Respectfully submitted, Michelle Harmer Deputy City Clerk Attach: Minutes 1 2 3 4 5 6 REGULAR ANDOVER CITY COUNCIL MEETING —DECEMBER 20, 2022 7 MINUTES 8 9 10 The Regular Bi -Monthly Meeting of the Andover City Council was called to order by Mayor Sheri 11 Bukkila, December 20, 2022, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard 12 NW, Andover, Minnesota. 13 14 Councilmembers present: Jamie Barthel, Ted Butler, Randy Nelson, and Valerie Holthus 15 16 Councilmembers absent: None 17 18 Also present: City Administrator, Jim Dickinson 19 Public Works Director/City Engineer, Dave Berkowitz 20 ON Plnnner Tne Inn ch 21 City Attorney, Scott Baumgartner 22 Others 23 24 PLEDGE OFALLEGIANCE_ 25 26 RESIDENT FOR UM 27 28 Hope Luedtke, 1,6932 Jivaro Street, came forward and stated she is speaking for herself and her 29 daughter's family. Ms. Luedtke stated she is in opposition of Phase 3 of Petersen Farms. She is 30 concerned that 33 new:homes only, have 1 exit, increasing traffic on 165`h Avenue and 7`h Avenue, 31 and overall traffic safety. Ms. Luedtke stated the plan before the Council is not what it was in 2018. 32 She stated the second access will not occur for a very long time. Ms. Luedtke asked if the Council 33 had a workshop about the development or is this the only time they have seen it. She asked how 34 many people were sent the letter. Ms. Luedtke asked the Council to be strong for the community 35 and consider those that live there and those that will be moving in. She understands the area will 36 be developed but doesn't believe it should be pushed through without looking at the big fety 37 issue. Ms. Luedtke asked the Council to hit the pause button and push the project out 3-4 years for 38 the roundabout to be built. 39 40 Merle Prochniak, 2941 —1415` Avenue, came forward and stated the City should take a pause and Regular Andover City Council Meeting Minutes —December 20, 2022 Page 2 1 look at other ways of doing things. He stated the City shouldn't make hasty decisions and should 2 look at Commission recommendations. Mr. Prochniak stated there is no guarantee the Red Oaks 3 neighborhood will get City water and sewer. He said the City should have something in place to 4 address the issue. 5 6 Mayor Bukkila stated she appreciates when residents come in during the project instead of after 7 the project and thanked the residents that spoke at open forum. 8 9 AGENDA APPROVAL 10 11 City Administrator Dickinson announced two supplemental items for Items 3 and 19. 12 13 Motion by Nelson, Seconded by Butler, to approve the Agenda as amended. Motion carries 14 unanimously. 15 16 ANOKACOUNTYSHERIFF'SOFFICE MONTHLYREPORT 17 18 Commander Lenzmeier provided a monthly report for November stating the Department 19 responded to 1,098 calls for service. He stated there were 5 personal injury accidents and 58 20 property damage accidents during November. Commander Lenzmeier noted changes to the report 21 which further detailed Sheriff calls. He stated there were 3 DWIs, 236 traffic stops, and 60 traffic 22 citations. Commander Lenzmeier cautioned residents to be aware of frauds and scams. He stated 23 deputies participated in the Anoka Toys for Joy campaign, serving 4 families. He noted the Grinch 24 was arrested and rehabilitated on December 13'h. Commander Lenzmeier congratulated 25 Councilmember Holthus on her service and wished her the best on her next adventure. 26 27 Councilmember Barthel appreciated the addition of offenses to the report. He asked where retail 28 thefts would fall into the report. Commander Lenzmeier stated it can be under any category 29 depending on the value of the theft, but they are mostly misdemeanors and gross misdemeanors. 30 31 Councilmember Nelson commended the Sheriff Reserve who volunteered for the Salvation Army 32 kettle campaign outside of Walmart. He suggested having a reserve officer posted at Walmart to 33 act as a deterrent. Commander Lenzmeier stated reserves cannot be used for that purpose. He 34 explained the Reserves have been bell -ringing for years and have brought in thousands of dollars. 35 36 Councilmember Butler stated he spoke with a resident about the City's THC ordinance, and they 37 inquired about driving while impaired. He asked the Commander what the process would be. 38 Commander Lenzmeier stated a DWI is driving while impaired and the process is the same for Regular Andover City Council Meeting Minutes —December 20, 2022 Page 4 1 alcohol and drugs. He explained they test differently for based on the product the Deputy suspects. 2 3 CONSIDER A CONDITIONAL USE PERMIT (CUP) AMENDMENT TO AMEND THE 4 PETERSEN FARMS PLANNED UNIT DEVELOPMENT TO INCORPORATE THE THRID 5 PHASE WHICH WILL BE KNOWN AS THE LEGACY AT PETERSEN FARMS 6 (APPLICANT— JD ANDOVER HOLDINGS) 7 8 The City Council is requested to consider a Conditional Use Permit Amendment (CUPA)/ Planned 9 Unit Development (PUD) Amendment for the third phase of the Petersen Farms development 10 known as Legacy at Petersen Farms. This request will modify the original PUD and PUD 11 Amendments that occurred on December 18, 2018 and August 25, 2020. As originally written, 12 changes to the " Master Plan" and each preliminary plat require an amendment to the PUD. 13 Development Director Janish identified the location of the development and stated it will be on 14 well and septic. He said the development plans on 33 lots over 75 acres and contains wetlands, 15 shoreline, and floodplain. Mr. Janish stated the applicant is seeking to modify the standards of the 16 PUD related to length of two cul-de-sacs, allowing two lots below the self-imposed net land area 17 of one acre, and adjustments to the Master Plan. 18 19 Mr. Janish presented connections to the County roads. Mr. Janish explained the City would like to 20 work with the developer on a 35 mile per hour design at Option B. He stated the applicant will 21 provide escrow and easements for Options B and C. Mr. Janish stated the addition of 33 homes 22 are not expected to have a negative impact on 7 1 Avenue as shown by the traffic study. He 23 explained 7 t Avenue is operating at 60% capacity. Mr. Janish noted the County received funding 24 for a roundabout at 165`h Avenue and 7`h Avenue in 2026-2027. 25 26 Mr. Janish reviewed the shoreland development requirements and Park Dedication. The Park and 27 Recreation Commission recommended cash -in -lieu of land for Park Dedication requirements. Mr. 28 Janish reviewed the minimum net land area and stated two lots fell below one acre. He displayed 29 the 2020 Master Plan and the changes the applicant made. Mr. Janish stated there are 3 fewer lots. 30 31 Mr. Janish stated the Planning and Zoning Commission held a public hearing on December 13th 32 and summarized public comments. Mr. Janish explained the Planning and Zoning Commission 33 recommended approval with the condition the applicant provides a second access to the 34 development as part of Phase 3. He provided the Council with City Code instructions to help them 35 make their decision. 