Carom. #11-85-1 Ordinance 8, Section 7.03/Hame Day Care CITY of ANDOVER REGULAR PLANNlliG AND ZONlliG CXlMJ:>1ISSION MEETING NOVEMBER 26, 1985 - J1INUTES '!he Regularly Scheduled Andover Planning and Zoning Carrmission rreeting was called to order by Chairman Jacobson at 7:30 P.M., Tuesday, November 26, 1985 at the Andover City Hall, 1685 Crosstown Boulevard N.W. Commissioners Present: Corrmissioners Absent: Also Present: Bosell, Rogers Jovanovich, Apel, Ward Janes Schrantz, City Engineer; others Chairman Jacobson noted that he received a letter from Steve vlard noting that he is resigning from the Planning Corrmission effective irrmecliately. Nr. Jacobson will send a letter to Steve thanking him for serving on the Commission. Approval of Minutes - November 12, 1985 Page 3 - the last sentence should read 'Mr. Schrantz noted that t.'1e County Highway Departrrent does not want any driveway accesses to Round Lake Boulevard.' Page 7 - At the bottom of the page, Corrrnissioner Apel' s =I11ITl2nts, second sentence should say 'that has all of the' instead of 'that has off I . . . . MOTION by Bosell, se=nded by Rogers to approve the minutes of November 12, 1985 as =rrected. Motion carried on a 2 yes, 1 present (Ja=bson) vote. Creekridge Estates Preliminary Plat, Cant. (COll1l1. #9-85-4) Tom O'Malley, Surveyor - noted that the street pattern in Phase II has been changed, bringing Jonquil and Kerry Streets straight down to South Coon Creek Drive thereby eliminating driveway accesses on the north side of South Coon Creek Drive. On the north side there are five lots served by on site sewage systems but with city water. '!his plan will allow for less grading. '!he south side of South Coon Creek Drive will be left intact, with the exception of the park. '!he park will include what used to be a two and a half acre lot and a city size lot. '!here is also a park on the north side west of Round Lake Boulevard. Phase I includes 4 lots on the south side of South Coon Creek Drive and one 15 acre outlot on the north side. '!he property shown as the outlot is relatively low and the developer's intent is to postpone doing any- thing with that until a future date. Chairman Jacobson questioned how big of a hole the excavation of the lots between Kerry Street and Jonquil Street will create and if there will be standing water. Mr. Schrantz stated that the water will be drained out; it will be a dry hole. Ken Gust, engineer for the developers - noted that the lots on the south side of South Coon Creek Drive have been made wider and the driveways will be together for each two houses. Carrrnissioner Bosell noted that on the legend on the plat drawing the baserrent elevations need to be noted. Also it should be noted what the lowest baserrent elevation is in Phase II. '!he owner of the property just north of t.~e creek needs to be identified on the plat. She also noted that driveway access for those lots that abutt Round Lake Boulevard and South Coon Creek Drive will be lirni ted to interior streets. Chairman Jacobson again noted that the excavation of the lots between Kerry and Jonquil bothers him. Mr. Schrantz assured him that the water will drain out of. the hole. MYI'ION by Bosell, seconded by Rogers that the Andover Planning and Zoning Comnission recormrend to the City Council approval of the prelimimrry plat of Creekridge Estates being developed by Carlson-Dropps Associates, legally described as 'Part of Govern- rrent Lot 5 and part of the Northeast Quarter of the Southeast Quarter of Section 29, 'J:'a.m.ship 32, Range 24, and part of the Southwest Quarter of the Northwest Quarter and part of the Northwest Quarter of the Southwest Quarter of Section 28, Township 32, Range 24, Anoka County, Minnesota', noting the following: I) This plat has been reviewed by the City Engineer. corrections have been made and the plat is now in conformance with the engineering requests; 2) The plat has gone before the Park Corrrnission and their reCOl1ID2TIdation has been received; 3) A public hearing was held in regard to this plat for infornational purposes; 4) The plat is in conformance with the Corrprehensive Plan of the City of Andover and dces not violate the intent and philosophy of that plan; 5) It should be further noted that this plat will be done in two parts - Phase