MINUTES
The regularly scheduled Andover Planning and Zoning Commission Meeting was called to
order by Chair.man Don Spotts at 7:30 P.M., Tuesday, October 9, 1984 at the Andover City
Hall, 1685 Crosstown Boulevard N.W., Andover, Minnesota.

Approval of Minutes
September 25, 1984
MOTION by Perry, seconded by Jovanovich to approve the mi nutes of September 25, 1984 as
written. Motion carried on a 3 yes, 1 present (Jacobson) vote.
Howard-Tempel Addition Preliminary Plat Public Hearing (Comm. #7~84-3)
Chairman Spotts opened the public hearing.
Dale Howard, 18200 Eidelweiss Street N.W., Cedar and Norbert Tempel, 2714 - 133rd Lane N.W.,
Andover appeared to represent this plat.
Chairman Spotts noted that there was an error on our part that in order to have twin homes
in the plat, a Special Use Permit needs to be issued and the developer was not informed on
this in time to have the public hearing along with this item. The Special Use Permit public
hearing will be held on October 23rd. There are some items on the plat that also need to
be cleared up.
Dale Howard understood that the surrounding property owners' names need to be on the plat
along with the density. He also noted that the engineer would not accept the soil' borings
because his surveyor had done them.
Commissioner Jacobson explained that the soil borings should have been done by a soils
engineer, not a surveyor. He also stated that Mr. Howard's surveyor could make 95% of the
corrections needed on the plat. The grading plan needs to be submitted to the city and
the Coon Creek Watershed District needs to review the plat.
Mr. Howard noted that be was at the Coon Creek Watershed Board but hasn't heard from them
yet.
Commissioner Jacobson also noted that Mr. Howard needs to petition the city for the street
and sanitary sewer. Also, the County Highway Department should be contacted regarding the
drainage on Crooked Lake Boulevard.
The 20 foot radius on the corners was questioned with Dave Almgren noting that the platting
ordinance explains this.

Dave Almgren asked what style twin homes are going to be in the plat. Mr. Howard Doted that
he will not allow any two story homes as there is one in the neighborhood aDd it really looks
out of place. Because of the water table the homes will have to be splits.
Chairman Spotts asked Mr. Howard if there are any twin homes in Andover like he plans to
build. Mr. Howard explained that there are some in Coon Rapids across from Blai.ne Senior
High that are similar to what he would like to build.
MOTION by Jacobson, seconded by Perry to move this item to the October 23rd meeting to allow
the applicants to make the necessary changes as outlined in the Andover Review Committee memo.
Motion carried unanimously.
James Smith Lot Split (Comm. #9~84-5)
James Smith, 1533 Sunny Way Court, Anoka appeared for this item.
Chairman Spotts asked if Mr. Smith's drawing is drawn to scale. Mr. Smith replied that it
is as close as he can get. Chairman Spotts asked if there are any dwellings on the parcel
now. Mr. Smith noted that hi s parent's house is on the southern porti on of the property.
Commissioner Jacobson asked Mr. Smith if he is the legal owner of the property. ~1r. Smith
noted that his parents are the owners. Commissioner Jacobson explained that he should have
a letter from his parents saying that they are aware of the lot split and have no objections.
He also noted that Mr. Smith's parents should realize that the property north of the split
off parcel will have less than 300 feet of frontage and cannot be split off as a lot in
the future.
Mr. Almgren asked if there was some reason why Mr. Smith is splitting off 2.6 acres rather
than 2.5 acres. Mr. Smith stated that his father told him to split off the parcel to the
fence line, which he did, and he ended up with 2.6 acres.
Chairman Spotts asked if it would be better to have the property surveyed before it goes
to the City Council. Commissioner Jacobson stated that he would 1 ike to have him survey
it and have a legal description for it before it goes to the City Council. Commissioner
Perry felt that he should just have the correct measurements of the property and also to
who what the distance is from the northern boundary of the entire parcel down to the northern
line of the lot being split off.
MOTION by Jacobson, seconded by Perry that the Andover Planning and Zoning Commission
recommend to the City Council approval of a lot split requested by James L. and Robyn C.
Smith for the property legally described as the North One-Quarter of the Northeast One-
Quarter of Section 5, Township 32, Range 24, subject to the following: 1) Either the
existing owners of the large parcel be present to grant their permission for the lot split
or it be in writing; and 2) Subject to a modified drawing of the parcel being split off.
The Commission also recommends the imposition of the appropriate park dedication fees for
the lot split and finds that said lot split is in accordance with Ordinance 40, 40A and 40B.

