WHEREAS, the Andover Planning and Zoning Commis sion has reviewed the Variance Request presented by Darkenwald Real Estate, Inc., and WHEREAS, after such review the Andover Planning and Zoning Commission has recommended approval of the request, and I I I WHEREAS, the Planning and Zoning Commis sion has set forth their I reasons for said recommendation. WHEREAS, Andover Ordinance No. 10 prohibits development of lots containing less than 39, 000 square feet in areas not serviced by public sewer, and WHEREAS, the Final Plat of."The Oaks" was approved by the Andover City Council with no provisions in said approval for the development of lots in accordance with Ordinance No. 1 0, and WHEREAS, the City of Andover issued building permits on three (3) consecutive lots in violation of the provisions of Ordinance No. 8 and Ordinance No. 1 0, and WHEREAS, the City Staff has requested a variance on those lots containing residential dwellings, and WHEREAS, the City Staff is requesting clarification on the issuance of building permits on the remaining lots. Andover, Minnesota 55303 Dear Mayor Schneider, I have discussed the following request with Jerry Lapham, Chairman of the Andover Parks & Recreation Commission, and he recommended that I bring the matter before the Council. It is my understanding that he personally favors the proposal, but that it has not been reviewed with the full park committee. It was his feeling that expediency is served by making the request directly to the City Council. As you and every member of the Council is aware, our neighborhood has created ) a true recreational park on property which is privately owned by my wife and me. At the present time the park consists of a full-sized ballfield which is used extensively by Little League ball players, an organized girls' softball league, mens' softball leagues, etc. We also have an area provided for infield practice when the regular ballfield is in use. At the south end of the property we have constructed a skating rink which includes lights and a well. The entire project has been made possible only through the contribution of time and money by private individuals and business enterprises. I was just recently informed by my insurance company that they will no longer insure me and my family from any legal suit that may arise as a result of the use of these recreational areas. I am told that a liability policy can be purchased, but that it is very expensive and subject to cancellation at virtually any time. I then discussed the matter with my attorney, because this type of liability exposure is simply a risk which I cannot bear. He suggested that the following is a workable solution and has been used in other communities: 1. Lease the subject property to the City for one dollar per year. 2. Request that the City hold me and my family harmless from any claims that may result from the use of this property. 3. During the lease period the City would be covered in the same manner it is protected when its other properties are in use. ) · '\. , / \ ) / I The Honorable Richard J. Schneider November 24, 1976 Page Two I am requesting that the Council review this matter as soon as possible. We as a neighborhood are in the process of flooding the rink and this matter is of utmost importance to all of us. Because my home is adjacent to the property, it is my property which would be leased and I have assumed the responsibility in past years, I am requesting that the City allow me the authority to supervise and oversee this park area. It should be noted that we have particular matters that are resolved at neighborhood meetings, such as working out schedules, maintenance of the grounds, snow removal, etc. We are not asking for the help of any City employees, nor do we expect it. This letter does not in any way request a single penny of expenditure by the City. We merely ask for the Council to recognize the problem that we have and take action on our behalf assuming that the City's legal counsel approves of this proposal. Hawkins Jerry Lapham ¡ J , ) \.J t Page 6 DRAFT ORDINANCE AN ORDINANCE PROVIDING FOR CITY OF ANDOVER TRUNK WATER CONNECTION CHARGE The City Council of Andover, Minnesota does ordain Ordinance No. of the Andover Municipal Code as follows: APPLICA TION FOR PERMIT. Any person desiring a permit to connect to the City Water System shall make written application to the City Clerk on a form furnished by the City. Applications shall 'contain exact description of the property to be served, estimated amount of water to be used per month, and the uses to which the water is put, and such other information as may be reasonably required. /' Before a permit is issued allowing a connection to a waterline or main in the City there shall be paid a connection fee of $1,000 for each service availability charge