I and Phase II. In Phase II there are sarre technical details that need to be straightened out in regard to the drainage; 6). In :Phase II, the lots on Round Lake Boulevard and the north side of South Coon Creek Drive will not be allowed to front on those streets, but will front on interior streets; 7t It should be further noted that in Phase II, Block 4 on the south side of South Coon Creek Drive shall be provided with extra driveway space to allow for additional parking as no parking is allowed on an MSA street. l-btion carried unaninously. This will go to the City Council on December 3, 1985. Smith's Green Acres Preliminary Plat,Cont. (como. jf10,..85-l) Ken Gust, engineer for developer - noted that the prirnaIy concern at the last rreeting was the additional traffic on l4lst Avenue and not having another access from the area. Chairman Jacobson asked Councilman Elling what the City Council said regarding this plat. Mr. Elling noted that the Council felt that they should stick with their original concept. Mr. Schrantz stated that staff dcesn' t feel that Dahlia Street will ever be built. Corrmissioner Bosell noted that with a temporary cul-de-sac, we need nore than a 30 foot radius. Chairman Jacobson noted that the lots are less than the 20,000 square feet that is required in an R- 3 zoning, but srraller lot sizes were recorrmended by the Plarming Corrrnission. Mr. Schrantz stated that the city has the equiprrent to plow the cul-de-sac but other errergency vehicles may not be able to turn arotIDd. He stated that by putting a temporary turnaround in we are telling the people that Dahlia Street will sarre day go through, which is very doubtful. Regular Planni. ~ Corrmiss:. . Meeting November 26, 1985 - Minutes Page 3 (Smith's Green Acres, Cont.) Corrmissioner Bosell noted that there needs to be a typical lot sho.vn on the plat. Also, the drainage easeIlEI1ts need to be sho.vn on the typical lot. Lot 1, Block 2 will require a variance for either the definition of lot front or lot depth. Corrmissioner Rogers asked where the driveway entrance for Lot 1, Block 2 will be. Mr. Gust noted it will be on l4lst Avenue. He also noted that the drainage will go to the east to the existing ditches. Councilman Elling felt that we should probably be looking at a full size cul-de-sac since it is going to be mmy years before anything is done with Phase II. Ms. Bosell also noted that the areas that are going to require fill need to be sho.vn as shaded on the plat. She also noted that the baseIlEI1t elevations in Phase II need to be sho.vn; also, the nurrber of linear road miles needs to be in the legend. Chris Dobbel, 2909 - l4lst Avenue N.W. - stated that they have standing water in the back comer of their lot and asked how the drainage from this plat will affect that situation. Mr. Gust noted that they will take care of the water that 1S standing in the Dobbel' s yard when they grade and fill the lots in this plat. Ken Slyzuk - asked if the water going to the ditch will be by pipe or over land. Mr. Gust stated it will be going over land. Suzanne Aldrich, 13860 Crocus Street N.W. - noted that Green Acres and Crocus Street have a big problem with traffic. The area cannot handle additional traffic. Mr. Schrantz asked Ms. Aldrich if she felt sidewalks would help to keep the kids off the streets. Ms. Aldrich felt perhaps they would help. Mr. Schrantz noted that Dahlia Street will have to be vacated if Phase II is done. He also noted that we have been trying to build Dahlia, but we are not accarrplishing that. This plat eliminates that possibility. Suzanne Aldrich stated that some of the people in Green Acres have a traffic problem but serre of the people who wanted Dahlia Street constructed were concerned with having another exit for errergency purtX)ses. 