Wm. C. Rademacher Amended Special Use Permit Public Hearing (Comm. #9-84-6)
Chairman Spotts opened the public hearing.
Wayne Anderson, Rademacher & Associates - explained that they are going to replace the
existing pumps at Bill's Superette. They now have six dual pumps. They will be extending the
islands and there will be 20 nozzles rather than the 12 that now exist. It will be a sub-
merged system. Four of the pumps will be quad pumps.
Chairman Spotts asked if they will be electronic. Mr. Anderson noted that they are. He
also noted that all of the pumps will still be under the canopy, which is 40' long.
Commissioner Jacobson asked what the limit on the number of pumps was on the original Special
Use Permit.
Mr. Anderson stated that there was no limit. He also noted that they might move the fill
pipes to the outer lane, but they haven't made that decis.ion as yet.
Rich Larson, Fire Marshal - didn't see any problem as long as they do everything they have
on their list such as coating the pipes and testing.
MOTION by Jacobson, seconded by Jovanovich to close the public hearing. Motion carried.
MOTION by Perry, seconded by Jacobson that the Andover Planning and Zoning Commission
recommend to the City Council approval of the request for an Amended Special Use Permit
by Wm. C. Rademacher for the property described as Lot 1, Block 2, Andover Community Shopping
Center pursuant to Ordinance 8, Section 5.03 (A) and (C) and Section 7.03. The proposed
changes will be for a total of 20 nozzles rather than the 12 that are currently at the
location. There will be four quad pumps and 2 standard pumps. The islands will be extended
a total of 6 feet on each end.
The Amended Special Use Permit will be subject to the following conditions: 1) The proposed
project is to install new submersible pumps and replace the existing piping. The islands
will be extended six feet on each end. The existing pumps will be replaced with electronic
dispensers; 2) All piping will be coated before covering; 3) Leak detectors will be install-
ed in the submersible pumps and 50 pound pressure tests will be done on the piping; 4)
Subject to the inspections by the appropriate city and state inspectors.
A public hearing was held; there was no opposition.
Motion carried unanimously. This will go to the Ci.ty Council on October 16, 1984.
Knudson/Steinbring Variance (Comm. #9-84-7)
Betty Knudson, 3155 - 174th Avenue N.W. was present to request a variance to construct a
new home on property already having a principal structure on it.
Chairman Spotts asked where the new dwelling is going to be built. Ms. Knudson noted that
it will be to the east of the existing building. A new septic system will also be installed.
Commissioner Perry asked what they plan to do with the existing building. Ms. Knudson noted

that they have had two offers from people who want to take it off the property. If they
don't sell it, it will be torn down.
Dave Almgren noted that it has to be removed. He also noted that the plot plan showing the
new house is incorrect as it has a rear yard setback of only 42 feet and it needs to be 50
feet.
Commissioner Jacobson asked who actually owns the property. Ms. Knudson noted that she and
Jean Steinbring are the owners. Mr. Jacobson asked if they are also the owners of the 83'
parcel on the west. Ms. Knudson noted that someone else owns that parcel.
Commissioner Jacobson asked if the parcel in question is a legal lot of record.
Mr. Almgren noted that it is and has been for many years. He also noted that the building
on there now is a non-conforming structure and she is trying to improve the property.
Chai rman Spotts asked how long it will take to buil d the new house. Ms. Knudson noted that
the contractor told them it would be 60 to 90 days.
Dave Almgren stated that the old building has to be removed prior to the issuance of a
Certificate of Occupancy.
MOTION by Jovanovich, seconded by Perry that the Andover Planning and Zoning Commission
recommend to the City Council approval of a variance requested by Betty Knudson and Jean
Steinbring for the property described as 'the North 198' of the South 912 feet of the west
303 feet of the Southwest quarter of the Southwest quarter of Section 4, Township 32, Ran~e
24, Anoka County, Minnesota except the west 83', to vary from. Ordinance 8, Section 4.04(B)
to allow construction of a new home on property al ready having a principal structure.
Granting of the variance is subject to the existing home being demolished prior to the
issuance of the Certificate of Occupancy.
Motion carried unanimously.
South Coon Creek Drive/Nurseries
The concensus of the Commission was that if nurseries are to be allowed by Special Use
Permit, they should be allowed in all districts, not only R-l or R-4. It was also mentioned
that we have to be careful with our definition of a nursery so it doesn't become something
too big.
Thomsen's Lakeview Villas/Attorhey'sOpinion
The secretary provided the Commission with copies of the attorney's opinion which stated that
Mr. Thomsen can build townhouses under a PUD with a Special Use Permit. The units do not
need to be 960 square feet, but they have to have a 440 square foot garage for each unit.
