MINUTES
The Regular Bi-Monthly Meeting of the Andover City Council was called to order by Mayor Mike
Gamache, March 1,2004,7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, 11innesotL

Councilmember Jacobson stated on Item 4, it talks about putting up no parking signs and he thought
they also discussed marking the crosswalk better than it was marked and he would like to add that.
On Item 5, it should be subject to the cost sharing on the signal of $50,000 as proposed by the
County. City Engineer Berkowitz stated one attachment on Item 5 was a letter from the Anoka
County Highway Department and they have stated that the $50,000 contribution would be payable in
2005 as part of this project. Councilmember Jacobson stated he read the information differently and
there was no guarantee of the money from Anoka County.

HOLD PUBLIC HEARING/04-2/0RDER PLANS & SPECIFlCATlONS/2004 OVERLAYS
City Engineer Berkowitz explained the City Council is requested to hold a public hearing at 7:00
p.m, for Project 04-4, for street mill and overlay in the area of Kiowa Terrace & Valley View Estates
2nd Addition.
Mr. Berkowitz stated a feasibility report was previously prepared for this improvement and was
submitted to the City Council at the February 17,2004 City Council meeting. The project identified
consists of milling the existing bituminous, shaping the gravel, constructing concrete curb and gutter
and placing a new layer of bituminous for the above listed developments. This project is included in
the CiIy's CIP and has been initiated by the city which requires a 4/5 vote from the City Council to
proceed.
Mr. Berkowitz stated the total project cost is estimated at $336,326.72. The City portion is estimated
at $208,316.55 and the assessed cost would be $128,010.18.
Councilmember Jacobson asked for the cross section of the curbing to be shovl'n and an explanation
as to why this needs to be done. Mr. Berkowitz stated when you do not have concrete curbing on a
roadway water tends to sit on the pavement and does not drain properly which will eat away at the
roadway.

Councilmember Trude asked if this affects the longevity of the pavement surface as well. Mr.
Berkowitz stated the concrete curb tends to keep the bituminous in place.
Councilmember Jacobson stated there was a meeting held in the neighborhood and he wondered how
many people attended. Mr. Berkowitz stated they did have a meeting and residents who attended
were from Valley View Estates Second Addition. The questions related to why they have the
concrete curb and other issues of the roadway itself not needing repair and through the pavement
management program, it was determined the rating was high enough to warrant repairs. As part of
that meeting they were looking at feedback on drainage issues so that could be corrected as well.
Mayor Gamache asked how they came up with a rating on the road, Mr. Berkowitz stated they have
a pavement management program and every three years they go through and rate a different section
of the roadway. They take into consideration cracking, potholes and any patches that were in the
street and by doing that they establish an overall condition index (OCI) from zero to one hundred and
it shows what their needs are to keep their system up throughout the years. He stated on average,
they are running in the upper seventies and the roadways overall are in good shape. They are trying
to keep everything at a minimum of seventy.
Councilmember Orttel asked if oruy the residents of Valley View showed up and there was not
anyone from Kiowa Terrace. Mr. Berkowitz stated this was correct.
Councilmember Orttel stated the City pays for the roadways in the City and the City standard
requires concrete curb and gutter and the adjoining properties pay for that. A lot of what was talked
about had to do with drainage. He wondered ifboth of the areas were curbed areas so they would not
need to put in any pipes or ditches. Mr. Berkowitz stated that was correct and they have all of the
easements and storm drains in place, The on1y thing they will do as part of this project is look at the
storm sewer and if it needs repairs, it will be repaired at that time. He stated it currently has
bituminous curb.
Motion by Jacobson, Seconded by Trude, to open the public hearing at 7: 17 p.m. Motion carried
unanimously.
Mr. Steve Herrala, 3855 Valley View Drive, stated the neighbors feel there is some reason for
redoing the roads especially in the low area where water builds up. The concern they have is
currently looking at the roads and looking at the asphalt coming up as opposed to the concrete curbs.
He did not know if the curbs in their neighborhood are necessary. Mr. Berkowitz stated regarding
the curb, in 1988, one of the big issues with bituminous curb was the snow plow ruining the curbs.
Another challenge is the actual construction of bituminous curb because it is more difficult to
construct.
Councilmember Trude thought the cost for concrete curb has come down immensely so there is not
much of a difference in cost between bituminous curb and concrete curb. Mr. Berkowitz stated the
cost of concrete is still a little bit higher than bituminous curb but bituminous curb is not as common
as it used to be.