unit assessed to the connection. For the purposes of this section, the City trunk water availability charge unit will be computed as follows: 1. Single family houses, townhouses, and duplex units shall each compris e one unit. 2. Condominiums and apartments shall each comprise 80% of a uni t. 3. Mobile homes shall each comprise 80% of a unit. 4. Other buildings and structures shall be assigned one unit for each 100,000 gallons of flow which is estimated they will consume; and commercial and industrial structures shall be assigned a minimum of one unit. . The City trunk water availability charge for a facility not included in the above list will be determined by the City Council. A request for a trunk water availability charge unit determination should be made prior to the is suance of the building permit. Structures which contain two or more facilities shall be charged a combined amount equal to the total water availability charge for each facility. The City trunk water availability charge unit shall be a whole number, with fra ctional portions resulting from calculations rounded to the nearest whole number. The minimum City trunk water availability charge shall be $1,000.00. This ordinance shall become effective upon its publication. WHEREAS, the City of Andover is promoting the development of a quality park system and recreation program consistent with the financial capability of the community; and WHEREAS, the City Council has the authority to establish commissions to advise the City Council with respect to policy formulation for municipal functions and activities; and WHEREAS, as a consequence of the increasing complexity of the park and recreation function it is desirable to establish a Park and Recreation Commission; and ~VHEREAS, it is acknowledged that the significance of the park and recreation function is such that it must be effectively responsive to the citizenry; and WHEREAS, in pursuit of such goals the City Council recognizes the need to define the duties and responsibilities to be assigned a Park and Recreation Commission: NOW THEREFORE BE IT RESOLVED by the City Council of the City of Andover that there is hereby established within the City an advisory Park and Recreation Commission as follows: SECTION 1. TITLE: This organization shall be known as the Andover Park and Recreation Commission. SECTION 2. SCOPE: The scope of activity of this Commission shall consist of advising the City Council and other advisory commissions regarding matters relevant to the park and recreation function. SECTION 3. PURPOSE: The general purpose of this Commission is to monitor and reflect the attitudes and concerns of the citizens of Andover relative to the park system and recreation programs, and to advise the City Council of citizen attitudes and policy matters relevant to the park and recreation function in Andover. SECTION 4. DUTIES AND RESPONSIBILITIES: In fulfillment of its purpose, the duties and responsibilities of the Commission shall be to: SUBDIVISION 1. Develop, recommend, and, upon adoption by the City Council, monitor the execution of a comprehensive plan for park and recreation function in the City of Andover. SUBDIVISION 2. Report to the City Council regarding achievements toward fulfillment of such comprehensive plan and recommend amendments to the plan as may be warranted. SUBDIVISION 3. Frequently visit the City's parks and keep informed of current recreation programs in order to continually review and evaluate park system development and recreation programming. SUBDIVISION 4. Develop and recommend methods to stimulate positive public interest in the park and recreation function. - ~ 'Page 2 SUBDIVISION 5. Serve as a forum for the citizens of Andover to voice their opinions regarding the park and recreation function. SUBDIVISION 6. Promote coordination with the school districts serving Andover, encouraging the interchangeable use of city and school distruct facilities and programs to the best interests of citizens. SUBDIVISION 7. Encourage dissemination of information to, and coordinate with, organizations interested in the park and recreation function such as athletic groups, youth groups, civic organizations, and the like. SUBDIVISION 8. Develop and recommend feasible methods to promote programs relative to conservation of the environment. SUBDIVISION 9. Encourage coordination with other communities and agencies to the extent appropriate in matters pertinent to the park and recreation function. SUBDIVISION 10. Monitor and reflect attitudes and concerns of citizens relative to the park system and recreation programs through informal contacts and structured meetings. SUBDIVISION 11. The Chairman shall coordinate maintenance and constructión of City parks with the Administrator or Assistant Administrator. SECTION 5. COHPOSITION: The Commission