MINUTES
The regularly scheduled Andover Planning and Zoning Commission meeting was called to order
by Chairman Don Spotts at 8:05 P.M., Tuesday, September 11,1984 at the Andover City Hall,
1685 Crosstown Bouelvard N.W., Andover, Minnesota.

MOTION by Apel, seconded by Rogers to approve the minutes of August 28, 1984 as written.
Motion carried.
Cunningham Addition Preliminary Plat Review (Comm. #7-84-2)
Jim Kurth, the surveyor for the plat was present to represent this item. He noted that the
City Engineer had wanted a test hole dug to see what the water table is; this has been done
and Mr. Schrantz has the report.
Chairman Spotts asked if the soils report was satisfactory. Mr. Schrantz noted that it is -
the water elevation has been established.
Commissioner Apel felt that all of the items required to be completed have been and that
the plat is now ready to go to the City Council.
Woodland Ridge Preliminary Plat Public Hearing (Comm. #7-84-4)
Chairman Spotts opened the public hearing.
Chairman Spotts noted that a letter from the County Highway Department has been received
allowing Lot 9, Block 1 and Lot 7, Block 4 to front on the county road.
It was noted that variances would be required to Lots 1 and 5, Block 2 and Lot 1, Block 3
because the frontage is not 300 feet.
Dave Almgren noted that on Lot 1, Block 3 the house could face either street. It would
be up to the owner to say which way he wants to face the house. A variance wouldn't be
required for the frontage on this lot.
City Engineer Schrantz noted that Lots 1 and 2 of Block 2 have been revised so that each
contains 39,000 square feet of buildable land.
Gaylord George, 17353 Verdin Street N.W. - noted that when pagent built in their area, they
were told that all lots had to be 10 acres and now Mr. Carlson is making 2! acre lots. He
asked when the change was made as he and his neighbors didn't know a thing about it.

Commissioner Apel noted that the city adopted the zoning ordinance allowing 2! acre lots in
the rural area and that prior to the adoption of the ordinance, notices were published in
the newspaper regarding the ordinance.
Sylvia Britton, representing Mr. Carlson, stated that all of their plats are restricted by
covenants.
Mike Greene, 17506 Verdin Street N.W. - noted that he is concerned with the over-development
of the land. With 27 new septic systems in the sandy soil, he felt that it wouldn't be long
before sanitary sewer is installed in his area.
Chairman Spotts pointed out on the city map where the sewer line for the year 2000 is.
Mr. Greene asked about the water table. Chairman Spotts noted that soil borings were done
and if they get below 867, they have a non-buildable lot.
Mr. Greene stated that it looks like a disaster to him to put 27 houses in that sandy area
and that he is against the project.
Dean Summerbell, 2609 - 176th Circle N.W. - Asked what the covenants will be on the property.
Ms. Britton noted that the houses must be a certain square footage, no junk cars are allowed,
garages must be attached and no nuisances are allowed. .
Mr. Summerbell asked who deals with someone who violates the covenants. Ms. Britton noted
that the developer does.
Mr. Schrantz noted that the Ordinary High Water Mark on the pond will have to be determined
by the DNR. Mr. Carlson's engineer is preparing a high water level. There are a number
of areas where the water will pond on the lots. He stated that he has asked for a 100 year
flood elevation for those ponds. The grading plan shows one grade that is too steep. They
are proposing to use an urban street section. The houses have to be 3 feet above the water
table and that is adequate.
Commissioner Apel noted that the main thing is that this particular plat conforms to the
ordinances. There are some minor housekeeping things that need to be done.
Commissioner Rogers asked who will maintain the pond. Commissioner Apel noted that the
DNR maintains it and the property owner cannot modify it without permission from the DNR.
MOTION by Apel, seconded by Rogers to close the public hearing. Motion carried unanimously.
Dave Almgren noted that Block 2 is 1750 feet long. The ordinance only allows 1320 feet so
this block will require a variance.
MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend
to the City Council approval of the Woodland Ridge Preliminary Plat legally described as
'The South 1/2 of the Southeast 1/4 of Section 4, Township 32, Range 24, Anoka County,
Minnesota' for the following reasons: 1) A public hearing was held. There was vociferous
opposition by some of the nearby land owners but overall the plat does conform to the
Comprehensive Plan; 2) It will not depreciate the adjacent properties significantly; 3) It
will not affect the health, safety or general welfare of the community. The following notes

