A regular meeting of the Andover Planning and Zoning Commission was called to order by
Chairman Spotts at 7:35 P.M., Tuesday, May 8, 1984 at the Andover City Hall, 1685 Cross-
town Boulevard N.W., Andover, Minnesota.
Commissioners Present: Bosell; Rogers; Jacobson
Commissioners Absent: Perry; Knutson; Apel
Also Present: City Engineer, James Schrantz; M.R. Olson; James Lund
Approval of Minutes
April 24, 1984
MOTION by Jacobson, seconded by Rogers to approve the minutes of April 24, 1984 as
written. Motion carried on a 3 yes, 1 present (Bosell) vote.
April 17, 1984
MOTION by Bosell, seconded by Spotts to approve the minutes of April lZ, 1984 as written.
Motion carried on a 2 yes, 2 present (Rogers, Jacobson) vote.
M.R. Olson Variance, Cont. (Comm. #4-84-1)
Chairman Spotts indicated that he contacted the City Attorney and that the attorney said
this request does not comply with Ordinance 40, but does comply with Ordinance 10 if the
parcels in question are combined into one parcel and then are split into two parcels.
The attorney stated that because of a hardship to the property, we can grant the variance.
Commissioner Bosell asked what the hardship is. Chairman Spotts noted that it's metes
and bounds.
Commissioner Bosell felt that that is wrong because Ordinance 40 doesn't allow for the
splitting of commercial property. Mr. Olson should be required to plat the property. Also,
there is no variance procedure in Ordinance 40.
M.R. Olson - noted that a typographical error was made when the legal description was typed;
it should be 668 feet rather than 658 feet. He also noted that his attorney spoke at
great length with the City Attorney and they both agreed that a variance is required.
Commissioner Bosell felt that the City Attorney is mistaken. The property should be platted.
If it is platted, Mr. Olson wouldn't have any streets to construct. He simply needs to
come up with a new legal description.
Commissioner Jacobson stated that either way it is done, the parcels need to be combined
into one parcel.
Commissioner Bosell indicated that this property could be platted into more than two lots if
a cul-de-sac was constructed.

Mr. Olson stated that he already checked into platting and he does not want to do that.
He asked if this could be continued to the next meeting at which time he will have his
attorney present as well as the City Attorney.
MOTION by Jacobson, seconded by Rogers to table the M.R.Olson variance request to the
next Planning Commission meeting. Motion carried.
Lund's Evergreen Estates 2nd Addition Preliminary Plat Public Hearing (Comm. #3-84-3)
Chairman Spotts opened the pUblic hearing.
Robert Snyder, 2858 - 167th Lane N.W. - asked if 167th is going to be extended. Commissioner
Bosell noted it will not be as it is outside the plat.
City Engineer Schrantz noted that the City Council asked the developer if he would construct
167th and the developer agreed to do it.
Ken Taylor, 16552 Verdin Street - noted that his property is the exception shown on the plat.
He stated that he spoke with Mr. Lund and Mr. Merila concerning the fact that he is going
to have three blacktop streets around his property. He noted that he would not like to
have a decision made on this item tonight as he is negotiating with Mr. Lund to change the
street system.
Commissioner Jacobson asked what sort of change he is talking about.
Jim Merila, Merila & Associates - noted that the change was stimulated by a discussion with
the County Highway Department and the City Engineer. There is a crest on Verdin Street
which makes it impossible to see on-coming cars. The county's preference is to have the
intersection on the north side of Taylor's property.
City Engineer Schrantz noted that if the street is moved to the north, it should be 166th
Avenue.
Commissioner Bosell noted that there is an easement owned by the State of Minnesota and
if 167th Avenue is constructed, Mr. Lund cannot cross that easement.
Mr. Schrantz stated that they would be able to get somthing from the State to enable them
to cross the easement.
Commissioner Bosell asked if there are going to be restrictive covenants on the property.
Mr. Lund noted that there will be. Commissioner Bosell stated that a copy of those
covenants must be on file at City Hall. She then asked what the density of the plat is.
Mr. Merila noted that it is 3 units per acre. He also noted that ~lr. Lund does not agree
with the Park Board on the park dedication.
Mr. Lund noted that the Park Board really doesn't have a reason for wanting Lot 1, Block
1. They wanted that piece because there are already two other plats in that area.

Mr. Lund noted that he would have preferred that they take Lot 1, Block 7.
Commissioner Bosell noted that the north row of lots doesn't have any dimensions. Lot 6,
Block 3 doesn't have any dimensions and the park property doesn't have any dimensions on
north side. 164th needs to have a temporary turnaround.
City Engineer Schrantz stated that the developer will provide a letter saying that all of
the lots have 39,000 square feet of buildable land.
Commissioner Bosell also noted that the statement of use is missing from the plat.
This item will be continued on May 22, 1984.
MOTION by Rogers to adjourn. Motion carried.
Meeting adjourned at 9:00 P.M.
