PRELIMINARYPLATPROCESS 20 21 The Planning & Zoning Commission is requested to discuss changes to the preliminary 22 plat process. Mr. Hellegers explained the preliminary plat review process and the changes 23 staff are proposing. He stated staff has brought this to Council and they support the change. 24 25 Commissioner Loehlein asked if the Commission will see the plat before it is final or if 26 they only look at it during the preliminary plat process. Mr. Hellegers stated the 27 Commission will see the project at the sketch plan phase, giving them two opportunities to 28 review the project. He noted that when the plat is finalized, it is placed on the City 29 Council's consent agenda. 30 31 Mr. Griffiths noted that sketch plans are optional for standard developments. He stated the 32 process for the Planning and Zoning Commission will not change, however, the core 33 requirements to move the preliminary plat forward will change. Mr. Griffiths stated the 34 core requirements are preliminary plat info, geological technical report, and stormwater 35 report. Mr. Griffiths explained there will be more staff comments on the report. 36 37 Commissioner Koehler asked if there would be review steps that are not completed and 38 gave the example of emergency services not reviewing the plan before it goes to the Andover Planning and Zoning Commission Workshop Meeting Minutes —February 22, 2022 Page 2 1 Planning Commission. Mr. Griffiths stated staff ensures the basic components are included 2 and would send it to the Andover Review Committee (ARC) for comments. 3 4 Chairperson Godfrey asked why tree protection wouldn't be included as a core item due to 5 the concern of residents around that issue. Mr. Griffiths stated not all developments have 6 tree preservation plans, only planned unit developments do. Mr. Griffiths stated the plat 7 comes before the tree preservation plan and the other core items are needed to create the 8 preliminary plat. 9 10 Commissioner Volkenant stated there are no checks between the Commission 11 recommending a project and the Council approving it on the consent items. He asked staff 12 to address his comment. Mr. Hellegers stated Council will also see the sketch plan and the 13 preliminary plat. Mr. Hellegers stated staff works with the developer to make sure the 14 Commission's and Council's concerns and suggestions are addressed. He stated that when 15 the final plat is approved, there have been many checks between the developer, staff, City 16 Council, and Planning Commission. Mr. Griffiths stated staff are only recommending a 17 change to the initial step of the preliminary plat. 18 19 Commissioner Koehler asked if the process is in place today. Mr. Griffiths stated it is in 20 place. Commissioner Koehler asked if the Commission has seen projects using this process. 21 Mr. Griffiths stated staff are following the current process and have been pushing towards 22 the new process. 23 24 Commissioner Loehlein agrees that the changes will be minor to what the Commission 25 sees, except they will see more comments. 26 27 Chairperson Godfrey stated the Commission relies on staff to make sure the issues are 28 resolved. 29 30 Commissioner Shafto appreciates staff looking at the project and making it more efficient. 31 32 OTHER BUSINESS 33 34 ADJOURNMENT 35 36 Motion Chairperson Godfrey assumed a motion to adjourn. PUBLIC HEARING: CONSIDER REPEALING EXISTING CITY CODE TITLE 12: ZONING REGULATIONS, ADOPTING UPDATED CITY CODE TITLE 12: ZONING REGULATIONS AND SUMMARY ORDINANCE FOR PUBLICATION - CITY OF ANDOVER (APPLICANT) The Planning Commission is requested to hold a public hearing and make a recommendation to the City Council updating City Code Title 12: Zoning Regulations. City Planner Hellegers explained the Code is changing to be consistent with the Comprehensive Plan. He stated the amendments create new zoning districts and requirements within them. Mr. Hellegers reviewed the changes as presented in the staff report and previously discussed at Planning Commission Work Sessions. Regular Andover Planning and Zoning Commission Meeting Minutes—April 12, 2022 Page 2 2 Commissioner VanderLaan asked about the changes to Chapter 11: Shoreland Lots and 3 how it evolved. CONSIDER AMENDMENTS TO CITY CODE 4-1- 2: PUBLIC 23 NUISANCES ENUMERATED AND SUMMARY ORDINANCE FOR PUBLICATION 24 - CITY OFANDOVER (APPLICANT) 25 26 The Planning Commission is requested to hold a public hearing and make a 27 recommendation to the City Council amendments to City Code 4-1-2: Public Nuisances 28 Enumerated. Associate Planner Griffiths explained there were nuisances that were deleted 29 in Title 12 and moved to City Code 4-1-2 where all other nuisance regulations are. He 30 noted City Council and the Planning Commission reviewed changes at workshops. Motion carried unanimously. 