36 37 Mayor Bukkila asked if Site Plan Figure 2 on page 57 was the concept plan used to conduct the 38 original traffic study and amended for Phase 3. Public Works Director/City Engineer Berkowitz 39 explained the traffic study looked at the redesign for the updated traffic study. Regular Andover City Council Meeting Minutes — December 20, 2022 Page 5 1 Councilmember Butler asked if the developer could move ahead with the 2020 design or if it 2 depends on action by the Council. Mr. Janish explained the applicant would still have to amend 3 the Conditional Use Permit because that was written in the CUP. 4 5 Mayor Bukkila asked if the connection to 170`h Avenue through the development was removed or 6 proposed for removal. Mr. Janish stated there are questionable soil borings along the proposed 7 road and it may not be able to be built. He stated the applicant would still like to show the 8 connection because there is a possibility the road can be constructed. Mr. Janish noted that staff 9 requested the cul-de-sac to be built at permanent standards because the road may not be financially 10 feasible. 11 12 Mayor Bukkila asked for the length of the cul-de-sac from Inca Street. Mr. Janish explained the 13 City measures cul-de-sacs from the closest intersection and not from the main connector. Mayor 14 Bukkila asked staff if they knew the road to the roundabout can be built. Mr. Berkowitz stated 15 there is strong belief the road can be built. 16 17 Mayor Bukkila asked why staff are proposing a 35 -mph road. Mr. Berkowitz stated the intent is to 18 construct the road at a 35 -mph status. He explained State Statute requires a 35 -mph road in the 19 rural residential area. He stated if there are cases where the road cannot be designed to a 35 -mph 20 standard, the City will post a curve sign with a 30 -mph limit. 21 22 Councilmember Holthus asked if the County has done research to verify the roundabout can be 23 built at the western location. Anoka County Traffic Engineer Joe MacPherson came forward and 24 stated the County has not dug into the design but knowing the road in the area, they are confident 25 it can be built. 26 27 Mayor Bukkila asked if the western roundabout received funding. Mr. MacPherson stated the 28 roundabout on 7 1 and 165`h Avenues received the funding. 29 30 Mayor Bukkila noted the long cul-de-sac in Phase 1 and stated it was difficult land to develop due 31 to topography and required concessions. She stated the trail connecting Phases 1 and 2 was 32 supposed to be a road but wasn't feasible because of the soil. City Administrator Dickinson added 33 environmental impact was another reason. 34 35 Mayor Bukkila explained the PUD is in place to work with the wetland and topography and allow 36 development, as well as allowing the Council to weigh in. Mayor Bukkila stated she is cautious 37 because she does not want to see a repeat of Phase 1. She is concerned the roads won't be able to 38 be constructed and the City will be stuck with a poor design. Mayor Bukkila is not in favor of Regular Andover City Council Meeting Minutes — December 20, 2022 Page 6 1 temporary emergency access points. She stated a right -in, right -out would need a center median 2 on Vh Avenue and creates a burden on snowplows and a change for drivers. She sees the access as 3 a problem. Mayor Bukkila doesn't believe the design is ready. 4 5 Councilmember Butler stated he likes the roundabout at location B and sees location C as a backup 6 to location B. He noted location C is not ideal, however, provides certainty that a second access 7 can be constructed. He would like to see a timeline on the construction of the road at location B 8 before location C is chosen. 9 10 Councilmember Nelson understands the concern for public safety and spoke with residents in 11 existing phases. He stated Phase 3 is not ideal and believes the access to 170`h Avenue should be 12 constructed with Phase 3. Councilmember Nelson stated there will be bottlenecking and increased 13 traffic. 14 15 Councilmember Barthel stated there are 79 houses going into one choke point on a corner of a 16 busy County intersection. He believes the roundabout should be constructed first. He assumes 17 most of the homeowners will take a left on 7th Avenue and they wouldn't go all the way to 170`h 18 Avenue to take that left. Councilmember Barthel noticed the lot sizes are getting smaller with 19 Phase 3 and he suggested the developer look at increasing lot sizes. Mayor Bukkila stated she has 20 concerns about density as well. She stated Phase 3 holds the bulk of the density. 21 22 Jason Osberg, JD Andover Holdings, 15356 Yukon Street, came forward and congratulated 23 Councilmember Holthus for her service and contributing to the great Andover community. He 24 stated the project is successful and is a work in progress. Mr. Osberg stated as they move forward 25 in each phase, they dive in deeper. He stated they don't want to eliminate the connection to 170`h 26 Avenue. He stated the soils are poor in the northwest section and they are looking at creating 27 larger lots. Mr. Osberg noted the project has the support of City Engineers, Planning, and Anoka 28 County Highway Department. He explained traffic safety is a concern, but they have worked with 29 the City and the Petersen family. He supports the roundabout on the west edge of the development. 30 Mr. Osberg stated the Petersen family has not sold the land for the final phase and they cannot 31 connect to 170`h Avenue since the Petersen family still owns the land. He indicated they would 32 prefer to connect to the roundabout in Phase 3, however, the County determines the timing of 33 constructing the roundabout. 34 35 Mayor Bukkila asked Mr. Osberg to address the concerns of the Council regarding the feasibility 36 of future connections. Darren Lazan, JD Andover Holdings, came forward and addressed the 37 density issue stating the density is the numerator (number of lots) and denominator (total acreage). 38 He explained they did soil borings in future connection areas to determine if they are suitable for Regular Andover City Council Meeting Minutes —December 20, 2022 Page 7 1 roads. 