Councilmember Trude stated concrete curb is nicer because it drains so well,
Mr. Herrala stated in their situation, there is a slope in every direction and if it sits anywhere, it will
sit in the bottom. He showed on the map the slope in their development.
Councilmember Jacobson asked if the existing bituminous is an inch and a half or two inches, Mr,
Berkowitz stated it is his understanding that it is an inch and a half. Councilmember Jacobson stated
if rebuilt, it would be built up to two inches,
Mr. HerraIa did not think the streets need work except in the area where there is a drainage issue.
Mr. Berkowitz stated the pavement section in that area was seal coated six or seven years ago and
when you look at the surface, the pavement is alligator cracked and they will be seeing potholes
develop and the roadway start to crumble and that is the reason it needs to be repaired.
Councilmember Jacobson stated the cost to do this at this time would be lower than what they would
be in the future because interest rates are very low.
Dan Nelson, 3844 17151 Circle, asked how the notice is given to the residents and how was the
$3,000 dollar number figured for assessment. Mr. Berkowitz stated they look at each development
by itself to determine the cost. As part of the City's Capital Improvement Plan, they have designated
for the next five years, which developments are going to be proposed for reconstruction. When it
comes to the year of construction, as soon as the CIP is approved, they schedule a neighborhood
informational meeting to discuss the proposed project and any issues and then they send out official
notices to schedule a public hearing and what the dollar amount will be for the project to the
residents,
Ms. Jean Gephardt, 1570 I Makah Circle, stated the map shows the cul-de-sac going in a circle which
it does not. She stated it sounds like the project is going to go forward. She stated they have been
there for twenty-six years and the bituminous has been great and they have not had any drainage
problems. They live at the end of the cul-de-sac and everything drains down, She wondered ifit will
curve the cul-de-sac and whose property does that become and do they sod it or does the City sod it.
What happens at the end of their driveways? Does the concrete curb put a concrete apron and do
they pull up part of their driveways as well? Mr. Berkowitz explained the process that will happen
for the proj ect.
Councilmember Trude explained that the assessment does not need to be paid all at once; it can be
spread out over time. Mr. Berkowitz stated their assessments can be paid over five years.
Councilmember Orttel asked if their CIP was on the website. Mr. Dickinson stated it is,
CounciImember Orttel thought it would be a nice idea to put a map up showing when the different
areas would be done.
Councilmember Jacobson stated if this passes, when will the assessment first show up on real estate

