The Regular Bi -Monthly Meeting of the Andover Planning and Zoning Commission was
called to order by Chairperson Karen Godfrey on January 10, 2023, 7:00 p.m., at the
Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.

Commissioner Koehler requested a change to page 12, line 9: add the word "Commission"
between "the" and "is".
City Planner Hellegers requested a change to page 4, line 23: change "Ms. Thomas" to
"Ms. Thompson".
Commissioner Volkenant requested a change to page 8, line 9: add "Noting the comment
about congestion on Inca"; take out the word "stated" and add "asked if"; take out the
words "would be" and add "is'; after the word "streets", add "as it appeared to be on the
big foldout map".
Motion: by Koehler, seconded by VanderLaan, to approve the December 13, 2022 Regular
Meeting minutes as amended. Motion carries unanimously.

2 PUBLIC HEARING: CONSIDER A CONDITIONAL USE PERMIT (CUP) FOR A
3 DRIVE THROUGH WINDOW — PIN 34-32-24-32-0027, 2248 BUNKER LAKE

7 The Planning & Zoning Commission is requested to hold a public hearing and make a
8 recommendation to the City Council on a Conditional Use Permit (CUP) for a drive
9 through window for a fast casual restaurant. City Planner Hellegers identified the location
10 of the proposed business and stated the surrounding property is primarily commercial with
11 residential located across Bunker. He noted the drive-through allows for the stacking of 7
12 vehicles. Mr. Hellegers presented the landscape plan. He explained the review criteria for
13 a CUP.

15 Commissioner Koehler asked if it was considered to have the drive-through go the opposite
16 direction so headlights wouldn't shine into people's houses. Mr. Hellegers stated going
17 the opposite way didn't work well for the flow of traffic.

19 Commissioner Volkenant asked if the flow of traffic through the drive-through could go
20 the opposite direction so it wouldn't shine onto cars traveling on Bunker. He asked if the
21 landscaping is sufficient to prevent headlights from causing difficulties for vehicles
22 traveling eastbound on Bunker. Mr. Hellegers brought up the landscape plan, stated the
23 traffic pattern follows the existing pattern, and feels the landscape plan will mitigate
24 headlights. Commissioner Volkenant stated the key is to have adequate landscaping on the
25 northwest corner as the vehicles exit the drive-through. Mr. Hellegers believes the existing
26 trees will block the headlights and stated the Commission can request additional
27 landscaping. Mr. Hellegers explained the drive-through lane is offset from Bunker.

29 Commissioner Koehler asked if Mr. Hellegers was aware of any complaints from the drive -
30 through at Caribou. Mr. Hellegers stated he is not aware of any complaints. Commissioner
31 Koehler asked if he was aware of comments from the police that the drive-through is
32 blinding traffic. Mr. Hellegers stated he is not aware of any issues.

34 Commissioner VanderLaan stated the City Council and Andover Review Committee
35 should consider landscaping options other than trees, such as walls, bricks, or other
36 materials that cut the glare.

38 Motion: by Koehler, seconded by Loehlein, to open the public hearing at 7:20 p.m. Motion
39 carries unanimously.

2 Chris Moe, with Andover Station 2016, came forward and stated he is fine with adding
3 language to the CUP for additional landscaping to provide an opaque screen. He explained
4 that vehicles traveling eastbound will have glare from vehicles traveling westbound. Mr.
5 Moe stated he is willing to work with staff to provide adequate screening.

7 Motion: by Koehler, seconded by Loehlein, to close the public hearing at 7:23 p.m. Motion
8 carries unanimously.

10 Commissioner Hudson asked if the conditions on the resolution to approve are consistent
11 with the Chipotle drive-through. Mr. Hellegers stated they are the same.

13 Commissioner Volkenant noted the parking for the Dollar Store gets severely cut down by
14 this development and asked if staff had discussions with the owner of the property. Mr.
15 Hellegers stated there are 374 parking spaces in the shopping center and parking will be
16 reduced due to Noodles, however, the remaining parking is sufficient. He noted Chipotle
17 increases the number of parking spaces to 387. Mr. Hellegers explained the Dollar Tree
18 should not be significantly impacted. Commissioner Volkenant asked if the Dollar Tree
19 parking spaces to the east of the curb would be open or blocked. Mr. Hellegers identified
20 the available parking for Noodles and the Dollar Tree.