2 3 Mr. Lazan stated they have spent three years analyzing traffic in the area and have high quality 4 professionals working on connections and roads. He stated the team has worked on multiple 5 options for connecting to 7th Avenue. Mr. Lazan explained the updated traffic study includes the 6 new homes. He noted the fatalities were not at the intersection, but on the throughfare. He 7 explained the traffic study looked at peak traffic hours at the intersection of 165th Avenue and Inca 8 Street and the intersection of 165th and 7th Avenues. Mr. Lazan stated the level of service prior to 9 development was an A and the level of service after the development is A. He noted the wait time 10 at Inca Street and 165h Avenue was 1.5 seconds and the left turn from 165th Avenue onto 7th 11 Avenue is 30 seconds. Mr. Lazan compared his development to two similar developments. He 12 stated their development has the same impact as the other two developments. Mr. Lazan noted that 13 they have worked intensely with the City and the County to come up with a plan that is feasible. 14 He stated the best option is a connection at the western roundabout and they will provide escrows 15 and easements to support it. He explained Phase 3 has not been rushed, they have worked on it for 16 the past two years. 17 18 Councilmember Nelson stated he is thinking about future phases and stated it would be ideal with 19 two access points and one emergency access point. He asked if they could connect northward to 20 1701h Avenue. Mr. Lazan stated it is not an option today, however, they can go back to the Petersen 21 family and see if they are interested in making it happen. He noted that pushing residents to 170' 22 Avenue would cause them to go through two dangerous curves. He stated the development helped 23 the County get funding for the roundabout at 71h and 165th Avenues. 24 25 Mayor Bukkila polled the Council on their opinion of supporting the amendment. Councilmember 26 Barthel and Councilmember Nelson are not in support of it. Councilmember Holthus and 27 Councilmember Butler support it if location C is constructed. Councilmember Butler stated the 28 decision on connections needs to be data drive. He stated location B would be the ultimate 29 connection. Councilmember Butler recommended taking time to look at it during a workshop. 30 Mayor Bukkila stated she is not in favor of the current phase. 31 32 Mayor Bukkila asked staff if it is appropriate to table the item versus having an up or down vote. 33 Mr. Lazan stated they are willing to extend the time period in order to talk to the Petersen family 34 and come up with an alternate plan. Mr. Janish stated the City has until February 4, 2023 and the 35 applicant would have to provide an extension in writing. Mr. Dickinson stated tabling the item 36 requires a time certain. 37 38 Mr. Osberg asked if the item would go back to the City Council or the Planning and Zoning Regular Andover City Council Meeting Minutes — December 20, 2022 Page 8 1 Commission. Mr. Dickinson stated it goes to the City Council. 2 3 City Attorney Baumgartner recommended the Council table the item until the January 17, 2023 4 meeting and if the request for extension is received, the Council acts upon the extension. He stated 5 if the request for extension is not received, the Council must take action. 6 7 Motion: by Butler, Seconded by Nelson, to table the Item to January 17, 2023 with the 8 understanding the applicant may further extend it. 9 10 Councilmember Barthel stated he won't support Phase 3 until the roundabout is constructed. 11 12 Motion carries 4 ayes, 1 nay (Barthel). 13 14 CONSIDER TOBACCO ORDINANCE AMENDMENTS AND ADMINISTRATIVE 15 HEARING ORDINANCE 16 17 The City Council is requested to consider amendments to the Tobacco Ordinance and adopting an 18 Administrative Hearing Ordinance. City Administrator Dickinson explained the only thing that 19 has changed since the Council last discussed the item is the format. 20 21 Motion by Butler, Seconded by Nelson, to adopt Ordinance No. 545 ordaining City Code Title 3: 22 Sale of Tobacco Related Products, adding Title 3, Chapter 10, Administrative Hearings in the City 23 of Andover, and Summary Ordinance for Publication. Motion carries unanimously. 24 25 ADMINISTRATOR'S REPORT 26 27 City Staff updated the Council on the administration and city department activities, legislative 28 updates, updates on development/CIP projects, and meeting reminders/community events. 29 30 (CouncilmemberHolthus) Mayor Bukkila provided Councilmember Holthus's service in the City 31 of Andover. She stated Councilmember Holthus has touched almost every Commission and aspect 32 of the City throughout her service. Councilmember Holthus spoke about her experience serving 33 Andover. Mayor Bukkila thanked Councilmember Holthus and stated it has been a pleasure 34 working with her. Councilmember Butler stated Councilmember Holthus influenced him to 35 participate in the City of Andover. He commended her for bettering the community. 36 Councilmember Butler indicated the Council will represent the northern part of the City that 37 attends St. Francis School District. 38 39 Mayor Bukkila stated the City is 48 years old and Councilmember Holthus has been a part of it Regular Andover City Council Meeting Minutes —December 20, 2022 Page 9 1 for 23 years. Mayor Bukkila presented Councilmember Holthus with recognition for her 2 exemplary service and a plaque. 3 4 Councilmember Holthus encouraged Councilmembers to get to know the City by exploring it, 5 visiting the parks and using the trails. She stated that is the way to find out what the City has and 6 what the City needs. Councilmember Holthus stated Andover has really beautiful places. 7 8 City Administrator Dickinson stated he started working for the City around the same time 9 Councilmember Holthus was on a Commission. He spoke on their similarities and stated they had 10 fun. Mr. Dickinson thanked her for her efforts. Public Works Director/City Engineer Berkowitz 11 noted that he has seen Councilmember Holthus at least once a month for the past 24 years and 12 stated she will be missed. City Planner Janish stated it has been great working with her and 13 encouraged her to stop by. 14 15 Mayor Bukkila stated Councilmember Holthus will be appointed to serve on the Lower Rum River 16 Watershed Management Organization in 2023. 17 18 Mayor Bukkila departed the meeting at 9:08 p.m. Mayor Pro Tem Barthel took the gavel. 