5 PUBLIC HEARING: CONSIDER REZONING REQUEST -REZONE PROPERTIES 6 FROM GR: GENERAL RECREATION TO R-4: SINGLE FAMILY URBAN - 7 PARCEL ID NUMBERS 22-32-24-43-0004, 22-32-24-43-0005, 22-32-24-43-0003, 22- 8 32-24-43-0002 —CITY OF ANDOVER (APPLICANT) to The Planning Commission is requested to hold a public hearing and make a 11 recommendation to the City Council regarding rezoning properties from GR: General 12 Recreation to R-4: Single Family Urban. Associate Planner Griffiths stated the City needs 13 to rezone properties due to the changes to zoning categories. He stated GR -General 14 Recreation is being eliminated and was only used for the property called Sunshine Park. 15 He stated the zoning change does not change the use of Sunshine Park. 16 17 Chairperson Godfrey asked if Sunshine Park was acquired using the Park Dedication Fund. 18 Mr. Griffiths stated Sunshine Park was not initially acquired using Park Dedication Funds, 19 but investments have been made since then using Park Dedication Funds. Chairperson 20 Godfrey stated her understanding is that once Park Dedication Fees are spent on a parcel, 21 it can no longer be used for development. Mr. Griffiths stated it would be very difficult to 22 justify the sale of a property in which Park Dedication Funds were invested. 23 24 Commissioner Volkenant asked for clarification on why City Hall is a different color on 25 the proposed zoning map. Mr. Griffiths stated the proposed zoning map is an administrative 26 update and City Hall will be changed to a different color because it is not a park. 27 28 Motion: Chairperson Godfrey assumed a motion to open the Public Hearing at 7:19 p.m. 29 The motion carried by unanimous consent. 30 31 No one appeared before the Commission. 32 33 Mr. Griffiths stated staff have received one written comment from Charles Bies,1969148`h 34 Avenue NW asking that Sunshine Park be zoned something other to be locked in as a park. 35 36 Motion: Chairperson Godfrey assumed a motion to close the Public Hearing at 7:20 p.m. 37 The motion carried by unanimous consent. 38 39 Chairperson Godfrey asked if staff reached out to the resident to address their concern. Associate Planner Griffiths explained the LB: Limited Business zoning district is being eliminated and will rezone the one property to NB: Neighborhood Business. He stated it will match the surrounding properties and will not impact the operation of the current business. PUBLIC HEARING: CONSIDER REZONING REQUEST -REZONE PROPERTIES FROM R-5: MANUFACTURED HOUSING TO R-4: SINGLE FAMILY URBAN - PARCEL ID NUMBERS 30-32-24-41-0003 AND 29-32-24-32-0011 - CITY OF ANDOVER (APPLICANT) The Planning Commission is requested to hold a public hearing and make a recommendation to the City Council regarding rezoning properties from R-5: Manufactured Housing to R-4: Single Family Urban. Associate Planner Griffiths stated the City is eliminating the R-5 Zoning District and evaluated where the parcels should be rezoned to. He explained there are two properties without development opportunities and are protected wetland and flood plain. He stated they will be rezoned to R-4: Single Family Urban to match the surrounding area. Motion: Chairperson Godfrey assumed a motion to open the Public Hearing at 7:25 p.m. The motion carried by unanimous consent. No one appeared before the Commission. Chairperson Godfrey asked if the City preserved the land as requested by the resident, the City would need to purchase the land. Mr. Griffiths stated the land is already largely protected due to it being wetland and flood plain. He stated if the City wanted to preserve it, the City would need to purchase the property or having the property donated. Motion by Loehlein, seconded by Hudson, to recommend approval of rezoning properties from R-5: Manufactured Housing To R-4: Single Family Urban - Parcel ID Numbers 30- 32-24-41-0003 And 29-32-24-32-0011. Motion carried unanimously. OTHER BUSINESS Associate Planner Griffiths stated the items on today's agenda will be on the Council agenda on April 19. He updated the Commission on Council actions. He announced the next Planning and Zoning Commission meeting on April 26, 2022. Chairperson Godfrey stated the Commission has been through the Code revisions extensively through workshops. She stated she appreciates the responsiveness and hard work of staff to make the Code understandable and usable. A map showing the location of the subject property is attached. The property is located within the Metropolitan Urban Service Area (MUSA) and is within the current stage of sewer expansion. Times and conditions have changed with the extension of municipal sewer and water into this area and with the development of single-family urban neighborhoods to the south and east of the subject property. The request aligns with the Comprehensive Plan as the subject property is guided as Transitional Residential; which contains properties within the MUSA boundary that are currently zoned rural but are guided for urban development. The rezoning has been requested so the land can be developed into single-family urban residential lots for the proposed development known as Nightingale Villas. The proposal contains 22 single-family urban lots on approximately 9.5 acres. The Planning & Zoning Commission previously reviewed a sketch plan for the proposed development on November 10, 2020. The PUD narrative submitted by the developer is attached for your review. According to City Code 13-3: Planned Unit Development, the purpose of a PUD is to encourage more efficient allocation of density and intensity of land use where such arrangement is desirable and feasible by providing the means of greater creativity and flexibility in