'I Mr. Gust questioned whether they could plat the whole thing and do the second phase as an outlot on the final plat. '!he smallest lot in Phase II could be OUtlot A and the rest of that property could be OUtlot B. O1.ainnan Jacobson felt that would be satisfactory, with the developer dedicating the easeIlEI1t for Dahlia Street to the city. Mr. Jacobson noted that Phase I indicates a terrporary cul-de-sac. He felt that the Planning Commission would go for the following: Phase I as sho.vn but as a condition of approving this plat, we would require that just into Phase II a nonnal cul-de-sac be constructed so we can get in and turn around. MYl'ION 'by Rogers, seconded by Bosell to close the public hearing. Motion carried unaninousiy. Regular Plarming Corrrnission Meeting November 26, 1985 - Minutes Page 4 (Smith's Green Acres, Cont.) Ken Gust noted that one of the things that the people in the area like is that the property is in a natural setting. If we construct a full cul-de-sac, we're going further into all the things they hold dearly. Mr. Jacobson stated that he could not vote for a 30 foot radius. Discussion was on what the radius should be, and whether the cul-de-sac should be blacktopped or only gravel. Mr. Schrantz noted that he would agree that a terrqJorary cul-de-sac paved would be better than a 120 foot gravel cul-de-sac. Camlissioner Rogers stated that he would like to see the cul-de-sac go to the end of phase I and be blacktopped. I-mION by Rogers, seconded by Bosell that the Andover Plarming and Zoning corrrnission recormend to the City Council approval of the preliminary plat of Smith's Green Acres described as 'Part of the Southeast Quarter of the Southwest Quarter of Section 28, Township 32, Range 24, Anoka County, Minnesota' for the following reasons: 1) The plat is in confonnance with the City Zoning Ordinance and the Comprehensive Plan; 2) The engineer has reviewed the plat; 3) The Park Board has recarnrended cash in lieu of land for park dedication. It should be noted that a public hearing was held and there was sc:nre opposition. IDt 1, Block 2 will require a variance for lot depth and width. A variance is also recormended for the width and depth of all of the lots in the plat, as they were platted to confonn to the existing lots in the area. A cul-de-sac at the property lines of Block 1, IDt 6 and Block 2, IDt 7, 30 foot radius will be a pennanent blacktop turn around which abuts the edge of Phase I. At the tine Phase II is fina1ed, the vacation of Dahlia Street will be held at a public hearing. In Phase II, IDt 4 will be Outlot A, IDt 7 will be Outlot B and the remainder of the property will be Outlot C. Motion carried unaninously. '!his will go to the City Council on December 17, 1985. Ordinance 46, Section 3A, Cont. (Conm. 1110-85-1) O1ainnan Jacobson explained that the concern was outdoor swimning rxx:>ls that are not fenced. He suggested that we arrend the ordinance to read: All outdoor pools here,- after constructed shall be completely enclosed by a fence or wall so as to be inpenetrab1e by tcxidlers, and a rnininn.1m of four feet in height, except that above ground rxx:>ls with a side wall height of at least 4 feet need not be fenced but shall have renovable steps. I-mION by Bosell, seconded by Rogers to recomrend to the City Council adoption of Ordinance No. 46B as presented. Motion carried unaninous1y. '!his will go to the City Council on December 17, 1985. Ordinance No.8, Section 7. 03, Hc:nre Day Care (Comn. # 11- 85-1). Regular Plarming Comnission Meeting November 26, 1985 - Minutes Page 5 (Ord. 8, Sec. 7.0.3, Cont.) Chairman Jacobson noted that this section of the ordinance dealing with the require- rrent for a Special Use Pennit for a day nursery is in conflict with state law and should be amended. He suggested that we leave day nursery in the ordinance and add (13 or lIDre children). Ordinance 8M will also have to be amended. A public hearing will be held on this ordinance amendment as soon as the publication requirenents are net. Chairman Jacobson noted that several of our ordinances list specific fees for appli- cations for various items. These should all be changed to read 'the fee will be set by Council resolution'. He asked that the Zoning Administrator go through the ordinances and list the ordinances where this is shawn so that they can be changed. Conmissioner Bosell noted that Ordinance 10., Section 7, 7.0.2 (/:i) should be changed (the 30. day requirenent). This item will be on the next Plarming Camnission agenda. It was noted that the second Plarming Comnission meeting for the lIDnth of Decerrber would be on Christmas Eve. It vIas the concensus of the Conmission that in the event any new items =ne in, the neeting will be held on December 19, 1985 rather than December 24, 1985.