19 20 (Administration) Mr. Berkowitz stated staff have been working to get the outdoor rinks open. 21 Hawkridge is open, but the weather will cause it to close. He commended the snowplow operators 22 who spent a lot of time working and plowing. Mr. Dickinson stated staff are working on year-end 23 operations. The City ended the year at 101 new single-family homes. Mr. Dickinson updated the 24 Council on construction projects in the City. He stated the Community Center is busy with kids 25 being out of school and events. Mr. Dickinson thanked the Council for a good year and wished 26 residents a wonderful holiday season. 27 28 MAYORICOUNCIL INPUT 29 30 (Holiday Wishes) Councilmember Nelson attended the Anoka Area Chamber of Commerce Toys 31 for Joy held at Pizza Ranch and wished the community a Merry Christmas. By enacting 2022 Session Law Chapter 98, Article 13, the Minnesota Legislature amended Minn. Stat. § 151.72 to allow for the sale of certain cannabinoid products. B. This new law does not prohibit municipalities from licensing the sale of cannabinoid products derived from hemp locally. C. The Minnesota Legislature recognized the danger of cannabis use among youth by prohibiting the sale of any product containing cannabinoid or tetrahydrocannabinol (THC) extracted or otherwise derived from hemp to those under the age of 21 and requiring that edible cannabinoid products be packaged without appeal to children and in child -resistant packaging or containers. D. Due to the passage of this new law by the Minnesota Legislature, the City Council believes the following rules, regulations, and standards for licensing the sale of cannabinoid products, and possession of cannabinoid products by minors, are necessary to promote and protect the public health, safety, and general welfare of the residents of Andover. The purpose of this ordinance is to establish licensing, sale and possession regulations for the sale and possession of cannabinoid products derived from hemp as provided in Minn. Stat. § 151.72. 3-9-2: DEFINITIONS: The following words and terms, when used in this chapter, shall have the following meanings unless the context clearly indicates otherwise: N W7 ►::►0� PRODUCT: Any product containing nonintoxicating cannabinoids extracted from hemp, including an edible cannabinoid product, that is sold for human or animal consumption. CERTIFIED HEMP: The definition for the same provided in Minn. Stat. § 151.72, Subd. 1(b), as may be amended. CITY: The City of Andover, Minnesota. COMPLIANCE CHECK: The system the City uses to investigate and ensure that those authorized to sell cannabinoid products are following and complying with the requirements of this ordinance and state laws. Compliance checks involve the use of compliance check minors, as authorized by this Chapter, who purchase or attempt to purchase cannabinoid products. Compliance checks may also be conducted by the City or other units of government for educational, research, and training purposes or for investigating or enforcing federal, state, or local laws and regulations relating to cannabinoid products. COMPLIANCE CHECK MINORS: Any person at least 17 years of age, but under the age of 21 years. DELIVERY SALE: The sale of any cannabinoid products to any person for personal consumption and not for resale when the sale is conducted by any means other than an in-person, over-the-counter sales transaction in a licensed Retail Establishment. Delivery sale includes, but is not limited to, the sale of any cannabinoid products when the sale is conducted by telephone, other voice transmission, mail, the internet, or app -based service. Delivery sale includes delivery by licensees or third parties by any means, including curbside pick-up. EDIBLE CANNABINOID PRODUCT: Any product that is intended to be eaten or consumed as a beverage by humans, contains a cannabinoid in connection with food ingredients, and is not a drug. HEMP OR INDUSTRIAL HEMP: The definition for the same provided in Minn. Stat. § 18K.02, Subd. 3, as may be amended. LABEL: The definition for the same provided in Minn. Stat. § 151.01, Subd. 18, as may be amended. LABELING: The definition for the same provided in Minn. Stat. § 151.72, Subd. 1(f), as may be amended. LICENSE: A retail license issued by the City of Andover, authorizing the holder to sell cannabinoid products. MATRIX BARCODE: The definition for the same provided in Minn. Stat. § 151.72, Subd. 1(g), as may be amended. MINOR: Any person under the age of 21 years. MOVEABLE PLACE OF BUSINESS: Any form of business that is operated out of a kiosk, truck, van, automobile or other type of vehicle or transportable shelter and that is not a fixed address or other permanent type of structure licensed for over- the-counter sales transactions. NON -INTOXICATING CANNABINOID: Substances extracted from certified hemp plants that do not produce intoxicating effects when consumed by any route of administration. OPERATOR: The person in legal possession and control of a location by reason of ownership, lease, contract or agreement, for the sale of cannabinoid products at retail. RETAIL ESTABLISHMENT: Any fixed place of business where cannabinoid products may be available for sale to the general public after obtaining a license from the City. For the purposes of this Chapter. Retail Establishments shall be limited to those establishments only open to customers 21 years of age and older. Retail Establishment for purposes of this ordinance does not include exclusive liquor stores or residences. SALE: Any transfer of goods for money, trade, barter, or other consideration. SELF-SERVICE DISPLAYS: Open displays of cannabinoid products in any manner where any person shall have access to the cannabinoid products without the assistance or intervention of the licensee or the licensee's employee. VENDING MACHINE: Any mechanical, electrical, or electronic or other type of device which dispenses cannabinoid products upon the insertion of money, tokens, or other form of payment directly into the machine by the person seeking to purchase cannabinoid products. 