PLANNING AND ZONING COMMISSION MEETING - JUNE 22, 2004
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was
called to order by Chairperson Daninger on June 22, 2004, 7:02 p.m., at the Andover City
Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Commissioners present: Chairperson Daninger, Commissioners Tim Kirchoff, Tony
Gamache, Rex Greenwald (arrived at 7 :04 p.m.), and
Michael Casey.
Commissioners absent: Commissioners Jonathan Jasper and Dean Vatne.
Also present: City Planner, Courtney Bednarz

APPROVAL OF MINUTES.
June 8, 2004
Motion by Gamache, seconded by Casey, to approve the minutes as presented. Motion
carried on a4-ayes, O-nays, 3-absent (Greenwald, Jasper and Vatne) vote.
PUBLIC HEARING: LOT SPLIT (04-03) TO RE-ESTABLISH TWO RURAL
RESIDENTIAL LOTS AT 2043 158TH A VENUE N. fv.
Mr. Bednarz explained that the applicant is seeking to re-establish a property line
between two previously combined urban residential lots (Lots I and 2, Block I of
Nightingale Preserve). A house exists on lot 2. The proposed lot split would allow a
second home to be constructed on lot 1.
Mr. Bednarz explained Nightingale Preserve was created with a Planned Unit
Development (p.U.D). This approval allowed lots to be created at less than the minimum
2.5-acre size, provided private open spaces were created so that the final density of the
0 development was one lot per 2.5 acres. The lots would be split along the original

(,J property lines, so both lots would meet all size, setback, easement, access, park
dedication, and utility specifications approved when the property was originally platted.
Commissioner Kirchoff asked if this was at one time a rural P.U.D. Mr. Bednarz stated it
was.
Motion by Gamache, seconded by Kirchoff, to open the public hearing at 7:04 p.m.
Motion carried on as-ayes, O-nays, 2-absent (Jasper and Vatne) vote.
Mr. John McKelvey, 2043 158th Avenue NW, stated this was set up as a P.U.D. !
approximately six years ago and each lot is smaller than the 2 Y:z acres but it was done this
way to keep seventeen acres of open land in the center of the project. There are eleven
lots and all of the eleven lots own the seventeen acres. He stated five years ago, he
combined them for tax purposes and he is putting them up for sale and would like them
split again. ,
Motion by Greenwald, seconded by Gamache, to close the public hearing at 7:06 p.m.
Motion carried on as-ayes, O-nays, 2-absent (Jasper and Vatne) vote.
Motion by Gamache, seconded by Greenwald, to recommend to the City Council
approval of Resolution No. _, approving the lot split. Motion carried on as-ayes, 0-
~) nays, 2-absent (Jasper and Vatne) vote.
Mr. Bednarz stated that this item would be before the Council at the July 6, 2004 City
Council meeting.

WORK SESSION: SEWER STUDY AND SEWER STAGING.
Mr. Bednarz explained staff and the consulting fIrm of Toltz, King, Duvall & Anderson
(TKDA) have been working on the sanitary sewer study to serve the undeveloped area on
the east side of Andover, which will assist in revising the sewer staging plan in the City's
Comprehensive Plan.
Mr. Berkowitz stated the City Council approved the sewer study and recommendations
presented in the "Alternative Sanitary Sewer Trunk Extension Report" prepared by
TKDA and City Staff. The recommendation is to construct a by-pass lift station at
Yellow Pine Street NW and Crosstown Boulevard NW, which is referred to as the
Yellow Pine Alternative.
Mr. Berkowitz explained the report extensively reviewed several alternatives in serving
sanitary sewer to the remaining non-developed land east of Hanson Boulevard NW that is
within the existing MUSA boundary. As alternatives were researched, it was determined
Ü that in the future there are potential bottleneck or capacity issues in the sewer system at
full development. By constructing a by-pass lift station at Yellow Pine Street NW and

~ ) diverting the flow to the Pine Wood Trunk which is west of Hanson Boulevard NW,
additional sewer capacity is available to serve all the remaining developable acres within
the MUSA boundary. This option utilizes excess capacity in underdeveloped trunk lines
and alleviates the sewer line which would be over capacitated.
Mr. Berkowitz noted the Yellow Pine Alternative is a cost effective alternative that will
utilize system capacities to the full extent. This alternative also allows for flexibility to
accommodate reasonable density and timing of new development. The next stage is to
revise the sanitary sewer staging plan as part of a Comprehensive Plan amendment.
Commissioner Kirchoff stated earlier this spring there was a gentleman in the audience
that stated there were some miscalculations referring to property along 161 st. He
wondered if this study resolved the issue. Mr. Berkowitz stated through the report, there
was some question about how numbers were calculated and determined and they went
through that extensively to make sure that they were conservative with the report. He
stated they did address that.
Chairperson Daninger asked why they decided on the Yellow pine lift station instead of
another one. Mr. Berkowitz stated they looked at several options and this option worked
out the best. He stated the main reason was flexibility and feasibility.
" - ') Commissioner Gamache asked if putting the Yellow pine lift station in affect the
\" -~ neighborhoods at all in the area. Mr. Berkowitz stated in that location, they would be
utilizing that space. They would do everything they could to install a sound barrier and
help it fit into the neighborhood and be aesthetically pleasing.
Commissioner Greenwald asked how this will get paid. Mr. Berkowitz stated they have
sewer area and sewer connection charges that will pay for this. He noted all the new
development will fund this.
Commissioner Kirchoff noted that he got the impression that the report was good. Mr.
Berkowitz stated this was a reasonable solution so they can ensure that they do not have
capacity issues in the future. He noted they will be purchasing a flow meter so they can
anticipate increased flow per City Council request.
Mr. Berkowitz noted the by-pass lift station would not be construction until the area starts
to develop.
Commissioner Gamache stated he saw a proposed trunk line, a ten inch force main, going
right through Clock Tower Commons and he assumed that would be laid in the ground as
construction moves forward. Mr. Berkowitz stated they would use clliectional drilling for
the force main pipe. It would not need to be dug up.

/ Commissioner Greenwald asked about the timing and if the amount was a reasonable
number or did they anticipate this price going up. Mr. Berkowitz stated they increase the
price typically by inflation.
Commissioner Kirchoff asked what the 2.58 million dollars included. He wondered if
this would be for the entire project and if they would bond this out and then start charging
back. Mr. Berkowitz stated the lift station bypass would probably be constructed as one
project. He stated the 2.58 million would be for the lift station but would also include a
trunk line that would run up Crosstown Boulevard.
Mr. Bednarz stated they will be having neighborhood meetings regarding this issue.
Commissioner Kirchoff thought this will be helpful as they move forward.
OTHER BUSINESS.
Mr. Bednarz updated the Planning Commission on related items.
Commissioner Kirchoff mentioned there was a mailing that went out recently regarding
the water quality and he understood by the letter that it would take approximately one
year for the water to get to the best quality. Mr. Berkowitz stated this was a statement
they put out there becauSe the experts say that it takes about a year once the water
treatment plant is online to clean out all of the pipes and sediment that has accumulated.
He stated they saw a drastic change within the fIrst two months but they will continue to
monitor and clean the water. ;

Commissioner Kirchoff asked if there was a decision made on the property at 133rd. Mr. i
Bednarz stated the motion to approve failed in the City Council so the Council directed
staff to prepare a resolution of denial and will be reviewed at the July 6, 2004 City
Council meeting. He stated this item will not be seen by the Planning Commission
unless the applicant changes the plat.
