Comm. #1-84-2 Anoka Independent Grain & Feed Rezoning Public Hearing Joe & Isabell Misslin Rezoning Public Hearing Ordinance 8 Update ~ 0& ANDOVER REGULAR PLANNING AND ZONING COMMISSION MEETING JANUARY 24, 1984 MINUTES The regularly scheduled Andover Planning and Zoning Commission meeting was called to order by Chairman Don Spotts at 7:35 P.M., Tuesday, January 24, 1984 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota~ Commissioners Present: Apel, Bosell, Perry, Rogers Commissioners Absent; Knutson Also Present: David Peterson; others Approval of Minutes January 10, 1984 MOTION by Rogers, seconded by Perry to approve the minutes of January 10, 1984 as written. Motion carried unanimously. December 13, 1983 MOTION by Perry, seconded by Rogers to approve the minutes of December 13, 1983 as written. Motion carried on a 4 yes, 1 present (Apel) vote. Anoka Independent Grain and Feed Rezoning Public Hearing (Comm. #1-84-4) Chairman Spotts opened the public hearing. David Peterson, 1814 Cressy Avenue, Anoka - noted that they are requesting to rezone 440 acres from residential to agricultural preserve. Chairman~Spotts asked when the:;eligibility was granted for this property. Mr. Peterson noted that it was approximately two years ago. Commissioner Bosell asked if there are three houses on the same 40. Mr. Peterson noted that two of the houses are on the same 40 acre parcel. Commissioner Bosell noted that according to the Agricultural Preserve Ordinance, a Special Use Permit is required for a feed lot or poultry facility. She stated that this should have been applied for two years ago. The Planning Commission can deal with the Special Use Permit along with the rezoning and the City Council can determine whether they should pay the Special Use Permit fee. MOTION by Apel, seconded by Bosell to close the public hearing. Motion carried. MOTION by Bosell, seconded by Apel that the Andover Planning and Zoning Commission recommend to the City Council approval of a rezoning request by Anoka Independent Grain and Feed to rezone the property described as Plat 65907, Parcels 4200,3600, 1800, 10, 5400, 4800, 6600, 7800, 7200 and 8400 from Residential to Agricultural Preserve noting the following: 1) There was a public hearing. No opposition was voiced; 2) The criteria of Ordinance 57 and 57A are met, more particularly the density, the lot size, and the setbacks; 3) The rezoning compliments the guidelines set out in the Comprehensive Planning Commission Meeting January 24, 1984 - Minutes Page 2 Plan and poses no threat to the health, safety or general welfare to the community; 4) Under Ordinance 57, a Special Use Permit is required for a poultry facility. Although there was no public notice it was felt that since this is a public hearing, no further notice would be required. Denial of the Special Use Permit would serve no purpose. The criteria for a special use permit as set out in Ordinance 57, Section 4 E(l) is met; therefore, it is recommended that this Special Use Permit be granted along with the rezoning request. Motion carried unanimously. This will go to the City Council on February 7, 1984. Joe & Isabell Misslin Rezoning Public Hearing (Comm. #1-84-2) Inasmuch as no one appeared for this item, it will be tabled until the next regularly scheduled meeting. The secretary was asked to contact Mr. Misslin to find out what the land is being used for, if they have had any complaints and how many dwelling units and other buildings there are on the property. Recess 8:05 - Reconvene 8:25 Ordinance 8 Update The secretary was requested to contact the City Attorney for a definition of Zero Lot Line. Section 4.11 Front Setbacks - will read as follows: 'Where adjoining principal buildings existing at the time of adoption of this Ordinance have a lesser setback from that required, the required front yard of a new structure shall not be less than the average front yard of the buildings on each side lot.' Section 4.13 Zero Lot Line-Side and Rear Setbacks will read: 'In all districts, the side and rear setback requirements may be excluded provided: 1) party walls are used; or 2) setback requirements on adjoining lots are increased to at least twice the required minimum setback. This second approach shall be allowed only as part of a larger planned develop- ment where the zero lot line becomes integral to the overall site plan.' Section 5.03.4, Vacation of Easements, Streets will be deleted.as this is covered in State Statutes. Chairman Spotts will finish the Manufactured Home Park District section for the next meeting. In the R-2 District, the Minimum lot depth for a two-family home will be 130 feet; the rear setback for accessory buildings will be 10 feet; side yard setback (accessory building at interior lot) will be deleted; side yard setback (carport or garage) will be deleted; side yard setback (corner Lot) will be 20 feet. Maximum density will be 4 units per buildable acre. M-l Medium Density Residential District - Minimum lot depth will be 100 feet. M-2 High Density Residential District - Minimum lot depth will be 150 feet. NB Neighborhood Business District - Maximum district size will be 5 acres; Minimum lot depth will be 100 feet; Buffering will read the same as in Limited Industrial; Criteria Planning Commission Meeting January 24, 1984 - Minutes Page 3 for Rezoning will say 'See Administrative Section'. LB Limited Business District - Minimum lot depth will be 100 feet; Buffering will be the same as in the Limited Industrial district; Criteria for Rezoning will say "See Administra- tive Section'. SC Shopping Center District - Minimum lot depth will be 100 feet; Buffering will be the same as in the Limited Industrial section; Criteria for Rezoning will be changed to the following: (I) Criteria for Rezoning. See Administrative Section 5.03.1. (J) Sanitary sewer is required. Public water is required where available. (K) Tho~oughfare Access........ (L) Site and Building Plans...... (M) Market Feasibility Study......... GB General Business District - Minimum lot depth will be 100 feet; Buffering will be taken from Limited Industrial section; Cirteria for Rezoning will say 'See Administrative Section'. LI Limited Industrial District - Minimum lot depth wi 11 be 100 feet; Criteri a for Rezoning will say 'See Administrative Section.' GI General Industrial District - Minimum lot depth will be 100 feet; Criteri a for Rezoning wi 11 say 'See Administrative Section'. MOTION by Perry to adjourn. Motion carried unanimously.