3-9-3: RETAIL LICENSE: A. No person shall directly or indirectly keep for retail sale or sell at retail any cannabinoid product in the City unless a license therefore shall first have been obtained. B. Only Retail Establishments, as identified in this Chapter, shall be eligible to receive a license. C. An application for a license to sell cannabinoid products shall be made on a form provided by the City. The application shall contain the full name of the applicant, the applicant's residential and business addresses and telephone numbers, the name of the business for which the license is sought, the location of the building and the part intended to be used by the applicant under such license, the kind or nature of business, and any additional information the City deems necessary. Upon the filing of such application with the City Clerk, and investigation as the City deems necessary, it shall be presented to the City Council for consideration, and if granted by the City Council, a license shall be issued by the City Clerk upon payment of the required fee. D. The fees for licenses under this Chapter shall be determined by the City Council. Each such license shall expire on December 31 of each year. Licenses shall not be transferable from one person or entity to another, nor shall they be transferable from one premises to another premises. E. Every license issued under this Chapter shall be kept conspicuously posted about the place for which the license is issued and shall be exhibited to any person upon request. F. The renewal of a license issued under this Chapter shall be made in the same manner as the original application. The request for a renewal shall be made at least 30 days but no more than 60 days before the expiration of the current license. G. No license will be approved unless the premises proposed to be licensed complies with all applicable zoning requirements. H. If a license is mistakenly issued or renewed to a person, the City will revoke the license upon the discovery that the person was ineligible for the license under this ordinance. The City will provide the license holder with notice of the revocation, along with information on the right to appeal. The following shall be grounds for denying the issuance or renewal of a license under this Chapter: (1) The applicant is under the age of 21 years; (2) The applicant has been convicted within the past five years of any violation of a federal, state, or local law, ordinance provision, or other regulation relating to cannabinoid products; (3) The applicant has had a license to sell cannabinoid products suspended or revoked within the preceding 24 months of the date of application; (4) The applicant fails to provide any information required on the application, or provides false or misleading information; (5) The applicant is prohibited by federal, state, or other local law, ordinance, or regulation from holding such a license; (6) The business for which the license is requested is a moveable place of business. Only fixed -location Retail Establishments that are not excluded under the definition for Retail Establishments in this ordinance are eligible to be licensed. (7) The applicant has failed to pay any required application or licensing fees to the City. J. There shall be no more than three (3) licenses issued in any one (1) year. Retail Establishments renewing a current license shall have priority over new Retail Establishments requesting a new license provided: (1) The renewing Retail Establishment complies with the requirements for renewal under this Chapter; and (2) There have been no violations under this Chapter by the renewing Retail Establishment. K. Location and Proximity restrictions. No license shall be issued to any Retail Establishment located within a residential zone district. Additionally, no license shall be issued if the proposed location is within one thousand (1,000) feet of one or more of the following locations: (1) Any school, church with a daycare or childcare establishment located within a commercial zone, with the distance computed by direct measurement in a straight line from the nearest legal parcel line of the land used for the school, church or childcare establishment to the nearest external portion of the building in which the licensed Retail Establishment is proposed to be located. In the event that the City receives two (2) or more applications for a license with proposed locations within one thousand (1,000) feet of each other, the City shall act upon only the first complete application received and shall not issue a license to subsequent applications proposing to be located within one thousand (1,000) feet. (3) Any alcohol or drug treatment facility, with the distance computed by direct measurement in a straight line from the nearest external portion of the building in which the alcohol or drug treatment facility is located to the nearest external portion of the building where the Retail Establishment is proposed to be located. 3-9-4: RESPONSIBILITY OF LICENSEE: All licensees under this Chapter shall be responsible for the actions of their employees in regard to the sale of cannabinoid products on the licensed premises, and the sale of such item by an employee shall be considered a sale by the license holder. All licensees shall comply with the provisions of this Chapter and all state and federal laws and regulations. 3-9-5: SALES OF CANNABINOIDS DERIVED FROM HEMP: In accordance with Minn. Stat. § 151.72, Subd.3, as may be amended: A. A product containing nonintoxicating cannabinoids, including an edible cannabinoid product, may be sold for human or animal consumption only if all of the requirements of this section are met, provided that a product sold for human or animal consumption does not contain more than 0.3 percent of any tetrahydrocannabinol and an edible cannabinoid product does not contain more than five milligrams of any tetrahydrocannabinol in a single serving, or more than a total of 50 milligrams of any tetrahydrocannabinol per package. B. No other substance extracted or otherwise derived from hemp may be sold for human consumption if the substance is intended: (1) For external or internal use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans or animals; or (2) To affect the structure or any function of the bodies of humans or other animals. C. No product containing any cannabinoid or tetrahydrocannabinol extracted or otherwise derived from hemp may be sold to any individual who is under the age of 21. D. Products that meet the requirements of this section are not controlled substances under Minn. Stat.§ 152.02. 3-9-6: TESTING REQUIREMENTS: All testing must comply with the requirements set forth in Minn. Stat. § 151.72, Subd. 4, as may be amended. 3-9-7: LABELING REQUIREMENTS: All labeling must comply with the requirements set forth in Minn. Stat. § 151.72, Subd. 5, as may be amended. 