shall be composed of a chairman and six members, all of whom shall be appointed and serve as set forth in Section 6. SECTION 6. MEMBERS METHOD OF SELECTION - TER}l OF OFFICE - REMOVAL: SUBDIVISION 1. CHAIm-fAN: The City Council, by a majority vote shall appoint and/or remove the Commission Chairman and the individual Commission members. The Chairman shall assure fulfillment of the following responsibilities in addition to those otherwise described herein: SUBDIVISION 1a. Preside over meeting of the Commission; SUBDIVISION lb. Appear or appoint a representative to appear, as necessary, before City advisory commissions and the City Council to present the viewpoint of the Commission on matters pertaining to the park and recreation function as it relates to business under consideration by said Commission or City Council; SUBDIVISION lc. Review all City Council, Planning Commission and other advisory commission minutes and inform the Park and Recreation Commission of matters therein relevant to the park and recreation function; SUBDIVISION ld. Provide liaison with other governmental and volunteer units in matters relating to the park and recreation function for the purpose of obtaining and providing timely information. SUBDIVISION 2. VICE CHAIRHAN: A Vice Chairman shall be appointed annually by the Chairman. The Vice Chairman shall perform such . '.rage .;¡ ) duties as may be assigned by the Chairman and shall assume responsibilities of the chair in the absence of the Chairman. SUBDIVISION 3. l1EMBER'S TERM OF OFFICE: Members of the Commission shall be appointed by the City Council for terms of three years, e:ccept that any person appointed to fill a vacancy occuring prior to the expiration of the term for which his predecessor was appointed shall be appointed only for the remainder of such term. Upon expiration of his term of office, a member shall continue to serve until his Successor is appointed and shall have qualified. SUBDIVISION 4. QUALIFICATION FOR MEMBERSHIP: Shall be as set forth in the Selection Process of the Park and Recreation Commission. SUBDIVISION 5. INITIAL APPOI~~T: The Commission shall become effective , and shall consist of three members appointed for a term through 1978, two members appointed for a term through 1977, and two members appointed for a term through 1976. SUBDIVISION 6. RESIGNATIONS - REMOVAL FROM OFFICE - VACANCIES: Commissioners may resign voluntarily or may be removed from office by the City Council. Three consecutive unexcused absences from duly called Commission meetings shall constitute automatic resignation from office. Vacancies in the Commission shall be filled by appointment of the City Council. SUBDIVISION 7. COHPENSATION: Commission members shall receive a perdiem compensation to cover incidental expenses, not to exceed $100 per year per member. SECTION 7. RULES AND PROCEDURES: The Commission shall adopt such rules and procedures not inconsistent with these provisions as may be necessary for the proper execution and conduct of business. SECTION 8. HEETINGS: The initial meeting of the Commission shall be convened at the call of the Chairman during 1976. Thereafter regular meetings shall be held with date and time to be determined by the Commission. Special meeting may be called by the Chairman. SUBDIVISION 9. EX OFFICIO MEMBERS: The Mayor or his appointee may serve as an ex officiò member of the Commission privileged to speak on any matter but without a vote, and shall provide a liaison between the Commission and the City Council. Prior to the tenth (10th) day of the billing month, the City will prepare and mail to the sanitary sewer customers a billing to include all known charges due the City as of the last day of the quarter preceeding the billing date. The quarterly fee will be $15.00, or as otherwise stated in Ordinance No. 32, Section VIII, or as amended by ordinance or resolution. Any charges due as of the billing date of less than $5.00 will not be billed at that time, but will be added to the next succeeding quarter's charges, except for finalbillings. If all charges billed have not been paid by the 25th day of the month of billing, a penalty of ten percent shall be added to that part unpaid. The determination of having been timely paid shall be actual receipt of the funds in the City Office, or mailed at such time to show a postmark of the due date or earlier. All unpaid balances over $5. 00 as of September 1 of any year may be certified by the Clerk for assessment against the property connected to the sewer system, and forwarded to the County Auditor for collecFon, as authorized by Ordinance Nú. 32 Section VIII, and Minnesota State Law. An additional charge of 15% will be added to help offset the costs of assessment. An interest rate on the amount assessed will be set by the City in an amount authorized by State Law. W., and WHEREAS, the present alignment is not an ideal street alignment and creates a dangerous intersection for traffic travelling to and from the Green Acres Area, and WHEREAS, said realignment would provide a safer access to the City Parkland. