Adjourn . -) CJ ( '\ \.J () CITY of ANDOVER ANDOVER ECONOMIC DEVELOPMENT AUTHORITY MEETING SEPTEMBEJ,l17, 2002 - MINUTES A Meeting of the Andover EconomicDevelopment Authority was called to order by Vice President Trude, September 17,2002,6:34 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Present: Commissioners Don Jacobson, Mike Knight, Ken Orttel; Voting resident member Robert Nowak; and Non-voting resident member Edward Schultz Absent: ,President Gamache, Voting resident member Terry Hokanson, Non-voting resident member Fred Larson Also present: Executive Director, John Erar Community Development Director, Will Neumeister City Engineer, Scott Erickson City Finance Director, Jim Dickinson 0 City Attorney, William Hawkins Others AGENDA APPROVAL Add Item 3, (Alta Survey:'Andover Station North Update). MOTION by Knight, Seconded by Jacobson, to approve the Agenda as amended above. Motion carried 5 ayes, 0 nay, 2 absent (Gamache, Hokanson). APPROVAL OF MINUTES August 14, 2002: Correct as written. MISTELSKE RELOCATION BENEFITS CLAIM ' 0 Executive Director Erar explained the EDAis requested to appoint a hearing examiner to consider the administrative appeal ofMr. Mistelske regarding a denial of his relocation claim as untimely. u U í---" Andover Economic Development Authority Meeting \J Minutes - September 17, 2002 Page 2 I City Attorney Hawkins explained the item and discussed the information provided by Assistant City Attorney Barry Sullivan regarding the need for the EDA to appoint a hearing examiner. Commissioner Trude asked why they are able to appeal when the statue of limitation has run out. City Attorney Hawkins stated that was what they were appealing. Commissioner Orttel asked if they had a case. City Attorney Hawkins stated he did not believe they did. He stated ifthe case were settled today, Mr. Mistelske still would not accept the forty thousand dollars. Motion by Knight, Seconded by Jacobson, approval of Mr. Randall Schumacher as hearing examiner to consider the appeal ofMr. Mistelske for additional relocation benefits. Motion carried 5 ayes, 0 nay, 2 absent (Gamache, Hokanson). o VERLA Y ZONING FOR ANDOVER STATION NORTH - UPDATE 0 Community Development Director Neumeister explained that over the past two weeks, the planning staff had prepared a draft of an Overlay Zoning District for the area known as "Andover Station North" and submitted it to the City Attorney for review. Upon review, the City Attorney recommended that the ED A/City would be best advised to make changes to the Andover Station Covenants and Design Guidelines rather than creating a new Overlay Zoning District. Mr. Neumeister stated the changes are primarily focused on two areas. Rooftop mechanical equipment being screened using parapet walls and architectural materials allowed to be used shall be upgraded to limit the use of plain or break off block and establish that more brick is needed on the buildings(s). Commissioner Trude stated on the architectural materials item, it is hard for the EDA to go to the business and tell them they need a nicer looking building in an area that is not upper grade. Commissioner Knight asked if Tanners triggered this. Mr. Neumeister stated the rooftop mechanical equipment triggered it. They would like to limit the use of the less desirable block material and encourage them to use nicer block. Commissioner Orttel stated they have people interested in the property and they should negotiate with them on a one on one basis. Mr. Erar stated these are not new standards. They are standards the EDA used on the primary Andover Station Site. The only difference is they want to incorporate the verbiage into the documents. eJ ANDOVER STATION NORTH DEVELOPMENT UPDATE ~) 0 (~, Andover Economic Development Authority Meeting \,--) Minutes - September 17, 2002 Page 3 Mr. Erar discussed the Alta Survey and RFP with the Board. A copy of the survey has been submitted to Ryan Companies. At this time the floodplain is where Target is looking at developing. He stated they would like to move forward and make some adjustments to the flood plain in both areas to make a more tenable site for development. Commissioner Orttel asked if they have been delineated. Mr. Erar stated they have not; they want to go through an adjustment process. Commissioner Trude asked what the process would be. City Engineer Erickson stated it would be to adjust the floodplain. Commissioner Orttel stated with a survey they would be able to determine the flood plane better because most of the land seems to be dry. Mr. Erar stated they have received four proposals and they would be reviewing them this week. They will need to set up another EDA meeting to discuss the proposals. Commissioner Orttel asked why they would be bidding the engineering services at a flat fee rate. Mr. Erickson stated normal engineering work is at a percentage basis where here they are bidding not to exceed a set amount. (J Motion by Orttel, Seconded by Jacobson to approve the Alta Survey to be done to determine an accurate floodplain adjustment. Motion carried 5 ayes, 0 nay, 2 absent (Gamache, Hokanson). ANDOVER STATION RESIDENTIAL DEVELOPMENT - VERBAL UPDATE Mr. Erar updated the Board on the Andover Station Residential Development. Commissioner Trude asked what is happening with BOZ Construction. Mr. Erar stated Bos Construction has withdrawn from the site. He stated the reason they have withdrawn is because of limited experience with multi-family housing and lack of development knowledge with development of housing. He stated they are builders, not developers. I Mr. Erar stated United Properties is talking to two new developers regarding this site and realize they need to move the project along. He noted that with BOZ Construction withdrawing, this ¡ would probably delay the project until next spring. OTHER BUSINESS Mr. Erar stated Festival Foods has moved back the grand opening two weeks. The tenant spaces ("\ are moving forward and the curb and gutter is in and landscaping is in full swing. U Commissioner Trude stated at a future EDA meeting they should talk about financing the Community Center. Mr. Erar stated they wanted the Alta Survey first. This will be brought back to the EDA with any requests Ryan Companies may have regarding the site.
