Motion carried on a 6 -ayes, 0 -nays, 1 -present (Commissioner 3 Shuman), 0 -absent vote. 5 PUBLIC HEARING: VARIANCE REQUEST -17337 ROANOKE ST NW; PID #06- 6 32-24-33-0016 -SAMANTHA HAUPERT & COLINANDERSON (APPLICANTS) 8 The Planning & Zoning Commission is requested to hold a public hearing and make a 9 recommendation to the City Council to either approve or deny the Variance request made 10 by Samantha Haupert and Colin Anderson. Associate Planner Jake Griffiths explained a 11 Variance is a way through Zoning that cities can allow an exception to an Ordinance that 12 would otherwise apply to a specific property. This Variance Request relates to minimum 13 lot standards. The request is to deviate from the minimum lot size and width requirements 14 of the R2 zoning district, one on Roanoke Street(7th Avenue) and one on 173rd Avenue to 15 the South. For lot size, the City Code requires 2.5 acres, and the applicant is requesting a 16 Variance to drop that to 1.15 acres. For lot width, the City Code requires 300 feet, and the 17 applicant is requesting 138.5 feet. The applicant must show there are practical difficulties, 18 and the Variance needs to be in harmony with the general purposes and intent of the 19 comprehensive plan for the property. The Commission is being asked to compare the 20 Variance Request with the review criteria outlined by the City Code, and make a 21 recommendation based on finding of facts to City Council. He shared the history of the 22 property being discussed, and that the Variance is requesting a lot split. 23 24 Commissioners had no questions about the presentation. 25 26 Motion: Chair Godfrey assumed a motion to open the Public Hearing at 7:10 p.m. Motion 27 carried by unanimous consent. 28 29 Dan Gregerson, Gregerson, Rosow, Johnson & Nilan, LTD, 16025 Temple Lane, 30 Minnetonka, the attorney for the applicants, who bought the property at a distressed sale. 31 They would like to develop the property into two lots to become their forever home. They 32 plan to build a home and accessory structure on the 173rd Avenue lot. The Roanoke Street 33 lot would be rented out to friends and family. Any split of this property would require a 34 variance along Roanoke, no matter how the boundary line is drawn. The applicant wants 35 the line drawn in the original position so there is uniformity in size, and so it's taken back 36 to what the property looked like 10-15 years ago. It would also allow the applicant to build 37 a larger accessory structure along the 173`d Avenue lot. 38 39 Earnest England, 17350 Roanoke Street NW, stated he is seeing a 2.5 acre parcel they want 40 to subdivide into 1.15 acres. It is in Andover's rules that 2.5 acres should be kept as the 41 smallest lot size. He doesn't understand the use of the parcel, and asked if there is an 42 easement going through the middle of the property. He used to plow the driveway of a man 43 named Bruce, who used to live there, and there is one driveway going down the middle so 44 he is not sure how the brown house would get access if the Variance was approved. He 45 asked if anyone from City staff has been out to look at the property to see if there is an Regular Andover Planning and Zoning Commission Meeting Minutes — March 19, 2023 Page 3 1 easement in the middle. He used to work for Andover fire and brought up concerns about 2 there not being City water or sewer on the properties, and about houses being built so close 3 together since it could be a fire hazard. He asked what the 20 year plan is for City water 4 and sewer. He is opposed to the Variance. He has 7.1 acres across the road and won't plan 5 to subdivide until there is City water and sewer. 7 Commissioner Koehler asked Mr. England when he moved into his house. 9 Mr. England shared he and his wife bought their property in 1999. They had under 10 acres 10 which were already subdivided and lived in the house on the 2 acre lot, then built their 11 home on the 7.1 acre lot. 12 13 Dan Gregerson returned to the stand to clarify Mr. England's questions. There is a property 14 on the Roanoke facing side, which will stay. A new residence will be constructed on the 15 173rd Avenue side, so there will be one residence on each parcel. 16 17 Commissioner Koehler asked what the planned access looks like to each primary dwelling 18 on each property of the proposed variance request. 19 20 Mr. Gregerson explained there is a current access off Roanoke Street with an easement 21 there, they could do a cross access easement or investigate if they could take access from 22 173rd Avenue. They would need to revisit that as a possibility. 23 24 Commissioner Koehler asked Staff if 173rd Avenue is a City road or a County road. Mr. 25 Griffiths clarified it is a City road. 26 27 Chair Godfrey asked Staff for additional information. Mr. Griffiths stated the email he 28 received prior to tonight's meeting was from Mr. England, and is an official part of the 29 record. He explained the plans for City water in the area of the property being discussed. 30 He presented Andover's zoning map showing the current boundary to which the City plans 31 on extending City water and sewer. It is several miles short of where the applicant's 32 property is, and the City does not plan to extend it farther. 