 5 acres. In advance of tonight's public hearing, staff provide the required notice consistent with Minnesota State Statute including mailed notice to all property owners within 700-feet of the subject property and advertised in the Anoka County Union Herald newspaper. Staff also attempted to post a sign on the subject property, but the ground was frozen and there was not enough snow to support the sign. A building permit for the house on the property at 17845 Round Lake Boulevard was issued in 1978 and the property is on private well and septic service. A permit was issued for a 40-foot by 60-foot storage building in 1982, and a permit was issued to move the 20-foot by 40-foot storage building to the rear yard area shortly thereafter. The subject property is generally located south of 181' Avenue NW, west of Gladiola Street NW, north of 176a' Lane NW, and east of Round Lake Boulevard NW. DISCUSSION The applicants are proposing to split the 10-acre property to allow for the development of the southern portion of the property. The property is approximately 580 feet wide by 792 feet long. The proposed lot split would utilize a jog in the property line to help accommodate the existing storage buildings which would remain with the existing home on the northerly portion of the property. The proposed lot split would utilize a provision of City Code 12-3-5, referred to as the "90% Rule"; which allows either the lot width, lot depth, or lot area to be less than the stated minimums provided that at least two of those three dimensions meets the standard, and the dimension that does not is within ninety percent of that standard. The proposed lot split meets the R-1 Single -Family - Rural requirements, is in compliance with the Comprehensive Plan, and meets the minimum lot requirements for the district utilizing the 90% rule for the lot width on Parcel B. The Anoka County Highway Department has also reviewed the proposed lot split and noted that it should have 10 more feet of Right -of - Way on Round Lake Boulevard for future reconstruction. A possible building pad location is shown on the survey, which would have the home location set back approximately 215 feet from this new edge of the Right -of -Way line. Other principal structure setbacks would include 10-foot side yard setbacks and a 50-foot rear yard setback. Site Suitability A geotechnical/soils report, soil borings, and septic borings were submitted with the application. The Engineering Department reviewed the report and determined that the new parcel is buildable. The survey shows the existing septic area for the existing house on Parcel A and two (2) eligible septic drain field locations on Parcel B which would comply with City Code requirements. A geotechnical/soils report was submitted with the application and has been reviewed by the City of Andover Engineering Department to verify that the proposed lot is buildable. A copy of the proposed lot split survey was provided to the Anoka County Highway Department (ACHD) to verify that the newly created lot would be able to have driveway access to Round Lake Boulevard NW, which is a county road in this location. ACHD has indicated that a new driveway should be located within the southerly 50 feet of the property and other than the access points for the two driveways, the remainder of the frontage should be access restricted. Staff Review Comments There are staff review comments for the lot split that will need to be addressed before the lot split can be recorded. A copy of these comments are attached to this staff report. Park Dedication and Trail Fees One new parcel is created by the lot split process. A park dedication fee and a trail fee for the new parcel would be required to be paid for at the time of the recording of the lot split. A permit for work within Anoka County Right of Way will be required for a new driveway access. Per ACHD comments received 12/27/23, dedicate additional 10' of right of way beyond the existing 50' ROW east of centerline. Also noted by ACHD, the new driveway access shall be located within 50' of the south lot line. 2. A proposed grading plan is required prior to building permit issuance but is not required for the lot split approval. Once the new structure is constructed, a final as -built grading survey will need to be prepared as a part of the final building department approval. Refer to the City's Land Survey Standards handout for complete list of requirements. 3. Per emails (see attached) between the City and design engineer / geotechnical engineer, a 15' boring depth was allowed based upon the fact that the homeowners were planning on constructing a slab on grade structure. City staff recommended going down 20' on the chance the owners wanted to construct a full basement on the new parcel. The proposed lot split plan calls out a basement and ground floor elevation, which is inconsistent with a slab on grade structure. For a slab on grade structure, the soil boring and ground water information provided is sufficient. However, if a basement (non -slab on grade structure) is desired, it is required to have the Geotechnical Engineer complete a 20' minimum depth boring and provide a memo on their opinion of what the Highest Anticipated Groundwater Elevation would be. Per City Code, low floor elevations shall be a minimum of 3' above this elevation and also a minimum of 2' above the adjacent wetland HWL (891.0) allowed for estimated HWL per City engineering department review and email. Either revise the plan to depict a slab on grade structure with no basement elevation provided, or, complete the boring to a minimum depth of 20' as originally recommended and provide memo as identified above. 