3-9-8: ADDITIONAL REQUIREMENTS FOR EDIBLE CANNABINOID PRODUCTS: In accordance with Minn. Stat. § 151.72, Subd. 5a, as may be amended: A. An edible cannabinoid product must not: (1) Bear the likeness or contain cartoon -like characteristics of a real or fictional person, animal, or fruit that appeals to children; (2) Be modeled after a brand of products primarily consumed by or marketed to children; (3) Be made by applying an extracted or concentrated hemp - derived cannabinoid to a commercially available candy or snack food item; (4) Contain an ingredient, other than a hemp -derived cannabinoid, that is not approved by the United States Food and Drug Administration for use in food; (5) Be packaged in a way that resembles the trademarked, characteristic, or product -specialized packaging of any commercially available food product; or (6) Be packaged in a container that includes a statement, artwork, or design that could reasonably mislead any person to believe that the package contains anything other than an edible cannabinoid product. B. An edible cannabinoid product must be prepackaged in packaging or a container that is child -resistant, tamper -evident, and opaque or placed in packaging or a container that is child -resistant, tamper - evident, and opaque at the final point of sale to a customer. The requirement that packaging be child -resistant does not apply to an edible cannabinoid product that is intended to be consumed as a beverage and which contains no more than a trace amount of any tetrahydrocannabinol. C. If an edible cannabinoid product is intended for more than a single use or contains multiple servings, each serving must be indicated by scoring, wrapping, or other indicators designating the individual serving size. D. A label containing at least the following information must be affixed to the packaging or container of all edible cannabinoid products sold to consumers: (1) The serving size; (2) The cannabinoid profile per serving and in total; (3) A list of ingredients, including identification of any major food allergens declared by name; and (4) The following statement: "Keep this product out of reach of children." E. An edible cannabinoid product must not contain more than five milligrams of any tetrahydrocannabinol in a single serving, or more than a total of 50 milligrams of any tetrahydrocannabinol per package. 3-9-9: PROHIBITED SALES: A. Samples Prohibited. Sampling of cannabinoid products within any Retail Establishment licensed under this ordinance is prohibited. No person shall distribute samples of any cannabinoid products free of charge or at a nominal cost. The distribution of cannabinoid products as a free donation is prohibited. B. Coupon and Price Promotion. No person shall accept or redeem any coupon, price promotion, or other instrument or mechanism, whether in paper, digital, electronic, mobile, or any other form, that provides any cannabinoid products to a consumer at no cost or at a price that is less than the non -discounted, standard price listed by a retailer on the item or on any related shelving, posting, advertising, or display at the location where the item is sold or offered for sale, including all applicable taxes. C. Prohibition Against Retail Sales of Cannabinoid Products by Vending Machines. No person will sell or dispense cannabinoid products through use of a vending machine. D. Delivery Sales. All sales of cannabinoid products must be conducted in person, in a licensed Retail Establishment under this ordinance, in over-the-counter sales transactions. 3-9-10: ADULTERATED OR MISBRANDED PRODUCTS: A cannabinoid product shall be considered adulterated or misbranded under the provisions set forth in Minn. Stat. §151.72, Subd. 6, as may be amended. 3-9-11: SIGNAGE: At each location where cannabinoid products are sold, the licensee shall display a sign in plain view to provide public notice that selling any of these products to any person under the age of 21 is illegal and subject to penalties. The notice shall be placed in a conspicuous location in the licensed establishment and shall be readily visible to any person who is purchasing or attempting to purchase these products. The sign shall provide notice that all persons responsible for selling these products must verify, by means of photographic identification containing the bearer's date of birth, the age of any person under 30 years of age. 3-9-12: AGE VERIFICATION: At each location where edible cannabinoid products are sold, the licensee shall verify, by means of government -issued photographic identification containing the bearer's date of birth, that the purchaser or person attempting to make the purchase is at least 21 years of age. Verification is not required if the purchaser or person attempting to make the purchase is 30 years of age or older. It shall not constitute a defense to a violation of this Section that the person appeared to be 30 years of age or older. 3-9-13: HOURS OF SALES: No sales of cannabinoid products will be allowed at the licensed premises after 10:00 p.m. and before 8:00 a.m. daily. 3-9-14: COMPLIANCE CHECKS AND INSPECTIONS: All licensed premises shall be open to inspection by the City police or other authorized City official during regular business hours. From time to time, but at least once per year, the City shall conduct compliance checks by engaging, with the written consent of their parents or guardians, compliance check minors to enter the licensed premise to attempt to purchase cannabinoid products. Compliance check minors used for the purpose of compliance checks shall he supervised by City law enforcement officers. Compliance check minors used for compliance checks shall not be guilty of unlawful possession of cannabinoid products when such items are obtained as a part of the compliance check. No compliance check minor used in compliance checks shall attempt to use a false identification misrepresenting the minor's age, and all compliance check minors lawfully engaged in a compliance check shall answer all questions about the minor's age asked by the licensee or his/her employee and shall produce any identification, if any exists, for which he/she is asked. Nothing in this section shall prohibit compliance checks authorized by state or federal laws for educational, research, or training purposes, or required for the enforcement of a particular state or federal law or regulation. 3-9-15: UNDERAGE PERSONS: A. Illegal sales. It shall be a violation of this Chapter for any person to sell or otherwise provide any cannabinoid products to any minor. B. Illegal possession. It shall be a violation of this Chapter for any minor to have in his/her possession any cannabinoid product. This subdivision shall not apply to compliance check minors lawfully involved in a compliance check. C. Illegal procurement. It shall be a violation of this Chapter for any minor to purchase or attempt to purchase or otherwise obtain any cannabinoid product, and it shall be a violation of this ordinance for any person to purchase or otherwise obtain such items on behalf of a minor. It shall further be a violation for any person to coerce or attempt to coerce a minor to illegally purchase or otherwise obtain or use any cannabinoid product. This subdivision shall not apply to compliance check minors lawfully involved in a compliance check. D. Use of false identification. It shall be a violation of this Chapter for any minor to attempt to disguise his/her true age by the use of a false form of identification, whether the identification is that of another person or one on which the age of the person has been modified or tampered with to represent an age older than the actual age of the person. 