33 34 Chair Godfrey asked if any proposed additional building in this area, including the 35 applicant's property, would require a new well and septic. Mr. Griffiths shared that is 36 correct. Chair Godfrey asked if that is possible on this site, and Mr. Griffiths said it would 37 be up for the applicant to determine as part of their lot split process in the future if the 38 Variance is approved and they choose to move forward. 39 40 Commissioner Loehlein asked a question related to City Code flexibility for lot splits, 41 where it explains lot splits being allowed under certain conditions. A lot split must result 42 in no more than two lots and must meet two of the following requirements: lot width, depth, 43 or area. He asked if the applicants considered simply drawing the line differently, so that 44 it would be within City Code, so each property would meet the Code. 45 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 Regular Andover Planning and Zoning Commission Meeting Minutes — March 14, 2023 Page 4 Dan Gregerson shared he discussed it with his staff and clients, but they would prefer to go back to the original line for purposes of creating two more normal sized lots. If the lot line was extended in a different area to try to meet the City Code, it might impact the accessory structure that the applicants are hoping to build on the 173rd Avenue parcel. They are going forward with two variance requests tonight. Commissioner Loehlein asked for Mr. Gregerson to indicate on the map where the applicants hope to build their accessory structure. Mr. Gregerson asked Colin Anderson (variance applicant) to come forward to show on the map where they plan on putting it. He explained they are not delving too much into details of a potential lot split. They know they need to get the Variance first before planning too much of the lot split. The applicants know there will be more hurdles even in the Variance is approved, and that the Variance is the first step. Colin Anderson, 17337 Roanoke Street NW, showed on the map that the shed would be near where the current structure on the property is. Motion: Chair Godfrey assumed a motion to close the Public Hearing at 7:36 p.m. Motion carried by unanimous consent. Commissioner Winge asked if the applicant were to redraw the lot lines to allow for only one variance request for lot width, so each parcel would be within the 2.5 acre requirement for a lot split, would the 90% rule apply to that? Mr. Griffiths shared that in this case, no. Staff reports indicate the 90% rule exists because if you meet two of the three criteria, the one requirement you are deviating from has to meet 90% of the City requirement. In this case, the deviation to lot width would be less than half of what City Code requires, so the 90% rule wouldn't apply. Commissioner Koehler asked if Zoning was enacted in 1974 when the City was incorporated, and if the Zoning changed considerably from 1974 until now. Mr. Griffiths explained details of the R2 zoning district. Before 1974, the City was known as Grow Township. When the City was incorporated first ordinances were passed, one being Zoning. The R2 zoning district was established as a way to identify properties that didn't meet City Code. There were properties that were already approved that didn't meet the City Code, such as the one being discussed. Rather than having a bunch of properties that didn't meet R1 district rules, the City created R2 so existing properties built before 1978 could remain but any new buildings would need to follow City Code for 2.5 acres and 300 feet minimum. Since that time, unless a Variance was approved, new structures have met those requirements. Commissioner Koehler asked if Mr. England moved in in 1999, the Zoning would have been in place as it is today, and the Zoning hasn't changed. Mr. Griffiths stated that is Regular Andover Planning and Zoning Commission Meeting Minutes—March 14, 2023 Page 5 1 correct, but noted that across the street there is an RI zoning district, but regardless 2 minimum lot size and width is the same between the two. 4 Commissioner Loehlein stated the R2 zoning district is unique and was created because 5 the properties there didn't meet the RI or R4 district requirements. He asked if many of 6 the properties were non -conforming at that time, or if they conformed to the R2 district 7 requirements. He stated the two properties being discussed didn't, but did most of the 8 properties not meet the R2 district? Mr. Griffiths said to look at properties in the R2 district 9 that were subdivided prior to 1978, which almost all were. Any of those properties in this 10 Zoning District meet city code because they were grandfathered in. Any new properties 11 need to meet City standards and be at least 2.5 acres. New properties can't be re -zoned. 12 The Zoning District can't grow, and is locked in to memorialize the non -conforming status 13 of properties that are in it. 14 15 Commissioner Koehler stated he understands this is a Variance Request not a lot split. He 16 asked if emergency services or engineering looked at this request, or if any other groups 17 within the City provided input. Mr. Griffiths stated they won't get feedback on anything 18 until the lot split happens. 