ANDOVER, MINNESOTA 55304 · (612) 755-5100 ANDOVER ECONOMIC DEVELOPMENT AUTHORITY MEETING DECEMBER 17, 1996 - MINUTES A Meeting of the Andover Economic Development Authority was called to order by Mayor Jack McKelvey on December 17, 1996, 11:10 p.m., at the Oak View Middle School" 15400 Hanson Boulevard NW, Andover, Minnesota. Present: Councilmembers Dehn (arrived at 11:14 p.m.), Jacobson, Knight Absent: Kunza Also present: City Attorney, William G. Hawkins City Engineer, Scott Erickson Community Development Director, Dave Carlberg City Administrator, Richard Fursman Others ADOPT 1997 EDA BUDGET MOTION by Jacobson, Seconded by Knight, approval of the 1997 Operating Budget for the EDA in the amount of $82,674 as presented by Staff. (See Resolution EDA002-96) Motion carried on a 4-Yes, I-Absent (Dehn) vote. :J DISCUSSION ACQUISITION/MISTELSKE/HEIDELBERGER (Councilmember Dehn returned at this time, 11:14 p.m.) Mr. Carlberg stated Staff is asking for direction on how to proceed regarding the acquisition of the Charles Mistelske property at 13576 Jay Street and the Richard Heidelberger properties at 2052 Bunker Lake Boulevard and a one-acre parcel at 197x Bunker Lake Boulevard NW. Richard Heidelberqer - stated he talked with Mr. Carlberg and Attorney Hawkins. He is willing to sell the back one-acre lot, and he was even at Mr. Hawkins' office, but it appears there has been a lack of communication in the legal description. Attorney Hawkins stated he prepared two purchase agreements so far and have sent copies to Mr. Heidelberger's attorney, but those agreements were never returned.. Soils testing has been done on the site, and it has been estimated soils corrections will be $41,000 to remove the buried debris and rubble and for removal of the oil contaminated soil. The report on Mom's Auto Salvage estimates a clean-up cost of $200,000. Mr. Heidelberqer - adamantly claimed there is no oil stain on that property. If there is, he alleged it happened when the City was allowed to use the site for grading. He asked for a copy of the report. Mr. Fursman briefly reviewed the results of the soils. testing report, 'J indicating the oil stain is in the front of the property and the burned ~ debris is located toward the rear of the lot. He noted Mr. Heidelberger can get a copy of the report at City Hall, as Staff did not have a copy at this meeting. A possibility would be to clean up the bil stain and ¡ ) ( ) I '-- , '- ~. That portion of the lot would be unbuildable, but it may be possible to use that area for something other than a building, possibly for landscaping or open space. In the price negotiations to purchase the lot, the unbuildable portion would be worth very little. He didn't advocate forcing all of the clean up on the property owner because he would get nothing for the property. Mr. Erickson stated the berm that was constructed between Commercial Boulevard and the residents and the stockpile of gravel are not on Mr. Heidelberger's lot. The Authority directed Staff and the Attorney to work with Mr. Heidelberger to determine whether the percentage of unbuildable area is acceptable and negotiate an agreement for acquisition. If it looks like the final computations show that most of the property is unbuildable, the item should be brought back to the EDA at a meeting in January. Charles Mistelske - asked if the City has had his property appraised. He would like to have an appraisal done, but not by Mr. Erickson. Attorney Hawkins also recommended that condemnation be ordered at this time. Negotiations for acquisition would still continue, but proceedings must begin now in the event negotiations fall through in order to be able to get on the property for the next construction \ season. ) MOTION by Jacobson, Seconded by Knight, to authorize the City Attorney to begin the process of condemnation on all three parcels (the two parcels of Richard Heidelberger and one of Charles Mistelske) and order an appraisal by an appraiser other than Mr. Erickson, and also to direct Staff and the Attorney to continue negotiating with all owners even though condemnation proceedings are on-going in the hopes of reaching a mutually satisfactory agreement for finalization of that land procurement. Motion carried on a 3 -Yes, I-No (Dehn, opposed to the condemnation process) vote. MOTION by Knight, Seconded by Dehn, to close the EDA meeting. Motion carried unanimously.
