Administrator's Report —Administration Mayor/Council Input Adjournment Some or all members of the Andover City Council may participate in the April 20, 2021 City Council meeting by video conference rather than by being personally present at the City Council's regular meeting place at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, MN 55304. Members of the public can physically attend, although there is very limited seating in the City Council Chambers as appropriate social distancing will be required by all visitors. The public can also be provided a ZOOM video conference invite by going to www.andovermn.11 and clicking on the meeting in the calendar for the link. x REGULAR ANDOVER CITY COUNCIL MEETING—APRIL 20, 2021 The Regular Bi-Monthly Meeting of the Andover City Council was called to order by Mayor Sheri Bukkila, April 20, 2021, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Valerie Holthus, Jamie Barthel, Ted Butler (remote), and Randy Nelson Councilmember absent: None Also present: City Administrator, Jim Dickinson Associate Planner, Jake Griffiths City Attorney, Scott Baumgartner Others 0 PLEDGE OFALLEGIANCE RESIDENT FORUM No one appeared before the Council. AGENDA APPROVAL City Administrator Dickinson introduced Item #l0A on the Consent Agenda and supplemental information for the Anoka County Sheriff s Report. Motion by Holthus, Seconded by Barthel, to approve the Agenda as amended. ANOKA COUNTYSHERIFFS OFFICE MONTHL Y REPOR T Commander Lenzmeier provided a monthly report for March 2021 reporting 1,064 calls for Q service with 3 burglaries and 21 thefts. He stated thefts are down from 2020. Commander Lenzmeier reported 5 felony arrests, 5 gross misdemeanor arrests, 5 misdemeanor arrests and Regular Andover City Council Meeting Minutes —April 20, 2021 © Page 3 106 traffic violation arrests. He stated there were 5 DWI arrests, 4 of which were drug related. He stated Andover is seeing an increase in drug activity and overdose incidents. Deputies continue to be busy and proactive. Deputies attended Tactic Training and MILO Simulation Training in March. Mayor Bukkila stated it is time to have the conversation about drug use and get information out to the public. She is concerned about the amount and quality of drugs coming into the community. She stated the effects of chemical abuse is ongoing and sobriety is a tough challenge. If there are people who are suffering, the community can work on educational components. Commander Lenzmeier stated residents can call 911 if they have concerns about drug use with their family members. Mayor Bukkila said she has had people in the community reach out to her stating they have a problem. She stated an increase in theft goes along with drug use. Commander Lenzmeier stated School Resource Officers give presentations to kids in elementary, middle, and high school about the effects of drugs. Mayor Bukkila stated many of the drugs are in pill form that may appear to be a prescription drug. Commander Lenzmeier agreed, and the street drugs are unknown; they look professional in their packaging but you do not know what you are getting. © CONSIDER CONDITIONAL USE PERMITILIQUOR LICENSE—1574154TH AVE. NW, SUITE 102 — TASTY TACO — ARMANDO OCAMPO AND VANESSA MEDINA (APPLICANTS) The City Council is asked to consider the recommendation of the Planning and Zoning Commission and come to a decision regarding the proposed Conditional Use Permit (CUP). If the Council approves the CUP, the applicant must also obtain a liquor license prior to serving alcohol. Associate Planner Griffiths identified the location of the business in Hanson Commons. He stated the business needs a CUP to sell liquor out of this location. Mr. Griffiths stated the back side of Hanson Commons abuts to a neighborhood. He stated the Planning and Zoning Commission held a public hearing and unanimously supported the CUP. Councilmember Barthel stated the hours of operation are through 10:00 p.m. He asked if the business wanted to stay open until 2:00 a.m. in the future, does the CUP end or does it cover the additional hours. Mr. Griffiths replied the CUP does not have a restriction on hours and the business would have to comply with the liquor sales ordinance. City Administrator Dickinson stated the CUP allows them to serve liquor on the site. Motion by Holthus, Seconded by Nelson, to adopt Resolution No. R040-21 approving the Conditional Use Permit request for liquor sales located at 1574 154th Avenue NW, Suite 102. APPROVE ON -SALE INTOXICATING