19 20 Chair Godfrey clarified that at this point, they are only looking at the request for two 21 variances. Staff guidance, MN state statutes, and City Code require the Commission to 22 look at specific review criteria. It seems clear that two of the three requirements must be 23 met and she doesn't see much leeway in that. She asked if from Staff's review, is it possible 24 to draw the boundaries differently so the lot size would conform to City Code and there 25 would only be one variance needed, which would be the frontage on Roanoke. Mr. Griffiths 26 stated that yes, currently the property is 6.4 acres in size, and minimum lot size is 2.5 acres. 27 There are many ways you could draw the line to meet the Code for minimum lot size. 28 29 Commissioner Hudson asked Mr. Griffiths to clarify if currently this property is a 30 conforming property, and Mr. Griffiths said that is correct. Commissioner Hudson asked if 31 the Commission would then be seeking to make one of them non -conforming if it were to 32 go through. Mr. Griffiths said a variance is required because the applicant, through their 33 request, is asking to make a conforming property non -conforming. 34 35 Chair Godfrey asked if the City Council in recent years has approved any requests to make 36 conforming properties non -conforming. Mr. Griffith's shared he does not have an answer. 37 Typically cities don't approve things like this, usually properties go from non -conforming 38 to conforming, not the other way around. He doesn't have an answer to how many similar 39 variance requests, if any, have been granted. 40 41 Community Development Director Joe Janish reminded the Commission that they are 42 evaluating requests based on four questions, which should be leading the Commission's 43 discussion related to this particular parcel. 44 Regular Andover Planning and Zoning Commission Meeting Minutes—March 14, 2023 Page 6 1 Chair Godfrey restated a paraphrased version of the four considerations the Commission 2 should be considering and focusing on. First, does the property owner propose to use the 3 property in an unreasonable manner that is not permitted, which in this case does not apply. 4 Second, is the plight of the landowner due to circumstances unique to the property and not 5 created by the landowner. In this case it sounds as if the applicant is creating the problems 6 based on their preference of where the line is drawn. Third, is that the variance, if granted, 7 will not alter the essential character of locality. Fourth, economic considerations alone do 8 not constitute practical difficulties. Mr. Griffiths added to also consider the test to look at 9 performance with the comprehensive plan as well. 10 11 Commissioner Koehler asked if there is an absolute bare minimum that a residential 12 property can be in the City of Andover, as he looked at the Zoning chart in front of him. 13 Mr. Griffiths said the minimum lot size would be 8,600 square feet - 3,600 for a building 14 pad and 5,000 for primary and alternate drain field locations. If the applicant went forward 15 with a lot split, City staff would be looking for those two criteria to be met. Commissioner 16 Koehler is having a problem with considerations two and three. He restated the second, 17 that the plight of the landowner is due to circumstances unique to the property and not 18 created by the landowner. He is hung up on where the applicant wants the line, as it could 19 be moved and then meet two of the requirements. He restated question three related to Mr. 20 England's comments, that if the Variance is granted it will not alter the essential character 21 of locality. There are two pieces of property there that match what they are asking for and 22 were there before the Zoning code was put in place. People like Mr. England bought into 23 the neighborhood understanding what the Zoning requirements were and what the 24 neighborhood should look like. From neighbors' perspectives, some may be okay with it, 25 some many not, but it alters what the expectation was when they moved in, knowing what 26 the Zoning Code was. Commissioner Koehler invited others to argue with him and show 27 him there is a way around it. 28 29 Commissioner Loehlein shared he can't argue. If the applicants had come before the 30 Commission having drawn the line in a different place, it would be different. But with the 31 request as is, he agrees with Commissioner Koehler. 32 33 Commissioner Koehler clarified he is not against the lot split, but there is another way to 34 do it that could maintain the integrity of what people expected when they bought into that 35 neighborhood and get the applicants closer to meeting the code. He shared about past 36 requests people have made to the Commission that were too far off from the Code to be 37 considered, one requesting 1.5 acres, and this request is even smaller. He struggles with 38 there being another way to draw the line, but the applicant not wanting to. 39 40 Commissioner Winge agreed with Commissioners Koehler and Loehlein. If the line could 41 be drawn so that the smaller lot would be closer to 2.5 acres, that would get them closer to 42 moving in the right direction. 