4. DATE: January 23, 2024 INTRODUCTION SMJ International has applied for a conditional use permit (CUP) on behalf of Dish Wireless, to allow Dish Wireless to attach antennas to an existing telecommunications tower, along with ground mounted equipment serving the antennas, on the property located at 16157 Round Lake Boulevard Northwest. The site is generally located north of 161" Avenue NW, east of Round Lake Boulevard NW, south of 162"d Lane NW, and west of Jonquil Street NW. DISCUSSION SMJ International was hired by the cell towner owner American Tower to submit the application on behalf of tenant Dish Wireless, to install three (3) antennas along with tower mounted equipment supporting the antennas, including six (6) remote radio head units (RRH) and one (1) overpower (OVP) unit. The owner of the underlying parcel is AVR, Inc., which has signed the CUP application. The proposed antennas and support equipment would be mounted at 166-foot height on the existing 200-foot self-supporting tower. In addition to the equipment mounted on the tower, Dish Wireless would also install ground -mounted equipment including a 5-foot by 7- foot raised metal platform that will hold an equipment cabinet. The ground equipment would be located inside the existing fenced cell tower lease area around the cell tower. The fenced cell tower lease area is a roughly 52-foot by 47-foot square of land located within the larger land parcel for 16157 Round Lake Boulevard NW. As part of the application, the fence around the leased area would add vinyl slats in the existing fence to provide screening since there is not sufficient space for another building to house the equipment. The cell tower leased `compound' area is located in north 75 feet and east 90 feet of the larger parcel, approximately 210 feet east of the west property line (Round Lake Boulevard side) and 84 feet north of the south property line, making it just under 300 feet north of the 161" Avenue Northwest. The attached site location map shows the approximate location of the tower lease area. The attached survey and plans show the specific location of the proposed equipment on the tower and within the tower lease area. Review Criteria City Code §12-14-6 B provides the following criteria for granting conditional use permits: 1. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: a. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. The existing tower is located a substantial distance back from the two closest streets, and the proposed equipment would not be located any closer to adjacent properties than others inside of the fenced lease area. Additionally, the Federal Communications Commission (FCC) regulates wireless facilities to ensure the health, safety, moral and general welfare of the occupants in the immediate area. b. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. Dish Wireless has indicated that during construction there may be 2 work trucks with a skid steer on site, but no crane should be necessary. Construction would take approximately 3 weeks. After installation there would typically be annual maintenance, which is usually completed within a few hours. c. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. Staff have not received supporting documentation regarding the effects of towers on property values. However, the existing tower is permitted in the zoning district through the Conditional Use Permit that was previously issued for the tower and three other antennas that are currently installed on the tower. The proposed antenna installation would be a collocation on the existing tower which is consistent with City Code, and the ground equipment would be located inside the fenced cell tower lease area and vinyl slats would be installed in the fence to provide screening. Additionally, City Code 9-11 provides more specific requirements for antennas and towers. The proposal meets the height, location, design, setback, and collocation requirements of City Code 9-11. A building permit will be required prior to installation of the equipment. Screening The subject property is zoned general business as are the properties to the north (auto repair / car sales), south (vacant) and east (canine care), while the property to the west is zoned single-family rural residential (church). The proposed installation is located a few hundred feet from the closest public roadway and inside an existing fenced cell tower area. The site does benefit from some existing coniferous trees at the SW corner of the fenced area along with existing equipment shelters to the west which help to screen the ground equipment from that direction. The installation of new vinyl slats into the existing fence should provide uniform screening around the fenced compound to ensure the site is inside a screened enclosure. Radio Frequency Emissions and Interference with Other Signals The wireless carriers are required to be licensed to use a specific frequency to prevent interference with other signals. The applicant is required to provide documentation indicating compliance with FCC requirements and has provided a signed letter confirming this. ACTION REQUESTED The Planning Commission is asked to hold a public hearing and make a recommendation to the City Council on the conditional use permit amendment request.