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Andover, to authorize realignment of Crocus Street N. Adopted this 5th day of February 1976. , \ ~/. , '\ '.-) 10-10 / CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA RESOLUTION TERMINATING BITUMINOUS STREETS AND STORM SEHER IN THE NORTHWOODS AREA WHEREAS, the City does not have a Comprehensive Storm Drainage Plan at this time, and WHEREAS, the construction of storm sewers in the Northwood Addition may require oversizing to serve areas to the east, and WHEREAS, áfter completion of the Comprehensive Storm Drainage Plan, the questions of areas to be served will be answered and the City will be assured of a proper construction program, and WHEREAS, the sanitary sewers to be installed in l38th Avenue N.W., Crocus Street N.W. and l40th Avenue N. W. will be 15-25 feet deep, and WHEREAS, the engineer does prefer to let the excavated trenches settle one year prior to paving, and WHEREAS, the majority of the petitioners were not in favor of the construction at this time. Lindquist, Clerk 76-11R CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA A RESOLUTION ENDORSING THE LEGISLATIVE REDISTRICTING OF THE CITIES OF ANDOVER AND ANOKA WHEREAS the incorporation of the City of Andover did provide different municipal boundaries than previously contained the Township of Grow, and WHEREAS the previously established boundary between Legislative Districts 19A and 19B does provide some small parts of District 19A within the City of Andover, and WHEREAS the number of voters (87) in the area of Andover presently within District 19A does not make a feasible election precinct, and \~EREAS combining two feasible representative districts within one precinct promotes confusion, misunderstanding and error within the voting process, and WHEREAS the most practical solution to the problem appears to be a legislative districting that will eliminate District 19A from the City of Andover, and \1HEREAS such redistricting should be effective prior to the September 1976 primary election, NOW THEREFORE BE IT RESOLVED that the Andover City Council does endorse and support Senate Files 252 and 330 as introduced by Senator Jerald C. Anderson, and encourages their adoption into law as soon as practical. .xI~ \ 76-9 CITY OF ANDOVER COUNTY OF ANOKA STATE OF MINNESOTA RESOLUTION APPROVING FIRE CONTRACT FOR 1976 WHEREAS the City of Andover is unable to provide fire protection for its citizens with its own personnel and equipment, and WHEREAS the City of Anoka has offered to provide such fire protection on a contractual basis, NOW THEREFORE BE IT RESOLVED that the City Council of the City of Andover does approve the contract for fire protection for the year 1976 with the City of Anoka, and authorizes the l1ayor and Clerk to affix their signatures thereto. Lindquist, Clerk 76-7 , ) CITY OF ANDOVER COUNTY OF ANOKA STATE OF HINNESOTA RESOLUTION ENDORSING THE CONCEPT OF AN ANDOVERATHL~TIC ASSOCIATION WHEREAS the citizenry of the City of Andover does include several thousand young people, and WHEREAS the City of Andover has some recreational facilities for those young people and does plan more facilities, and WHEREAS the City is not able to provide the broad range of recreational programs of interest to these young people, and WHEREAS such programs can be undertaken by a volunteer athletic association, NOW THEREFORE BE IT RESOLVED that the City of Andover does encourage and endorse the formation of such an Andover Athletic Association, the City will provide athletic fielàs ÿ' and maintain them to the best of its ability. That' said Andover Athletic Association be conducted on a voluntary basis supported in part by the City of Andover. Such City participation to consist of provid:tng: facilities and maintenance of facilities, monetary assistance with official's salaries and equipment. That said Association be primarily financed by registration fees, business membership, and Association-sponsored fund raising projects. Further, said Association be accountable for annual expenditures of City fundj.ng for each program \1ith budgets submitted and approved prior to January 1 of each year. That the Park and Recreation Board of the City of Andover act as liason between the City of Andover Council and the Athletic Association. That the Park and Recreation Board of the City of Andover coordinate all City participation of the Assoc1~tion's various progr:J.ms. That each sport or progr~m established by the Association submit a budget outlining requested City participation or funding.