43 44 Chair Godfrey explained before moving to a motion that the Commission makes 45 recommendations to City Council, but does not make official decisions. Regular Andover Planning and Zoning Commission Meeting Minutes —March 14, 2023 Page 7 2 Mr. Griffiths clarified there are two variance requests being considered, one for lot size 3 and one for lot width. He wanted to make sure the Commission wasn't missing one part of 4 the applicant's request. Commissioner Hudson asked if it's one request that is being 5 considered to recommend to City Council, two variances but one request that will either 6 pass or fail. Mr. Griffiths stated that is correct, but as part of the Commission's review, 7 both items should be discussed. 9 Commissioner Koehler asked if the line was drawn differently and the acreage of each 10 parcel was closer to 2.5acres, would the lot width still be a problem. Mr. Griffiths said yes, 11 it would be. Commissioner Koehler is hung up on how far off the request is, 300 feet is the 12 requirement for lot width and the request is off by more than 50%. Mr. Griffiths explained 13 there is no way to draw the line differently to tackle lot width. Lot width will be 138.5 as 14 requested, or it will be as it is today. He explained the reason as he showed the map of the 15 current property. Commissioner Koehler clarified that no matter how the line is drawn, the 16 lot width on Roanoke is staying the same no matter what, which was confirmed by Mr. 17 Griffiths. 18 19 Commissioner Loehlein asked Mr. Griffiths to clarify why the applicants couldn't draw the 20 line in a different place and meet the 90% rule, as stated in Item 2 of the City Code, since 21 a new line could help the applicants meet requirements for lot area and depth. Mr. Griffiths 22 explained it's because of Criteria 3, which states each lot within the proposed lot split shall 23 provide at least 90% of the requirement that can't be met. The lot width of the proposed lot 24 split would still be less than 50% of the City requirement. 25 26 Mr. Griffiths reminded the Commission that it can direct Staff to go back and craft findings 27 to present to the City Council based on tonight's discussion, to be forwarded to them. It 28 can be indicated in the motion. Chair Godfrey asked Mr. Griffith's if it needs to be part of 29 the motion or if it can be a direction after action on the motion is taken. Mr. Griffiths stated 30 that however the Commission would like to do it is okay. 31 32 Motion by Commissioner Koehler to recommend to the City Council approval of the 33 Variance Request as presented. Motion died for lack of a second. 34 35 Motion by Commissioner Koehler, seconded by Commissioner Loehlein, to recommend 36 to the City Council denial of the Variance Request as presented based on the fact that the 37 land area of the lot is due to the landowners decision as to where to draw the line, and that 38 the essential character of the locality is changed based on the fact that it no longer meets 39 Zoning Code. Motion carried by unanimous consent. 40 41 Chair Godfrey asked Mr. Griffiths to direct Staff to craft a summary of tonight's comments 42 and discussion for City Council. She stated the City Council will view the QCTV recording 43 of tonight's meeting and see the comments made during the public hearing. 44 Regular Andover Planning and Zoning Commission Meeting Minutes—March 14, 2023 Page 8 1 Mr. Griffiths stated that this item would be before the Council at the March 21, 2023 City 2 Council meeting. 4 PUBLIC HEARING. CONSIDER AMENDMENT TO CITY CODE TITLE 12-7-3 5 FENCE HEIGHT- CITY OFANDOVER (APPLICANT) 7 The Planning and Zoning Commission is requested to hold a public hearing and make a 8 recommendation to the City Council on an amendment to City Code related to fence height. 9 Community Development Director Joe Janish shared this is coming to the Planning and 10 Zoning Commission based on things City staff has been seeing and based on research that 11 was conducted. As they have gone through their Commercial Site Plan process required of 12 commercial or larger residential sites, when it comes to ground mounted mechanical 13 equipment like ground generators, hvac units, etc. it appears screening isn't adequate. He 14 contacted nearby communities who allow for fencing up to higher heights through the 15 screening process. He wanted to make an amendment to Code to make exceptions for fence 16 height, and presented the language that will be added to the code. The proposed new 17 language reads: 18 Fences that are required for screening of ground mounted mechanical equipment, through 19 a required commercial site plan (CSP), may exceed the height otherwise required by City 20 Code provided that: 21 1. Location of fencing meets Building Setbacks for a principal structure. 22 2. Fencing is to screen around mounted mechanical equipment. 23 3. Fencing shall be the minimum height needed to screen the equipment and no 24 taller than 10 feet. 25 4. Fencing shall not be taller than the height of the adjacent building wall. 26 5. All other screening requirements are met. 27 28 Commissioner Koehler asked if the City has ever given exceptions before related to 29 fencing. Mr. Janish is not aware of that. Commissioner Koehler asked if this code would 30 pertain only to commercial buildings. Mr. Janish said yes, only those that require a 31 Commercial Site Plan process. A single-family home would not qualify for this section of 32 the code. 33 34 Chair Godfrey asked if a 4-plex or larger residential property would qualify. Mr. Janish 35 said yes because they would trigger the Commercial Site Plan process. 