Comm. #6-84-6 Discussion/Temporary Migrant Worker Housing ~ 0& AND'OVER PLANNING AND ZONING COMMISSION MEETING - JULY 10, 1984 MINUTES The Regular Meeting of the Planning and Zoning Commission was called to order by Chairman Don Spotts on July 10, 1984, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota. Commissioners present: Bosell, Perry, Rogers, Jacobson Commissioner absent: Apel Also present: ~uilding Inspector, David Almgren APPROVAL OF MINUTES June 12, 1984: Page 2, third line from bottom: should read "was in error". June 26, 1984: Page 6, Dale Howard Variance, statement by City Engineer should read "there was a sewer stub." Page 7, Dick Carson Variance, second line, should read "he can build a house on five acres". Chairman Spotts asked for a motion to accept the Minutes as corrected. MOTION by Jacobson, Seconded by Rogers, to so move. Motion carried unanimously. COMM. #6-84-1 KOTTKE'S BUS SERVICE SPECIAL USE PERMIT PUBLIC HEARING CONTINUED Charles Peterson representing Kottke's Bus Service presented a drawing showing a revised location of the tank. A copy has been sent to the State Fire Marshal , but he has not yet received an answer back. The tank is a used one and it will be tested and coated next week. Rich Larson, City Fire Marshal , suggested the permit be limited to the use for heating oi 1 only. He relYorted the State Fire Marshal was not too concerned with that use. Because it will be placed on high ground, he is not recommending the soil to be tested. Mr. Almgren also had no problem with the tank because it will not be buried that deep, and he didn't feel there would be a problem with ground water causing flotation of the tanks. Further discussion with Mr. Peterson was on the exact location of the tank, the Commission suggesting some specific distances should be noted on the location map. Mr. Peterson stated the location was moved north so there will be no driving or parking over the tank. It was determined the location is a couple feet north of the building and about 40 feet out west of the building. MOTION by Jacobson, Seconded by Rogers, that we recommend to the City Council approval of a special use permit for Kottke's Bus Service, Inc., at 13625 Jay Street NW to place a 10,000 gallon in-ground fuel oil tank to be used for fuel oil only to heat the bus maintenance bUildings. This special use permit is subject to the approval of the installation by the Andover Fire Department, subject to applicable provisions of the State Building Code and the State of Minnesota Fire Marshal's Office. This special use permit is under Ordinance 8, Section 4.26, and we recommend the following provisions be attached: 1) that the tank shall be tested for tightness before installation; 2) that the tank shall be protected from corrOsion before installation; 3) that the tank shall be set on firm foundations as determined by the Andover Fire Department and the Building Inspector; 4) that the tank filling pipe and vent pipe shall be protected from vehicles via steel posts set in appropriate manner to protect the striking or breaking of these pipes by vehicles; Planning and Zoning Commission Meeting July 10, 1984 - Minutes Page 2 (Kottke's Bus Service Special Use Permit, Continued) (Motion by Jacobson, Seconded by Rogers, continued) 5) and that the tank vent shall be higher than the fill pipe and the vent pipe shall be above the normal snow level. Motion carried unanimously. Discussion was this item should normally be placed on the August 7 Council agenda; however, Mr. Peterson indicated a desire to install the tank prior to the starting of School on August 23. Mr. Peterson stated he would see if the,item could be placed on the July 11 or July 17 Council agenda instead. COMM #6-84-3 RICHARD SZYPLINSKI VARIANCE CONTINUED Commission noted the letter from the DNR requesting the item to be postponed until fall so the DNR can inspect the property in question. Chairman Spotts also noted a memo from the City Clerk stating she has talked with Mr. Szyplinski, who seemed agreeable to the proposal. Mr. Szyplinski was not present at this meeting. The Commission felt the request for the delay should come from the applicant in writing. MOTION by Bosell, Seconded by Jacobson, that the Richard Szyplinski variance be tabled to late fall contingent upon the receipt of such request from Mr. Szyplinski in writing. Motion carried unanimously. COMM #6-84-4 DALE HOWARD VARIANCE, CONTINUED Commission noted the memo trom the Clerk on this item; but because Mr. Howard was not yet present, it was agreed to hold the item until later in the meeting. COMM #6-84-7 DICK CARSON VARIANCE CONTINUED Commission noted the memo from the City Clerk/A. Administrator and briefly reviewed the problems of not meeting lot width, the request to vary from blacktopping the street, and future planning possibilities. Because Mr. Carson was not present, it was agreed to postpone any actlon on this item until later in the meeting. COMM #6-84-8 ROBERT LOFTUS SPECIAL USE PERMIT PUBLIC HEARING Note the written request from Mr. Loftus to reschedule the item to the July 24 meeting. MOTION by Jacobson, Seconded by Bosell, that we move the Robert Loftus special use permit to the next regularly scheduled meeting of the Planning and Zoning Commission at his request. Motion carried unanimously. This item will be on the July 24 P & Z Agenda. MEADOWCREEK I PARTNERSHIP/COMMERCIAL DEVELOPMENT IN CITY OF ANOKA Commissioner Bosell reported on the note received from the City of Anoka relative to the Meadowcreek I Partnership commercial development on the southwest corner of Round Lake Boulevard and County Road 116. Anoka is considering the approval of the final plat this evening of approximately 1.64 acres, of which 10,000 square feet would be for a Tom Thumb store with gas pumps. There are three other lease spaces. She also noted the entire commercial land on that corner is approximately 5\ acres in size. She was told that the developers had done a study and thought they could make such a business successful even in light of the business already established at Bill's Superette just down the street. Planning and Zoning Commission Meeting July 10, 1984 - Minutes Page 3 (Meadowcreek