environmental design than provided under strict application of the standards established by the City Code. City Code 13-3-9 regulates the findings that are required for a PUD to be approved and 13-3-11 identifies desirable PUD design standards that are sough in any PUD proposal. As part of the attached PUD narrative, the applicant addresses the design criteria they believe the City seeks when approving a PUD proposal. DISCUSSION City Code 13-3-9 states that the following are required findings the Council should consider when reviewing a PUD (italicized responses are from the applicant's narrative, please see narrative for additional information): The proposed development is not in conflict with the goals of the Comprehensive Plan for the City. The proposed development is not in conflict with the goals of the comprehensive plan of the city because the plan calls for the development of this property as urban with a density range of 2.4 to 4 units per acre. Our proposal includes an urban development with detached villas and provides a density of3.0 units per acre. 2. The proposed development is designed in such a manner as to form a desirable and unified environment within its own boundaries. The proposed development is designed in such a manner within its own boundaries as it will consist of one builder creating an HOA maintained landscaping neighborhood. Access will be provided from Nightingale Street NW and Quinn Street NW. Access will be stubbed to the west for future urban development. House plans have been submitted as examples of the homes to be built in this area as well. The proposed development demonstrates how each modified or waived requirement contributes to achieving the purpose of the PUD. In order to have a detached villa product an 80' wide lot is not conducive. 65' wide lots allow for a more economical association fee for residents in order to maintain their property. Due to providing a connection to the west the driveway of Lot 1 Block 2 is shown as 50' from the intersection of Quinn Street NW and future alignment of 153rd Lane in which the City of Andover already has an easementfor. A 7.5' side yard setback allows for the placement of the home in the center of the lot, and assists with the smaller lot width. Due to the change in lot width and lot depth a smaller lot is desirable in some instances. Lot sizes range from 9,744 to 30,408. 4. The PUD is of composition, and arrangement that its construction, marketing, and operation are feasible as a complete unit without dependance upon any subsequent unit. Buffering The applicant originally had hoped to establish a 30 -foot landscaping and tree preservation buffer between the project area the existing rural neighborhood to the north of the site. However, in order to meet stormwater requirements some trees will have to be removed in this area. The northern edge of the site is entirely encompassed by a minimum 30 -foot -wide drainage and utility easement to accommodate stormwater infrastructure such as drainage swales that will also serve as a buffer between the two neighborhoods. The applicant is also still proposing additional plantings along the northern edge of the site and some tree preservation areas to provide a full row of landscaping and trees between the two neighborhoods. While not required, a privacy fence is also proposed to be installed outside of the plat area on the adjacent property to the west of the site. Trees & Landscaping In addition to the landscaping and plantings proposed along the northern edge of the site, the development will meet City Code requirements for planting trees on each lot and will provide I tree per 50 -feet of lot frontage. Most lots will have at least two trees in addition to any landscape buffers. Housing Styles The applicant has provided the attached examples of floorplans that could be built in Nightingale Villas. For each of these styles of homes residents will be able to choose varying architectural elements and residents will also have the option to custom build homes in the neighborhood. The PUD narrative provides additional details on unique architectural features that may be available. A separate builder will construct the homes in Nightingale Villas; however, design elements are expected to be similar to those in the existing urban neighborhood to the south of the site. Homeowners Association (HOA) The applicant has indicated that they plan to create an HOA for Nightingale Villas, which will be responsible for the following: maintenance of the retaining wall, all private sewer and utility infrastructure, stormwater ponding, lawn care and snow removal of the units and common areas including plantings, and mailboxes. The HOA will be the entity that is responsible for enforcement of items that might be restricted by the HOA but are otherwise permitted by the City Code. It should also be noted that as individuals purchase property within the development, the buyer receives a copy of the HOA rules and requirements and title companies generally require acknowledgement of the document. This means that the buyer will be aware of any restrictions prior to purchasing. The extension of Quinn Street has been a priority for this project from the beginning. This extension, along with a new