3-9-16: PENALTIES; REVOCATION OR SUSPENSION OF LICENSE: A violation of any provision of this Chapter shall constitute a misdemeanor, unless otherwise specified by other federal or state laws or regulations. DISCUSSION Identified in the City's 2023-2027 Capital Improvement Plan is a full depth reclamation project for streets in the east -central portion of the City as identified on the attached location map, Exhibit 1. The pavement of the streets in this area have deteriorated to the point that a full depth reclamation is the best course of action to correct this deterioration. The project would include reclaiming the existing bituminous roadway, limited concrete curb and gutter replacements, storm sewer structure repairs, paving a new bituminous surface, and replacing pedestrian curb ramps not meeting ADA standards. The water main in the project area was constructed during a timeframe where bolts on gate valves have rusted away, so those would be exposed and replaced during construction. This project is expected to extend the life of the roadway another 25+ years before a reconstruction would be considered. Within the project limits the feasibility report identifies 535 existing or potential residential units which includes 1 City Park. There are two existing parcels that are potentially subdividable within the project limits. The two parcels are in the southeast quadrant of Hanson Boulevard and Bluebird Street. One parcel has frontage along Bluebird Street, which is proposed to be assessed for 1 existing unit and an additional 6 potential units for a total of 7 units. The other property has frontage along 150`h Lane, which is proposed to be assessed for 1 existing unit and an additional 2 potential units for a total of 3 units. Refer to the attached location map, Exhibit 1 for a schematic of the potentially subdividable parcels. The estimated assessment rate for each unit is $1,540.00 There is a article in the January/February Andover Newsletter regarding the project and properties owners were notified of the project details by a letter dated December 27, 2023, in lieu of scheduling a neighborhood informational meeting. The Public Hearing for the project will be held on January 17, 2023 and notices for the hearing will be sent out once that date has been approved by the City Council. BUDGETIMPACT The project would be funded from the City's Road & Bridge Fund with twenty-five percent (25%) of the total project costs for the roadway improvements to be assessed to the benefiting properties as identified in the City's Roadway Reconstruction Assessment Policy. Full depth reclamation differs slightly from full reconstruction in the fact that only limited curb and gutter and utility repairs are completed, versus large scale curb and gutter or utility replacement. The process used for the full depth reclamation projects as far as the bituminous roadways are concerned is very similar to what is done during a total reconstruction project. The intent of this project is to provide the community with a high-quality transportation system and maintain the integrity of the City's street infrastructure. Rehabilitation of the streets reduces short term routine maintenance costs (crack sealing, pothole patching, etc.). Long term, this reconstruction prolongs the structural stability of the City's roadways, providing for a longer serviceable life. City staff evaluates each segment of roadway within the City every two to three years to help determine which roadways and developments are in the most need of rehabilitation. A pavement management program utilizing these inspection records is maintained by the Engineering Department. This program provides an analytical tool which, along with additional site inspections, review of maintenance records, and input from Public Works staff, allows us to determine the best schedule for improvements to maximize the program benefits and reduce the amount of annual maintenance needed by our Public Works crews. The segments identified for the improvements are then included in the Capital Improvement Plan which is approved by the City Council. A large portion of the east -central portion of the City has been identified in the City's current 5 - Year Capital Improvement Plan for full depth reclamation during the summer of 2023. The project is generally bounded by Crosstown Boulevard on the north, Hanson Boulevard on the west, Coon Creek on the south, and Xeon Street on the east. The Oak Bluff development, which is located in the central portion of these project boundaries, is included in the City's 2023 Street Reconstruction program. The rehabilitation of the streets and any associated work will be funded through special assessments to the benefiting properties in accordance with the City's Roadway Reconstruction Assessment Policy and through the Road and Bridge Fund. Repairs to water main gate valves in the project limits would be funded through the Trunk Water Fund. A Project Location Map is attached in the Appendix as Exhibit 1. 2.0 EXISTING CONDITIONS The streets within the project limits were originally paved between 1988 and 1995, with the newer streets generally in the southern half of the project limits. The existing street widths are 33' back to back with concrete curb and gutter. The existing pavement section is 2" - 2.5" of bituminous over 4" of Class 5 aggregate base. The average Paser Rating (pavement management rating) for this project on a scale of 1-10 (10 being the best) is 3.4. Stormwater runoff in the neighborhoods is managed via overland flow channelized along the curb and gutter and storm sewer. All stormwater runoff from the within the project limits discharges to existing stormwater treatment basins within or downstream of the neighborhoods and is ultimately tributary to Coon Creek. All parcels within the project limits are served with City sewer and water. This project is located within the Coon Creek Watershed District. 3.0 Roadway Improvements The streets within the project limits will be reclaimed, utilizing the recycled material for aggregate base. The roadway surface elevation will generally match the existing roadway surface to match into the existing concrete curb and gutter. 