Comma #7-85-1 Ordinance 8 Arnendment/Hinor Retail CITY of ANDOVER REGULAR PLANNING AND ZONING CO~lISSION MEETING JULY23, 1985 - MINUTES The Regularly Scheduled Andover Planning and Zoning Commission Heeting was called to order by Chairman Don Jacobson at 7:30 P.M., Tuesday, July 23, 1985 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, MN. Commissioners Present: Bosell, Ward, Jovanovich, Rogers Commissioners Absent: Apel Approval of Minutes July 9, 1985 MOTION by Ward, seconded by Jovanovich to approve tile minutes of July 9, 1985 as written. Motion carried on a 4 yes, 1 present (Rogers) vote. Chairman Spotts noted that COITmissioner Spotts has resigned and stated that he will send him a letter thanking him. MOTION by Rogers, seconded by Ward that the City Council appoint a new Commissioner. Hot ion carried. Ordinance 8 Amendment/ainor Retail -(Comma #7-85-1) Chairman Jacobson stated that there are two sections to this. The first is a discussion of Ordinance 8 to allow minor retail sales in a home. This carne about because of the Round Barn. Also, the Council is saying that there should be something other then Neighborhood Business that would go in the rural area and be bigger than an NB zone. They are also thinking of something for the urban area that would be a buffer. Commissioner Bosell asked if there had been a complaint filed about the Round Barn. Mr. Jacobson noted that there has been. Commissioner Ward asked what minor retail is. Chairman Jacobson stated that to him, retail is retail. Commissioner Bosell noted that Section 4.05 of Ordinance 8 uses accessory buildings, private garages, detached garages interchangeably. Section (I) only says that a garage should not be used for a home occupation. It seems that in the definition section it says accessory buildinss and structures, yet it also says private garages and detached garages in other sections. Chairman Jacobson noted that first of all we have to see what the definition of a home occupation is. Referring to a memo from Pat Lindquist dated May 24, 1985, Hr. Jacobson noted that Section 7.03 states that Special Use Permits for uses not listed in this section shall Regular Planning Commission Meeting July 23, 1985 Page 2 (Ord. 8, Cont.) not be granted except where the governing body determines they are similar in character to those actually listed for a residential district. Mr. Jacobson stated that looking at the uses listed, he didn't see a use that it similar to the Round Barn operation. That leaves a zoning change or a Planned Unit Development and a PUD is ridiculous, which leaves a rezoning. Commissioner Bosell felt that the Round Barn should be put on the back burner until something is done with M.R. Olson. Commissioner Rogers felt that if we request that the Round Barn corne in for a Special Use Permit we have some control over it, but if it is rezoned, we don't have that much control. Chairman Jacobson stated that they are now operating illegally. He didn't feel that a Special Use Permit applies, and it should probably be rezoned. Commissioner Ward agreed that it should be rezoned. Commissioner Bosell felt that there are too many problems with the property to rezone it. She stated that this should have gone to the City Attorney rather than the Planning Commission and he should have made a decision on what should be done. Commissioner Ward agreed that the City Attorney should handle this by telling them they are in violation and what they should do to become compliant with the ordinance. MOTION by Ward, seconded by Rogers that the first item regarding minor retai~ in a home that was forwarded to us, we understand refers to the Round Barn on Bunker Lake Boulevard and that the Andover Planning Commission requests that this item be sent to the City Attorney so that he can inform the owners of the Round Barn that they are in violation of city ordinances and also to inform them of the proper procedure to comply, if possible, to city ordinances for legal operation of their business. Motion carried unanimously. Chairman Jacobson noted that the next section to deal with is if it is advisable to create another district that would allow more than what is allowed in between a Neighborhood Business district and something heavier. Commissioner Bosell noted that the Planning Commission created such a district in the draft of Ordinance 8 and named it General Commercial. However, this new section really limits it to the rural area. In the urban area there are other areas that can meet the commercial needs. Chairman Jacobson suggested taking a look at this new zoning district Regular Planning Cornrnission Meeting July 23, 1985 - Page 3 (Ord. 8, Cont.) and discussing it at the next meeting. Also, we should look at whether there should be some other category allowed in the urban area. Ordinance Violations Several ordinance violations throughout the city were discussed.