36 37 Commissioner Koehler asked if an exception outside of this would be a home that wanted 38 to build a fence in the front yard taller than 4 feet tall, and clarified that would not be 39 allowed. Mr. Janish stated that is correct. Mr. Janish stated that this item would be before the Council at the March 21, 2023 City Council meeting. OTHER BUSINESS. Associate Planner Jake Griffiths updated the Planning Commission on related items. He updated that at the last meeting there was a Conditional Use Permit for Grace Lutheran Church which will be on the City Council agenda for March 21. The Commission is planning to have a meeting on the 4th Tuesday of the month, March 28th. He also recapped that the City had the North Suburban Home show and it was great to see several present and former Commissioners there. Commissioner Koehler thanked Staff and the City for the wonderful job they did on the Home Show. ADJOURNMENT. DATE: March 28, 2023 INTRODUCTION AT & T is seeking to install 6 additional antennas on the existing city water tower #2 located at 1717 Crosstown Blvd NW (next to City Hall a.k.a city water tower #2). Currently the water tower has antennas on the tower. A conditional use permit is required to locate an antenna above 35 feet in height. The water tower top is 169 feet tall. The proposal would have antenna tip height of 176' 5". The current height of equipment on water tower #2 is 184'. DISCUSSION As with all antenna installations, some ground mounted equipment will be necessary, which will be located within the tower itself and identified as part of a lease to the City. The attached site plan illustrates equipment placement both on and inside water tower #2. City code 12-14-6B provides the following general review criteria to consider when granting a CUP. In granting a Conditional Use Permit, the City Council shall consider the advice and recommendation of the Planning and Zoning Commission and: 1. The effect of the proposed use upon the health, safety, moral and general welfare of occupants of surrounding lands. The antennas will be placed on the water tower. Currently the water tower has other providers located on the tower. The proposal is currently being reviewed by a structural engineer to evaluate the placement of the equipment. The Federal Communication Commission regulates wireless facilities to ensure the health, safety, moral and general welfare of the occupants in the immediate areas. 2. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. The CUP Amendment will not generate substantial additional traffic on adjacent streets as only maintenance vehicles would be expected at the site after install. Parking facilities and adjacent streets will not be impacted. A parking pad is provided adjacent to the water tower for maintenance personnel. 3. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. The existing use is permitted in the zoning district. Water tower #2 is existing and installation of antennas does not adversely affect the development of the surrounding lands. The location is part of the City Campus, with an elementary school to the south, Community Center to the north, and commercial businesses to the east. The nearest home is approximately 1217 feet to the SE and the nearest development land is approximately 840 feet to the east from the water tower. Radio Frequency Emissions and Interference with Other Signals The applicant will be present to address these items. Additionally, the applicant is required to be licensed to use a specific frequency to prevent interference with other signals. The applicant is required to provide documentation indicating compliance with FCC requirements. ACTION REQUESTED The Planning and Zoning Commission shall conduct a public hearing and make a recommendation to the City Council on the CUP Amendment request. If the recommendation is approval, staff suggests the CUP amendment be approved subject to the conditions listed in the attached resolution. Facilitate the provision of commercial wireless telecommunication services to the residents and businesses of the city; B. Minimize adverse effects of towers through careful design and siting standards in order to lessen the aesthetic impact on surrounding properties; C. Avoid potential damage to adjacent properties from tower failure through structural standards and setback requirements; and D. Maximize the use of existing and approved towers and buildings to accommodate new commercial wireless telecommunication antennas in order to reduce the number of towers needed to serve the community. (Ord. 270, 12-5-2000) 9-11-2: DEFINITIONS: The following words and terms shall have the following meanings when used in this chapter: ANTENNA: That portion of any equipment located on the exterior or outside of any structure and used for transmitting or receiving radio, telephone and television signals. "Antenna", as defined in this chapter (unless otherwise noted), pertains to all of the following antennas: Antenna, Public Utility Microwave: A parabolic dish or cornucopia shaped electromagnetically reflective or conductive element used for the transmission and/or reception of point to point UHF or VHF radio waves in wireless telephone communications, and including the supporting structure thereof. Antenna, Radio And Television, Broadcasting Transmitting: A wire, set of