SPECIAL PLANNING AND ZONING COMMISSION MEETING
SEPTEMBER 18, 1984
MINUTES
A special Andover Planning and Zoning Commission meeting was called to order by Chairman
Don Spotts at 7:30 P.M., Tuesday, September 18,1984 at the Andover City Hall, 1685 Cross-
town Boulevard N.W., Andover, Minnesota, to discuss the draft of Ordinance 8.

Commissioner Jacobson felt that in the Rules and Definitions section of the ordinance it
should be noted that this ordinance is effective on January 1,1971. If that statement isn't
put in the ordinance, everything prior to the adoption of it will be grandfathered in.
The following changes were made in the draft:
3.02 Definitions
Club - The first sentence will be changed to read "A non-profit association of persons who
are bona bide members paying dues.
Fast Food, Take-out Establishments - 'cooked food' will be changed to 'prepared food'.
Home Occupation - Will be changed to read: 'Any gainful occupation or profession engaged
ln by the occupant of a dwelling when carried on within a dwelling unit. No signs other
than those normally utilized in a residential district are present, no stock in trade is
stored on the premises and over-the-counter retail sales are not involved.'
Mining - Changed to read 'The extraction of sand and gravel or other material from the land
in the amount of 400 cubic yards or more.'
Motel - in the last sentence, the word 'automobile' will be deleted.
Multiple Conversions - Change to read 'A change of common ownership of a multiple dwelling
to individual unit owners (i.e., renters can become owners of their respective dwelling units).
Multiple Residence - 'Apartment Buildings' will be deleted.
A definition for Apartment Buildings will be inserted and will read as follows: 'Three or
more dwelling units in one structure. Does not include hotels, motels, condos, townhouses.
Parking Space - Will be changed to read: 'A suitably surfaced area of sufficient size to
store one standard automobile either within or outside a building.'
Planned Unit Development - Discussion centered on whether this should be allowed in the rural
and urban areas or only the urban area. It was the concensus of the commission that PUD's
should be allowed in both areas. The word urban will be deleted from the first sentence and
in the second sentence, the word shall be changed to 'may'.
..est Home - will be changed to read: 'A private home for the care of children or the aged
and infirmed or place of rest for those suffering bodily disorders. Such a home may contain
equipment for surgical care or for the treatment of disease or injury, and may include care

for mental illnesses or infirmities.'
Shopping Center - After the definition, it will state (See Section 6.10).
It was noted that the League of Minnesota Cities is mailing to the secretary a definition
for Zero Lot Line.
4.03 Non-Conforming Uses and Structures
(E) Will be changed to read: 'A non-conforming use may be changed only to a use appropriate
to the district.'
4.19 Planned Unit Development (PUD)
In the last sentence, the word 'urban' will be deleted.
5.03.1 Rezonings
The last sentence of the first paragraph will be changed to read: 'Rezonings may be initiated
by Council, Planning Commission or property owner.
6.04 R-2 Single Family Urban District
Public Parks will be taken from the Conditional Use section and put in the permitted use
section.
M-l Medium Density Residential District
(A) Purpose: Multiple-family structures will be changed to 'multiple residences.
Under Conditional Uses, Nursery schools will be changed to Group day care and Day Nurseries
will be changed to Day Care.
M-2 High Density Residential District
Under purpose, 'multiple-family housing will be changed to 'multiple-residences'.
6.08 General Commercial
(H) Refuse. Will be changed to read: 'Garbage recepticles, refuse areas or incinerators
must be in the rear or side yards and must be screened from public view and contained by a
six (6) foot high solid fence. No outdoor storage of any materials is permitted.'
(J) Permitted Uses. Will be changed to read: 'In the GC district, no building or land
shall be used, and no building shall be erected, converted or structurally altered unless
otherwise provided herein, except for one or more of the following uses:'

(B) Lot and Yard Requirements: Minimum lot size will be 10,000 square feet.

A section on landscaping will be added to the following districts: M-l, M-2, GC, SC, GB,
LI and GI and will read: Landscaping. (See Section 6.15).
Commissioner Perry suggested comparing the existing ordinance with the draft to see if any-
thing has been excluded that should be in the new ordinance.
MOTION by Apel to adjourn. Motion carried unanimously.
Meeting adjourned at 10:10 P.M.