I Partnership/Commercial Development in City of Anoka, Continued) Commission discussion was on their disappointment that they were not informed of this proposal until this evening, the night the final plat is being considered by the City of Anoka. The Commission generally felt there would be no use commenting on the proposal because of the late notice and felt the City of Anoka should be asked to advise Andover of developments along the city borders in the preliminary plat stages to allow time tor Andover to comment. MOTION by Jacobson, Seconded by Rogers, that we authorize the Chairman to send such a letter and sign such to the Community Development Director with a copy to the City Administrator, City of Anoka. Motion carried unanimously. UALE HOWARD VARIANCE, CONTINUED Dale Howard asked to withdraw the variance request because he is working on ideas to plat the pieces of property. The Commission noted any monies not spent on the variance request would be refunded. They also suggested that Mr. Howard work closely with the City Engineer and City Building Official, and explained the procedure of submitting a sketch plan to the City Council prior to drawing up the plans for the preliminary plat and public hearing before the P & Z. There was also a brief discussion on the problems involved with the properties in question, especially on meeting the minimum width requirement on the lots. The Commission suggested Mr. Howard get an understanding from the Council that the lots for twin homes need to meet the 150 percent requirement of lot width and area but not of lot depth. Commissioner Perry had thought at the time the lot dimensions were amended in Ordinance 8 there was an understanding to allow some flexibility in meeting minimum lot width and depth dimensions as long as the square footage is met. Hut at a subsequent meeting the Mayor had stated that was not the case. However, at the last meeting with the Council she sensed that the Council was looking tor some flexibility in meeting lot dimensions. Commissioner Jacobson felt a possibility for platting would be either under a PUD or to place a small cui de sac with homes facing that street. ~OTION by Jacobson, Seconded by Bosell, that we recommend to the City Clerk a refund of r;lrale Howard of any unexpended money for his variance request due to the tact that he has withdrawn his request. Motion carried unanimously. COMM. #6-84-6 DISCUSSION/TEMPORARY MIGRANT WORKER HOUSING Commissioner Perry explained this matter arose because Mr. Slyzuk and Mr. Fields had requested placing trailers on their property to be used for migrant workers. Because the City does not allow mobile homes tor this use, she has done some research and found that there are separate requirements that can be used for temporary housing ot seasonal workers. She found it is possible to construct a permanent dwelling that still meets' the State Building Code, but it does not have to meet the energy codes or square footage requirements. Commissioner Perry felt this would meet the needs of the farmers to provide temporary housing for seasonal workers at a reasonable cost to them. It was Mr. Almgren's opinion that the regulations of MH 204 would make it possible to construct a block building with concrete floor and meet the minimal requirements of those regulations. It would have to be inspected by the State and a certificate of inspection must be obtained. He felt something could be worked out tor housing of migrant workers using those regulations. Uiscussion was on the interpretation ot the regulations before the Commission. Commissloner Jacobson questioned why the City would allow a reduced standard for seasonal workers, less than what is required for the other citizens of the community. He Planning and Loning Commission Meeting July 10, 1984 - Minutes Page 4 (Uiscussion/Temporary Migrant Worker Housing, Continued) questioned why an exception in housing should be granted for only a handful of people in the City, noting the recommendation that this would apply only to those farmers under the Agricultural Preserve zoning. And he asked what the farmers would do if the City did nothing in this matter. Commissioner Rogers also questioned the enforcement of the regulations as to how many people would be in a housing unit and how temporary housing is handled now. Commissioner Perry and Mr. Almgren noted this is an alternative to bringing in trailers and is economically feasible for the farmers to house their seasonal workers. After further discussion, it was generally felt it WOuld be advantageous to have a joint meeting with the City Council and some ot the farmers involved to determine the needs ot the farmers and to reach a consensus of how the situation should be handled. MOTION by Jacobson, Seconded by Perry, to make a recommendation to the Council noting our discussion and requesting a common meeting time within the next three month time period with the P & Z and Council and three or four operators to whom this may apply tor an informational session on the issue. Motion carried unanimouslY. URDINANCE 8 REVISIONS/WOHK SESSION It was agreed to keep the Agenda for July L4 to a minimum, to meet at 6 p.m. to work on .the Ordinance 8 revisions, break at 7:30 to dispense with the Agenda items, and then return working on the Ordinance 8 revisions. UICK CAHSON VARIANCE Mr. Carson was not present. MOTION by Jacobson, Seconded by Rogers, to table the Carson Variance until the next scheduled meeting and ask the secretary to contact the individual to see if he still intends to continue it. Motion carried unanimously. There was a brlef discussion on the request, with Mr. Almgren noting the variance is basically to construct the road without the blaCktopping. There was also a question of whether the City would want to maintain a 400-foot-long cul de sac to serve only one property. The problems of planning the property were noted, especially the tact that the property does not meet the minimum lot width requirement. Mr. Almgren also stated the actual easement lS the opposite of what is shown on the maps and is a 60-foot easement off Round Lake Boulevard which becomes a 30-foot easement on the back five acres.