wires, metal or carbon fiber rod or other electromagnetic element used to transmit public or commercial broadcast radio or television programming, and including the support structure thereof. Antenna, Radio And Television Receiving: A wire, set of wires, metal or carbon fiber elements, other than satellite dish antennas, used to receive radio, television, or electromagnetic waves, and including the supporting structure thereof. Antenna, Satellite Dish: A device incorporating a reflective surface that is solid, open mesh, or bar configured and is in the shape of a shallow dish, cone, horn, or cornucopia. Such device shall be used to transmit and/or receive radio or electromagnetic waves between terrestrially and/or orbitally based uses. This definition is meant to include, but not be limited to, commercial satellite earth stations, TVROs (television, receive only), and satellite microwave antennas, but does not include personal TVRO satellite reception receivers. Antenna, Short Wave Radio Transmitting And Receiving: A wire, set of wires or a device, consisting of a metal, carbon fiber, or other electromagnetically conductive element, used for the transmission and reception of radio waves used for short wave radio communications, and including the supporting structure thereof. Antenna, Telecommunications: A device consisting of a metal, carbon fiber, or other electromagnetically conductive rod or element, usually arranged in a circular array on a single supporting pole or other structure, and is used for the transmission and reception of radio waves in digital, analog or other wireless or personal communication services (i.e., cellular, paging, internet, etc.). CO -LOCATION: The placement of wireless telecommunication antennas by two (2) or more service providers on a tower, building or structure. COMMERCIAL WIRELESS TELECOMMUNICATION SERVICES: Licensed commercial wireless telecommunication services including cellular, personal communication services (PCS), specialized mobilized radio (SMR), enhanced specialized mobilized radio (ESMR), paging, and similar services that are marketed to the general public. FEDERAL COMMUNICATIONS COMMISSION: The federal administrative agency, or lawful successor, authorized to regulate and oversee telecommunications carriers, services and providers on a national level. GUYED TOWER: A tower that is supported, in whole or in part, by wires and ground anchors. LATTICE OR SELF -SUPPORTED TOWER: A tower erected on the ground that consists of metal crossed strips or bars to support antennas and related equipment. MAST: That portion of the outside antenna system to which the antenna is attached, and the support of extension is required to elevate the antenna to a height deemed necessary for adequate operation. PRIVATE PROPERTY: Land that is not "public property" as defined in this section. PUBLIC PROPERTY: Land owned or operated by a government entity. PUBLIC UTILITY: Persons, corporations, or governments supplying gas, electric, transportation, water, or landline telephone services to the general public. For the purposes of this chapter, wireless telecommunication service facilities shall not be considered public utility uses and are defined separately. SERVICE PROVIDER: Any individual or entity that provides wireless telecommunication services. SMALL WIRELESS FACILITY: A wireless facility that meets both of the following qualifications: each antenna is located inside an enclosure of no more than six cubic feet in volume or could fit within such an enclosure; and ii all other wireless equipment associated with the small wireless facility provided such equipment is, in aggregate, no more than 28 cubic feet in volume, not including electric meters, concealment elements, telecommunications demarcation boxes, battery backup power systems, grounding equipment, power transfer switches, cutoff switches, cable, conduit, vertical cable runs for the connection of power and other services, and any equipment concealed from public view within or behind an existing structure or concealment. (Ordinance 478, 2-5-18) TOWER: Any pole, monopole, spire, or structure (excluding structures required for the transmission of electric energy), or any combination, to which any antenna could be attached, or which is designed for any antenna to be attached, and all supporting lines, cables, wires and braces. (Amd. Ord. 364, 2-19-08) TOWER, MULTI-USER: A tower to which is attached the antennas of more than one commercial wireless telecommunication service provider or governmental entity. TOWER, SINGLE USER: A tower to which is attached only the antennas of a single user, although the tower may be designed to accommodate the antennas of multiple users as required in this chapter. (Ord. 270, 12-5-2000) 9-11-3: PERMIT AND LEASE AGREEMENT REQUIRED: All towers and antennas over thirty five feet (35') from ground level shall require a conditional use permit and building permit approvals from the City. All towers and antennas on City -owned public property shall require a lease agreement with the City. Any changes to a tower or antenna shall require an amended conditional use permit. (Ord. 364, 2-19-2008) 9-11-4: HEIGHT REQUIREMENTS: A. In Commercial and Industrial zoning districts, towers and antennas may not exceed 150 feet in height. B. In residentially zoned districts, towers