taxes for people who do not want to pay this all at once. Mr. Dickinson stated it would show up in
May 2005.
Mr. Berkowitz stated if the project goes through, they would look at starting the project in early June
and it would continue through August.
Mr. Mike Koontz, 15821 Makah Street, stated in the development they just did in their
neighborhood, they did not put any curbing in because there is not any drainage in there. Mr.
Berkowitz stated in that area, the stonn sewer consists of an existing ditch system without any
bituminous curb, ponds or stonn sewer and all of the water is conveyed through the ditch system. In
that case, they would have to do a complete redesign and there has not been any ponding designed
for it so they leave the street as is.
Motion by Jacobson, Seconded by Orttel, to close the public hearing at 7:45 p.m. Motion carried
unanimously.
Motion by Orttel, Seconded by Jacobson, to approve the resolution ordering the improvement of
Project 04-2, street mill and overlay in the area of Kiowa Terrace & Valley View Estates 2nd
Addition and order plans and specifications for the entire 2004 Overlay Project which include the
following additional developments: Cedar Crest Estates, Cedar Crest Estates 2nd Addition, Lake
Ridge and Lakeside Estates 2nd Addition. Motion carried unanimously. (Res. R040-04)
ACCEPT FEASIBILITY REPORTIWAlVE PUBLIC HEARlNG/04-9/CROSSTOWN
MEADOWS
City Engineer Berkowitz explained a feasibility report has been prepared identifying the
improvements and estimated improvement costs associated with the Crosstown Meadows
development project.
Motion by Jacobson, Seconded by Trude, to approve the resolution accepting the feasibility study,
waiving public hearing and directing preparation of plans and specifications for Project 04-9,
Crosstown Meadows for sanitary sewer, water main, streets and stonn sewer. (Res. R04I-04)
Mayor Gamache asked when they are doing the sewer and water, do they know how it will affect
traffic on 141 st Lane and I42nd Avenue. Mr. Berkowitz stated the connections should take one day
and they will have a one day closure, They will not close both down at once. They will have proper
traffic control and divert traffic to other areas.
Mayor Gamache stated in under budget impact staff recommended the trail be constructed as part of
this project. Is that in the resolution? Mr. Berkowitz stated it was.

DISCUSS ANOKA COUNTY PLAT COMMISSION LEGISLATION
City Administrator Erar explained Anoka County is seeking legislation that would provide county
boards with approval authority on city preliminary plat applications or initial plat filings which abut
any County roadway, highway and county state-aid highway. This proposed county authority would
supercede city authority to the extent that county boards could deny a preliminary plat which in their
review opinion does not meet county requirements regardless of whether the subject plat meets all
city requirements. This legislation would add another layer of bureaucracy to the development
approval process.
Mr. Erar stated he has talked to the City Administrator in Ramsey and their Council has already
taken the position of opposition to this legislation and both of them have agreed that if the Council
would support the position opposing this legislation, they would be attempting to contact other
growth cities in Anoka County and try to formulate a unified position in that regard.
Councilmember Trude asked if this year, the legislation was linúted to Anoka County. Mr. Erar
stated it is not,
Discussion ensued in regard to if passed, what authority the County would have over the City in
regard to preliminary plats.
Motion by Jacobson, Seconded by Orttel, to prepare a letter signed by the Mayor and Administrator
articulating the Council's position on this issue and urging unified opposition amongst cities, contact
local government associations and to direct staff to work with other cities in coordinating a unified
municipal position on this issue. Motion carried unanimously.
Councilmember Trude stated she has talked to someone who is doing business in Ramsey and they
have said they are having a very difficult time when they have to submit their preliminary plat for
preliminary review to the County Engineering Department, She stated the person has not seen this
happen in any other County they are doing business in.
DISCUSS NEW DEVELOPMENT FEE LEGISLATION
Finance Director Dickinson stated a bill has been introduced at the current legislative session that
requires municipalities (cities and towns) that impose fees or require dedications under local
planning and zoning ordinances to have (and make written fmdings on) a direct and essential nexus
between the fees or dedication and the municipality's costs or infrastructure needs created by the
development. The bill also spells out additional procedures that municipalities will be asked to
undertake.
Mayor Gamache stated he would hope, based on a lot of the discussions they had over a year ago,
and it was the State Finance Commissioner at the time and now the Governor's Chief of Staff who

