Home My WebLink About1973 - TOWNSHIP OF GROW COUNTY OF ANOKA STATE OF MINNESOTA RESOLUTION WHEREAS, commensurate with the adoption on April 11, 1972, of a Resolution establishing the Grow Township Zoning and Planning Commission, the Grow Township Board of Supervisors deems it .appropriate to review the purpose and intent of all Township ordinances with special emphasis placed on Ordinance No.8, Zoning Regulations, and Ordinance No. 10, Subdividing and Platting, and; VlHEREAS, the current intensive development of Grow Township manifestly increases the importance of adhering to the provisions of the Ordinances, and; WHEREAS, since adoption of Ordinance No.8 on October 21, 1970, a number of willful or inadvertant violations of the Ordinance not in accord with the long range goals and objectives of the community have been documented, and; VlHEREAS, the citizens of Grow Township have a right to believe that properties with which they are concerned will indeed be developed in accordance with the provisions of the Ordinances, NOW, THEREFORE, BE IT RESOLVED, that the Zoning and Planning Commission interpret and apply the provisions of the Ordinances impartially, consistently, judiciously and comprehensively, thereby promoting the orderly development of the residential, business, industrial, recreational and public areas of the Township of Grow. - The foregoing Resolution was moved and adopted -2- at a meeting of the Grow Township Board of Supervisors held at Crooked Lake Elementary School at //.'35;' P.¡17ø on ") /1 It) (.l A~1 , 9Th , 1973. ~ ('K .~ t7'Cl:J\N1,~ . TOWNSHIP OF GROW I COUNTY OF ANOKA STATE OF MINNESOTA RESOLUTION AUTHORIZING INTERVENTION IN LEGAL ACTION CHALLENGING 1973 COST ALLOCATION OF METROPOLITAN SEWER BOARD AND METROPOLITAN COUNCIL. Supervisor moved adoption of the following Resolution: WHEREAS, the Township of Grow has over the past five years experienced ever increasing urban growth and; WHEREAS, portions of Grow Township lie within the Metropolitan Sewer Board District #2, District #3, and peripheral areas and; WHEREAS, a Metropolitan Sewer Board interceptor now abutts the southern boundary of Grow Township, thereby making said Township liable for participation in the payment of Metropolitan Sewer Board operating costs and bonded indebtedness retirement and; WHEREAS, the Metropolitan Sewer Board's previous cost J allocation system resulted in an initial 1972 billing of approximately $54,000.00 to Grow Township, with said Township presently ha~ an annual budget of less than $90,000.00 per year and; h~ WHEREAS, Grow Township found the collection of and payment of said cost allocation to be impractical and inequitable to the citizens of Grow Township and; WHEREAS, Grow Township finds the 1973 cost allocation system as set out in the Metropolitan Sewer Board's 1973 operating budget to be a practical, reasonable, and equitable method of collecting and paying said Township's fair share of the Metropolitan Sewer Board's current and reserve capacity costs and; WHEREAS, the City of Brooklyn Center and various other municipalities have commenced legal action challenging the allocation of current costs of reserve capacity adopted by the Metropolitan Sewer Board and Metropolitan Council as part of the Board's 1973 operating budget, wherein they allege that such allocation is not practical, reasonable or equitable, and is contrary to law. WITNESSETH: WHEREAS, the Township deems it desirable to be relieved of the responsibility for ownership and maintenance of that certain town road ) known as Nightengale Street in Sections 15 and 22, Township 32, Range 24; and . - WHEREAS, the County deems it desirable to provide a connecting County link between County State Aid Highway No. 18 and County State Aid HighHay No. 20, and said link could be made by establishing Nightengale Street as a County Road; and ì-lHEREAS , the parties hereto desire to exercise their respective powers \ in a mutual accord in the manner provided by law. ". ) NOW, THEREFORE, in consideration of the mutual covenants expressed herein, it is stipulated and agreed as follows: l. The County shall proceed to do the necessary engineering, planning and study and determine the engineering changes necessary to bring Nightengale Street up to County Road Standards. 2. The County shall proceed to define and describe any centerline . / variations from the present centerline. 3. The County shall proceed to acquire in its name highway easements sufficient to provide one hundred twenty (120) feet of right-of-way along the designated centerline. J " , , \ ) I Lf. The County shall, in the manner provided by law, establish said road as a County road. 5. The Tmmship shall reimburse the County for the amount of money expended for the right-of-way acquisition required in paragraph 3 ab ave. This amount shall consist of land costs only and will not include administrative expense. Payments are due to the County as follows: A. 50% due upon certification from the County Engineer that 50% of the total right-of-way has \ been acquired. \.. ) B. Remaining 50% due upon certification that right-of- way acquisition is complete. In the event it appears during construction that some unexpected additional right-of-way is required, payment will be due upon acquisition. . \ l IT IS FURTHER STIPULATED AND AGREED, that prior to commencement of right- \~ of-way acquisition proceedings, there shall be given in writing, approval by the Township of the centerline proposed by the County.