and antennas may not exceed 120 feet in height. C. Antennas (including the mast) may be mounted on a building or structure provided that the antennas do not extend over fifteen feet (15') above the highest portion of the roof of the building or structure. (Ord. 364, 2-19- 2008) 9-11-5: ZONING DISTRICT REGULATIONS: A. Residential Zoning Districts: 1. Towers supporting antennas and conforming to all applicable provisions of this chapter may be allowed only in the following residentially zoned locations: (Ord. 270, 12-5-2000; amd. 2003 Code) a. Religious institution sites, when camouflaged; (Amended Ord. 481, 4/3/18) b. Public land, including City water towers, schools, and publicly - purchased parks when the City Council determines that the tower will not adversely affect the use of the park or neighboring properties; (Ord. 364, 2-19-2008) C. Utility and transmission structures located in public rights-of-way; when attached thereto; and d. Utility and transmission structures located outside of public rights-of-way, exclusively to serve the structures. (Ord. 364, 2-19- 2008) 1. Only one tower or monopole shall exist on any one residentially zoned parcel of land. 2. Small Wireless Facilities require a Conditional Use Permit and shall conform to all applicable provisions of City Code pertaining to Public Right-of-way Management (Ordinance 478, 2-5-18). B. Commercial And Industrial Districts: 1. Towers supporting antennas and conforming to all applicable provisions of this chapter may be allowed only in the following commercially and industrially zoned locations: a. Industrial (1) zoned parcels of land when the appearance is consistent with the surrounding area and is compatible with the use; b. Commercially zoned parcels (Shopping Center SC and General Business GB) parcels of land when the appearance is consistent with the surrounding area and is compatible with the use; and c. Utility and transmission structures located in public rights-of-way when attached thereto. d. Utility and transmission structures located outside of public rights-of-way exclusively to serve these structures. (Ord. 364, 2-19- 2008) 4. Only one tower shall exist on any one industrially or commercially zoned parcel of land. (Ord. 270, 12-5-2000) 5. Small Wireless Facilities shall conform to all applicable provisions of City Code pertaining to Public Right -of -Way Management (Ordinance 478, 2-5-18). 9-11-6: COLOCATION REQUIREMENTS: All telecommunication towers erected, constructed, or located within the city shall comply with the following requirements: A. A proposal for a new telecommunication service tower shall not be approved unless the City Council finds that the telecommunications equipment planned for the proposed tower cannot be accommodated on an existing approved tower or building due to one or more of the following reasons: 1. The planned equipment would exceed the structural capacity of the existing or approved tower or building, as documented by a qualified and licensed structural engineer, and the existing or approved tower cannot be reinforced, modified, or replaced to accommodate planned or equivalent equipment at a reasonable cost. 2. The planned equipment would cause interference materially impacting the usability of other existing or planned equipment at the tower or building as documented by a qualified and licensed professional engineer, and the interference cannot be prevented at a reasonable cost. 3. Existing or approved towers and buildings within the search radius cannot accommodate the planned equipment at a height necessary to function reasonably as documented by a qualified and licensed professional engineer. 4. Other unforeseen reasons that make it infeasible to locate the planned telecommunications equipment upon an existing or approved tower or building. B. Towers must be designed to allow for future arrangement of antennas upon the tower and to accept antennas mounted at varying heights. A tower one hundred feet (100') or more in height shall accommodate at least three (3) additional users. (Ord. 270, 12-5-2000) (Ord. 364, 2-19- 2008) 9-11-7: DESIGN REQUIREMENTS: Telecommunication service towers shall be of a monopole design unless the City Council determines an alternative design would better blend into the surrounding environment. Lattice towers are prohibited. (Ord. 270, 12-5-2000) 9-11-8: SETBACKS: Towers shall conform with each of the following minimum setback requirements: A. Towers and ground mounted equipment shall meet the building setbacks of the underlying zoning district as stated in the zoning ordinance. B. Towers shall be set back from all structures and all property lines at a distance equal to the height of the tower (plus an additional 10 feet), unless a qualified professional structural engineer certifies in writing that the collapse of the tower will occur within a lesser distance under all foreseeable circumstances. C. A tower's setback may be reduced or its location in relation to a public street or neighboring property varied, at the sole discretion of the City Council. The Council's decision must be based on legitimate findings such as, but not limited to: a. Aesthetic concerns b. Safety concerns c. City staff review (Ord. 364, 2-19-2008) 9-11-9: GENERAL REQUIREMENTS: All towers and antennas for which permit is required shall comply with the