was saying that if there are any things out there that the cities thought were unfunded mandates or
would cost money or were not good ideas that they should let the Governor's office know because
those are the types of things they would like to get rid of at the Legislature, He thought this
legislation to be exactly what they were talking about and will not improve anything cities are
concerned. It will actually cost more money, Mr. Dickinson stated in his opinion in reading this he
sees this as job security for accountants.
Motion by Jacobson, Seconded by Trude, to adopt an official position in opposition to House File
2103 as introduced and authorized. Staff is to send notification of that stand to the Representatives
that represent Andover and send a copy to the League of Minnesota Cities and to the author of the
House and Senate versions of the bill.
Councilmember Orttel stated he did not have a problem with the cities showing a relationship
between what they collect and where the money goes and the impact the developer has. He stated
the law already requires that and there are other things he is in opposition to.
Motion carried unanimously.
CONSIDER DONATION REQUEST/ANDOVER HIGH SCHOOL SENIOR ALL NIGHT
PARTY
City Administrator Erar explained they have received a request from the Senior All Night Party
Donation Committee for a City donation to help fund activities in support of an Andover High
School Senior All Night Party.
Mr. Erar stated the Committee's suggested donation amount is $1.00 per graduating senior. They
anticipate 170 seniors to attend the All Night Party, with funds being used for foods, events and
other miscellaneous items that celebrate the accomplishments of the graduating senior class.
Mr, Erar explained the City Attorney has been consulted on this and there could be public
purpose rationale behind this in that it keeps kids off the streets and would reduce calls for police
services. He stated this is a pretty effective approach to making sure the graduates stay safe.
Mr. Erar stated they could donate up to the actual number of seniors attending the all night party.
Councilmember Trude stated initially she was not sure if they wanted to go down this road and
then she read some of the other things they do support and she equates this to a type of safety
camp to keep them safe. She thought this was an extension of policing.
Mayor Gamache stated this year they are asking a dollar per student and wondered what they
would do in the future. Mr. Erar stated it could be more in future years and they could set a fIxed
amount for the senior party.
Councilmember Jacobson asked if the intention was to approve this, what would be the wording

to change the policy and would this open it up to other groups in the City. Councilmember Orttel
stated to him it is an issue of public safety and some of the students in the city go to other schools
and do they donate to other schools.
Councilmember Orttel thought they should check with other cities to see what they do. Mr, Erar
stated in other cities there is not a rule, some choose to give and some choose not to give.
Motion by Orttel, Seconded by Trude, to have the policy amended to have the expenditure come
from the gambling tax money for this year and future years until the policy is amended.
Mr, Dickinson stated they would come back to the Council with an amendment for approval.
Motion approved unanimously.
DISCUSS NEW STANDARD STREET SECTION
City Engineer Berkowitz explained City staffis requesting that the City Council discuss and approve
increasing the standard pavement section used for street construction in new urban and rural
developments.
Councilmember Jacobson stated he looked at the list to see what other cities have a thicker lay down
then they do. He wondered if in the search they found other cities that were the same or less and not
listed. Mr. Berkowitz stated through the research, the on1y other city they found with less was the
City of Coon Rapids,
Mr, Erar thought Mr. Berkowitz should be commended for his initiative to bring the information to
the Council.
Mayor Gamache stated they currently have a 2.5 inch bituminous with a four inch class five
aggregate base for a total of 6.5 and Coon Rapids is the on1y one that is less than that and they are at
6. What has been suggested by staffis to move to a 3.5 bituminous with a 6 inch class five aggregate
base which puts it at 9,5 which is similar to Anoka. Mr, Berkowitz stated when looking at the
survey, they also asked for the "R" value of the sub grade in other communities. A lot of the
communities not only have a thick section of bituminous and class five, they also do graoular sub
grade correction. It is somewhat comparable to Andover's drainage.
Mayor Gamache asked if they would adopt this when it would go into effect. Mr. Berkowitz stated it
would go in effect for all new projects moving forward and the on1y exception would be the
Crosstown Meadows Development approved at this meeting. He stated they sent this through to the
developer for his review with the explanation that they were moving this forward for discussion and
possible approval. The developer reviewed the document and did not have any issue with that so the
first development would be Crosstown Meadows and then every other development where they have
not gone through the feasibility stage.