connection to Nightingale Street NW will provide for efficient vehicular access. This layout also provides for the density of 2.97 units per acre. Landscaping and layout Nightingale Villas has been designed so that there are no back-to-back lots. Each home built in the neighborhood will have views of existing trees, new landscape buffers or ponding. Several lots have large flat backyards for recreation and privacy. Other lots have unique elements such as ponding, natural trees and vegetation. Landscape Preservation Care has been taken to preserve as many trees as possible on the perimeter of the site. Stormwater ponding requirements in other portions of the site did not allow for additional trees to remain. Landscape buffers have been planned in many areas on the perimeter to allow for seamless transition between the new neighborhood and the older -growth trees. Varied and high-quality architecture The builder, Dane Allen Homes, has provided four attached plans as examples of what will be built in Nightingale Villas. For each of these styles of homes, residents will be able to choose architectural elements including: different siding styles (shakes, board/batten and lap siding), stone, front porch, posts on porch, window with prairie -style grids, window wraps, garage doors with carriage hardware, freeze boards, MiraTECH separator boards between different siding styles, and 12-8 pitch front -facing dormers. Dane Allen Homes will also offer the option for clients to custom -build homes in the neighborhood. These design elements are similar to those design elements on the existing homes to the south and neighboring properties. Aesthetically -pleasing layout, streetscape The site of Nightingale Villas is relatively flat and the proposed streetscape flows with the existing grading. Trees will be planted every 50'. A privacy fence on the west side of the project will provide a buffer for new residents and the homeowners to the west. Because the lawncare will be provided by the HOA, the uniform look of the streetscape will be maintained in the future. In addition, HOA -provided landscaping and snow removal will ensure continued, top- notch maintenance for the neighborhood so that residents will enjoy both existing and new natural elements for years to come. For basin 100 -Year HWLs (for setting HWL, not rate control analysis), infiltration basin routing should start at the outlet elevation (similar to NURP pond modeling), unless the 100 - year RATE CONTROL model HWL is below the outlet, then the modeling for the HWL model can begin at the 100 -Year Rate Control model HWL. Typically with infiltration basins, the outlet is below the 100 -year HWL Rate Control model elevation, but with this plat that is not the case. For existing and proposed landlocked basins (where outlet is above 100 -year Rate Control HWL), it is reasonable to begin routing at the 100 -year Rate Control HWL. Most basins in the 100 -Year HWL model were started at the outlet elevation, though Basin 1 P was a started assuming it was dry. Review all basins and refer to comments in stormwater report. If the results of the 100 -Year HWL Outlet analysis result in higher HWLs than all other models, use that as the basin HWL. The 100 -Year HWL for Basin B2 as labeled in the plans was based upon the rate control model (routing starting at basin bottom, or dry). Review all other basins in plans for labeled 100 -Year HWL elevations, verify the "outlet" model is used. Also verify the most restrictive of all models is labeled in the plans as the basin HWL (could be 100 -year Outlet Model, 2-100 Year Back to Back, or 10 -Day Snowmelt). Revise plan elevations, HWL summary tables in Appendix and body of stormwater report as well as Exhibit E2 accordingly. As all proposed structures backing up to basins are slab on grade, we do not anticipate this to result in plan changes except for correct labeling of basin HWL's. If there are questions about this, please contact the Engineering Department to discuss. 2. Based upon the current model (pre -comment #1 revisions), Basin 4P HWL is most restrictive with the outlet model (and should have been labeled as the HWL in the plans). That being the case, an Existing Outlet 100 -Year model should be prepared for comparison purposes to verify HWL's were not increased with the project, following similar methodology as with proposed outlet model. If the proposed 100 -year Outlet Model as revised per comment 1 does NOT result in being the design HWL for any basin, then preparing an existing 100 -year outlet model would not be necessary. 3. Revise minimum grade for 12" storm sewer to 0.5% to maintain 3 ft/s in storm sewer calculations spreadsheet and update plans accordingly. 4. A map showing the site location is attached. The proposed development consists of 22 single-family urban residential lots. The Andover Review Committee (ARC) has reviewed the preliminary plat application and submitted comments to the developer. The remaining comments that have yet to be addressed are attached for review. City staff would suggest the comments be included as part of the Commission's review of the preliminary plat. Conformance with Local Plans and Ordinances 1. The property is located within the Metropolitan Urban Service Area (MUSA) boundary. 