following requirements: A. Lighting: Towers shall not be illuminated by artificial means and shall not display strobe lights unless such lighting is specifically required by the Federal Aviation Administration or other federal or state authority for a particular tower. When incorporated into the approved design of the tower, light fixtures used to illuminate ball fields, parking lots, or similar areas may be attached to the tower. B. Signs And Advertising: The use of any portion of a tower for signs is prohibited. Warning or equipment signs are exempt from this provision. C. Supplemental Information: Applications for towers shall include the following supplemental information: 1. A report from a qualified and licensed professional engineer that: a. Describes the tower height and design including a cross section and elevation; b. Documents the height above grade for all potential mounting positions for co -located antennas and the minimum separation distances between antennas; c. Describes the tower's capacity, including the number and type of antennas that it can accommodate; d. Documents what steps the applicant will take to avoid interference with established public safety telecommunications; e. Includes an engineer's stamp and registration number; f. A coverage map showing what portions of the city will be served by the user, along with future coverage plans and potential construction sites to provide similar service elsewhere in the city; g. A report indicating that the request meets technical emission standards set by the FCC; and h. Includes other information necessary to evaluate the request. 2. For all telecommunication service towers, a letter of intent committing the tower owner and his or her successors to allow the shared use of the tower if an additional user agrees in writing to meet reasonable terms and conditions for shared use. 3. Before the issuance of a building permit, the following information shall be submitted to the city: a. Proof that the proposed tower complies with regulations administered by the Federal Aviation Administration; and b. A report from a qualified and licensed professional engineer that demonstrates the tower's compliance with the aforementioned structural and electrical standards. (Ord. 270, 12-5-2000) 9-11-10: GROUND MOUNTED EQUIPMENT: A. Ground mounted equipment shall be stored within a closed, secure building. All buildings accessory to a tower or antenna shall be architecturally designed to blend in with the surrounding environment. (Ord. 364, 2-19-2008) B. Screening shall be provided in compliance with Chapter 12-13-5. (Ord. 364, 2-19-2008) 9-11-11: NONCONFORMING ANTENNAS AND TOWERS: Antennas and towers in existence prior to the adoption of this chapter that do not conform to or comply with the provisions of this chapter may continue in use for the purpose now used and as now existing but may not be structurally altered without complying with this chapter. (Ord. 270, 12-5-2000; amd. 2003 Code) 9-11-12: INTERFERENCE WITH PUBLIC SAFETY TELECOMMUNICATIONS PROHIBITED: No new or existing telecommunications services shall interfere with public safety telecommunications. (Ord. 270, 12-5-2000) 9-11-13: DAMAGED OR DESTROYED ANTENNAS AND TOWERS: If an antenna or tower is damaged or destroyed due to any reason or cause whatsoever, the same may be repaired or restored to its former use, location and physical dimensions upon obtaining a building permit. The repair or restoration must comply with this chapter. Provided, however, that if the cost of repairing such damaged or destroyed antenna or tower would be fifty percent (50%) or more of the cost of purchasing and erecting a new antenna or tower of like kind and quality, as estimated by the Building Official, and to the former use, physical dimensions and location, then the antenna or tower may not be repaired or restored except in full compliance with the requirements of this chapter. (Ord. 270, 12-5-2000; amd. 2003 Code) 9-11-14: ABANDONED ANTENNAS AND TOWERS: Any antenna or tower that is not used for one year shall be deemed abandoned. Within ninety- (90) days of notice by the city, the antenna or tower and all other associated equipment must be removed from the property. If the antenna or tower and equipment are not removed from the property within the time period as stated herein, a public nuisance may be declared, and the city may order that the public nuisance be abated in a manner consistent with ordinances and policies of the city. (Ord. 270, 12-5-2000; amd. 2003 Code) 9-11-15: VARIANCES: Variances from the provisions of this chapter shall be processed and granted or denied in the same manner and based on the same criteria as stated in the city zoning ordinance. (Ord. 270, 12-5-2000) 9-11-16: VIOLATION; PENALTIES: Any person who shall violate any provision of this chapter shall be charged with a misdemeanor and upon conviction thereof, shall be subject to applicable fines and imprisonment as defined by state law. In addition to the penalties imposed by this chapter, the city may exercise, with or separately from such penalties, all and any other legal and equitable remedies then available to the city by this chapter, or by statute, or by other ordinances of the city, or by applicable rules or regulations, to enforce this chapter, including, without limitation, injunction.