shall be made: 1) A variance be granted for Lot 7, Block 4 and Lot 9, Block 1 for drive-
ways exiting onto Verdin Street pursuant to Ordinance 10, Section 9.06 (g); 2) A variance
be granted for Lot 5, Block 2 to allow the home to face 173rd Lane N.W. pursuant to Ordinance
8, Section 3.02 (WW); 3) A variance will be required to allow Block 2 to exceed the 1320
foot maximum block length pursuant to Ordinance 10, Section 9.05 (a); 4) It is required
that the City Engineer be given a grading plan and the ponding elevations for the 100 year
flood level.
Comments: 1) The plat has been reviewed by the City Engineer and the Anoka County Highway
Department; 2) The Park Board recommendation has been received; 3) Lot 1, Block 3 was
considered for a variance but the concensus was that it does not require one.
Motion carried unanimously. This will go to the City Council on September 18, 1984.
Prairie Meadows Preliminary Plat Public Hearing (Comm. #7-84-5)
Chairman Spotts opened the public hearing.
Chairman Spotts noted that if the vacation of easement is approved by the City Council, it
eliminates frontage for the Page's who own the property directly north of the plat. They
would not be able to subdivde their property.
Discussion centered on the property owned by the Page's and the Vigstol's and how they
could subdivide their properties. Ms. Britton noted that if 170th Lane were to be extended
to the east, Lot 1, Block 2 would become a substandard lot.

Commissioner Bosell noted that we probably won't be able to facate the whole easement.
It was noted that Blocks 2 and 4 both exceed the 1320 foot maximum and will require variances.
MOTION by Apel, seconded by Rogers to close the public hearing. Motin carried.
MOTION by Rogers, seconded by Jovanovich that the Andover Planning and Zoning Commission
recommend to the City Council approval of the Prairie Meadows Preliminary Plat legally
described as 'The Southwest Quarter of the Northeast Quarter, Section 8, Township 32, Range
24, Anoka County, Minnesota, lying South of the Easterly extension of the North line of
170th Lane Northwest as the same is platted in the plat of Sylvester Addition, except that
part platted as Sylvester Addition AND the South 20 acres of the southeast quarter of the
northeast Quarter of Section 8, Township 32, Range 24, Anoka County, Minnesota' for the
following reasons: 1) A public hearing was held. Comments were received from residents
involved in the area; there was no opposition; 2) The plat conforms to the Comprehensive
Plan; 3) The plat has been reviewed by the City Engineer; 4) The Anoka County Highway
Department has reviewed the plat; 5) The Park Board recommendation has been received; 6)
The plat meets city ordinances with the following variance: a) A variance for Blocks and
and 4 as both exceed the 1320' maximum length, pursuant to Ordinance 10, Section 9.05 (a).
It is also recommended that the City Attorney look closely at the legal description,
especially for Lot 1, Block 2 to determine exactly who has interest in the easement that
is proposed to be vacated. Comments: 1) Lot 5, Block 2 shall enter on 169th Lane and not
Round Lake Boulevard; 2) Lot 1, Block 3 shall enter on 169th Lane and not Round Lake Boule-
vard; 3) Several lots on the south side of 169th Lane have a greater width than depth.

Motion carried on a 4 yes, 1 abstain (Bosell) vote. This will go to the City Council on
September 18, 1984.
Commissioner Bosell noted that she abstained from voting as she arrived in the middle of the
discussion.

Ordinance 8 Amendment Public Hearing (Comm. #8-84-1)
Chairman Spotts opened the public hearing.
Commissioner Bosell asked which district this amendment would apply to once our new zoning
ordinance is completed. Dave Almgren stated it is intended for smaller lot sizes.
Commissioner Apel noted that this amendment makes sense. It will give the building inspector
some flexibility to make some decisions.
MOTION by Apel, seconded by Rogers to close the public hearing. Motion carried unanimously.
Dave Almgren noted that this amendment makes sense in that if you have a subdivision that
has 10 houses set back 30 feet, why would a new one have to have a 35 foot setback.
Commissioner Bosell suggested the wording be changed to read: Unless the existing structures
would indicate a lesser setback to maintain uniformity. She also suggested that this be
changed for the R-2 district. The Commissioner concurred with her suggestions.
MOTION by Apel, seconded by Rogers that the Andover Planning and Zoning Commission recommend
to the City Council adoption of an amendment to Ordinance 8, Section 6.02, Minimum Require-
ments, Side Yard Setback from Street and Front Yard Setback in the R-2, R-3 and R-4 districts
as attached.
Motion carried unanimously. This will go to the City Council on October 2, 1984.
Ordinance 10 Amendment Public Hearing (Comm. #8-84-1)
Chairman Spotts opened the public hearing.
Commissioner Bosell questioned the wording for the requirements for a two-family lot,
suggesting that it be changed to read: '...except for two-family lots which shall be required
to be 150 percent of a single family minimum area and width' rather than 150 percent of
a single family minimum size and dimensions. The way it is now worded, someone might think
that the depth also has to be 150 percent of the single family size, which is not the case.
MOTION by Apel, seconded by Rogers to close the public hearing. Motion carried unanimously.
MOTION by Apel, seconded by Rogers that the Andover Planning Commission recommend to the

City Council adoption of an amendment to Ordinance 10, and 10H, Section 9.06 as attached.
Motion carried unanimously. This will go to the City Council on October 2, 1984.
The Planning Commission will hold a special meeting on Tuesday, September 18, 1984 at 7:30
P.M. to review the draft of Ordinance 8.
MOTION by Bosell to adjourn. Motion carried unanimously.