4" — 5" of reclaimed aggregate base material will remain in place and 3" of new bituminous (paved in two lifts) will be constructed, meeting the City's standard pavement section. Excess reclaimed material will be hauled out off- site. There is no street widening or increase in impervious surfacing proposed with this project. Storm Drainage Improvements All stormwater runoff within the project limits either flows directly or indirectly into adjacent stormwater treatment ponds and/or wetlands via overland flow, curb and gutter and storm sewer systems. Storm water runoff from this project is ultimately tributary to Coon Creek. Receiving bodies of stormwater discharge and drainage patterns will not be altered with this project. Storm sewer improvements with the project will be limited to making repairs to existing catch basins and manholes, which includes re -grouting concrete adjusting rings, re -grouting deteriorated dog houses, and filling in shallow sumps with concrete in existing structures. When these projects were constructed it was standard practice to install shallow (1' — 2') sumps in drainage structures. This has proven to cause maintenance issues due to freeze / thaw cycles in these sumps resulting in deterioration of grout around the pipe dog houses. Sumps will be left in place in the last structure upstream of discharge into stormwater treatment basins to provide some sedimentation cleaning. Water Main Improvements The City has experienced leaks in water main systems installed during the general timeframe of the developments within this project. Most of those issues has been traced back to the deterioration of the bolts on the bonnet, or top, of water valves. Those gate valves will be exposed, and existing bolts replaced with stainless steel bolts. This will reduce the potential of future water main leaks or breaks due to this condition and the need for more costly emergency repairs and water main shutdowns. Sanitary Sewer Improvements All areas within the project limits are served with sanitary sewer. Public Works crews have inspected the sanitary sewer within the project limits and it is generally in satisfactory condition. Repairs will be limited to replacing concrete adjusting rings beneath the manhole castings. 2 4.0 RIGHT -OF WAY / EASEMENT All work will take place within the existing right of way and drainage and utility easements. 5.0 PERMITS The City of Andover Engineering Department will obtain any necessary permits for the project. Permits required for the project include: - Coon Creek Watershed District for grading, erosion control and storm water drainage - MPCA NPDES Construction Storm Permit 6.0 ESTIMATED PROJECT COSTS The construction cost estimate is $3,395,700. The total estimated project costs are $3,853,700. This estimated cost includes construction costs, contingencies (10%), and indirect costs. These costs are estimated based upon preliminary design. The final cost will be based upon final design, actual work completed by the contractor, and unit bid prices for the project. In accordance with the City's Assessment Manual, twenty-five percent (25%) of the total street related project costs would be assessed to the benefiting properties or specifically those properties fronting along or addressed along the roadway being improved. The remaining seventy-five percent (75%) of the street related costs will be funded through the City's Road and Bridge Fund. They are: area, unit, front footage (short side) and variable costs. For this project, the per unit method will be used to assess each property for their individual benefit as the lots within the project limits are relatively equal in size. To calculate the rate per unit, twenty-five percent (25%) of the total project costs associated with the street improvements would be divided by the number of parcels within the project which front or access the proposed improvements. Also included would be potential lots, or larger parcels that front the improvements that have the potential to subdivide. There are two existing parcels that are potentially subdividable within the project limits. The two parcels are in the southeast quadrant of Hanson Boulevard and Bluebird Street. The proposal is to seek funding for connections to water main in the following area: properties along 1401 Lane NW and a portion of Raven St NW. These properties are adjacent to water main, but they remain unconnected. The area is located near the Red Oaks neighborhood. Connecting to city water requires paying for: city water connection charges, city water lateral charges, and often for water area charges, in addition to any private fees to have a plumber connect the home. In addition, property owners connecting to city water would also need to have their well permanently sealed. These can be financial burden for property owners that may otherwise want to connect, which may make it difficult for property owners to take that step. - Expenses connecting to city water $16,000-20,000 - Well Sealing $500 - $1,500 (or more) $16,500 - $21,500 (estimate) The current proposal looks at a number of areas in the city which are within the Metropolitan Urban Service Area (MUSA) but where they either do not have city water main or do not have connections to the city water main. The application request will be for $100,000. DISCUSSION To pay some vendor claims, the City may use electronic funds transfers instead of paper checks. Electronic funds transfers may also be used to purchase and sell investments. While these transactions are convenient, they present unique opportunities for fraud. As a result, state law requires local governments to adopt certain policies and procedures before electronic funds transfers are made as noted in Minnesota State Statutes 471.38. The law specifically states these requirements: • On an annual basis, the governing body must delegate to a designated business administrator the authority to make electronic funds transfers; • The disbursing bank must keep on file a certified copy of the delegation of authority; • The person initiating the electronic funds transfer must be identified • The person initiating the electronic funds transfer must document the request and obtain approval for the designated business administrator before initiating the transfer; • Written confirmation of the transaction must be made within one business day after the transaction; and • A list with all the transactions made by electronic funds transfers must be submitted to the governing body at its next regular meeting.