22 Chairperson Godfrey stated she appreciates that the proposal retains the existing trees with
23 supplemental landscaping. She asked Mr. Hellegers to confirm the existing trail will be
24 retained. Mr. Hellegers stated the existing trail remains in place.

26 Motion: by Loehlein, second by Hudson to recommend approval of a Conditional Use
27 Permit for a drive-through window for the proposed business located at 2248 Bunker Lake
28 Boulevard.

30 Commissioner Koehler requested striking "coniferous/evergreen" from condition 3 to
31 allow the developer to do what needs to be done to screen correctly.

33 Commissioner VanderLaan asked staff to suggest language for condition 3. Mr. Hellegers
34 stated coniferous/evergreen landscaping is placed as a condition to provide foliage year -
35 round. He noted it is not the only way the developer can screen, and the language is
36 consistent with past proposals. He suggested changing condition 3 to providing opaque
37 landscaping.

Commissioner Koehler stated he is satisfied the City Council will hear the concern and
would like to vote on the motion as presented.

BACKGROUND
A lot split is a division of one property into two properties. If both properties are greater than 5 -
acres in size and meet City Code requirements, the lot split application can be administratively
approved by City staff without Planning & Zoning Commission or City Council review. Since
the proposed lot split would create a lot less than 5 acres in size, the Planning & Zoning
Commission is required to hold a public hearing on the proposed lot split and make a
recommendation to the City Council. Prior to tonight's meeting, City staff followed the
requirements of Minnesota State Statute regarding notice for public hearings and mailed notice
of tonight's hearing to all property owners within 350 -feet of the subject property, advertised in
the Anoka County Union Herald newspaper, and posted a sign on the subject property.
DISCUSSION
The applicant is proposing to split the existing 1.31 -acre property at 14034 Crosstown Blvd NW
to create a new residential lot approximately 0.47 acres in size and maintain the existing dwelling
on a lot approximately 0.84 acres in size. A survey showing the proposed lot split is attached for
review. When reviewing lot splits, the Planning & Zoning Commission should focus its review
on applying the requirements established by the Andover City Code and the Comprehensive
Plan. The proposed lot split exceeds the requirements of the R-4: Single Family Urban zoning
district in which the property is located and is in conformance with the Comprehensive Plan.

The attached survey identifies the front yard setback as 35 -feet which meets the requirements of
the R-4 zoning district. However, City Code 12-5-1 does provide flexibility in situations where
adjoining dwellings would indicate a lesser setback in order to maintain uniformity which would
apply to the newly created property. At the time of building permit submittal the applicant could
propose a different setback to be evaluated by City staff.
A geotechnical/soils report was submitted with the application and has been reviewed by the City
of Andover Engineering Department to verify that the proposed lot is buildable. The applicant
worked with the Anoka County Highway Department to verify that the newly created lot would
be able to have driveway access to Crosstown Blvd NW, which is a county road in this location.
The applicant has also worked with City staff to provide a trail easement across both the existing
and proposed lots to accommodate a future trail along Crosstown Blvd NW.
ACTION REQUESTED
The Planning & Zoning Commission is requested to hold a public hearing on the proposed lot
split and make a recommendation to the City Council.

1. The applicant shall be required to pay a park dedication fee for the new lot in the amount
of $5,079.00 and a trail fee is the amount of $1,039.00 prior to the release of the lot split
for recording.
2. The applicant shall dedicate a trail easement to the City of Andover as shown on Exhibit
A.
3. The applicant shall obtain all required permits from any agency having an interest in the
site including but not limited to the Anoka County Highway Department, City of
Andover Building Department, etc.
4. A grading and erosion control plan must be submitted to the City at the time of building
permit submittal.
5. As part of the building permit process, all organic material shall be removed and replaced
with granular material with no more than five (5%) percent organic material by volume
for the front one hundred and ten (110.0) feet of the lot and at a minimum width of eighty
(80) feet to the satisfaction of the City Engineer.
6. Prior to the issuance of a Certificate of Occupancy on the newly created parcel, any
dwelling is required to connect to municipal sewer and water services.
7. Per City Code 13-lA-6-F, if the City Council determines that the conditions of approval
are not met within twelve (12) months, the lot split will be null and void.