2. The proposal has a net density of 3.0 units per acre which meets the Comprehensive Plan requirement of 2.4 — 4.0 units per acre for the subject property. 3. Pending tonight's action(s) the property was proposed to be rezoned to R-4: Single Family Urban. 4. The preliminary plat request complies with City Code requirements and deviations noted in the PUD request. Street Access There are two proposed street accesses into the site. One at Quinn St NW to the south of the site, and one from Nightingale St NW to the east of the site. Both access points will be full accesses. The two access points will be connected to create a through -road serving the entire development. A street stub is proposed to be constructed along the western boundary of the plat in order to serve an adjacent property with development potential. The developer has also indicated that "Outlot B" will be deeded to the owner of the property to the southeast of the site in order to provide them access to a street should they choose to develop their property in the future. Lots Each of the 22 proposed lots will be served with City water and sewer. The residential lots will meet the requirements established by the City Code and deviations noted in the PUD narrative. The developer has indicated that Outlot A and Outlot B will be deeded to adjacent property owners once the neighborhood is platted in order to avoid the creation of any permanent outlots. Coordination with Other Agencies The developer and/or owner is responsible to obtain all necessary permits from any agency that may have an interest in the site. Initial contact shall be made with the City Engineering Department regarding this item. The project has obtained an approved permit with conditions from the Coon Creek Watershed District. Easement documents shall be required as part of the final plat. Separate easement documents shall be required for each Vehicle Maintenance Access Area. 5. Prior to construction and recording of the final plat, signed Quit Claim deeds shall be submitted to the City to accommodate the construction of Quinn Street NW. 6. Provide copy of easement document to City prior to construction or recording of final plat for 10' easement on west plat boundary for fence installation. 7. Such plat approval is contingent upon approval of the rezoning and PUD requests. 8. This Preliminary plat shall be part of the PUD. 9. Applicant shall obtain all necessary permits from appropriate jurisdictions and agencies in order to develop the property. 10. Applicant shall provide Association documents at time of final plat addressing items identified during CUP/PUD approval process. 11. For basin 100 -Year HWLs (for setting HWL, not rate control analysis), infiltration basin routing should start at the outlet elevation (similar to NURP pond modeling), unless the 100 - year RATE CONTROL model HWL is below the outlet, then the modeling for the HWL model can begin at the 100 -Year Rate Control model HWL. Typically with infiltration basins, the outlet is below the 100 -year HWL Rate Control model elevation, but with this plat that is not the case. For existing and proposed landlocked basins (where outlet is above 100 -year Rate Control HWL), it is reasonable to begin routing at the 100 -year Rate Control HWL. Most basins in the 100 -Year HWL model were started at the outlet elevation, though Basin 1 P was started assuming it was dry. Review all basins and refer to comments in stormwater report. If the results of the 100 -Year HWL Outlet analysis result in higher HWLs than all other models, use that as the basin HWL. The 100 -Year HWL for Basin B2 as labeled in the plans was based upon the rate control model (routing starting at basin bottom, or dry). Review all other basins in plans for labeled 100 -Year HWL elevations, verify the "outlet" model is used. Also verify the most restrictive of all models is labeled in the plans as the basin HWL (could be 100 -year Outlet Model, 2-100 Year Back to Back, or 10 -Day Snowmelt). Revise plan elevations, HWL summary tables in Appendix and body of stormwater report as well as Exhibit E2 accordingly. As all proposed structures backing up to basins are slab on grade, we do not anticipate this to result in plan changes except for correct labeling of basin HWL's. If there are questions about this, please contact the Engineering Department to discuss. 2. Based upon the current model (pre -comment #1 revisions), Basin 4P HWL is most restrictive with the outlet model (and should have been labeled as the HWL in the plans). That being the case, an Existing Outlet 100 -Year model should be prepared for comparison purposes to verify HWL's were not increased with the project, following similar methodology as with proposed outlet model. If the proposed 100 -year Outlet Model as revised per comment 1 does NOT result in being the design HWL for any basin, then preparing an existing 100 -year outlet model would not be necessary. 3. Revise minimum grade for 12" storm sewer to 0.5% to maintain 3 ft/s in storm sewer calculations spreadsheet and update plans accordingly. 4. Once plans and model are approved by the City, submit revised plans and stormwater report to the CCWD for their information. 5. Additional comments pending further review.