Mayor Gamache stated the real reason to do this is to make the roads better and for an extended life.
Mr. Berkowitz stated this was correct. It would be extending the life of the road from twenty-five
years to fifty years.
Councilmember Jacobson asked if the depth of both the class five and bituminous are an average or a
minimum, Mr. Berkowitz stated if would be set as a minimum.
Councilmember Jacobson stated the on1y negative they received was from Woodland Development
who was not in favor of this. He wondered if they received any other feedback from other
developers who were not in favor of this, Mr. Berkowitz stated he had a discussion with Mr. Mike
Quigley and he did not have a chance to put a written response together but he did voice some
concern with increasing the section.
Councilmember Jacobson asked by increasing this, what the increase in cost would amount to. Mr.
Berkowitz stated it would increase the cost of a lot by $800.00 to $1,000.00.
Councilmember Orttel wondered if they should have different standards for different road types in
the City, depending on how much they are traveled.
Councilmember Jacobson asked in regard to the concrete curb, with the increase in depth, would
there also be an increase in depth for concrete curb as well. Mr, Berkowitz stated the curb would
stay the same as before.
Councilmember Trude asked ifMnDOT had anything to say regarding their soils in general. Mr.
Berkowitz stated the city has an "R" value of 50 to 70 and they have exceptional drainage sub grade
soils but in looking at the survey, other cities are doing correction to their soils.
Councilmember Trude asked if this is the on1y way to address the issue of road restrictions, Mr.
Berkowitz stated this would allow heavier trucks to use the roads year round.
Motion by Jacobson to approve implementation of a 9 \-'>" minimum pavement section (3 Y2"
bituminous and 6" class 5 aggregate base) for newly constructed urban and rural developments for
projects that are constructed after January 1, 2005.
Motion failed for lack of second.
Councilmember Trude wondered if it would be just as cost effective to go to the standard Blaine did,
the 3 \-'> inch bituminous and have the base be five inches instead of six. Mr. Berkowitz stated this
would reduce this under the curb to one inch which would be pretty thin, Councilmember Trude
stated she cannot make a financial decision like this without knowing.
Mayor Gamache asked if they reduced the class five by one inch, does it make a big difference in the
cost. Mr. Berkowitz by reducing it an inch, it may reduce the cost $100.00 per lot.

Councilmember Trude stated she would like to get more input and move this item to a Council
workshop. She would like to get feedback from Blaine.
Motion by Jacobson, Seconded by Trude, to table this item until the March Workshop. Motion
carried unanimously.
Mayor Gamache suggested they offer Mr. Berkowitz their ideas as to what they are looking for. He
stated Oak Grove almost has the exact amount as Andover and he wondered if this was because Oak
Grove's soil was the same and maybe Blaine had different soil types and he thought Mr. Berkowitz
could talk about the different costs of what they could estimate.
Councilmember Orttel asked if the industrial areas in the city were built to a nine ton load. Mr.
Berkowitz stated that was correct.
SCHEDULE MARCH CITY COUNCIL WORKSHOP
Motion by Jacobson, Seconded by Orttel, to Schedule a City Council Workshop for Tuesday, March
30,2004 at 7:00 p.m with the addition of the Street Standard.
Councilmember Trude stated she noticed there was some research being done by the League of
Minnesota Cities on a transit type of fee and she wondered if staff could give them an update on this
at the workshop.
Motion carried unanimously.
APPROVE ANOKA-HENNEPIN SCHOOL DISTRICT LEASE/FUN FEST
City Administrator Erar stated in light of the impending construction activity for the new Andover
YMCA Community Center, the use of the large soccer field located directly due west of the City Hall
tennis courts and outdoor skating rink will be unavailable for Fun Fest activities,
Motion by Trude, Seconded by Jacobson, to approve the attached agreement and authorize the
Mayor and City Clerk to execute the agreement as presented. Motion carried unanimously.
MAYOR/COUNCIL INPUT
(Fiscal Disparities Packet) - CounciImember Orttel stated he received a manila packet with a good
fiscal disparities report from AMM and worth reading. Councilmember Trude thought the report
was from North Metro Mayors Association. Mayor Gamache agreed it was.