LIQUOR LICENSE/1574154TH AVE. NW SUITE 102 - TASTY TACO The City Council is requested to consider approval of the On -Sale Intoxicating Liquor License and Sunday License for Armando Ocampo, owner of Tasty Taco, contingent on a favorable background investigation. The City Council is requested to approve the above license for the period of May 1, 2021 through December 31, 2021 at a pro -rated fee. Motion by Barthel, Seconded by Holthus, to approve the On -Sale Intoxicating Liquor License and Sunday License for Armando Ocampo, owner of Tasty Taco, contingent on a favorable background investigation. Mayor Bukkila invited Mr. Ocampo to podium to introduce his business. Mr. Ocampo and Ms. Medina approached the Council. Mr. Ocampo stated they are excited to bring their business to Andover and wants people to have a good time. Ms. Medina stated she is the mother of two kids and does not want to be open until 2:00 a.m. She said she wants the business to be part of the community. Ms. Medina stated the liquor they serve will be tequila, mezcal, and rum. She stated the food will be Guatemalan, El Salvador, and Mexican flavors. Mr. Ocampo invited the Council to the friends and family night. CONSIDER CONDITIONAL USE PERMIT FOR A COMMERCIAL GREENHOUSE AT 14700 SYCAMORE STREET NW — NA YANG (APPLICANT) The City Council is asked to consider the recommendation of the Planning & Zoning Commission and make a decision on the Conditional Use Permit (CUP) request for a commercial greenhouse at 14700 Sycamore Street NW. Associate Planner Griffiths explained a commercial greenhouse is a retail business with operations to sell food or plants grown in the greenhouse. He stated the commercial aspect triggers the need for a CUP. Mr. Griffiths said the applicant is planning on growing products to © sell at farmers markets and for customer pick-up during limited days and times. He stated the City has worked with the applicant to be in compliance with accessory buildings. He identified Regular Andover City Council Meeting Minutes —April 20, 2021 © Page 5 the location and stated the property is approximately 3 acres in size and in the R-1 zoning district. Mr. Griffiths stated the Planning and Zoning Commission held a public hearing and recommended approval of the CUP. The Commission discussed traffic issues and decided it would not be an issue. Councilmember Holthus asked how the business will be marketing itself. Na Vang, 14700 Sycamore Street NW, came forward and stated the majority of marketing will be online through social media and he does not plan on signage. Motion by Barthel, Seconded by Nelson, to adopt Resolution No. R041-21 approving the Conditional Use Permit for a Commercial Greenhouse located at 14700 Sycamore Street NW. Mayor Bukkila stated she supports this opportunity but if the City gets complaints about traffic and other issues, the CUP will have to be reviewed. ADMINISTRATOR'S REPORT City Staff updated the Council on the administration and city department activities, legislative updates, updates on development/CIP projects, and meeting reminders/community events. (Administrative Staff Activities) — Mr. Dickinson reminded the Council of a Workshop Meeting on Tuesday, April 271h at 6:00 p.m. at the Senior Center. He updated the Council on meetings he will attend. He stated staff are working on development projects. The City has received 50 new home permits which meets 2021 budget predictions. The City Audit is nearing completion. Mr. Dickinson stated it is a challenge hiring seasonal and part-time workers. the mill and overlay project begins next week. The automatic meter reading project is working through the contract and public information strategy. Councilmember Nelson asked if the Grace Lutheran Church property is up for sale. Mr. Dickinson replied that Grace is interested in selling the property along Nightingale Street. MAYOR/COUNCIL INPUT Regular Andover City Council Meeting Minutes — April 20, 2021 © Page 6 (Kelsey Interpretive Signs) — Councilmember Holthus stated she has been working on interpretive signs for Kelsey Round Lake Park and is not having luck finding pictures. She is asking for photos of the Kelsey brick yard or any other photos of the area. (Code Enforcement) — Mayor Bukkila reminded residents that Code Enforcement has been elevated in the past year because more people are home. She stated the City has a complaint driven Code Enforcement policy and does not actively go out and seek violations. She encouraged people to clean up their yards.
